CIRCULAR
Providing for Energy Labeling for Energy-Using Vehicles under the Management of the Ministry of Construction
Pursuant to the Law on Economical and Efficient Use of Energy No. 50/2010/QH12; the Law Amending and Supplementing a Number of Articles of Eleven Laws Related to the Planning Law No. 28/2018/QH14; the Law Amending and Supplementing a Number of Articles of the Law on Economical and Efficient Use of Energy No. 77/2025/QH15;
Pursuant to the Government’s Decree detailing a number of articles and measures to organise and guide the implementation the Law on Economical and Efficient Use of Energy;
Pursuant to Government’s Decree No. 33/2025/ND-CP dated February 25, 2025, defining the functions, tasks, powers, and organizational structure of the Ministry of Construction;
At the proposal of the Director of the Vietnam Register;
The Minister of Construction hereby promulgates the Circular providing for Energy Labeling for Energy-Using Vehicles under the Management of the Ministry of Construction.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
1. This Circular provides guidance on the provisions set out in Clause 3, Article 39 of the Law on Economical and Efficient Use of Energy No. 50/2010/QH12, as amended and supplemented under Clause 17, Article 1 of the Law Amending and Supplementing a Number of Articles of the Law on Economical and Efficient Use of Energy No. 77/2025/QH15.
2. This Circular does not apply to:
a) Vehicles manufactured, assembled, or imported under the management of the Ministry of National Defence or the Ministry of Public Security;
b) Vehicles temporarily imported for re-export; vehicles in transit or transferred across borders; and vehicles of diplomatic and consular missions.
Article 2. Subjects of application
This Circular applies to manufacturers, importers, distributors and traders of vehicles, including those operating on e-commerce platforms, and laboratories testing the energy consumption of vehicles under the management of the Ministry of Construction.
Chapter II
PROVISIONS ON ENERGY LABELING FOR VEHICLES
Article 3. General provisions on vehicle energy labeling
The energy consumption indicated on the vehicle energy label must be consistent with the energy consumption stated in the Energy Consumption Test Report as prescribed by the regulations of the Minister of Construction on the order and procedures for certification of technical safety quality and environmental protection for motor vehicles, specialized motorcycles, and motor vehicle components in production, assembly, and importation.
Article 4. List of vehicles subject to energy labeling
The list of vehicles subject to energy labeling is provided in Appendix I issued together with this Circular.
Article 5. Provisions on the content and format of vehicle energy labels
The content and format of vehicle energy labels shall comply with the template specified in Appendix II issued together with this Circular.
Article 6. Regulations on laboratories for testing vehicle energy consumption
Laboratories for testing vehicle energy consumption are laboratories belonging to product and goods quality testing service providers that meet the conditions specified in Article 5 of the Government’s Decree No. 107/2016/ND-CP dated July 1, 2016, prescribing conditions for provision of conformity assessment services, as amended and supplemented under the Government’s Decree No. 154/2018/ND-CP, amending, supplementing and repealing certain regulations on investment and business conditions in sectors under management of the Ministry of Science and Technology and certain regulations on specialized inspections.
Article 7. Guidance on and declaration of vehicle energy labeling
1. Receipt of dossiers for declaration of vehicle energy labeling
Manufacturers, importers, distributors and traders of vehicles shall submit dossiers for declaration of energy labeling, either directly, via postal services, or through electronic means, as prescribed by the Government’s Decree detailing a number of articles and measures to organise and guide the implementation the Law on Economical and Efficient Use of Energy, to the Vietnam Register.
2. The declaration form for vehicle energy labeling shall comply with the template provided in Appendix III issued together with this Circular.
3. The Vietnam Register shall publish information on vehicle energy labels of manufacturers, importers, distributors and traders of vehicles on its official web portal within 05 working days from the date of receipt of the declaration dossier.
4. Guidelines for energy labelings
a) Importers and manufacturers shall print the energy labels as prescribed in the template provided in Appendix II issued together with this Circular and affix them to the vehicles.
b) Location for affixing energy labels
For vehicles with fixed side windows or a rear windshield, the energy label must be affixed inside the vehicle at one of these two positions so that it is easily visible from outside the vehicle.
In cases where the vehicle has neither side windows nor a windshield, or where the label is difficult to observe when affixed inside the vehicle, the energy label shall be affixed on the exterior of the vehicle at a clearly visible position.
Article 8. Recognition of energy labels for imported vehicles
1. The recognition of foreign energy labels for imported vehicles shall be carried out in accordance with treaties to which the Socialist Republic of Vietnam is a contracting party.
2. In cases where the energy label of an imported vehicle is recognized under treaties to which the Socialist Republic of Vietnam is a contracting party, importers, distributors and traders of vehicles shall affix a supplementary label presenting the Vietnamese translation of the contents on the foreign energy label, placed adjacent to the foreign energy label.
Article 9. Suspension and revocation of energy labels
1. The Vietnam Register shall suspend the energy labeling of vehicles as prescribed by the Government’s Decree detailing a number of articles and measures to organise and guide the implementation the Law on Economical and Efficient Use of Energy. The suspension shall follow the template specified in Appendix V issued together with this Circular.
2. The Vietnam Register shall require manufacturers, importers, distributors and traders of vehicles to carry out the revocation of energy labels as prescribed by the Government’s Decree detailing a number of articles and measures to organise and guide the implementation the Law on Economical and Efficient Use of Energy. The notice requesting the revocation of vehicle energy labels issued by the Vietnam Register shall follow the template provided in Appendix V issued together with this Circular.
Chapter III
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
Article 10. Responsibilities of manufacturers, importers, distributors and traders of vehicles
1. Comply with the regulations on energy labeling for vehicles as provided in this Circular.
2. Implement the reporting regime as prescribed by the Government’s Decree detailing a number of articles and measures to organise and guide the implementation the Law on Economical and Efficient Use of Energy and submit reports to the Vietnam Register. The report template is provided in Appendix IV issued together with this Circular.
Article 11. Responsibilities of the Vietnam register
1. Organize the receipt and publication of declarations of vehicle energy labeling on the portal of the Vietnam Register.
2. Inspect the implementation of vehicle testing for energy labeling at testing laboratories.
3. Suspend or revoke vehicle energy labels as prescribed.
Chapter IV
IMPLEMENTATION PROVISIONS
Article 12. Effect
1. This Circular takes effect from January 1, 2026.
2. Vehicle types that have been granted a certificate of energy consumption or a certificate of technical safety and environmental protection combined with energy consumption certification before the effective date of this Circular may continue to use energy labels printed in accordance with previous regulations until December 31, 2027.
3. Testing laboratories that were conducting energy consumption tests for energy-using vehicles under the management of the Ministry of Construction before the effective date of this Circular may continue such activities until December 31, 2027.
4. The following Circulars and certain provisions of Circulars shall be repealed from the effective date of this Circular, specifically:
a) The Minister of Transport and the Minister of Industry and Trade’s joint Circular No. 43/2014/TTLT-BGTVT-BCT dated September 24, 2014, providing regulations on energy labeling for passenger cars with 07 seats or fewer;
b) Article 16 and Clause 9, Article 19 of the Minister of Transport’s Circular No. 54/2024/TT-BGTVT dated November 15, 2024, providing regulations on the order and procedures for certification of technical safety quality and environmental protection for motor vehicles, specialized motorcycles, and motor vehicle components in importation;
c) Appendix XIX of the Minister of Transport’s Circular No. 54/2024/TT-BGTVT dated November 15, 2024, providing regulations on the order and procedures for certification of technical safety quality and environmental protection for motor vehicles, specialized motorcycles, and motor vehicle components in importation;
d) Article 18 of the Minister of Transport’s Circular No. 55/2024/TT-BGTVT dated November 15, 2024, providing regulations on the order and procedures for certification of technical safety quality and environmental protection for motor vehicles, specialized motorcycles, and motor vehicle components in manufacturing and assembly;
dd) Appendix XV of the Minister of Transport’s Circular No. 55/2024/TT-BGTVT dated November 15, 2024, providing regulations on the order and procedures for certification of technical safety quality and environmental protection for motor vehicles, specialized motorcycles, and motor vehicle components in manufacturing and assembly./.
