DECISION
Regarding the credit applicable to pupils and students with difficult circumstances for purchase of computers and equipment in service of their online learning

Pursuant to the Law on Organization of the Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on Public Investment dated June 13, 2019;
Pursuant to the Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and monetary policies supporting socio-economic recovery and development program;
Pursuant to the Government’s Decree No. 78/2002/ND-CP dated October 04, 2002 on credit for poor people and other policy beneficiaries;
Pursuant to the Government’s Decree No. 07/2021/ND-CP dated January 27, 2021 promulgating multidimensional poverty standards for the 2021-2025 period;
At the proposal of the Minister of Finance;
The Prime Minister promulgates the Decision regarding the credit applicable to pupils and students with difficult circumstances for purchase of computers and equipment in service of their online learning.
Article 1. Scope of regulation
This Decision defines the credit policy applicable to pupils and students with difficult circumstances for purchase of computers and equipment in service of their online learning under the National Assembly’s Resolution No. 43/2022/QH15 dated January 11, 2022 on fiscal and monetary policies supporting socio-economic recovery and development program (hereinafter referred to as Resolution No. 43/2022/QH15); and the Government’s Resolution No. 11/NQ-CP dated January 30, 2022 on the socio-economic recovery and development program and the implementation of the National Assembly’s Resolution No. 43/2022/QH15 on fiscal and monetary policies supporting socio-economic recovery and development program (hereinafter referred to as Resolution No. 11/NQ-CP).
Article 2. Subjects of application
1. Vietnam Bank for Social Policies.
2. Borrowers.
3. Other relevant organizations and individuals.
Article 3. Borrowers, conditions for loan borrowing
1. Borrowers include:
a) Pupils at all education levels who are studying at education institutions of the national education system in accordance with the Law on Education and satisfy the conditions specified in Clause 2 of this Article (hereinafter referred to as pupils);
b) Pupils and students who are studying at universities (or equivalent to university), colleges, professional secondary schools and vocational education centers established and operating under Vietnamese law and satisfy the conditions specified in Clause 2 of this Article (hereinafter collectively referred to as students).
2. Pupils and students must meet the following conditions for loan borrowing:
a) Be a member of a household in one of the following household categories: poor households, near-poverty households, and better-off households in accordance with the standards prescribed by law regulations, or households with difficult circumstances due to the COVID-19 pandemic (with the father or mother or parent who died of COVID-19 pandemic);
b) Do not have computers and equipment meeting online learning requirements and have not yet enjoyed the benefits of the policy of supporting in computers and equipment for online learning in any form.
Article 4. Loan method
1. The loans for pupils and students shall be provided via households. Households of the pupils and students shall use their representatives’ names to borrow the loans and make transactions with the Vietnam Bank for Social Policies.
2. If a person specified at Point b, Clause 1, Article 3 of this Decision is full 18 years old, he/she may directly apply for loans at the Vietnam Bank for Social Policies of the locality where he/she resides or where his/her school is located if there is no member of his/her household who is full 18 years old or older, or the remaining member of his/her household is no longer able to work or no longer has full civil act capacity in accordance with law regulations.
3. The Vietnam Bank for Social Policies may entrust the loan provision to socio-political organizations under entrustment contracts, or provide loans directly for the borrowers.
Article 5. Loan use purpose
The loans must be used for purchase of computers and equipment fully meeting requirements for online learning, including: desktop computers, laptops, tablets, and webcams, microphones.
Article 6. Loan levels
The loans shall not exceed 10 million dong/pupil or student.
Article 7. Loan currency
Loans shall be provided and repaid in Vietnam dong.
Article 8. Loan terms
1. The maximum loan term is 36 months.
2. For cases where a student directly applies for loans under Clause 2, Article 4 of this Decision:
a) At the time of borrowing, if the expected remaining duration of completing the course is 24 months or more, the maximum loan term will be from the date of loan to the end of 12 months after the expected time of finishing the course;
b) The expected time of completing the student’s course stated at Point a of this Clause shall be determined according to the school’s certification.
Article 9. Loan interest rate
1. The loan interest rate shall be 1.2%/year.
2. The overdue debt interest rate shall be equal to the loan interest rate applicable to poor households at the time of borrowing.
Article 10. Funding for loan and time limit for disbursement
1. Funding for loan under this Decision and under the Prime Minister’s Decision No. 157/2007/QD-TTg dated September 27, 2007 regarding the credit applicable to pupils and students and its amending and supplementing documents (if any) shall not exceed 3,000 billion dong, allocated from the issuance of government-guaranteed bonds of the Vietnam Bank for Social Policies in accordance with the Resolution No. 11/NQ-CP.
2. The use of funding shall comply with the Resolution No. 43/2022/QH15, Resolution No. 11/NQ-CP and related guiding documents.
3. The time limit for disbursement of loans is December 31, 2023, or the time of running out of the funding for loan specified in Clause 1 of this Article, whichever comes first.
Article 11. Classification of loans and handling of non-performing loans
1. The Vietnam Bank for Social Policies shall classify loans specified in this Decision in accordance with the Prime Minister’s Decision No. 976/QD-TTg dated July 01, 2015 on promulgating the Regulation on debt classification in the Vietnam Bank for Social Policies and its amending, supplementing or replacing documents (if any).
2. The Vietnam Bank for Social Policies shall handle the non-performing loans in accordance with the Prime Minister’s Decision No. 50/2010/QD-TTg dated July 28, 2010 on promulgating the mechanism on handling of non-performing loans in the Vietnam Bank for Social Policies, the Prime Minister’s Decision No. 08/2021/QD-TTg dated March 11, 2021 on amending and supplementing a number of articles of the mechanism on handling of non-performing loans in the Vietnam Bank for Social Policies issued together with the Prime Minister’s Decision No. 50/2010/QD-TTg dated July 28, 2010, and amending, supplementing or replacing documents (if any).
Article 12. Dossiers, order and procedures for loan, debt repayment term, rate and extension, conversion into overdue debts
The Vietnam Bank for Social Policies provides guidance on dossiers, order and procedures for loan, debt repayment term, rate and extension, conversion into overdue debts, ensuring the simplicity, clarity, ease of implementation and compliance with law regulations.
Article 13. Reporting regime
1. On a quarter and annual basis, and at the end of the program, the Vietnam Bank for Social Policies shall send the Ministry of Finance reports on lending results, made according to the Appendix I and Appendix II to this Decision.
2. Time limit for sending reports, the period for closing data and methods of sending reports:
a) Time limit for sending reports:
- For quarterly reports: Within 15 days from the end of the quarter;
- For annual reports: Within 60 days from the end of the year;
- For reports at the end of the program: Within 60 days from the end of the program.
b) Period for closing quarterly or annual report data: The time of starting data collection is the first day of the reporting quarter or year; the time of ending data collection is the last day of the reporting quarter or year.
c) Period for closing ending program report data: The time of starting data collection is the time this Decision takes effect; the time of ending data collection is December 31, 2023, or the time of notifying the running out of the funding for loan, whichever comes first.
d) A report shall be sent according to one of the following methods:
- Send directly in the form of paper documents;
- Send by post in the form of paper documents;
- Send via e-mail system or specialized reporting information software system;
- Other methods as specified by law.
Article 14. Organization of implementation
1. Borrowers shall be responsible for using the loans properly in accordance with this Decision and making a sufficient payment on schedule to the Vietnam Bank for Social Policies.
2. The Vietnam Bank for Social Policies shall:
a) Promulgate regulations stated in Article 12 of this Decision;
b) Manage and use the funding, provide loans for eligible subjects with the right purposes as prescribed in this Decision; report on the results of loan to the Ministry of Finance in accordance with Article 13 of this Decision;
c) Based on the actual implementation situation, 01 month before the maximum funding for loan specified in Clause 1, Article 10 of this Decision runs out, the Vietnam Bank for Social Policies shall be responsible for publicly making an announcement on the portal and headquarters of the Vietnam Bank for Social Policies on the expected time of funding disbursement completion, and reporting on such expected time of funding disbursement completion to the Prime Minister and the Ministry of Finance;
d) Coordinate with ministries and branches in reporting to the competent authorities for timely handling of difficulties arising in the course of lending in accordance with this Decision.
3. The Ministry of Finance shall assume the prime responsibility for reporting to the Prime Minister to amend and supplement this Decision (if necessary).
4. The Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs and relevant agencies shall: Direct universities, colleges, professional secondary schools and vocational education centers under their management to coordinate with People’s Committees at all levels and the Vietnam Bank for Social Policies in organizing the propagation and implementation of the policies specified in this Decision.
5. People’s Committees of provinces and centrally-run cities shall direct their commune-level People’s Committees to review and certify the beneficiaries and conditions for policy beneficiaries specified in Article 3 of this Decision.
6. Relevant agencies shall, based on their assigned tasks and functions, coordinate to implement this Decision.
Article 15. Handling of violations
Agencies, organizations and individuals that abuse the policies prescribed in this Decision to make personal profits and violate the law, upon the nature and seriousness of the violation, shall be required to make compensation, be disciplined, administratively sanctioned or prosecuted for penal liability in accordance with law regulations.
Article 16. Implementation provisions
1. This Decision takes effect on the signing date.
2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairpersons of People’s Committees of provinces and centrally-run cities, Chairperson of the Board of Directors and General Director of Vietnam Bank for Social Policies shall take responsibility for the implementation of this Decision.
