DECISION
PROMULGATING THE BRACKET OF FEES FOR THE STATE MANAGEMENT OVER AVIATION
THE MINISTER OF FINANCE
Pursuant to the Government’s Decree No.15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No.178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to the Government’s Decree No.04/1999/ND-CP of January 30, 1999 on the charges and fees belonging to the State budget;
Pursuant to the Government’s Official Dispatch No. 3010/VPCP-KTTH of August 6, 1998 on the collection of aviation fees;
After getting opinions of the Civil Aviation Administration of Vietnam (in its Official Dispatch No. 1423/CHK-TC of August 24, 1999);
At the proposal of the General Director of Tax,
DECIDES:
Article 1.- To promulgate together with this Decision the bracket of fees for the State management over aviation.
Article 2.- The agencies collecting the fees for the State management over aviation shall carry out the registration, declaration, collection and remittance of such fees with/to the tax authorities of the localities where such fees are collected according to the provisions of the Ministry of Finance’s Circular No.54/1999/TT-BTC of May 10, 1999 guiding the implementation of the Government’s Decree No.04/1999/ND-CP of January 31, 1999 on the charges and fees belonging to the State budget.
Article 3.- The agencies collecting the fees for the State management over aviation shall be entitled to set aside 40% of the total collected fee amount to cover expenses for organizing the collection as prescribed at Point 5b, Section III of the Ministry of Finance’s Circular No.54/1999/TT-BTC of May 10, 1999 guiding the implementation of the Government’s Decree No.04/1999/ND-CP of January 30, 1999 on the charges and fees belonging to the State budget.
Article 4.- This Decision takes effect 15 days after its signing.
Article 5.- Organizations and individuals liable to pay fees, units assigned by the Civil Aviation Administration of Vietnam to organize the fee collection, and the concerned agencies shall have to implement this Decision.

Footnotes: The fee levels specified in Section 1 (the fees for granting of certificates to aircraft) and Section 4 (the fees for granting of licenses and/or certificates to specialized aviation operating personnel), shall not include expenses for hiring foreign experts, foreign machinery and equipment for expertise inspection, and expenses for checking health of personnel. Organizations, legal persons and individuals that wish to be granted such licenses and/or certificates must pay the above-said fees (if any) by themselves.-
