SUMMARY

National land use planning for the period of 2021-2030

On March 09, 2022, the Prime Minister issues Decision No. 326/QD-TTg on allocating criteria for the national land use planning for the period of 2021-2030, with a vision toward 2050, 5-year national land use plan for the 2021-2025 period.

Accordingly, the Minister of National Defence and Minister of Public Security shall coordinate with provincial-level People's Committees to urgently complete the formulation of the land use planning for national defense for the 2021-2030 period and 5-year land use plan for national defense for the 2021-2025 period; land use planning for security for the 2021-2030 period and 5-year land use plan for security for the 2021-2025 period.

Besides, provincial-level People’s Committees, the Ministry of National Defence and Ministry of Public Security shall report the results of implementation of the land use criteria of the approved land use plannings and plans on an annual basis as prescribed. The Ministry of Natural Resources and Environment shall monitor and inspect the implementation results, summarize reports and propose the Prime Minister to review and adjust unused or inefficiently criteria among localities in order to create opportunities for localities to attract investment, exploit and use land resources in an efficient and sustainable manner, etc.

Localities wishing to change the use purpose of paddy land without changing the nature or conditions for changing back to paddy land when necessary, may flexibly carry out the change of use purposes in accordance with the National Assembly's Resolution No. 39/2021/QH15. The Ministry of Agriculture and Rural Development is assigned to assume the prime responsibility for, and coordinate with the Ministry of Resource and Environment in, guiding the criteria and conditions for implementation by localities.

This Decision takes effect on the date of its signing.

DECISION

On allocating criteria for the national land use planning for the period of 2021-2030, with a vision toward 2050, 5-year national land use plan for the 2021-2025 period

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government dated June 19, 2015, and the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Land Law dated November 26, 2013; the Planning Law dated November 24, 2017; the Law Amending and Supplementing a Number of Articles of Thirty Seven Laws Related to the Planning Law;

Pursuant to the National Assembly’s Resolution No. 39/2021/QH15 dated November 13, 2021, on the National Land Use Planning for the 2021-2030 period, with a vision toward 2050; and 5-year National Land Use Plan for the 2021-2025 period;

At the proposal of Minister of Natural Resources and Environment in Report No. 93/TTr-BTNMT dated December 09, 2021; Official Dispatch No. 411/BTNMT-TCQLDD dated January 19, 2022, and Official Dispatch No. 1072/BTNMT-TCQLDD dated March 03, 2022,

DECIDES

Article 1. To allocate criteria for the national land use planning for the period of 2021-2030 and 5-year national land use plan for the 2021-2025 period applicable to provinces and centrally-run cities, the Ministry of National Defence and the Ministry of Public Security (details in Appendices 1 - 65 to this Decision).

Article 2. Based on criteria for the land use planning and plan allocated in Article 1 of this Decision, the Minister of National Defence, Minister of Public Security and People's Committees of provinces and centrally-run cities (hereinafter referred to as provincial-level People’s Committees) shall:

1. The Minister of National Defence and Minister of Public Security shall coordinate with provincial-level People's Committees to urgently complete the formulation of the land use planning for national defense for the 2021-2030 period and 5-year land use plan for national defense for the 2021-2025 period; land use planning for security for the 2021-2030 period and 5-year land use plan for security for the 2021-2025 period.

2. The provincial-level People's Committees shall urgently complete the formulation of the provincial plannings for the 2021-2030 period, 5-year provincial land use plans for the 2021-2025 period; formulate and adjust the district-level land use plannings for the 2021-2030 period; ministries and branches shall urgently complete the formulation of national sectoral plannings, regional plannings, plannings of urban areas and rural areas, relevant land-used technical and specialized plannings which use land, ensuring compliance with land use criteria, consistency with national land use plannings and plans; review plannings that use land to ensure conformity with the national land use planning; carry out field determination and delineation on the cadastral map for allocated land use criteria and locally-determined land use criteria as a basis for building a database on land use plannings and plans in accordance with the law. The change of land use purposes, land recovery, land allocation, land lease, compensation, resettlement, and site clearance must have a specific plan in accordance with annual district-level land use plannings and plans as approved by competent State agencies; the provincial-level People's Committees shall implement land use plans based on financial mobilization plans for land recovery, resettlement, and attraction of investment projects, concurrently take responsibility for land use efficiency, without leaving land fallow; ensuring both economic, social and environmental efficiency and sustainable development.

Article 3. Provincial-level People’s Committees, the Ministry of National Defence and Ministry of Public Security shall report the results of implementation of the land use criteria of the approved land use plannings and plans on an annual basis as prescribed. The Ministry of Natural Resources and Environment shall monitor and inspect the implementation results, summarize reports and propose the Prime Minister to review and adjust unused or inefficiently criteria among localities in order to create opportunities for localities to attract investment, exploit and use land resources in an efficient and sustainable manner, which latter will be used as a basis for the Government to report the National Assembly to consider and adjust the national land use planning, and develop the 5-year national land use plan for the 2026-2030 period in accordance with law provisions, ensuring socio-economic development, national defense and security.

Localities shall concentrate resources to effectively implement land use criteria in the 5-year plans (2021 - 2025). Any demand for land use arising in the course of implementation organization, which satisfies the socio-economic development requirements, should be reported to the Prime Minister for appropriate adjustment in accordance with regulations, or submitted to the National Assembly for consideration and adjustment of the national land use planning for the 2021-2030 period, with a vision toward 2050, and formulation of the land use plans in 5 years (2026-2030) and 2024.

Article 4. The Natural Resources and Environment shall solely take responsibility before the Prime Minister for the plan on allocating the land use criteria for 63 provinces and centrally-run cities, the Ministry of National Defence and Ministry of Public Security, ensuring compliance with the land use planning and plan criteria decided by the National Assembly in Resolution No. 39/2021/QH15 dated November 13, 2021.

Article 5. This Decision takes effect on the date of its signing.

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, Chairpersons of People's Committees of provinces and centrally-run provinces and concerned agencies shall implement this Decision./.
