Resolution 76/NQ-CP 2024 entities eligible for reduction of land and water surface rentals in 2022 under Resolution 07/NQ-CP

RESOLUTION

On subjects eligible for reduction of land rentals and water surface rentals under the Government’s Resolution No. 07/NQ-CP on January 30, 2023, on reduction of land rentals and water surface rentals in 2022 for subjects affected by the Covid-19 pandemic^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the Political Bureau’s Conclusion No. 24-KL/TW of December 30, 2021, on the Socio-Economic Recovery and Development Program;

Pursuant to National Assembly’s Resolution No. 43/2022/QH15 of January 11, 2022, on fiscal and monetary policies to support the Socio-Economic Recovery and Development Program;

Pursuant to the Government’s Decree No. 39/2022/ND-CP of June 18, 2022, promulgating the Working Regulation of the Government;

Pursuant to the Secretary-General of the National Assembly’s Official Dispatch No. 1649/TTKQH-TCNS on October 27, 2022, notifying opinions of the Standing Committee of the National Assembly;

At the proposal of the Minister of Finance in Report No. 197/TTr-BTC of September 13, 2023, and Official Dispatch No. 2401/BTC-QLCS of March 8, 2024;

On the basis of the voting result of the Government Members,

RESOLVES:

Article 1. To supplement and clarify regulations on the subjects in Article 1 of the Government’s Resolution No. 07/NQ-CP of January 30, 2023, as follows:

“The impact of the Covid-19 pandemic as prescribed in Article 1 of the Government’s Resolution No. 07/NQ-CP of January 30, 2023, means the general impact on the national economy. Organizations, units, enterprises, households and individuals that are leased land or water surface directly by the State under a decision, contract, or certificate of land use rights and ownership of houses and land-attached assets by a competent state agency in the form of land or water surface rent with annual payment of land rentals or water surface rentals will be eligible for reduction of land rentals or water surface rentals under Article 1 of the Government’s Resolution No. 07/NQ-CP of January 30, 2023.”

Article 2. Effect

1. This Resolution takes effect on the date of its signing

2. Land or water surface lessees that have submitted dossiers of application for reduction of land rentals or water surface rentals for 2022 under Article 2 of the Government’s Resolution No. 07/NQ-CP of January 30, 2023, shall comply with the provisions of this Resolution (including also cases in which dossiers of application for reduction of land rentals or water surface rentals have been submitted according to regulations but not yet processed by the effective date of this Resolution).

Article 3. Ministers, heads of ministerial-level agencies and government-attached agencies, chairpersons of provincial-level People’s Committees, Chairpersons of the Members’ Councils, and Chief Executive Officers of state-owned economic groups and corporations shall implement this Resolution; if meeting with any problems in the course of implementation of this Resolution, promptly and fully report such problems and propose solutions to competent authorities according to regulations.-
