DECISION
Promulgating water levels in accordance with flood warning levels on rivers nationwide

THE PRIME MINISTER
Pursuant to the Law on Governmental organization dated June 19, 2015;
Pursuant to the Law on Natural Disaster Prevention and Control dated June 16, 2013;
Pursuant to the Law on Hydro-meteorology dated November 23, 2015;
At the request of the Minister of Natural resources and Environment;
The Prime Minister hereby issues the Decision promulgating water levels in accordance with flood warning levels on rivers nationwide.
Article 1. Scope of regulation
This Decision promulgates water levels in accordance with flood warning levels at hydrological stations on rivers for flood prevention and control, and for socio-economic development.
Article 2. Subjects of application
This Decision shall apply to national hydro-meteorological forecast and warning systems; Natural disaster prevention and control agencies from central to grassroot levels; other organizations and individuals engaged in activities related to flood warning levels on rivers nationwide.
Article 3. Principles for classifying flood warning levels
1. Flood warning level is the delineation of flood levels. Each flood level shall be determined by a corresponding water level specified in hydrological stations on rivers and streams, reflecting the magnitude of floods as well as the extent of floodss caused by flooding.
2. The flood warning levels shall be classified into three levels based on the characteristics, magnitude of flood water level and the impacts of flood on the safety of dykes, banks, river banks, people s buildings and livelihoods, and the socio-economic situation of a region.
Article 4. Detailing the promulgation of water levels in accordance with flood warning levels at hydrological stations on rivers
1. Water levels in accordance with flood warning levels at hydrological stations on rivers nationwide shall be specified in Appendix I to this Decision.
2. For locations under the management of provinces or municipalities where water levels in accordance with flood warning levels are not specified in Clause 1 of this Article, such levels shall be prescribed by provincial or municipal People’s Commitees. For locations situated at river sections crossing provinces, concerned provincial or municipal People’s Committees must discuss and reach a consensus to promulgate a shared set of regulations on water levels in accordance with flood warning levels at such locations.
Article 5. Responsibilties of ministries, sectors and localities
1. Ministry of Natural resoucres and Environment shall be responsible:
a) Receiving and summarizing feedbacks of agencies, organizations and individuals on the use of flood warning levels for flood prevention and control, and for socio-economic development.
b) Reviewing and evaluating the implementation of this Decision on a 5-year basis and sending written report to the Prime Minister for considering, amending and supplementing the list of hydrological stations which have regulations on flood warning levels and the water levels in accordance with flood warning levels; written reports to the Prime Minister must be sent by December 25 of the year when the review and evaluation are conducted.
2. The Central Steering Commitees on National disaster prevention and control and Ministries, including: Ministry of Agricultural and Rural Development, Ministry of Transports, Ministry of Constructions, and Ministry of Trade shall be responsible for:
a) Organizing the effective implementation of water levels in accordance with flood warning levels, based on their functions, tasks and powers.
b) Organizing the annual review and evaluation of the implementation of this Decision and sending a written report to the Ministry of Natural Resources and Environment (The report shall be made according to the form provided in Appendix II to this Decision) before the December, 20.
3. Provincial and Municipal People’s Committees shall be responsible for:
a) Organizing the development and promulgation of regulations on water levels in accordance with flood warning levels at locations which are under their management and are not specified in this Decision;
b) Organize the effective implementation of regulations on water levels in accordance with flood warning levels;
c) Organizing the annual review and evaluation of the implementation of this Decision and sending a written report to the Ministry of Natural Resources and Environment (The report shall be made according to the form provided in Appendix II to this Decision) before December, 20.
Article 6. Transititional terms
For activities on hydro-meteorologics, natural disaster prevention and control, and socio-economic development which are implementing the water levels in accordance with the flood warning levels on rivers under regulations of the Prime Minister’s Decision No. 632`/QD-TTg dated May 10, 2010 on promulgating water levels in accordance with flood warning levels on rivers nationwide shall continue implementing until this Decision takes effect.
Article 7. Effect
1. This Decision takes effect from March 20, 2020.
2. The Prime Minister s Decision No. 632 /QD-TTg dated May 10, 2010 on promulgating water levels in accordance with flood warning levels on rivers nationwide shall be annulled from the date on which this Decision takes effect.
Article 8. Implementation responsibilities
1. Ministers, Heads of Ministerial-level agencies, Heads of Governmental agencies, Chairpersons of municipal or provincial People’s Committees, heads of relevant agencies, organizations and concerned individuals shall be responsible for implementing this Decision.
2. Ministry of Natural resources and Environment shall assume the prime responsibilty for and coordinate with relevant ministries, sectors and localities in, monitoring and supervising the implementation of this Decision ./.
