Decision No. 10/2012/QD-TTg of February 10, 2012, amending and supplementing a number of articles of the Regulation on visa exemption for overseas Vietnamese promulgated together with the Prime Minister’s Decision No. 135/2007/QD-TTg of August 17, 2007
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the April 28, 2000 Ordinance on Entry, Exit and Residence of Foreigners in Vietnam;
Pursuant to the Government’s Resolution No. 61/NQ-CP of December 17, 2010, on simplification of administrative procedures under the Ministry of Public Security’s management;
Pursuant to the Government’s Resolution No. 50/NQ-CP of December 10, 2010, on the simplification of administrative procedures under the Ministry of Foreign Affairs’ management;
At the proposals of the Minister of Public Security and the Minister of Foreign Affairs,
DECIDES:
Article 1. To amend and supplement a number of articles of the Regulation on visa exemption for overseas Vietnamese promulgated together with the Prime Minister’s Decision No. 135/2007/QD-TTg of August 17, 2007, as follows:
1. To amend and supplement Clause 4, Article 3 as follows:
“A competent agency shall grant a visa exemption certificate within 5 working days after receiving a complete and valid dossier.”
2. To add Clause 5 to Article 4 as follows:
“5. A dossier of application for a visa exemption certificate shall be made in one set:”
3. To amend and supplement Article 6 as follows:
“A person entering Vietnam with a visa exemption certificate may stay in Vietnam for up to 90 days following each entry. If wishing to stay longer, being guaranteed by an agency, organization or individual in Vietnam and having plausible reasons, he/she may be considered for extension of his/her stay for another 90 days at most.
A person wishing to extend his/her temporary residence must carry out procedures 5 days before the visa exemption certificate expires.
- A dossier of application for temporary residence extension comprises: Passport of the applicant and application for visa grant or modification or temporary residence extension (made according to a set form) certified by the police of the commune or ward in which he/she temporarily resides.
- Places for dossier submission: The Immigration Department or Immigration Division of the city or province of temporary residence.
- Time limit for settlement: Within 5 working days after receiving a complete and valid dossier.”
Article 2. This Decision takes effect on April 15, 2012.
Article 3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairpersons of provincial-level People’s Committees shall implement this Decision.-
