CIRCULAR

Providing for the methods of declaration and receipt of information on foreigners' temporary residence in Vietnam

Pursuant to the Law on Foreigners’ Entry in, Exit from, Transit through and Residence in Vietnam No. 47/2014/QH13, amended and supplemented under Law No. 51/2019/QH14, Law No. 23/2023/QH15, Law No. 103/2025/QH15 and Law No. 118/2025/QH15;

Pursuant to the Government’s Decree No. 02/2025/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Public Security, amended and supplemented under Decree No. 11/2025/ND-CP;

At the proposal of the Director of the Immigration Department;

The Minister of Public Security hereby promulgates the Circular providing for the methods of declaration and receipt of information on foreigners' temporary residence in Vietnam.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of regulation

This Circular provides for the methods of declaration and receipt of information on foreigners' temporary residence in Vietnam.

Article 2. Subjects of application

This Circular applies to foreigners residing in Vietnam; accommodation establishments where foreigners temporarily reside overnight (hereinafter referred to as accommodation establishments); agencies in charge of managing foreigners’ residence; and other relevant agencies, organizations, and individuals.

Article 3. Interpretation of terms

In this Circular, the terms below are construed as follows:

1. Electronic temporary residence declaration system means an electronic information system managed and operated by the Ministry of Public Security for the declaration, receipt, management, sharing, and utilization of information on temporary residence declarations of foreigners in Vietnam.

2. Digital accommodation service platform means an information system established in the electronic environment to connect accommodation service providers with accommodation lessees.

3. Temporary residence declarant means the owner of an accommodation establishment, the legal representative of an accommodation establishment, or an authorized person.

4. Declaration Account means an account granted for making declarations and updating information on the Electronic temporary residence declaration system.

Article 4. Principles of implementation

1. Facilitating foreigners, accommodation establishments, and relevant agencies, organizations, and individuals in carrying out the declaration and receipt of information on foreigners' temporary residence in Vietnam.

2. Information on the temporary residence of foreigners must be declared and received in a timely, complete, and accurate manner. In case where a foreigner does not possess a passport or an international travel document, or where signs of violations of the laws on foreigners’ entry in, exit from, transit through and residence in Vietnam are detected, the accommodation establishment shall immediately report to the public security office of commune, ward, or special zone, or police post or station where the accommodation establishment is located (hereinafter referred to as the commune-level police). Where such signs are detected in a border area, the accommodation establishment shall immediately notify the commune-level police or the nearest border guard post or station.

Article 5. Responsibility for temporary residence declaration

1. Accommodation establishments shall declare temporary residence for foreigners through the electronic environment or by temporary residence declaration form.

2. Temporary residence declarants shall carry out temporary residence declarations for foreigners, including declarations made through digital accommodation service platforms.

Chapter II

SPECIFIC PROVISIONS

Section 1

DECLARATION AND RECEIPT OF FOREIGNERS’ TEMPORARY RESIDENCE INFORMATION THROUGH THE ELECTRONIC ENVIRONMENT

Article 6. Access to the electronic temporary residence declaration system for obtaining declaration accounts

1. The temporary residence declarant shall access the electronic temporary residence declaration system and provide his/her information and information on the accommodation establishment on the electronic temporary residence declaration system as required by the system in order to obtain a declaration account. In case of any change to information related to the declaration account, the temporary residence declarant shall immediately update such information on the electronic temporary residence declaration system.

2. The temporary residence declarant shall manage and maintain the declaration account confidentiality and shall bear responsibility for information generated through the declaration account. Upon detecting that the declaration account has been disclosed, unlawfully used, or is unusable, the temporary residence declarant shall immediately notify the commune-level public security office.

3. A declaration account shall be temporarily suspended, and a notification shall be sent via the registered email address or telephone number in the following cases:

a) Where no temporary residence declaration information is generated within a period of 12 months;

b) Where information provided through the declaration account is found to be inaccurate.

4. A declaration account shall be restored immediately upon receipt of a request submitted by the accommodation establishment through the electronic temporary residence declaration system in the case specified at Point a, Clause 3 of this Article, or upon full and accurate updating of information on the electronic temporary residence declaration system in the case specified at Point b, Clause 3 of this Article.

Article 7. Declaration of temporary residence information

1. The declaration of temporary residence information shall be carried out on the electronic temporary residence declaration system.

2. The temporary residence declarant shall access the electronic temporary residence declaration system and log into the declaration account to declare temporary residence information. The declaration must be made immediately upon the foreigner’s arrival at the accommodation establishment.

3. Temporary residence declaration information shall include the following information of the foreigner: full name, gender, date of birth, nationality, passport number or number of the international travel document, validity period of the temporary residence certification or temporary residence extension or temporary residence card issued by a competent agency, and the expected period of temporary residence at the accommodation establishment.

Article 8. Receipt of temporary residence information

1. The commune-level public security office shall receive foreigners' temporary residence information declared through the electronic temporary residence declaration system round the clock.

2. Border guard posts and stations shall use accounts issued by competent agencies under the Ministry of Public Security to access temporary residence information of foreigners at accommodation establishments located in border areas and other locations related to border areas in accordance with law, including commune-level administrative units, tourism and service areas, special administrative-economic units, and other economic zones.

3. In case where a border guard post or station has not yet met the infrastructure conditions necessary to access information as prescribed in Clause 2 of this Article, the commune-level public security office shall immediately notify the border guard post or station of the foreigners’ temporary residence information.

Section 2

DECLARATION AND RECEIPT OF FOREIGNERS’ TEMPORARY RESIDENCE INFORMATION BY TEMPORARY RESIDENCE DECLARATION FORMS

Article 9. Completion and submission of temporary residence declaration forms

1. The temporary residence declarant shall fully and accurately complete the temporary residence declaration form using Form NA17 to the Minister of Public Security’s Circular No. 04/2015/TT-BCA prescribing forms and documents relating to the foreigners’ entry, exit, and residence in Vietnam, as amended and supplemented under Circular No. 57/2020/TT-BCA, Circular No. 22/2023/TT-BCA, and Circular No. 70/2026/TT-BCA. The completed temporary residence declaration form shall be submitted directly to the commune-level public security office within 12 hours from the time the foreigner arrives at the accommodation establishment, or within 24 hours for accommodation establishments located in remote and isolated areas.

2. Before submitting the temporary residence declaration form within the time limit prescribed in Clause 1 of this Article, such form shall be immediately transmitted to the commune-level public security office by an appropriate means of communication.

Article 10. Receipt of temporary residence declaration forms

1. The commune-level public security office shall receive foreigners' temporary residence information declared by temporary residence declaration forms round the clock.

2. The commune-level public security office shall examine the temporary residence declaration form and, require immediate supplementation in case of insufficient declaration, and shall certify, make a copy of, and immediately return the temporary residence declaration form to the temporary residence declarant.

3. The commune-level public security office shall immediately update the foreigners’ temporary residence declaration information into the electronic temporary residence declaration system through the granted account. In case where a border guard post or station has not yet met the infrastructure conditions necessary to access information as prescribed in Clause 2 of Article 8, the commune-level public security office shall immediately notify the border guard post or station of the foreigners’ declared temporary residence information.

4. Where a border guard post or station receives the foreigners’ temporary residence declarations in accordance with a treaty to which Vietnam is a contracting party, such border guard post or station shall immediately update such declaration information into the electronic temporary residence declaration system through the granted account. Where the infrastructure conditions necessary for such updating have not yet been met, it shall immediately notify the commune-level public security office of the foreigners’ temporary residence declaration information.

Chapter III

IMPLEMENTATION ORGANIZATION

Article 11. Effect

1. This Circular takes effect from July 24, 2026.

2. This Circular replaces the Minister of Public Security’s Circular No. 53/2016/TT-BCA dated December 28, 2016, providing for the methods of declaration and receipt of information on foreigners' temporary residence in Vietnam.

3. In case any legal documents referred to in this Circular are amended, supplemented, replaced or newly promulgated, the provisions relevant to this Circular shall be modified accordingly.

Article 12. Implementation responsibilities

1. The Immigration Department shall monitor, provide instructions and inspect the implementation of this Circular.

2. Heads of units under the Ministry of Public Security, Directors of Public Security Departments of provinces and cities, and relevant agencies, organizations and individuals shall implement this Circular./.
