DECISION

STIPULATING THE ABSOLUTE EXPORT DUTY RATE APPLICABLE TO BARITE AND APATITE ORE

THE PRIME MINISTER OF THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated 25 December 2001; Pursuant to the Law on Export and Import Duties dated 14 June 2005;

Pursuant to Decree 149-2005-ND-CP of the Government dated 15 December 2005 on implementation of the Law on Export and Import Duties;

Having considered the proposal of the Minister of Finance;

DECIDES:

Article 1

To stipulate the absolute export duty rate applicable to barite and apatite ore as follows:

1. Applicable to barite ore (in Code Group 2511.10.00.00 and 2511.20.00.00):

Export Price (USD per tonne)	Absolute export duty rate (usd per tonne)
From 100 USD to below 120 USD	35
From 120 USD to below 140 USD	50
From 140 USD to below 160 USD	60
From 160 USD and above	70

2. Applicable to apatite ore (in Code Group 2510.10.00.00 and 2510.20.00.00):

Export Price (USD per tonne)	Absolute Export Duty Rate (USD per tonne)
From 40 USD to below 60 USD	6
From 60 USD to below 80 USD	10
From 80 USD to below 100 USD	15
From 100 USD and above	20

Article 2

The Ministry of Finance is hereby assigned, based on market fluctuations and prices of barite ore and apatite ore from time to time, to issue a decision increasing or decreasing the above absolute export duty rates within a range not to exceed twenty per cent (20%). If it becomes necessary to increase or decrease the above absolute export duty rates in excess of 20%, the Ministry of Finance shall make a submission to the Prime Minister for his decision.

Article 3

This Decision shall be of full force and effect fifteen (15) days after the date on which it is published in the Official Gazette.

Article 4

Ministers, heads of ministerial equivalent bodies, heads of Government bodies and chairmen of people's committees of provinces and cities under central authority shall be responsible for implementation of this Decision.
