CIRCULAR

ON AMENDMENT AND SUPPLEMENT OF REGULATION ON MANAGEMENT OF SAFETY TECHNIQUE FOR MACHINES, EQUIPMENT AND HAZARDOUS CHEMICALS WITH SPECIFIC SAFETY REQUIREMENTS FOR SPECIALIZED INDUSTRIES ISSUED TOGETHER WITH DECISION NO.136/2004/QD-BCN ON NOVEMBER 19, 2004 THE MINISTER OF INDUSTRY

Pursuant to Decree No.189/2007/ND-CP of December 27, 2007 of the Government regulating functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to Resolution No.59/NQ-CP of December 17, 2010 by the Government on the simplification of administrative procedures within the scope of functions of the Ministry of Industry and Trade;

Ministry of Industry and Trade amends and supplements some Articles of the Regulation on management of safety technique for machines, equipment and hazardous chemicals with specific safety requirements for specialized industries, issued together with Decision No.136/2004/QD-BCN dated November 19, 2004 of the Minister of Industry issuing the List of machines, equipment and hazardous chemicals with specific safety requirements for specialized industries and Regulation on management of safety technique for machines, equipment and hazardous chemicals with specific safety requirements for specialized industries (hereinafter referred to as the Regulation attached to Decision No.136/2004/QD-BCN) as follows:

Article 1. To amend and supplement some Articles of the Regulation attached together with Decision No.136/2004/QD-BCN

1. To annul the provisions of Chapter II from Article 3 to Article 7.

2. To amend and supplement Article 19 as follows:

"Article 19. Departments of Industry and Trade shall guide and supervise the implementation of this Regulation for the units in the provinces and synthesize to report to the Ministry of Industry and Trade on the appraisal in the provinces on May 30 and on November 30 every year. "

3. To amend and supplement Clause 9 of Article 21 as follows:

"9. Making Report of statistics on the appraisal in year and appraisal plan of the following year and send to the Department of Industry and Trade on November 30 every year. "

4. To annul the row "registration number" in the Form of certificate of technical safety appraisal in Annex 6, issued together with Decision No.136/2004/QD-BCN dated November 19, 2004 of the Minister of Industry.

5. To annul Annexes No.1, 2, 3, 5, 7, issued together with Decision No.136/2004/QD-BCN dated November 19, 2004 of the Minister of Industry.

Article 2. Implementation provisions

1. This Circular takes effect from May 15, 2011.

2. Chief Office of the Ministry, heads of ministerial agencies and other concerned organizations and individuals shall implement this Circular./.
