CIRCULAR
On energy consumption norms in beer and non-alcoholic beverage production industry

Pursuant to the Law on Economical and Efficient Use of Energy dated June 28, 2010;
Pursuant to the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 105/2024/ND-CP dated August 1, 2024, amending and supplementing a number of articles of the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade, and the Government’s Decree No. 26/2018/ND-CP dated February 28, 2018, on Charter of organization and operation of Vietnam Electricity;
At the proposal of the Director General of the Energy Efficiency and Sustainable Development Department;
The Minister of Industry and Trade hereby promulgates the Circular on energy consumption norms in beer and non-alcoholic beverage production industry.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
This Circular prescribes methods of determining specific energy consumption, energy consumption norms and reporting regimes in beer and non-alcoholic beverage production industry.
Article 2. Subjects of application
1. Production establishments and organizations engaged in beer and non-alcoholic beverage production industry that have the production type and capacity scale as prescribed in Article 5 of this Circular.
2. Other relevant agencies, organizations, and individuals.
Article 3. Interpretation of terms
1. Beer and non-alcoholic beverage production industry means the industry that produces all kinds of beer products and non-alcoholic beverage products as regulated under the Vietnam's Economic Sector System.
2. Production establishments in beer and non-alcoholic beverage production industry regulated by this Circular (hereinafter referred to as production establishments) mean establishments with the production types and capacity scale as prescribed in Article 5 of this Circular.
3. Production establishment means the establishment producing beer and non-alcoholic beverage products according to the 7-digit headings promulgated by the Prime Minister regarding the Vietnam's Product Industry System.
4. Non-alcoholic beer refers to beer produced using alcohol reduction technology.
5. Specific energy consumption (SEC) refers to the total amount of energy consumed to produce a product unit.
6. Energy consumption norm means the specific energy consumption applicable to a specific product type as prescribed in this Circular.
Chapter II
METHODS OF DETERMINING SPECIFIC ENERGY CONSUMPTION, ENERGY CONSUMPTION NORMS AND REPORTING REGIME
Article 4. Methods of determining specific energy consumption
1. Specific energy consumption in beer production shall be determined by using the method prescribed in Appendix I to this Circular.
2. Specific energy consumption in non-alcoholic beverage production shall be determined by using the method prescribed in Appendix II to this Circular.
Article 5. Energy consumption norms
Energy consumption norms applicable to production establishments in non-alcoholic beverage and beer production industry as follows:

Article 6. Periodic reporting regime
1. Before January 31 every year, production establishments specified in Clause 1 Article 2 of this Circular shall send written reports on results of compliance with energy consumption norms of the preceding year according to Appendix IV to this Circular, to the provincial-level Departments of Industry and Trade of localities directly or via postal service or via the website https://dataenergy.vn. In case of submission of reports via the website https://dataenergy.vn, production establishments shall contact with the provincial-level Departments of Industry and Trade for report-making and account issuance.
Within 20 working days from the receipt of the written reports from the production establishments, the provincial-level Departments of Industry and Trade shall respond and request additional information provision (if any).
Within 5 working days from the receipt of the request for additional information provision from the provincial-level Departments of Industry and Trade, production establishments shall re-submit their modified reports as required.
2. Before March 31 every year, the provincial-level Departments of Industry and Trade shall send written reports on results of compliance with energy consumption norms of the preceding year in beer and non-alcoholic beverage production industry in their respective localities, which are made using the form provided in Appendix III to this Circular, to the Ministry of Industry and Trade (the Energy Efficiency and Sustainable Development Department) directly, or via postal service or via the website https://dataenergy.vn.
Chapter III
IMPLEMENTATION ORGANIZATION
Article 7. Responsibility of the Energy Efficiency and Sustainable Development Department
1. To assume the prime responsibility for, and coordinate with relevant agencies in, disseminating, propagandizing and guiding concerned organizations and individuals to follow this Circular.
2. To coordinate with provincial-level Departments of Industry and Trade in inspecting the compliance with energy consumption norms targeted in plans for ensuring the energy consumption norms specified in this Circular.
3. To summarize and make statistics of data on energy consumption norms in beer and non-alcoholic beverage production industry from local reports.
Article 8. Responsibility of provincial-level Departments of Industry and Trade
1. To annually assume the prime responsibility for guiding, urging, reminding and formulating plans for inspection, and inspect the compliance with energy consumption norms by production establishments regulated by this Circular in localities, and handle violations in accordance with law.
2. To coordinate with the Energy Efficiency and Sustainable Development Department in guiding, urging and inspection the compliance with energy consumption norms in accordance with this Circular.
3. To follow the reporting regime prescribed in Article 6 of this Circular.
Article 9. Responsibility of production establishments
1. To manage and supervise the production to determine the specific energy consumed.
2. To comply with the energy consumption norms specified in Article 5 of this Circular. In case of changes or fluctuations in the production process that cause the establishment to not meet the norms, such establishment shall report to the competent agencies the reasons and implementation plan to meet the norms based on the energy audit report.
3. To follow the reporting regime prescribed in Article 6 of this Circular.
Article 10. Effect
1. This Circular takes effect on April 1, 2025, and replaces the Minister of Industry and Trade’s Circular No. 19/2016/TT-BCT dated September 14, 2016, on energy consumption norms in beer and beverage production industry.
2. Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Industry and Trade for study, amendment and supplementation./.
