CIRCULAR
Stipulating the periodic reporting regime on industrial clusters, the national industrial cluster database, and several forms for managing and developing industrial clusters

Pursuant to the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade; the Government’s Decree No. 105/2024/ND-CP dated August 01, 2024 amending and supplementing a number of articles of the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade, and the Government’s Decree No. 26/2018/ND-CP dated February 28, 2018, on the Charter of organization and operation of the Vietnam Electricity;
Pursuant to Clause 1, Article 30 of the Government's Decree No. 32/2024/ND-CP dated March 15, 2024 on management and development of industrial clusters;
Pursuant to Clause 2, Article 6 and Clause 1, Article 30 of the Government's Decree No. 09/2019/ND-CP dated January 24, prescribing reporting regimes applicable to state administrative agencies;
At the proposal of the Director General of the Agency for Regional Industry and Trade;
The Minister of Industry and Trade promulgates the Circular stipulating the periodic reporting regime on industrial clusters, the national industrial cluster database, and several forms for managing and developing industrial clusters.
Article 1. Scope of regulation
This Circular stipulates the periodic reporting regime for industrial clusters as prescribed in the Government's Decree No. 09/2019/ND-CP dated January 24, 2019 prescribing reporting regimes applicable to state administrative agencies the national industrial cluster database, and several forms for managing and developing industrial clusters as prescribed in the Government's Decree No. 32/2024/ND-CP dated March 15, 2024 on management and development of industrial clusters.
Article 2. Subjects of application
1. Enterprises, cooperatives and organizations investing in the construction of industrial cluster infrastructure.
2. Organizations and individuals producing and conducting business in industrial clusters.
3. Other agencies, organizations and individuals related to the management, investment and operation of industrial clusters.
Article 3. Periodic reporting regime on industrial clusters
1. Entities subject to the periodic reporting regime
a) Departments of Industry and Trade of provinces and centrally-run cities (hereinafter referred to as the provincial-level Departments of Industry and Trade);
b) District-level People's Committees;
c) Construction project owners of industrial cluster infrastructure;
d) Organizations and individuals investing in production and business activities within industrial clusters.
2. Deadline for closing periodic report data
a) The deadline for closing data for the (first) 6-month report is from December 15 of the year preceding the reporting period to June 14 of the reporting period;
b) The deadline for closing data for the annual report is from December 15 of the year preceding the reporting period to December 14 of the reporting period.
3. Implementation of the periodic reporting regime
a) Before June 20 and before December 20 each year, organizations and individuals investing in production and business activities within industrial clusters must report the operational status of their investment projects within the industrial clusters for the past 6 months and the entire year, according to Form No. 01 in Appendix I attached to this Circular. Reports should be sent to the district-level statistical agencies and district-level People's Committees;
b) Before June 20 and before December 20 each year, construction project owners of industrial cluster infrastructure must report the operational status of their infrastructure construction investment projects within the industrial clusters for the past 6 months and the entire year, according to Form No. 02 in Appendix I attached to this Circular. Reports should be sent to the district-level statistical agencies, district-level People's Committees, and provincial-level Departments of Industry and Trade;
c) Before June 25 and before December 25 each year, district-level People's Committees must report the status of industrial clusters within their jurisdiction for the past 6 months and the entire year, according to Form No. 03 in Appendix I attached to this Circular. Reports should be sent to the provincial-level People's Committees and provincial-level Departments of Industry and Trade;
d) Before June 30 and before December 31 each year, the provincial-level Department of Industry and Trade must report the status of industrial clusters within the province for the past 6 months and the entire year, according to Form No. 04 in Appendix I attached to this Circular. Reports should be sent to the provincial-level People's Committee and the Ministry of Industry and Trade (the Agency for Regional Industry and Trade).
4. Methods of sending and receiving periodic reports
Periodic reports shall be made in paper or electronic form, and shall be sent to the receiving agency through one of the following methods: direct submission, postal service, national document interconnection system, email, or other methods as prescribed by law.
In case the national industrial cluster database has been developed and operated, the provincial-level Department of Industry and Trade shall submit periodic reports to the Ministry of Industry and Trade (the Agency for Regional Industry and Trade) with data updates and report submissions via the National industrial cluster database.
Article 4. Developing and operating the National industrial cluster database
1. The Agency for Regional Industry and Trade shall coordinate with the Vietnam E-commerce and Digital Economy Agency and relevant agencies and units in developing and operating the National industrial cluster database.
2. The provincial-level Department of Industry and Trade shall be responsible for updating the data of industrial clusters within the province into the National industrial cluster database in accordance with the regulations and guidance of the Ministry of Industry and Trade.
Article 5. Forms for managing and developing industrial clusters
A number of forms for managing and developing industrial clusters are provided in Appendix II attached to this Circular, including: Written request for acting as a construction project owner of industrial cluster infrastructure; Decision on establishment/expansion of industrial clusters; Decision on promulgation of the Regulation on management of industrial clusters in the province and its attached regulation; Decision on promulgation of the Regulation on management of public services and utilities in industrial clusters and its attached regulation.
Article 7. Implementation provisions
1. This Circular takes effect from October 1, 2024; annuls the Minister of Industry and Trade’s Circular No. 28/2020/TT-BCT dated November 16, 2020 prescribing and guiding the implementation of a number of provisions of the Government’s Decree No. 68/2017/ND-CP dated May 25, 2017, on management and development of industrial clusters, and the Government’s Decree No. 66/2020/ND-CP dated November 06, 2020, on amending and supplementing a number of articles of Decree No. 68/2017/ND-CP.
2. In case the legal documents cited in this Circular are replaced, amended, supplemented, the new ones shall prevail.
3. Any difficulties arising in the course of implementation of this Circular should be reported to the Ministry of Industry and Trade (via the Agency for Regional Industry and Trade) for consideration and settlement according to the competence./.
