THE PRIME MINISTER

Decision No. 1438/QD-TTg dated October 29, 2018 of The Prime Minister on approving the scheme to help children with disabilities access community-based child protection, care and education services in the 2018-2015 period[1]

THE PRIME MINISTER

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to the June 17, 2010 Law on Persons with Disabilities;

Pursuant to the April 5, 2016 Law on Children;

Pursuant to the Government’s Resolution No. 63/NQ-CP of July 22, 2016, promulgating the Government’s action program to implement the National Assembly’s Resolution on the 2016-2020 five-year socio-economic development plan;

Pursuant to the Prime Minister’s Decision No. 535/QD-TTg of April 14, 2014, approving a plan to implement recommendations of the United Nations Committee on the Rights of the Child;

At the proposal of the Minister of Labor, Invalids and Social Affairs,

 

DECIDES:

Article 1. To approve the scheme to help children with disabilities access community-based child protection, care and education services in the 2018-2025 period (below referred to as a scheme) with the following principal contents:

1. OBJECTIVES OF THE SCHEME

1. Overall objective:

By 2025, children with disabilities will have access to community-based child protection, care and education services to integrate themselves into the community and opportunities to fully exercise their rights.

2. Specific objectives for the 2018-2020 period:

a/ 70% of children with disabilities will have access to the community-based child protection, care and education services;

b/ 50% of children with disabilities will be provided with knowledge and appropriate community integration skills; 60% of parents and caretakers of children with disabilities will be provided with knowledge and skills to help children with disabilities access community-based child protection, care and education services;

c/ 70% of workers engaged in the provision of child protection, care and education services, social organizations related to children with disabilities, workers and collaborators helping children with disabilities will be provided with knowledge and skills in the protection, care and education for children with disabilities;

d/ 50% of cities and provinces will set up a network for linking community-based protection, care and education services for children with disabilities and pilot application of models of services for children with disabilities.

3. Objectives for the 2021-2025 period:

a/ 90% of children with disabilities will have access to community-based child protection, care and education services;

b/ 70% of children with disabilities will be provided with knowledge and appropriate skills to integrate themselves into the community; 80% of parents and caretakers of children with disabilities will be provided with knowledge and skills to help children with disabilities access community-based child protection, care and education services;

c/ 90% of workers engaged in the provision of child protection, care and education services, social organizations related to children with disabilities, workers and collaborators helping children with disabilities  will be provided with knowledge and skills in the protection, care and education for children with disabilities;

d/ 90% of cities and provinces will set up a network for linking community-based protection, care and education services for children with disabilities and pilot application of models of services for children with disabilities.

II. TARGET GROUPS, SCOPE OF THE SCHEME

- Children with disabilities nationwide.

- Related agencies, organizations and individuals.

III. MAJOR TASKS AND SOLUTIONS OF THE SCHEME

1. To disseminate the State’s viewpoints, guidelines, policies and laws, raise the awareness and responsibilities of families and the entire society to help children with disabilities access community-based protection, care and education services.

2. To improve laws and policies to help children with disabilities access community-based protection, care and education services.

3. To raise the capability and sense of responsibility of the workers at all levels and in all sectors, providers of services relating to children with disabilities to help them get access to community-based protection, care and education services.

4. To help children with disabilities access community-based protection, care and education services

- To complete the network of community-based protection, care and education services for children with disabilities and set up a network for linking child protection, care and education services.

- To help children with disabilities access community-based protection, care and education services for their healthcare, nutrition, education, physical rehabilitation, vocational education, psychological counseling, child protection and community integration.

- To apply on a pilot basis models of helping children with disabilities gain access to community-based child protection, care and education services.

5. To enhance the state management of helping children with disabilities access community-based protection, care and education services

- To intensify the coordination among the sectors in providing all-sided protection, care and education services for children with disabilities.

- To regularly inspect and supervise the compliance with law and policies to help children with disabilities access community-based services. To develop and operate the system monitoring, supervising and evaluating the process of helpingchildren with disabilities access community-based protection, care and education services.

6. To step up international cooperation, take advantage of support, financial assistance and experiences of domestic and foreign organizations and individuals to implement the Scheme.

IV. BUDGET FUNDS FOR IMPLEMENTATION OF THE SCHEME

Funds for implementation of the Scheme include:

1. Amounts included in annual state budget estimates of ministries, sectors and localities under the current decentralization of the state budget. Part of budget funds for implementation of a number of related programs and schemes approved by competent authorities.

2. Resources mobilized from domestic and foreign organizations and individuals, and other lawful sources.

3. Based on the tasks assigned under this Scheme, ministries, central agencies and localities shall take the initiative in preparing their annual expenditure estimates and submit them to competent agencies for approval.

Article 2. Organization of implementation

1. The Ministry of Labor, Invalids and Social Affairs shall assume the prime responsibility for implementing the Scheme in coordination with related ministries and sectors, and:

a/ Organize and guide the implementation of the Scheme nationwide;

b/ Organize the communication work and activities to build the capacity for helping children with disabilities access community-based services;

c/ Review and revise according to its competence or propose competent agencies to revise policies and laws on support for children with disabilities to access community-based protection, care and education services;

d/ Set up a network for linking protection, care and education services for children with disabilities;

dd/ Help children with disabilities access child protection and care services and social welfare;

e/ Apply on a pilot basis models of helping children with disabilities access protection, care and education services according to its functions;

g/ Mobilize support, financial and technical cooperation and international experiences in implementing the Scheme;

h/ Monitor, supervise and evaluate the Scheme implementation; organize preliminary and final reviews of the Scheme implementation.

2. The Ministry of Education and Training shall assume the prime responsibility for providing education services appropriate to children with disabilities; guide education services appropriate to children with disabilities; apply on a pilot basis models of community-based education for children with disabilities according to its functions.

3. The Ministry of Health shall help children with disabilities access community-based healthcare and physical rehabilitation services; guide healthcare consulting services and early detection and intervention for children with disabilities; apply on a pilot basis models of healthcare for children with disabilities according to its functions.

4. The Ministry of Culture, Sports and Tourism shall assume the prime responsibility for implementing cultural, sports and tourist activities for children with disabilities, guiding the implementation of cultural, sports and tourist activities for children with disabilities to ensure their community integration; integrate the contents on access of children with disabilities to community-based protection, care and educations services with the contents on building prosperous, advanced and happy families.

5. The Ministry of Planning and Investment shall coordinate with related ministries and sectors in mobilizing official development assistance (ODA) funds for programs and projects on protection, care and education for children with disabilities.

6. The Ministry of Finance shall ensure funds for the annual implementation of the Scheme in accordance with the Law on the State Budget and guiding documents; and coordinate with the Ministry of Labor, Invalids and Social Affairs in inspecting and examining the use of funds for the Scheme implementation.

7. Related ministries and sectors shall, within the ambit of their respective functions, tasks and powers, implement the Scheme’s tasks.

8. The Vietnam Fatherland Front’s Central Committee, the Vietnam Women’s Union’s Central Committee, the Ho Chi Minh Communist Youth Union’s Central Committee, the Vietnam Red Cross Society’s Central Committee and member organizations of the Front, Vietnam Society for Protection of Children’s Rights, Vietnam Relief Association for Handicapped Children, and Association in Support of Vietnamese Handicapped and Orphans shall, within the ambit of their respective functions and tasks, participate in organizing the Scheme implementation.

9. Provincial-level People’s Committees shall:

a/ Implement the Scheme in their respective localities;

b/ Work out plans for the Scheme implementation with focus on enhancing the interdisciplinary coordination in helping children with disabilities access community-based protection, care and education services; apply on a pilot basis models of helping children with disabilities access community-based child protection, care and education services; evaluate and widely develop these models in their localities; integrate the effective implementation of this Scheme with other related programs and schemes in their localities;

c/ Take the initiative in arranging budget funds for the Scheme implementation in accordance with the law on the state budget; mobilize resources for the Scheme implementation in their localities;

d/ Regularly examine, monitor, evaluate and periodically report to the Ministry of Labor, Invalids and Social Affairs on the Scheme implementation in their localities for  subsequent reporting to the Government.

Article 3. This Decision takes effect on the date of its signing.

Article 4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees and related agencies and organizations shall implement this Decision.-
