Decision No. 150/2003/QD-TTg dated July 22, 2003 of the Prime Minister amending and supplementing Decision No. 46/2001/QD-TTg on the management of goods import and export in the 2001-2005 period and Decision No. 79/2002/QD-TTg on management of the reception of foreign television programs

DECISION

AMENDING AND SUPPLEMENTING DECISION NO. 46/2001/QD-TTG ON THE MANAGEMENT OF GOODS IMPORT AND EXPORT IN THE 2001-2005 PERIOD AND DECISION NO. 79/2002/QD-TTG ON MANAGEMENT OF THE RECEPTION OF FOREIGN TELEVISION PROGRAMS

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;

At the proposals of the Minister of Trade and the Minister of Culture and Information,

DECIDES:

Article 1.- To amend and supplement Article 6 of the Prime Minister’s Decision No. 79/2002/QD-TTg of June 18, 2002 on management of the reception of foreign television programs as follows:

“Article 6.- Responsibilities for management of the reception of foreign television programs:

1. The Ministry of Culture and Information:

a/ To grant permits for the import and trading of TV Receive Only (TVRO) equipment;

b/ To grant permits for the installation and use of TVRO to receive foreign television programs to the subjects mentioned at Points a, c, e and f of Clause 1 and Points a and b, Clause 2, Article 1 of this Decision.

c/ To grant registration papers to foreign television firms which supply program decoders to their representative distributors in Vietnam;

d/ To grant registration papers to agencies and organizations which act as Vietnam-based representative distributors of foreign television program decoders;

e/ To grant registration papers to agencies and organizations which deal in the installation and/or repair of TVRO equipment.

2. The People’s Committees of the provinces and centrally-run cities:

To grant permits for the installation and use of TVRO to receive foreign television programs to the subjects mentioned at Points b and d of Clause 1, and Points c and d, Clause 2, Article 1 of this Decision in their respective localities.

The provincial/municipal Services of Culture and Information shall be held responsible before the provincial/municipal People’s Committees for the granting of permits for the installation and use of TVRO to receive foreign television programs in their respective localities.”

Article 2.- To amend and supplement the Prime Minister’s Decision No. 46/2001/QD-TTg of April 4, 2001 on the management of goods import and export in the 2001-2005 period as follows:

To add Point 5 to the “Import goods” part of Section “V – List of goods subject to specialized management by the Ministry of Culture and Information” in “Appendix No. 03: List of goods subject to the management by 07 specialized branches and their management principles”, with the following contents:

Article 3.- This Decision takes implementation effect 15 days after its publication in the Official Gazette.

Article 4.- The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of the People’s Committees of the provinces and centrally-run cities as well as all organizations and individuals shall have to implement this Decision.
