Decision 13/2024/QD-TTg (updated) lists of sectors and establishments emitting greenhouse gases subject to greenhouse gas inventory

DECISION

Promulgating the (updated) lists of greenhouse gas-emitting sectors and facilities subject to greenhouse gas inventory

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the November 17, 2020 Law on Environmental Protection;

Pursuant to the Government’s Decree No. 06/2022/ND-CP of January 7, 2022, providing the mitigation of greenhouse gas emissions and protection of the ozone layer;

At the proposal of the Minister of Natural Resources and Environment,

The Prime Minister issues the Decision promulgating the (updated) lists of greenhouse gas-emitting sectors and facilities subject to greenhouse gas inventory.

Article 1. To promulgate the lists of greenhouse gas-emitting sectors and facilities subject to greenhouse gas inventory which are updated for 2024, including:

1. The list of sectors subject to greenhouse gas inventory provided in Appendix I;

2. The list of the industry and trade sector’s greenhouse gas-emitting facilities subject to greenhouse gas inventory provided in Appendix II;

3.  The list of the transport sector’s greenhouse gas-emitting facilities subject to greenhouse gas inventory provided in Appendix III;

4. The list of the construction sector’s greenhouse gas-emitting facilities subject to greenhouse gas inventory provided in Appendix IV;

5. The list of the natural resources and environment sector’s greenhouse gas-emitting facilities subject to greenhouse gas inventory provided in Appendix V.

Article 2. Organization of implementation

1. The greenhouse gas-emitting facilities specified in Article 1 shall carry out facility-based greenhouse gas inventory under the guidance of the Ministry of Industry and Trade, Ministry of Transport, Ministry of Construction and Ministry of Natural Resources and Environment; and send their reports on greenhouse gas inventory in accordance with the Government’s Decree providing the mitigation of greenhouse gas emissions and protection of the ozone layer.

2. Provincial-level People’s Committees shall:

a/ Direct related specialized agencies under their management to urge greenhouse gas-emitting facilities in their localities that are on the lists provided in the Appendices to this Decision to carry out greenhouse gas inventory under regulations.

b/ Update and adjust lists of greenhouse gas-emitting facilities in their localities that are subject to greenhouse gas inventory and send them to the Ministry of Natural Resources and Environment and related line ministries under regulations.

3. The Ministry of Natural Resources shall assume the prime responsibility for, and coordinate with the Ministry of Industry and Trade, Ministry of Transport, Ministry of Construction, Ministry of Agriculture and Rural Development and provincial-level People’s Committees in, reviewing and updating lists of greenhouse gas-emitting sectors and facilities subject to greenhouse gas inventory, and submit them to the Prime Minister for consideration and decision.

Article 3. Implementation provisions

1. This Decision takes effect on October 1, 2024. The Prime Minister’s Decision No. 01/2022/QD-TTg of January 18, 2022, promulgating lists of greenhouse gas-emitting sectors and facilities subject to greenhouse gas inventory (below referred to as Decision No. 01/2022/QD-TTg), ceases to be effective on the effective date of this Decision.

2. The greenhouse gas-emitting facilities that are on the lists provided in the Appendices to Decision No. 01/2022/QD-TTg but not on the lists provided in the Appendices to this Decision are not obliged to carry out facility-based greenhouse gas inventory and submit reports thereon for 2025. 

3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and legal representatives of the facilities on the lists of greenhouse gas-emitting facilities subject to greenhouse gas inventory shall implement this Decision.-
