CIRCULAR
On providing the Regulation on university enrollment; college enrollment in early childhood education

Pursuant to the Law on Education dated June 14, 2005, and the Law on amending and supplementing a number of Articles of the Law on Education dated November 25, 2009;
Pursuant to the Law on Higher Education dated June 18, 2012, and the Law on amending and supplementing a number of Articles of the Law on Higher Education dated November 19, 2018;
Pursuant to the Government s Decree No. 69/2017/ND-CP dated May 25, 2017, on defining functions, tasks, powers and organizational structure of Ministry of Education and Training;

Pursuant to the Government s Decree No. 15/2019/ND-CP dated February 01, 2019, on detailing a number of Articles of, and providing measures to implement, the Law on Vocational Education;
At the proposal of the Director of the Department of Higher Education,
The Minister of Education and Training hereby promulgates the Circular on providing the Regulation on university enrollment; college enrollment in early childhood education.
Article 1.To promulgate together with this Circular the Regulation on university enrollment; college enrollment in early childhood education.
Article 2.This Circular takes effect on June 22, 2020, and replaces the Circular No. 05/2017/TT-BGDDT dated January 25, 2017, on providing the Regulation on formal university enrollment, college enrollment in the formal teacher education and Circulars amending and supplementing the above-mentioned Regulation (the Circular No. 07/2018/TT-BGDDT dated March 01, 2018, and the Circular No. 02/2019/TT-BGDDT dated February 28, 2019); replaces regulations related to the enrollment as prescribed in the Circular No. 06/2017/TT-BGDDT dated March 15, 2017, on providing the Regulation on in-service training at bachelor s level, the Circular No. 10/2018/TT-BGDDT dated March 30, 2018, on providing regulations on enrollment and training to grant the second university degree major in teacher training and the Decision No. 22/2001/QD-BGDDT dated June 26, 2001, on providing regulations on education to grant the second university degree.
Article 3.The Chief of the Ministerial Office, the Director of the Department of Higher Education, heads of relevant units of the Ministry of Education and Training; Chairpersons of People’s Committees of provinces and centrally run cities; Directors of the Department of Education and Training; Director of the Department of Education, Science and Technology of Bac Lieu province; Directors of universities and institutes; University Principals; the Principals of the colleges enrolling in early childhood education shall be responsible for implementing this Circular.

REGULATION
ON UNIVERSITY ENROLLMENT; COLLEGE ENROLLMENT IN EARLY CHILDHOOD EDUCATION

Chapter I
GENERAL PROVISIONS
Article 1. Scope of adjustment and subjects of application
1. This Regulation stipulates the university enrollment; college enrollment in early childhood education, including: General provisions; enrollment of formal training; enrollment of in-service learning training, on order and permeability; organization, duties, and powers of training institutions in the enrollment work; handling of information reflecting violations of the enrollment Regulation, reporting, and archival regimes; reward and handle violations and settle complaints and denunciations (hereinafter referred to as the enrollment Regulation).
2. This Regulation applies with universities, institutions, universities, and colleges enrolling with early childhood education major (hereinafter collectively referred to as schools), the Department of Education and Training, the Bac Lieu Department of Education, Science and Technology (hereinafter collectively referred to as the Department of Education and Training) and organizations and individuals related to the university enrollment and college enrollment in early childhood education.
3. This Regulation does not apply to the enrollment for studying abroad and distance education.
Article 2. Enrollment plan
1. The school’s enrollment plan must meet the following requirements:
a) To provide full information on university enrollment and college enrollment in early childhood education and other quality requirements (as prescribed in Appendices attached hereto);
b) To provide enrollment targets according to various enrollment methods (if any) and the threshold of input quality assurance in accordance with this Regulation, reflecting the school s quality policy;
c) To provide clear regulations on whether the school uses the results of exemption for a foreign language exam, mark reserved by high school and national high school examinations in the previous years or not and conditions for using the results of exemption for a foreign language exam, mark reserved by high school and national high school examinations in the previous years;
d) To provide clear regulations on the method of admission of pedagogical intermediate graduates to college-level education in the early childhood education major, complying with Article 5 of this Regulation;
dd) To clearly state the year beginning to training, a decision on the permission of the competent agencies or a decision on permitting such school taking self-responsibility for enrollment majors in accordance with law provisions.
2. Teacher training schools may extend the direct admission (in addition to the provisions of Clauses 2 and 3, Article 7 of this Regulation) to students who have graduated from specialized upper secondary schools of provinces and cities into majors suitable to professional subjects or awarded subjects if they meet the following conditions: Having 03 years studying in specialized upper secondary schools of provinces and achieve excellent students or achieve the first, second or third prizes in the excellent student exams organized by the provincial or higher level and other conditions prescribed by the school s enrollment plan.
3. All schools must formulate and publicize the enrollment plans with educations forms on the schools’ websites 15 days before the date on which the candidates start registering for admission and take responsibility for an explanation of the plan content to the Ministry of Education and Training (MOET), the competent agencies and relevant parties as prescribed and upon request; to take responsibility before law for enrollment conditions, quality assurance conditions, the completeness, and accuracy of the plan contents; and send the plans to the Ministry of Education and Training immediately after posting on the schools websites.
a) The first phase of enrollment for the formal training, the enrollment under the enrollment schedule shall be decided by the Ministry of Education and Training;
b) For the enrollment for other training forms, schools may adjust their enrollment plans at least 45 days before the candidates start to register for admission.
4. Schools shall carry out the enrollment according to the announced enrollment plans, complying with current regulations.
Article 3. Enrollment direction
The Minister of Education and Training shall promulgate document on guiding the enrollment for schools, unifying the management and direction of schools in the enrollment; establish the Enrollment Steering Committee and the Advisory Council to determine the threshold of input quality assurance for health care sector with practice certificates and teacher training sector to advise the Minister of Education and Training in directing the enrollment, determining the input quality assurance threshold for the above-mentioned two sectors; decide on the enrollment without applying a number of Articles and Clauses under this Regulation in case of natural disasters, epidemics, etc. and other force majeure cases but not contrary to the provisions of law.
Article 4. Rules, enrollment methods and the threshold of input quality assurance
1. Rules: Schools shall only enroll students if they fully meet conditions for training in accordance with current regulations.
2. The enrollment methods include: Exams, admission, or combination exams and admission.
3. The threshold of input quality assurance
a) Based on the enrollment methods, schools shall define and announce the threshold of input quality assurance in the enrollment plans. For the health care sector with practice certificates and the sectors of teacher training of bachelor s level and early childhood education of college level (hereinafter collectively referred to as the teacher training sector), the threshold of input quality assurance shall be decided by the Ministry of Education and Training;
b) The threshold of input quality assurance decided by schools must ensure the quality of enrollment sources. The Directors of universities, institutions, Principals of universities and colleges enrolling in early childhood education (hereinafter collectively referred to as the Principals) shall be responsible for explaining the process and basis for determining the threshold of input quality assurance with the Ministry of Education and Training, competent agencies and relevant parties.
Chapter II
ENROLLMENT FOR FORMAL TRAINING
Section 1: CONDITIONS FOR TAKING PART IN THE ENROLLMENT, ORGANIZING THE ENROLLMENT AND PREFERENTIAL POLICIES
Article 5. CONDITIONS FOR TAKING PART IN THE ENROLLMENT
1. Candidates who have graduated from the Vietnamese upper secondary education (according to the formal education or continuing education) or have graduated from intermediate-level education (within that, candidates graduated from intermediate-level education without the upper secondary diplomas and must study and take the exam to meet the required volume of upper secondary cultural knowledge in accordance with the Education Law and its guiding documents) or have graduated from a foreign upper secondary education (permitted by the host country and reach the level equivalent to that of upper secondary education in Vietnam) or abroad (hereinafter collectively referred to as graduating from upper secondary schools).
2. Be physically fit to study according to current regulations. For people with disabilities who have been recognized by competent agencies to be deformed and impaired in self-help in living and studying, the principals of the schools shall consider and decide to apply for admission to the appropriate sectors with their health status.
3. In the prescribed ages for schools and sectors having age requirements.
4. To pass the prequalification requirements, if the candidates register for admission or take the entrance examination to schools with prequalification.
5. To have permanent residence in the prescribed enrollment regions, if registering for admission or taking the entrance examination to schools that have regulations on enrollment regions.
6. Army personnel; military officers, noncommissioned officers, and soldiers serving in the People s Public Security in the army may only enroll in schools prescribed by the Ministry of National Defense or the Ministry of Public Security after being permitted by the competent agencies to attend school. For a soldier on active service is about to expire from the military service as prescribed, if he/she is permitted by the head of the regiment or higher, he/she may enroll according to his/her personal wishes; if he/she is admitted, he/she must enroll in that year and cannot reserve to the following school year.
Article 6. Enrollment organization
1. If the results of the upper secondary exam are used for prequalification, admission, schools shall perform the following rights and tasks:
a) To identify and publicize a combination of tests/subjects for admission to major and sector, in which, Math, Literature, Foreign Languages, Natural Sciences, and Social Sciences are exams; the component subjects of the Natural Science exam and the Social Science test are exam subjects;
b) Based on the guidelines for direct admission and the admission priorities of the Ministry of Education and Training to specify and publicize the conditions for direct admission and priority conditions for admission to sectors of the subjects specified in Clause 2, Article 2; Clauses 2 and 3, Article 7 of this Regulation;
c) Schools that have prequalification procedures or organize the competency assessments, aptitude tests and other forms of exams combined with using the upper secondary graduation exam results must clearly state in the enrollment plans and publicize them on the schools’ websites and on mass media about the time and application for prequalification registration; procedures and conditions to meet the prequalification requirements; methods of organizing examinations, admission methods, and exam questions; and perform the enrollment processes as prescribed in Clause 6, Article 10 of this Regulation.
2. If the results of the upper secondary exam are not used for admission, schools shall perform the following rights and tasks:
a) To select and decide the enrollment methods including: Exams, admission or combination exams, and admission;
The Principals of schools shall be responsible for the implementation of the following phases: To set exam questions, monitor the exam, to give marks to the candidates’ assignments (if organizing examination); to organize admission and send a notification to the successful candidates; settle complaints and denunciations related to the enrollment;
b) If the enrollment results of other schools or the global prestigious examination organizations are used for admission, it shall be specified in the school’s enrollment plan;
c) Partial enrollment may be organized for one major or sector (hereinafter collectively referred to as sector);
d) To fully satisfy the following requirements: To publicize the enrollment plan as prescribed; do not allow any organizations and individuals being cadres, civil servants, public employees and teachers of the school to organize a training course for the exam; to ensure equity (to admit candidates from high marks to low marks), publicity and transparency in enrollment; do not cause troubles and difficulties to candidates and sociality.
3. Schools using various enrollment methods at the same time for one sector must identify and publicize criteria for each enrollment method. Schools combining methods as prescribed in Clauses 1 and 2 of this Article shall perform rights and tasks corresponding to each method.
4. For the teacher training sector and the health care sector with practice certificates, if the school use the admission method combined with the marks of the upper secondary graduation examination and the upper secondary study results stated in the school profile issued by the principals of upper secondary schools, vocational and continuing education centers or in the school profile/transcripts on studying and taking exams meeting the required volume of cultural knowledge of upper secondary school according to the Education Law and its guiding documents which are issued to people with an intermediate-level diploma and/or the mark of the school organizing the prequalification and entrance examination (as prescribed in Article 12 of this Regulation), the threshold of input quality assurance of the upper secondary graduation examination mark and upper secondary learning results must meet the thresholds as prescribed in this Regulation. To be specific:
a) Marks on the admission examination/exam subjects or the average marks of the admission examination/exam subjects using the upper secondary graduation exam marks at least equal to the average marks of the combined examinations/exam subjects according to the input quality assurance threshold as prescribed by the Ministry of Education and Training;
b) To use the upper secondary studying results for admission to a university: Marks on the admission examination/exam subjects or the average marks of the admission examination/exam subjects are stipulated as follows:
For the teacher training sector and sectors of Medicine, Traditional Medicine, Tooth - Ham - Facial and Pharmacy, the marks must be 8.0 or more;
For sectors of: Nursing, Preventive Medicine, Midwifery, Orthodontic Technique, Medical Laboratory Technique, Medical Imaging Technique, and Rehabilitation Technique, the marks must be 6.5 or more;
For Physical Education and Sports Training sectors, the marks must be 6.5 or higher. If the candidate is an athlete of class 1, grandmaster or athlete who has ever won a medal at National Phu Dong Sports Festival, national and international youth tournaments or national, international championships or has an excellent aptitude test marks organized by such school (from 9.0 and above on a 10.0 scale), the average mark for admission of upper secondary study results shall be 5.0 or more;
For music pedagogy and art pedagogy sectors, the marks must be 6.5 or higher. If a candidate has an excellent aptitude test marks organized by such school (from 9.0 and above on a 10.0 scale), the average mark for admission of upper secondary study results shall be 5.0 or more;
c) To use the upper secondary studying results for admission to study early childhood education of college level: Marks on the admission examination/exam subjects or the average marks of the admission examination/exam subjects must be at least 6.5.
5. In case of admission from the marks of the prequalification/examination organized by the school and the upper secondary graduation examination marks and/or the upper secondary studying results, then the threshold of input quality assurance must comply with Clause 2, Article 11, and the entrance examination must comply with Article 12 of this Regulation.
6. Schools may organize many enrollments in one year and clearly state in the schools’ enrollment plans.
Article 7. Preferential policies in enrollment
1. Preferential policies upon each subject
a) Preferential group 1 (PG1) including the following people:
- Subject 01: Vietnamese citizens being ethnic minority people with permanent residence (during the upper secondary or intermediate level studying period) of 18 months or more at region 1 as prescribed in Point c, Clause 4 of this Article;
- Subject 02: Workers who have been directly producing for 05 consecutive years or more, within that there are at least 02 years being emulation fighter recognized and awarded by provincial level or higher;
- Subject 03:
+ War invalids, diseased soldiers and people with "Certificate of persons enjoying policies like war invalids”;
+ Army personnel; military officers, noncommissioned officers, and soldiers serving in the People s Public Security who is sent to study with the serving time in region 1 of 12 months or more;
+ Army personnel; military officers, noncommissioned officers, and soldiers serving in the People s Public Security who is sent to study with the serving time of 18 months or more;
+ Army personnel; military officers, noncommissioned officers, and soldiers serving in the People s Public Security who have been discharged from the military service and recognized to fulfill their service in the army according to regulations;
+ Priority subjects as prescribed in points i, k, l and m, Clause 1, Article 2 of the Ordinance No. 26/2005/PL-UBTVQH11 dated June 29, 2005, amended and supplemented by the Ordinance No. 04/2012/UBTVQH13 dated July 16, 2012, of the National Assembly Standing Committee on Preferential Treatment of People with Meritorious Services to the Revolution;
- Subject 04:
+ War martyrs’ children;
+ Children of war invalids having their working capacity reduced by 81% or higher;
+ Children of diseased soldiers having their working capacity reduced by 81% or higher;
+ Children of resistance war activists infected with toxic chemicals with the working capacity decline of 81% or higher;
+ Children of a person who has been granted a Certificate of persons enjoying policies like war invalids and such person having his/her working capacity reduced by 81% or higher;
+ Children of the People’s Armed Force heroes and heroines and children of labor heroes and heroines
+ The biological children of resistance activists are deformed as a result of toxic chemicals receiving monthly allowance;
+ Children of the people with meritorious services to the revolution as prescribed in Points a, b and d, Clause 1, Article 2 of the Ordinance No. 26/2005/PL-UBTVQH11 dated June 29, 2005, amended and supplemented by the Ordinance No. 04/2012/UBTVQH13 dated July 16, 2012, of the National Assembly Standing Committee on Preferential Treatment of People with Meritorious Services to the Revolution;
a) Preferential group 2 (PG1) including the following people:
- Subject 05:
+ Youth volunteers being sent to school;
+ Army personnel; military officers, noncommissioned officers, and soldiers serving in the People s Public Security who is sent to study with the serving time of fewer than 12 months in region 1 and less than 18 months in other regions;
+ Chief commanders, deputy commanders of the military command of communes, wards, and towns; village chiefs, core militia and self-defense platoon, self-defense militia who have completed the obligation to join the core militia and self-defense force for 12 months or more, take part in the junior military. The maximum period for enjoying priority shall be 18 months from the date of signing the decision on discharging from the military to the date of taking part in the examination or registering for admission;
- Subject 06:
+ Vietnamese citizens who are ethnic minority people having permanent residence outside the regions as prescribed for the subject 01;
+ Children of war invalids, children of diseased soldiers and children of a person who is entitled policies like war invalids with the working capacity decline of less than 81%;
+ Children of resistance war activists infected with toxic chemicals with the working capacity decline of less than 81%;
+ Children of revolutionary activists and resistance war activists who have been imprisoned or exiled by the enemy;
+ Children of activists in resistance wars for national liberation, national defense and performance of international duties with certificates of persons enjoying preferential policies as prescribed in the Government’s Decree No. 31/2013/ND-CP dated April 09, 2013, on detailing and guiding a number of the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution;
+ Children of a person having merits in assisting the revolution;
- Subject 07:
+ Severe disabled people who have a certificate of disability issued by a competent agency as prescribed in the Joint Circular No. 37/2012/TTLT-BLDTBXH-BYT-BTC-BGDDT dated December 28, 2012, of the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Health, the Ministry of Finance and the Ministry of Education and Training on providing regulations on the level of disability conducted by the Council for determining the level of disability;
+ Excellent employees of all economic sectors who are recognized with the title of excellent craftsman, artisan by the provincial or ministerial level or higher level, and are granted a certificate or creative labor badge of the Vietnam General Confederation of Labor or Central Committee of Ho Chi Minh Communist Youth Union;
+ Teachers who have been taught for 03 years or more and take part in the pedagogical examination;
+ Nurses, pharmacists, assistants, physician, technicians, and people with a pharmaceutical intermediate diploma who have worked for 03 years or more and take part in the health care sector;
c) Other preferential people as prescribed in current legal documents shall be considered and decided by the Minister of Education and Training;
d) People falling into many preferential subjects shall be only entitled to one highest priority.
2. People subject to direct admission to a school:
Schools shall publicize targets, criteria, sectors, and training orientation program for direct admission in the schools enrollment plans.
a) Labor heroes and heroines, People’s Armed Force heroes and heroines and nationwide emulation soldiers who have been graduated from upper secondary schools;
b) The person who was admitted to the school, but that year, he/she was ordered to serve in the army or to volunteer youths and have now fulfilled his/her duty, were demobilized, and discharged from military but not yet admitted to any formal long-term school, recommended by the regiment level in the army or the Youth Volunteers General Team, if he/she meets the health conditions and standards, having all valid papers, then, he/she can be considered for admission to a school that has previously been admitted. If the study is discontinuity for 03 years or more and the person subject to the direct admission wishes, then, he/she shall be considered and recommended to the following pre-university classes or schools to review before the enter the official studying program;
c) A candidate who is summoned to take part in the national team for the International Olympic Competition, in the national team participating in the International Science and Technology Contest and have graduated from upper secondary school shall be considered for direct admission to the university with the appropriate major with the exam subject or candidate s exam content. A candidate in the national team for the International Olympic Competition, the International Science and Technology Contest but has not yet graduated from upper secondary school shall have his/her result reserved until the end of the graduating year.
d) A candidate who has graduated from upper secondary school and is a member of the national team, certified by the Ministry of Culture, Sports and Tourism to have completed the task of competing in official international tournaments, including: World Championships, World Cups, Olympic Games, Asian Games (ASIAD), Asian Championships, Asian Cups, Southeast Asian Championships, Southeast Asian Games (SEA Games), the Southeast Asia Cups shall be admitted directly to the University of Physical Education and Sports (PES) or the physical education and sports sectors in accordance with each school’s regulations;
dd) An artistically gifted contestant who has graduated from upper secondary school or graduated from arts aptitude professional secondary school, winning official awards in international art contests of singing, dancing, music, fine arts certified by the Ministry of Culture, Sports and Tourism shall be considered for direct admission to the corresponding majors at a university level in accordance with each school’s regulations;
For candidates who win prizes in the fields of physical education and sports, the arts aptitude, the time for enjoying priority shall not exceed 04 years calculating to the date of examination or admission to the school;
e) A candidate who won the first, second and third prizes in the national exam to select good students; a candidate who won the first, second or third prizes in national science and technology contests and has graduated from upper secondary schools shall be considered to be admitted directly into universities with the major in accordance with the exam subject or the exam subject content that he/she has won;
A candidate who won the consolation prizes in the national exam to select good students; a candidate who won the fourth prizes in national science and technology contests and has graduated from upper secondary schools shall be prioritized to admission into universities with the major in accordance with the exam subject or the exam subject content that he/she has won;
A candidate who won a prize in the national exam to select good students or the national science and technology contest and has not yet graduated from upper secondary schools shall have his/her results preserved until the end of the graduating year;
g) For a candidate who is particularly severe disabled with the competent agency s certification of disability as prescribed: The principals of schools shall base on the upper secondary studying results (school profile) of the candidate, the health status and the training major requirements to consider and decide to admit such candidate;
h) For a foreign candidate wishing to study in Vietnamese universities and colleges: The principals of schools shall base on the upper secondary studying results (transcript) of the candidate, the knowledge test results and the ability to communicate in Vietnamese as prescribed in Article 6 of the Circular No. 30/2018/TT-BGDDT dated December 24, 2018, of the Minister of Education and Training on the management of the foreigners studying in Vietnam to consider and decide to admit such candidate;
i) A candidate with permanent residence for 03 years or more, 3-year schooling and upper secondary school graduation in poor districts (a student of ethnic minority school according to his/her permanent residence), up to the date of submission of admission register application according to the Government s Resolution No. 30a/2008/NQ-CP dated December 27, 2008, on the rapid poverty reduction and sustainable program for 61 poor districts and the Prime Minister’s Decision No. 275/QD-TTg dated July 07, 2008, on approving the list of poor districts and districts out of poverty in the period of 2018 - 2020; a candidate who is an ethnic minority with few people according to the current regulations of the Government and a candidate in 20 border poor districts and islands in the Southwest region;
Such candidates must study additional knowledge for 01 (one) year before entering the official studying program. The additional knowledge programs shall be decided by the principals of schools;
k) A person with a very good intermediate degree or higher in pedagogy major; a person who has a good intermediate degree in pedagogy major, has at least 02 (two) years working in a major or profession that has been trained and meets the provisions of Article 5 of this Regulation may be considered for direct admission to the early childhood education at the college level;
l) A person who has won one of the first, second and third prizes at ASEAN occupational skills contests and international vocational competitions, possessing an upper secondary diploma or intermediate diploma, has studied and passed the required quality cultural knowledge exam of the upper secondary education in accordance with the Education Law and its guiding documents shall be admitted directly into the school to study the major or profession appropriate to the awarded major or profession.
3. A candidate who does not use the right of direct admission shall be given priority for considering admission to the school.
Schools shall publicize targets, sectors, and training orientation program for giving priority to being considered for admission in the schools enrollment plans;
A candidate who won a prize in the national exam to select good students or the national science and technology contest and has graduated from the professional secondary school, if his/her upper secondary examination result satisfies the targets on input quality assurance as prescribed in this Regulation, the principals of schools shall consider and decide to admit such candidate;
b) A candidate who has been rewarded a gold, silver and bronze medals of the international contests organized once a year and a candidate who has been recognized by the General Department of Physical Education and Sports as a national grandmaster and has attended the upper secondary graduation examination, without any subject mark of 1.0 or under, shall be given priority to be considered for admission to the University of Physical Education and Sports or the corresponding physical education and sports sectors according to each school s regulations;
c) An artistically gifted contestant who has graduated from upper secondary school or graduated from arts aptitude professional secondary schools, winning official awards in nationwide officially professional art contests of singing, dancing, music, fine arts and has taken part in the upper secondary graduation examination without any exam/exam subject mark (in the admission subject combination) of 0.1 or under, except for the cases of preferential admission as prescribed by each school;
For candidates who win prizes in the fields of physical education and sports, the arts aptitude, the time for enjoying priority shall not exceed 04 years calculating to the date of examination or admission to the school;
d) A person who has won one of the first, second and third prizes at ASEAN occupational skills contests and international vocational competitions, possessing an upper secondary diploma or intermediate diploma, has studied and passed the required quality cultural knowledge exam of the upper secondary education in accordance with the Education Law and its guiding documents shall be considered by the principal to be given priority in admission to study the major or profession appropriate to the awarded major or profession in accordance with each school s regulations.
4. Preferential policies according to regions
a) A candidate who continuously studies and graduates from high school in any region shall be given priority according to such a region. If during 03 years of upper secondary school (or during professional secondary school), such candidate has transferred to another school, then he/she shall be given priority according to the region of the longer study period. If each year, he/she attended one school in the different priority region or half of the school time in one school, the other half of the school time in the other school, then he/she shall be given priority according to the region where he/she has graduated. This regulation applies to all candidates, including candidates graduated before the enrollment year;
b) The following cases shall be given priority according to the permanent residence:
- Students in boarding general education schools for ethnic minority students;
- Students in pre-university schools or classes;
- Students with permanent residence (during the studying time in upper secondary school or professional secondary school) of 18 months or more in region III communes and communes in extremely difficult hamlets of ethnic minority and mountainous areas as prescribed by the Minister or the Chairperson of the Committee of Ethnic Affairs and the Prime Minister; extremely difficult communes in coastal areas and islands; extremely difficult communes, border communes, and safety zones in the investment area of Program 135; villages and communes meeting with exceptional difficulties in areas as prescribed by the Prime Minister if studying at upper secondary schools (or professional secondary schools) at a location in a district, town or provincial city where at least one of the communes belongs to special difficulties;
- Army personnel, military officers, noncommissioned officers and soldiers on duty in the People s Public Security who are sent to take part in the examination, if they are stationed for 18 months or more in any region, they shall be given priority according to that region or the permanent residence before enlist, depending on which region has the higher priority; if they are stationed for 18 months or more in different priority regions, they shall be given priority according to the regions with longer time of stationing; if less than 18 months, they shall be given priority according to the region of permanent residence before enlistment;
c) Enrollment regions shall be divided as follows: - Region 1 (R1) including:
Communes of regions I, II, III of ethnic minority and mountainous areas as prescribed to be applied during the studying periods of upper secondary school or professional secondary school students; extremely difficult communes in coastal areas and islands; extremely difficult communes, border communes, and safety zones in the investment areas of the Program 135 as prescribed by the Prime Minister;
- Region 2 - Rural (R2) including:
Localities other than Regions 1, 2 and 3;
- Region 2 (R2) including:
Towns and cities directly under the province; suburban towns and districts of centrally run cities (except for communes of Region 1);
- Region 3 (R3) including:
The urban districts of centrally run cities. Candidates of Region 3 shall not be given priority according to region.
5. The framework of priority points by subjects and regions
a) The difference in matriculation points between the next two groups of subjects is 1.0 (one point), between the next two regions is 0.25 (one-quarter of points) corresponding to the total mark of 3 tests/exam subjects (in a combination of admission subjects) on a 10-point scale for each test/exam subject (without multiplying the coefficient);
b) Based on the regulations on the priority points in Point a of this Clause, the schools shall themselves determine the priority points for admission according to other point scales equivalent to the priority/total points for admission as prescribed in Point a of this Clause.
Section 2: ENROLLMENT BY THE UPPER SECONDARY EXAMINATION RESULTS
Article 8. Principles of selecting a combination of exams/exam subjects for admission
1. The publicity of a combination of exams/exam subjects for admission shall be carried out according to the following principles:
a) To use the results of 03 exams/exam subjects, including at least one of the two Math and Literature tests for admission. The exams/exam subjects taken in the combination for admission must be associated with the requirements of the training sector; it is not allowed to use more than 04 combinations of exams/exam subjects for admission to one sector (those that change only different languages are considered a combination).
The principals of the education institutions shall be responsible for explaining the process and basis for determining the combination for admission;
b) For schools and sectors with aptitude tests, the results of 03 exams/exam subjects, of which, there is at least one exam/exam subject of Math or Literature combined with the aptitude exam results shall be used to consider for admission.
2. Depending on the requirements of the training sectors, schools may specify the main exam/exam subject to be multiplied when considering for admission.
Article 9. The threshold of input quality assurance
1. Based on the results of the upper secondary school graduation examination, the Ministry of Education and Training shall determine the threshold of input quality assurance for the teacher training sectors and the health care sectors with practice certificates;
2. For other sectors, schools may themselves determine the threshold of input quality assurance in accordance with Clause 3, Article 4 of this Regulation.
Article 10. Admission organization
1. Admission principles:
a) A candidate must fully meet the conditions as prescribed in Article 5 of this Regulation and satisfy the requirements of the school where he/she has the right to register for admission;
b) A candidate may register for admission with unlimited aspirations and schools, and has to arrange his/her aspirations in priority order from high to low (the first aspiration is the highest aspiration). In the first phase of admission, for each school and sector, a candidate may be considered for admission in an equal manner according to the examination results, regardless of the priority order of his/her registration aspirations except for the cases as prescribed in Point c of this Clause. For each candidate, if he/she registers for admission to various schools/sectors, then the admission shall be carried out in the priority order of aspirations; a candidate can be admitted only to one of the highest priority aspirations possible in the list of registered aspirations. A candidate registering for admission to schools of the Ministry of Public Security and Ministry of National Defense, in addition to these regulations, such candidate must comply with regulations and guidance of the relevant ministries;
c) Exam marks considered for admission shall be the total marks of exams/exam subjects on a 10-point scale for each exam/exam subject of the admission combination, plus the priority points for the subjects and regions as prescribed in Article 7 of this Regulation and shall be rounded up to two decimal places. For candidates with the admission marks at the end of the list, they shall be considered for admission according to the additional conditions announced by each school, if the targets are still exceeded, the candidates with higher aspirations shall be given priority;
d) The successful candidate must confirm the admission within the prescribed time limit. Past this time limit, a candidate who does not confirm the admission shall be considered to refuse the admission and the school shall be allowed to consider for admission for other candidates in the subsequent enrollment (if any);
dd) Schools may perform multiple enrollments in a year, the enrollment plan of each phase must be publicized on the schools’ websites at least 15 days before the candidates start to register for admission;
Before the last day of March, June, September and December, and according to the enrollment schedule of phase 1, schools must update the list of admitted candidates and the list of candidates confirmed the admission on the schools’ websites and the portals of the Ministry of Education and Training to remove such admitted candidates from the admission list of the next phases.
2. Support from the Ministry of Education and Training
The Ministry of Education and Training shall build, maintain and operate the enrollment portal to support candidates and schools in the enrollment, including information on: Directly administering the enrollment; database of upper secondary school graduation exam results; The system imports statistical data of candidates aspirations and other information necessary for the admission.
3. Responsibility of localities
a) People s Committee of provinces and central affiliated cities and the Department of Education and Training shall take responsibility to:
Direct the review and determination of priority area of upper secondary school and the same in the locality in accordance with regulations in force; direct the receipt units of the Admission register application and the Modification of the Admission register application to college or university of early childhood education (herein after referred to as application receipt place); prepare the necessary facilities, equipment and assign experienced officer with insight in the Enrollment regulations to guide and assist candidates; put in information of the Enrollment Register Application and the Admission Register Application in to the database of the Enrollment portal of the Ministry of Education and Training; ensure to follow the process and time line of the works in accordance with general plans of enrollment;
b) Responsibility of the application receipt place
Update the Admission Register Application of the candidate and modify mistakes (if any), archive the dossier and bear responsibility on imported information on the database of the Enrollment portal of the Ministry of Education and Training.
4. Duties of education facilities
a) Before the candidate implement the procedure of Admission Register, education facilities shall publicize necessary information on to its website so that candidates can implement the Admission Register, as follow: Education facilities’ code, major s code; enrollment target of the major, the combination criteria of Admission, regulations on different of score between combinations, sub - criteria used in admission and other regulation not contrast with provisions of this Regulation; fully import information of education facilities on to the information portal of the Enrollment portal of the Ministry of Education and Training as required in the stipulated time. Particularly for the range of score to accept the Admission Register, it may be stipulated after the result of upper secondary school graduation exam in accordance with the range to guarantee the enrollment quality as prescribed in this Regulation; to implement the procedure of admission as prescribed in Clause 6 this Article;
b) To independently implement the admission or coordinate with other to form the group of schools for admission;
c) To implement the procedure of the first phase of admission as prescribed in Clause 6 this Article and the next phase of admission as prescribed in Clause 7 this Article; decide on the selection score, the list of selected candidate of each major of the school and publicize the selection result in the stipulated time; update the list of candidate entered on the information portal of enrollment of the Ministry of Education and Training;
d) Report to the Ministry of Education and Training on occurred incidents and suggest resolve plan, report on the result of candidate enter as prescribed in point dd Clause 1 this Article;
dd) Determine the enrollment target in accordance with provisions of the Ministry of Education and Training.
5. Duties of candidates
a) To participate in the first admission, the candidate shall apply the Admission Register Application with the register dossier of upper secondary school graduation in accordance with provisions of the Department of Education and Training with the fee of admission. For admission after the first admission phase, the candidate shall carry out the admission register and submit the fee in accordance with provisions of each school;
b) After receive the result of upper secondary school graduation, the candidate allowed to modify the aspiration once in the stipulated time, via online methods or directly at the place of enrollment register;
c) confirm to enter the school after passed in accordance with regulation in point dd Clause 6 or point e Clause 7 this Article;
d) The candidate shall bear responsibility for the truthfulness of information of admission register and entry exam register. Education facilities may reject or expel if the candidate fail to satisfy the enrollment criteria up on collate information of admission and the origin dossier.
6. The first admission phase
a) After finish the first admission registration, education facilities shall reference information on the information portal of the Ministry of Education and Training to prepare the appropriate plan of enrollment;
b) after the time for candidate to modify the aspiration of admission, school or group of school shall exploit information (of such school or group of school and other related school or group of school) from the information portal of the Ministry of Education and Training to estimate the enrollment score, estimate the list of selected candidate of such school or group of school in accordance with principles as prescribed in point b this Article;
c) School or group of school shall update the estimation list of selected candidate on to the information portal of the Ministry of Education and Training in the stipulated time so that the system shall automatically erase lower aspiration of candidates who have been estimated to achieve multiple aspirations as prescribed in point b Clause 1 this Article;
d) Schools or groups of school shall modify enrollment score in accordance with the target in stipulated time; decide on official enrollment score and list of selected candidates; publicize the enrollment result on the website of such school and other mass media facilities;
For groups of major have threshold to ensure the entry quality which are major of teacher training and major in health sector with practice certificate to be granted, if the selected candidate is not sufficient to establish classes, the school must contact and agree with candidate on resolve plan which shall not be violate law provisions or report to the Ministry of Education and Training for resolve plan, protect the legit interest of candidates.
dd) Candidate verify to entry the school in the stipulated time by send the origin of the Entry exam result certificate to the school directly or by express mail, candidate verified to entry school shall not allow to participate in admission of other schools;
e) School shall receipt and archive the origin of Entry exam result certificate, sum up the result of candidate verify to entry on to the information portal of enrollment of the Ministry of Education and Training and decide on stop or continue to recruit on the next phase.
7. Next phase of admission
a) The next phase of admission can be carry out one time or many times;
b) Based on the enrollment target and the number of selected candidate verified to entry the school after the first admission phase (including the number of candidates are admitted directly and the number of preparatory students of the school; students from preparatory school assigned to the school), the Enrollment Board of the school shall consider and decide for the next enrollment contents;
c) Schools shall notify on the criteria of admission in the next phase after the first one, the score to be accepted in the later shall not lower than that of the first one; to publicize the admission schedule;
d) Candidate selected or not, not yet verify to entry any school may carry out the registration for admission online or by other methods prescribed by the school;
dd) At the end of each admission phase, the school shall public on its website and on mass media on selected score and the list of selected candidate.
e) Candidate shall verify to entry school within the stipulated time through online system or by other methods as prescribed by each school;
g) The school shall update the list of candidates verify to entry on the information portal on enrollment of the Ministry of Education and Training.
Section 3: ADMISSION WITHOUT USING RESULT OF THE UPPER SECONDARY SCHOOL GRADUATION EXAM
Article 11. Requirement on input quality
1. For school implement enrollment by testing or testing subject or admission by the combination of the subject on upper secondary school, the selection of testing/testing subject combination or combination of subject used in admission shall be implemented as prescribed in Article 8 this Regulation;
Result of subjects on upper secondary school used for admission indicated in the school profile shall be provided by the head of upper secondary schools, the director of the centers for continuing education, Centers for continuing - vocational education or indicated in the school profile or the score record granted to the candidate showing that the candidate has the adequate learning process and satisfy the requirement on exam for the quantity of knowledge in upper secondary level as prescribed in the Law on Education and guiding documents.
2. For all the methods of enrollment without using the result of upper secondary school graduation exam, the threshold to ensure the input quality of major of teacher training and health sector with practice certificate to be granted shall be determined as follow:
a) For major in teacher training
- Admission for bachelor level on the basis of the subject combination on the upper secondary school: Upper secondary school graduated student must has learning capacity at excellent in 12 grade or upper secondary school graduate score from 8.0 or higher;
Particularly for Physical Training or Sport Coaching, candidate must have learning capacity in the 12 grade from good level or higher or upper secondary school graduate score from 6.5 or higher; if the candidate to be enrolled is level 1 athlete, grant master, athlete achieved medal in Phu Dong National Sport Tournament, national and international competition for young candidate or has excellent score in aptitude test held by the school (from 9.0 or higher in the score band of 10.0) then candidate satisfies criteria as prescribed in Article 5 of this Regulation may be enrolled. For Musical Pedagogy, Artistic Pedagogy, the candidate must have learning capacity in the 12 grade from good level or higher or upper secondary school graduate score from 6.5 or higher; if the candidate has excellent score in aptitude test held by the school (from 9.0 or higher in the score band of 10.0) then candidate satisfies criteria as prescribed in Article 5 of this Regulation may be enrolled
- Admission for college level in early childhood education on the basis of the subject combination on the upper secondary school: The candidate must has learning capacity at good level in 12 grade or upper secondary school graduate score from 6.5 or higher;
- Enrollment for bachelor level: Upper secondary school graduate student must has learning capacity at good level in 12 grade or upper secondary school graduate score from 6.5 or higher;
Particularly for Physical Training, Sport Coaching, Musical Pedagogy, Artistic Pedagogy, candidate satisfies criteria as prescribed in Article 5 this Regulation shall be allow to take part in entry exam;
- Enrollment for college level in early childhood education: The candidate must has learning capacity at medium level in 12 grade or upper secondary school graduate score from 5.5 or higher;
b) For major in health sector with practice certificate to be granted:
- Admission on the basis of the subject combination on the upper secondary school as follow:
For Medical, Traditional Medical, Dentomaxillofacial, Pharmacology: Upper secondary school graduate student must has learning capacity at excellent in 12 grade or upper secondary school graduate score from 8.0 or higher;
For Nursing, Preventive Medicine, Midwifery, Odontology Prosthesis Techniques, Medical Testing Techniques, Medical Imaging Techniques, Rehabilitation Techniques: Upper secondary school graduate student must has learning capacity at good or higher in 12 grade or upper secondary school graduate score from 6.5 or higher;
- Entry exam
For Medical, Traditional Medical, Dentomaxillofacial, Pharmacology: Upper secondary school graduate student must has learning capacity at good level in 12 grade or upper secondary school graduate score from 6.5 or higher;
For Nursing, Preventive Medicine, Midwifery, Odontology Prosthesis Techniques, Medical Testing Techniques, Medical Imaging Techniques, Rehabilitation Techniques: Upper secondary school graduate student must has learning capacity at medium or higher in 12 grade or upper secondary school graduate score from 5.5 or higher;
3. Schools enrolling students who graduated from pedagogical secondary school to study at college level in Early Childhood Education must specify the admission method in the Enrollment Scheme.
Article 12. Organization of separate examination and testing for admission
1. Schools that organize their own entrance exams, including those in culture or competency assessments or other forms of exams, or a combination of several exams, must comply with quality assurance requirements as follow:
a) There is an independent unit in charge of organizing the entrance examination (hereinafter referred to as the specialized section).
b) Ensure that the managerial and professional staff meet the requirements to organize the exam successfully, including from the leader of the specialized section, the officer who builds the exam structure, and the officer of question development and bank of standardized question and/or essay questions, examiners, assessors, appraisers, and testers of parameters of test questions, support staff and technicians.
c) To build an exam structure suitable for undergraduate and college admissions; announced at least 15 days before candidates’ registration. The content of exam questions is to assesses core competencies for studying at higher education of candidates, does not violate Vietnamese laws and traditions and culture, in which the content of the questions to assessment of educational attainment must be part of upper secondary education.
d) Make sure the bank of standardized test questions and/or essay questions are large enough to prepare the exam questions for the organization of each exam; have solutions to ensure the equivalence of the exam questions and must follow the process to ensure the exam questions, answers, and grading instructions are confidential before, during and after the exam.
dd) The school has promulgated the entrance examination regulations, including the organization process and regulations related to the following contents: preparation for the exam; organize contest registration; exam question works and exam security process; work of exam monitoring examinations, re-examination, evaluation; reporting and archiving regimes; handle abnormal incidents, examine, inspect and handle violations. Regulations of the entrance examination signed by the principal, must not be contrary to the provisions of this Regulation and must be published publicly on the website of the school, and also send reports to the Ministry of Education and Training at least 15 days before the date the candidate starts registering for the exam.
e) Ensure the conditions on facilities, equipment and devices for the examination, suitable to the scale and form of the examination.
g) Promulgate the Scheme to organize a separate examination for admission of the school, which shows all information and proof of meeting the quality assurance requirements to organize the exam. The plan for organizing the entrance examination must be publicized on the website of the school at least 15 days before the date the candidate starts registering for the exam, and send it to the Ministry of Education and Training for reporting.
The head of the training institution shall take accountability for the contents of the scheme and hold legal responsible for the entire exam.
2. Schools organizing exams and aptitude tests for enrollment must comply with the following quality assurance requirements:
a) To establish an independent department which performs the function of organizing the aptitude test for admission.
b) To ensure that the contingent of managerial officials, examiners, exam questioning officers, assessment and evaluation officers, support staff, technicians, meet the quantity and ability requirements to organize aptitude tests for admission.
c) Make sure the number of questions/practice questions in the bank of exam questions/practice questions of the school is large enough to build exam questions for the organization of each exam. The content of the questions/exercises to evaluate the aptitude, learning capacity of candidates at undergraduate or college level of candidates in accordance with the requirements of the training industry, not violating the law and traditions, culture of Vietnam.
d) Satisfying the requirements at points dd and e Clause 1 of this Article;
e) The head of the training institution is accountable and legally responsible for the entire examination.
Article 13. Organization of admission
1. The organization of admission is conducted according to the school’s Enrollment scheme. Schools have the right to choose the following methods:
a) Admission based on the academic results of upper secondary school or the competency test of candidates or the results of the competency assessment of other schools or the results of the prestigious international testing organizations and the other methods;
b) Simultaneous use of the above admission methods (including prequalification combined with admission) and must publicize the criteria for each admission method;
c) Selected candidates must verify their entry by submitting the original Certificate of Examination to the school in accordance with this Regulation, within the time limit prescribed by the school. Past this time limit, candidates who do not verify the entry are construed to refuse admission and the school will consider admissions to other candidates; Candidates who have confirmed admission are not allowed to participate in admission of other schools.
2. The priority regime shall be implemented as prescribed in Article 7 of this Regulation. In case of using upper secondary school academic results for admission, priority points shall be added for admission after candidates reach the input quality assurance threshold specified in Article 11 of this Regulation.
3. The time for enrollment examination and admission registration shall be prescribed by the principal of the school in accordance with the regime of training organization at the school and the time framework of the general education school year.
4. Examination of dossiers of selected candidates shall be implemented as prescribed in Articles 20 and 21 of this Regulation.
Chapter III
ENROLLMENT FOR TRAINING OF IN-SERVICE LEARNING, ORDER TRAINING AND INTER LEVEL TRAINING
Article 14. Enrollment training for in-service learning (VLVH)
Admissions for in-service learning shall comply with the provisions of Chapter II of this Regulation, in which the organization of examinations prescribed by the school must ensure quality requirements and the admission shall not apply regulation of Article 10, point c Clause 1 Article 13 of this Regulation. Schools must specify the admission for training of in-service learning, ensure the quality, fairness, transparency and hold legal responsible, accountability to the Ministry of Education and Training, the competent authorities and related parties.
Article 15. Enrollment for training according to order
1. Basis of enrollment training according to order
a) Enrollments are ordered by the Government in accordance with the Government’s Decree No. 32/2019/ND-CP dated April 10, 2019 on assigning tasks, ordering goods or bidding to provide products and public services covered by the state budget from regular expenditure;
b) Admissions which ordered by trainees and committed to employ graduates according to the contract between the concerned parties and not contrary to the provisions of law;
c) The document on task assignment, order or bidding for the provision of public products and services covered by the state budget or agreement between the parties and related information must be included in the appendix of the Enrollment Scheme.
2. The input quality assurance threshold shall comply with the provisions of this Regulation. The passing score according to order requirements shall not lower than the passing score of the training major. In case the provincial level People’s Committee orders to train labor for agencies, organizations and enterprises of the province in the Northwest, Central Highlands, Southwest region; candidates are those who have had permanent residence for 3 years or more in the province and the province commits to employ graduates, the passing score may be lower but not lower than 1 (one) point compared to the passing score of the training major, calculated on the scale of 30 point. The Chairperson of the provincial level People’s Committee ordering shall be accountable for the training order and employment needs after training.
3. Other contents in the task of admission according to order shall be prescribed by schools, which not contrary to the provisions of this Regulation and such schools shall be responsible for explanation.
Article 16. Admission of inter level training
1. Admissions inter level training for college level of Early Childhood Education.
a) Subjects for enrollment: Persons with intermediate level diplomas in teacher training disciplines and upper secondary school diplomas; Those who have graduated from the secondary level, who have majored in teacher training, but have not yet graduated from upper secondary school must study and pass the required volume of upper secondary school cultural knowledge in accordance with the Law on Education and guiding documents; people with a college degree or higher degree in the field of teacher training.
b) Methods of admission include: entrance examination, admission or a combination of examination and admission. If using the method of recruitment examinations, the following provisions shall apply:
- Specifying the test/exam subject; to promulgate the school’s admissions regulations, after getting the written opinion of the Science and Training Council; publicize on the school’s website and send to the Ministry of Education and Training for inspection and examination;
- The content of the school’s entrance examination regulations includes: Organizing process and regulations on exam preparation; organize registration; exam work; monitor the exam; mark the test; re-examination; appraisal of the exam; reporting and archiving regime; inspect; handle abnormal incidents and handle violations;
c) The input quality assurance threshold and accountability shall be set by the training institution.
2. Enrollment of higher education inter level training
a) Subjects for enrollment: Persons with intermediate degree diplomas and upper secondary school diplomas; those who have graduated from the intermediate school but do not have an upper secondary school diploma must study and pass the required volume of high school cultural knowledge in accordance with the Law on Education and guiding documents; people with a college degree or higher degree;
b) Enrollment of inter level training from intermediate and college-level to bachelor s level shall comply with current regulations of the Prime Minister; particularly for the threshold of input quality assurance shall be specified at Point d of this Clause;
c) Enrollment of bachelor’s level for people who have graduated from university or higher shall follow the method specified at point b, Clause 1 of this Article. The school shall have prescribed other contents, clearly stated in the Enrollment Scheme, organization of implementation and held the accountability;
Particularly, the group of majors of the health sector with practicing certificates only admit students to those obtained a bachelor degree or higher in the health sector;
d) The input quality assurance threshold shall be specified as follows:
- The fields of teacher training and the major of Medical, Traditional Medical, Dentomaxillofacial, Pharmacology must meet one of the following criteria: Candidate has learning capacity at excellent level in 12 grade or upper secondary school graduate score from 8.0 or higher or has learning capacity at good level in 12 grade and have 3 years of working experience in accordance with training specialty or graduating intermediate level, or college level or bachelor level at excellent level; or graduated from intermediate level, or college level, or bachelor level at good level and has 3 years of working experience in accordance with the training specialty;
- Sectors: Nursing, Preventive Medicine, Midwifery, Orthopedic Technique, Medical Laboratory Technique, Medical Imaging Technique, Rehabilitation Technology, Music Education, Pedagogy Arts, Physical Education, Sports Training, must meet one of the following criteria: Candidate has learning capacity good level in 12 grade or average score of general subjects of 6.5 or higher, or graduated from upper secondary school in good level or has learning capacity in 12 grade in medium level and have 5 years of working experience in accordance with training specialty or graduated intermediate level, or college level or bachelor level at good level;
- Particularly for the group of teacher training major, the inter level training for those who have been recruited or graduated from the teacher training industry before the issuance date of this Regulation to reach the standard level prescribed in Article 72, of the 2019 Law on Education, the threshold for ensuring the quality of inputs shall be set by the training institution.
Chapter IV
ORGANIZATION, TASKS AND POWERS OF SCHOOLS FOR ENROLLMENT WORK
Article 17. Organization, tasks and powers of the School Enrollment Council
1. The school principal shall issue the decision to establish the Enrollment Council to implement the administrative work related to the admission, the admission inspection, the organization, tasks and powers of the Expertise Committees according to Article 19 of this Regulation.
2. The composition of the School Enrollment Council includes:
a) The President: The school Principal or Vice Principal;
b) Vice President: The Vice Principal;
c) Permanent member: Head of Department or Deputy Head of Training Department (or Testing Department);
d) Members: heads or deputy heads of division, heads or deputy heads of departments, heads or deputy heads of subjects related to enrollment examinations and information technology staff;
People whose relatives (children, spouse, father, mother, siblings or spouse’s sibling) who take the exam or register to admission to the school are not allowed to participate in the school’s Enrollment Council and the Assistance Council in that year.
3. Duties and powers of the School Enrollment Council.
a) Organize the implementation of selected admission plans;
b) To resolve questions, complaints and denunciations related to the admission work;
c) Collect or authorize the collection and use of enrollment fees and admission fees;
d) Summary of admission work; decide on commend and discipline in accordance with law provisions;
dd) Promptly report the enrollment results to the Ministry of Education and Training and the school’s managing agency (ministry, agencies and provincial-level People’s Committees).
4. Tasks and powers of the President of the School Enrollment Council.
a) Organize the implementation and take responsibility for the school’s enrollment work;
b) Report to the Ministry of Education and Training and the responsibility agencies for the school’s enrollment work;
c) Establishing the Secretariat and the Specialized Committees as prescribed in Clause 1, Article 19 of this Regulation to assist the school’s Enrollment Council in the enrollment work; Heads of Specialized Committees must be members of the Enrollment Council.
5. The Vice President of the Enrollment Council shall carry out the tasks assigned by the President of the Enrollment Council and solve the work on behalf of the President of the Enrollment Council up on authorization.
6. Hanoi National University, National University of Ho Chi Minh City, Thai Nguyen University, Hue University, and Da Nang University shall establish the Enrollment Steering Committee to direct the enrollment work of subordinated and affiliated units.
Article 18. Organization, tasks and powers of the Secretariat of the school’s Enrollment Board
The composition of the School Council’s Secretariat consists of:
a) The Chairman is the standing member of the school’s Enrollment Board;
b) Members: A number of officials of the Training Department or Testing Department, concerned faculties and sections and information technology officers.
2. Tasks and powers of the School’s Secretariat in using upper secondary school exam results for pre-qualification and admission:
a) Update to the information portal on enrollment of the Ministry of Education and Training all the school information as prescribed in Article 10 of this Regulation to conduct the admission;
b) Proposed plan of passing score and submit to the school’s Enrollment Board for decision;
c) Making list of passing candidates;
d) Notice to passing candidates to entry;
dd) Examine the dossier of the passing candidate according to the provisions of Articles 20 and 21 of this Regulation;
e) Perform other duties as assigned by the President of the school’s Enrollment Board.
3. Duties and powers of the Secretariat committee of the school does not use upper secondary school exam results for prequalification and admission:
a) To publish information related to the criteria, dossiers, time and places for registration for examination and admission on the school’s website and other mass media;
b) To perform the tasks prescribed in Clause 2 of this Article and other tasks of the Secretariat according to the Regulation on enrollment examinations of the school;
c) Perform other duties assigned by the President of school’s Enrollment Board.
Article 19. Organization, tasks and powers of the Specialized Committees for admission schools by the method of entrance examination or examination combined with admission
1. The Specialized Committees for school’s implement admission by the method of entrance exam or entrance examination combined with the admission include: Examination Thread Board, Examination Monitor Board, Exam Tag Committee, Examination Board, and Re-examination Board. For the Examination Thread Board, the Head is the school leader, the leader of the specialized unit which performs the functions and tasks of organizing the exam is standing member.
2. The organization, tasks and powers of the specialized committees for the school implement enrollment by the method of entrance exam or entrance exam combined with admission and the Secretariat are specified in the Regulation on entrance examination signed by the principal of the school.
Article 20. Notice to passing candidate for entry
1. The school admissions council shall send a notice of the passing candidate to entry the school when the candidate has met the conditions according to the provisions of this Regulation and the school’s regulations, clearly stating the necessary procedures for candidates upon entry.
2. Passing candidates need to submit a valid copy of the following documents:
a) Academic profile;
b) Temporary upper secondary school graduation certificate for those who passing in the year of graduation or upper secondary school diploma for those who graduated in previous years. Those who have just submitted the certificate of temporary graduation, must present the original high school diploma for comparison at the beginning of the next school year;
c) Birth certificate;
d) The evidences for enjoying the priority regime prescribed in the guidance documents of the Ministry of Education and Training;
dd) Other requirements prescribed by the schools.
3. For students who arrive late for admission after 15 days or more from the date stated in the admission notice:
a) If there is no plausible reason, it shall be regarded as dropping out of school;
b) If the student is late due to illness or accident, certified by a district hospital or higher or due to a natural disaster certified by the People’s Committee of the district or higher level, the school shall consider granting admission for the candidate or reservation of admission results for candidates to enroll later.
Article 21. Examination of dossiers of passing candidate
1. When candidates come to enroll, the school must organize the examination of the submitted dossiers according to the provisions of Clause 2, Article 20 of this Regulation.
2. During the course of the student’s enrollment at the school, the school shall organize the examination and inspection of the candidate’s dossier and exam results in accordance with law provisions.
Article 22. Using of information technology in the work of enrollment
1. The provincial-level Departments of Education and Training shall prepare adequate material facilities and equipment and send qualified personnel to enter the candidates’ initial admission register data onto the information portal on enrollment of the Ministry of Education and Training; ensure the process and time to perform the work according to the general plan for enrollment.
2. Schools shall prepare adequate material foundations and equipment and appoint qualified official in information technology to perform the following tasks:
a) Establishing the official E-mail address used in the enrollment works;
b) Exploiting and processing information; update the data in accordance with the structure, process, and deadline to the Ministry of Education and Training enrollment portal;
c) Send the notice of admission to the passing candidate, clearly stating the candidate’s exam results, if the school organizes the examination;
d) Comply with the provisions of Article 10 of this Regulation and other regulations on enrollment.
3. Persons who enter data on the enrollment portal of the Ministry of Education and Training shall be responsible for checking and comparing the entered information with relevant information in the candidate’s dossier and the information on the high school exam database; sign the confirmation minutes and take responsibility for the inspection.
Chapter V
HANDLING OF FEEDBACK INFORMATION ON VIOLATIONS OF ENROLLMENT REGULATIONS AND REPORT AND STORAGE REGIME
Article 23. Inspection and examination of enrollment work
1. The Ministry of Education and Training shall organize inspection and examination of the enrollment work of schools and agencies and organizations participating in the enrollment work.
2. Ministries and agencies; People’s Committees of provinces and centrally run cities (hereinafter referred to as provincial-level People’s Committees) organize the examination of enrollment work for their attached schools according to their respective competence.
3. The Chief Inspector of the Ministry of Education and Training shall decide to inspect and set up the inspection team for admissions; in case of necessity, the Minister of Education and Training shall decide on inspection and establish inspection team according to regulations.
4. The Chief Inspector of the Department of Education and Training decides to inspect and set up the inspection team for admissions; in case of necessity, the director of the provincial Department of Education and Training shall decide on inspection and establish an inspection team for the enrollment work for education facilities under the provincial People’s Committee.
5. Principals of schools shall organize the inspection and examination of enrollment work in such facilities in accordance with law provisions.
6. The order and procedures for organizing inspection and examination shall comply with the law on inspection, examination and guidance of the Ministry of Education and Training.
7. Persons who have relatives (children, spouses, parents, siblings or spouse’s sibling) taking examinations or admission to schools must not participate in the inspection and examination work in that year.
Article 24. Handling of feedback information on violations of the Enrollment Regulation
1. Place of receiving information and evidence about the violation of the Enrollment Regulation:
a) The school’s Enrollment Board;
b) Enrollment and Education Inspectors at all levels.
2. Evidence of violations of the Enrollment Regulations after being verified for their authenticity shall be the basis for handling violators.
3. Providing information and evidence on violations of the Enrollment Regulations:
a) All citizens, including candidates and participants in the enrollment work, if detecting violations of the enrollment regulations, must provide information to the receiving places as specified in Clause 1 of this Article in order to promptly handling according to law provisions on denunciations;
b) Persons who provide information and evidence on violations of the Enrollment Regulations shall be legally responsible for the authenticity of the information and evidence provided and must not take advantage of such actions to cause negative impact to the enrollment works.
4. For organizations and individuals that receive information and evidence on violations of the Enrollment Regulation:
a) Organize the receipt of information and evidence in accordance with law provisions; protect the status quo of evidence; verify the authenticity of information and evidence;
b) Promptly implement preventive measures to prevent violation of the Enrollment Regulation according to the information provided;
c) To handle according to its competence or report to competent agencies and persons for handling and publicize results of handling individuals and organizations that violate the enrollment regulations;
d) Keeping confidential of information and the identity of information providers.
Article 25. Reporting regime
Schools must report to the Ministry of Education and Training:
1. Enrollment results of the previous year before February 28, 2021.
2. Information about the school’s enrollment in accordance with law provision or up on required by the Ministry of Education and Training.
Article 26. Storage regime
1. The exam/exam subjects of the schools that implement enrollment by entrance examination or the entrance examination combined with the admission shall be archived by the school according to the time limit specified in the Regulation on the graduation exam of upper secondary school.
2. Other documents related to enrollment, schools must be preserved and archived during the training in accordance with the Law on Archives, and the time limit for preserving professional documents of education sector.
Chapter VI
COMMENDATION AND HANDLING OF VIOLATIONS, SETTLEMENT OF COMPLAINTS AND DENUNCIATIONS
Article 27. Commendation
The President of School’s Enrollment Board shall carry out the reward or requesting competent authorities to reward:
1. People who successfully complete the assigned tasks.
2. People with many accomplishments contribute to the enrollment works.
Article 28. Settlement of complaints and denunciations related to the enrollment work
1. During the enrollment period, the School Enrollment Council organizes and receives citizens’ complaints and denunciations related to the enrollment work.
2. At the end of enrollment, the principal shall receive and handle citizens’ complaints and denunciations related to the enrollment work.
3. Complainants shall implement the rights to complain when there is basis to believe that such administrative decisions or administrative acts are illegal and infringe their lawful rights and interests.
4. The order, procedures and time limits for settling complaints and denunciations of citizens related to the enrollment work shall comply with the law provisions on settlement of complaints, denunciations and regulations relevant laws.
Article 29. Handling of violating schools, admissions officials and candidates
1. Cadres and candidates who commit acts of violation in the course of organizing entrance examinations shall be handled according to the current Regulation on the upper secondary school’s graduation of the Ministry of Education and Training.
2. Candidates who have succeed and admitted but be found to have cheated or are directly involved in cheating during the examination or admission, the candidate may be forced to leave the school and be prohibited from enrolling in the school in the following years; this shall be considered and decided by the schools.
3. The principal, the President of the school s Enrollment Board and the relevant persons shall be disciplined in accordance with the provisions of Article 71 of the Law on Higher Education; The Law on Cadres and Civil Servants, the Law on Public Officials, the Labor Code, the documents guiding the implementation, other relevant laws and regulations on organization and operation of the school (if any) when violating one of the following errors:
a) Issuing decisions and documents related to the enrollment work ultra vires and against the provisions of this Regulation;
b) Implement the enrollment for majors that have not yet been decided to open a major; enrollment is not in accordance with the registered aspiration of the candidate;
d) Determine the enrollment quota incorrectly and implement enrollment exceed the quota;
dd) Failing to promptly report and publicize the Enrollment Scheme in accordance with law provisions;
e) Organizing the enrollment not in compliance with the provisions of the announced Enrollment Scheme;
g) Carrying out the enrollment process not in accordance with provisions of the Enrollment Regulation and the guidance of the Ministry of Education and Training;
h) Deliberately violating other provisions of this Regulation.
4. Participants in the enrollment work are civil servants and public employees who commit acts of violating regulations, depending on the seriousness shall be handled by the management agency in accordance to the provisions of Article 71 of the Law on Higher Education; the Law on Public Officials, the Law on Cadres and Civil Servants and documents stipulating the disciplining of civil servants and public employees. For those who violate the Enrollment Regulation are officials, lecturers, teachers and staff members of non-public schools other than public employees and civil servants, the school’s principal shall decide to handle according to regulations of the Labor Code and current legal documents.
5. Schools that violate enrollment procedures, depending on the seriousness of their violations shall be handled according to current regulations.
