Decision No. 11/2013/QD-TTg of January 24, 2013, banning the import and export of, and trade in, specimens of a number of wild fauna species in the appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the December 3, 2004 Law on Forest Protection and Development;

Pursuant to the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

Pursuant to the Government’s Decree No. 82/2006/ND-CP of August 10, 2006, on the management of export, import, re-export, introduction from the sea, transit, breeding, rearing and artificial propagation of endangered species of precious, rare wild fauna and flora;

At the proposal of the Minister of Agriculture and Rural Development,

The Prime Minister promulgates the Decision to ban the import and export of, and trade in, specimens of a number of wild fauna species in the appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Article 1. To ban the import and export of, and trade in, specimens of the following wild fauna species in the appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), except the cases specified in Article 2 of this Decision:

1. White (square-lipped) rhinoceros (Ceratotherium simum) and their products.

2. Black (hook-lipped) rhinocerous (Diceros bicornis) and their products.

3. African elephants (Loxodonta Africana) and their products.

Article 2. The specimens specified in Article 1 of this Decision may be imported only when:

1. They are used for foreign affairs, scientific research, biodiversity conservation facilities, display at zoos; exhibitions and circus performances not for commercial purposes; law enforcement; and exchange among CITES management authorities of member countries.

2. They are not used for commercial purposes and are eligible for import under the cooperation agreements between the CITES management authority of Vietnam and CITES management authorities of countries of export.

3. They had been granted CITES import permits before the effective date of this Decision.

Article 3. Handling of violations

Organizations and individuals that violate this Decision shall, depending on the nature and seriousness of their violations, be criminally or administratively handled under current laws on management, protection, trade in, transport, import and export of wild fauna and flora species.

Article 4. Implementation provisions

1. This Decision takes effect on March 15, 2013.

2. Ministers, heads of ministerial agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decision.-
