DECISION

Promulgating the List of major energy users in 2021^[1]

THE PRIME MINISTER

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 28, 2010 Law on Economical and Efficient Use of Energy;

Pursuant to the Government’s Decree No. 21/2011/ND-CP of March 29, 2011, detailing, and providing measures to implement, the Law on Economical and Efficient Use of Energy,

At the proposal of the Minister of Industry and Trade,

DECIDES:

Article 1. To promulgate the List of major energy users in 2021 provided in the Appendix to this Decision.

Article 2. Organization of implementation

1. The Ministry of Industry and Trade shall:

a/ Assume the prime responsibility for, and coordinate with related ministries, sectors and localities in, organizing the management of energy use by major energy users in accordance with the Law on Economical and Efficient Use of Energy and the Government’s Decree No. 21/2011/ND-CP of March 29, 2011, detailing, and providing measures to implement, the Law on Economical and Efficient Use of Energy;

b/ Assume the prime responsibility for, and coordinate with related ministries and sectors, and provincial-level People’s Committees in, updating, and proposing the Prime Minister to promulgate, the List of major energy users for publicization before March 31 every year.

2. Provincial-level People’s Committees shall:

a/ Direct related departments and sectors in the localities to notify major energy users in the localities which are on the List provided in the Appendix to this Decision of, and manage and monitor such users in implementing, programs on economical and efficient use of energy;

b/ Direct specialized agencies in the localities to examine, review, and make lists of major energy users in the localities, then  summarize and send such lists to the Ministry of Industry and Trade before February 1 every year.

3. State economic groups and corporations shall:

a/ Request major energy users being their members, which are on the List provided in the Appendix to this Decision, to perform tasks on economical and efficient use of energy in accordance with the Law on Economical and Efficient Use of Energy and relevant legal documents, and to report such to provincial-level People’s Committees of the localities where their head offices are located and concurrently to the groups and corporations for sum-up and reporting to the Ministry of Industry and Trade;

b/ Review and update the lists of major energy users under their management, then summarize and send such lists to the Ministry of Industry and Trade before February 1 every year.

4. Major energy users on the List provided in the Appendix to this Decision shall fully perform the obligations specified in the Law on Economical and Efficient Use of Energy and the Government’s Decree No. 21/2011/ND-CP of March 29, 2011, detailing, and providing measures to implement, the Law on Economical and Efficient Use of Energy, and relevant legal documents.

Article 3. This Decision takes effect on the date of its signing.

Article 4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, heads of state economic groups and corporations, and those on the List of major energy users shall implement this Decision.-
