DECISION
ON THE ISSUANCE OF THE REGULATION ON THE SYSTEM OF BANKING CODES USED IN THE PAYMENT TRANSACTIONS THROUGH THE STATE BANK
THE GOVERNOR OF THE STATE BANK
- Pursuant to the Law on the State Bank of Vietnam issued in 1997 and the Law on the amendment, supplement of several articles of the Law on the State Bank of Vietnam issued in 2003;
- Pursuant to the Law on Credit Institutions issued in 1997 and the Law on the amendment, supplement of several articles of the Law on Credit Institutions issued in 2004;
- Pursuant to the Decree No.52/2003/ND-CP dated 19/5/2003 of the Government providing for the function, assignment, authority and organizational structure of the State Bank of Vietnam;
Upon the proposal of the Head of the Payment Board,
DECIDES:
Article 1. To issue in conjunction with this Decision the “Regulation on the system of banking codes used in payment transactions through the State Bank”.
Article 2. This Decision shall be effective after 15 days since its publication in the Official Gazette and replace the Decision No.1247/2003/QD-NHNN dated 20/10/2003 of the Governor of the State Bank on the issuance of the Regulation on the system of banking codes used in payment transaction through the State Bank, the Decision No.1677/2003/QD-NHNN dated 31/12/2003 on the amendment of the Article 2 of the Decision No.1247/2003/QD-NHNN dated 20/10/2003 of the Governor of the State Bank.
Decisions on the amendment, supplement, cancel of the banking codes issued in conjunction with the Decision 1247/2003/QD-NHNN dated 20/10/2003 providing for the banking codes used in payment transactions through the State Bank shall cease their effectiveness.
Article 3. The Director of the Administrative Department, the Head of the Payment Board, Director of the Banking Informatics Technology Department, Heads of units of the State Bank, Director of the Banking Operation Department, General Manager of the State Bank branches in provinces, cities under the Central Government’s management; Chairperson of the Board of Directors and General Director (Director) of payment services suppliers shall be responsible for the implementation of this Decision.

REGULATION
ON THE SYSTEM OF BANKING CODES USED IN PAYMENT TRANSACTIONS THROUGH THE STATE BANK
(Issued in conjunction with the Decision No.02/2006/QD-NHNN dated 18/01/2006 of the Governor of the State Bank)
Chapter I
GENERAL PROVISIONS
Article 1. Scope of application
1. Banking code is a symbol of series of digits, which is stipulated under a unified principle and determined to be unique for each payment services supplier, which is a subject to be granted a banking code in accordance with the provisions in Article 2 of this Decision.
2. Banking code is used to identify payment services suppliers (hereinafter referred to as banks), used for the application of information technology to electronic money transfer (EMT) of the State Bank and inter - bank electronic payment (IBEP) organized by the State Bank.
Article 2. Subjects to be granted a banking code
1. Units of the State Bank including: Banking Operation Department, Finance - Accounting Department, Administration Department, branches of the State Bank in provinces, cities under the central Government's management, Representative Office of the State Bank in Ho Chi Minh City and other units entitled to engage in EMT or IBEP.
2. Credit Institutions, the State Treasury and other organizations permitted to engage in payment services (Head office, or branches), which maintain deposit account at Banking Operation Department or branches of the State Bank in provinces, cities under the central Government's management for direct payment operations; or do not maintain deposit account at the State Bank but are accepted by competent levels to engage in IBEP organized by the State Bank.
Chapter II
SPECIFIC PROVISIONS
Article 3. Composition of a Banking code
A Banking code shall consist of 2 parts including 8 digits which are divided into 5 groups as follows:
1. Base code includes 5 digits divided into group 1, group 2 and group 3, of which:
Group 1 includes 2 first digits in the left which stand for the code of province, city under the central Government's management and are numbered from 10 to 99 (Appendix 1)
Group 2 includes 1 digit (the third digit counted from the left) which stands for the type of bank and is numbered from 1 to 9 (Appendix 2);
Group 3 includes 2 succeeding digits which stand for the code of banks of the same type and are numbered from 01 to 99 (Appendix 3)
2. Unit code consists of 3 digits divided into group 4 and 5, of which:
Group 4 includes 2 digits (preceding the checking number) which stand for the code of a bank branch in the same province, city and are numbered from 01 to 99;
Group 5 includes the 8th digit counted from the left to the right and is the checking number.
For example: Banking code 5120101X which is granted to Industrial and Commercial Bank of Vietnam (Incombank), Danang city branch, has 8 digits, of which:
51 - stands for Da Nang city
2- stands for a state owned commercial bank
01- stands for the code of Industrial and Commercial Bank of Vietnam- being the first bank in the system of the state owned commercial banks.
01- stands for the 1st branch of Industrial and Commercial Bank of Vietnam in Da Nang city
X- stands for the checking number
Article 4. Banking code management
1. The issuance, adjustment or cancellation of the base code shall be decided upon by the Governor of the State Bank.
2. The issuance, adjustment or cancellation of the unit code shall be decided upon by the Head of the Payment Board and he shall be authorized by the Governor of the State Bank to sign the notification in line with the composition of the banking code as provided for in Article 3 of this Regulation
Article 5. Procedures for issuance, adjustment or cancellation of a Banking code
1. The issuance, adjustment or cancellation of a Banking code shall be performed when subjects granted a banking code have experienced such changes as: new establishment, change of name, integration, dissolution, and other changes, which require the supplement, adjustment or cancellation of a Banking code correspondingly.
2. The Bank which requests for the issuance, adjustment or cancellation of a banking code must send the Banking Operation Department or State Bank branch in the local area two sets of application file including following documents:
a. A written request of the General Manager (Manager) of the bank for the issuance, adjustment or cancellation of the banking code (accurately and fully stating the content, transaction name of the bank);
b. A Decision by the agency in charge of the establishment, change of registered name, split, separation, integration or dissolution of the bank;
c. A written approval by the State Bank of Vietnam of the establishment, change of registered name, split, separation, integration or dissolution of the bank or bank branches;
d. A lience on the opening of a branch (for newly established unit)
3. Within a maximum period of 7 working days from the sufficient receipt of the file, the Director of the Banking Operation Department or General Manager of the State Bank branch in province, city must give opinion in writing on the conditions of application file for the issuance, adjustment or cancellation of Banking code and submit them, enclosed with 01 set of file of the bank, to the State Bank (the Payment Board)
4. Based on the written documents of the Director of Banking Operation Department or General Manager of the State Bank branch in province, city and the application file for the issuance, adjustment or cancellation of the Banking code, the Head of the Payment Board shall be responsible for verification of the accuracy and proceed as follows:
a. Submitting to the Governor of the State Bank for the issuance, adjustment or cancellation of the banking code;
b. In compliance with the order of the Governor of the State Bank, carrying out the issuance, adjustment or cancellation of a unit code;
c. Timely giving a written notice of the issuance, adjustment, cancellation of banking code to the Banking Informatics Technology Department; subjects being granted a banking code as provided for in paragraph 1 Article 2 of this Regulation and banks (Head office) engaging in the payment transaction through the State Bank.
Chapter III
IMPLEMENTING PROVISIONS
Article 6. The Head of the Payment Board shall be responsible for the guidance, deployment, supervision and examination of the implementation of the provisions on banking code in accordance with this Regulation.
Article 7. The Director of the Department of Banks and Non-banking credit institutions shall be responsible for the supply of necessary information, upon request, for the issuance, adjustment or cancellation of banking code.
Article 8. General Directors (Directors) of the payment services suppliers shall be responsible for the monitoring, supervision, and examination of the use of banking code at their units in accordance with this Regulation.
