RESOLUTION

On entities eligible for reduction of land and water surface rentals under the Government’s Resolution No. 07/NQ-CP dated January 30, 2023, on reduction of land and water surface rentals in 2022 for entities affected by the COVID-19 pandemic

THE GOVERNMENT

 

Pursuant to the Law on Organization of the Government dated June 19, 2015 and the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Political Bureau’s Conclusion No. 24-KL/TW dated December 30, 2021, on the Program on socio-economic recovery and development;

Pursuant to the National Assembly’s Resolution No. 43/2022/QH15 dated January 11, 2022, on fiscal and monetary policies supporting socio-economic recovery and development program;

Pursuant to the Government’s Decree No. 39/2022/ND-CP dated June 18, 2022, on promulgating the Working Regulation of the Government;

Pursuant to the National Assembly Secretary-General’s Official Letter No. 1649/TTKQH-TCNS dated October 27, 2022, on notification of the National Assembly Standing Committee’s opinions;

At the proposal of the Minister of Finance in Report No. 197/TTr-BTC dated September 13, 2023, and Official Dispatch No. 2401/BTC-QLCS dated March 8, 2024;

Based on the Government members’ voting results.

 

RESOLVES:

 

Article 1. To clarify entities specified in Article 1 of the Government’s Resolution No. 07/NQ-CP dated January 30, 2023 as follows:

“The impact of the COVID-19 pandemic prescribed in Article 1 of the Government’s Resolution No. 07/NQ-CP dated January 30, 2023 means the general impact on national economy. Organizations, units, enterprises, households and individuals that are directly leased land or water surface by the State with annual land rental and water surface rental payment under competent state agencies’ decisions or contracts or certificates of land use rights and ownership of houses and other land-attached assets are eligible for reduction of land and water surface rentals under Article 1 of the Government’s Resolution No. 07/NQ-CP dated January 30, 2023.”.

Article 2. Effect

1. This Resolution takes effect on the date of its signing.

2. Land or water surface lessees who have submitted one set of dossiers of request for reduction of land and water surface rentals in 2022 under Article 2 of the Government’s Resolution No. 07/NQ-CP dated January 30, 2023, shall comply with this Resolution (including dossiers of request for reduction of land and water surface rentals that have been submitted by land or water surface lessees as prescribed but have not yet been processed by the effective date of this Resolution).

Article 3. Ministers, Heads of ministerial-level agencies, Government-attached agencies, Chairpersons of People's Committees of provinces and centrally run cities, Chairpersons of Members’ Councils, and Chief Executive Officers of state corporations and groups shall implement this Resolution. Any problems arising in the course of implementation of this Resolution should be promptly and fully reported and proposed to competent authorities according to regulations./.
