CIRCULAR
Promulgating the Parent Association Charter
Pursuant to the Education Law No. 43/2019/QH14, which is amended and supplemented under Law No. 123/2025/QH15;
Pursuant to the Government’s Decree No. 279/2026/ND-CP dated July 12, 2026, defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;
At the proposal of the General Director of the General Education Department,
The Minister of Education and Training hereby promulgates the Circular promulgating the Parent Association Charter.
Article 1. Promulgation of the Charter
To promulgate together with this Circular the Parent Association Charter.
Article 2. Effect and transitional provisions
1. This Circular takes effect on November 15, 2026 and replaces Circular No. 55/2011/TT-BGDDT dated November 22, 2011 of the Minister of Education and Training on promulgating the Parent Association Charter.
2. Parent Associations established before the effective date of this Circular shall continue to operate until the end of their term of office. The consolidation of Parent Associations during the remaining period of their term of office shall comply with the Charter promulgated together with this Circular.
Article 3. Responsibility for implementation
The Chief of Office, the General Director of the General Education Department, the heads of relevant units under the Ministry of Education and Training; the Chairpersons of People’s Committees of provinces and centrally run cities; Directors of Provincial-level Departments of Education and Training; the heads of state education management agencies as decentralized; the heads of early childhood education institutions and general education institutions; Parent Associations, and relevant agencies, organizations and individuals shall be responsible for the implementation of this Circular./.

PARENT ASSOCIATION CHARTER
(Issued together with Circular No. 81/2026/TT-BGDDT dated September 28, 2026 of the Minister of Education and Training)
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation and subjects of application
1. This Charter provides for the organization and operation of Parent Associations; coordination between families and educational institutions in the care, nurturing and education of education of children in early childhood education and students with the participation of Parent Associations; conditions for ensuring the operation of Parent Associations; and responsibilities for implementation.
2. This Charter applies to:
a) Public, people-founded and private early childhood education institutions;
b) Public and private general education institutions;
c) Parent Associations, student parents, heads of educational institutions, teachers, education support personnel, and relevant agencies, organizations and individuals.
Article 2. Interpretation of terms
In this Charter, the terms below are interpreted as follows:
1. Student parents mean fathers, mothers or guardians of early childhood education children and students in accordance with law.
2. Parent Associations including Parent Associations of groups and classes and Parent Associations of educational institutions shall be organized and operate in accordance with this Charter.
Article 3. Principles of organization, operation and coordination
1. Parent Associations shall be organized and operate on a voluntary, democratic, public and transparent basis; and shall properly perform the tasks and exercise the rights specified in this Charter and relevant laws.
2. Parent Associations shall coordinate with educational institutions and student parents in the care, nurturing and education of early childhood education children and students; ensure the lawful rights and interests and the best interests of early childhood education children and students; and conform to educational objectives and programs and actual conditions.
3. Coordination among families, educational institutions and Parent Associations shall be carried out on the basis of respect, cooperation and timeliness, and in accordance with the functions and responsibilities of each party; ensuring the rights of student parents to be informed, provide opinions, give feedback and make recommendations in accordance with law and this Charter.
4. Parent Associations shall operate within the scope of the tasks and rights specified in this Charter; shall not replace or result in the transfer of responsibilities of families, educational institutions, heads of educational institutions, teachers and relevant entities; and shall not interfere in the governance, management, administration and professional activities of educational institutions.
5. Parent Associations’ activities and coordination between families and educational institutions shall be practical and economical; ensure voluntariness and shall not give rise to any mandatory contribution or financial obligation contrary to law; and ensure information security and protection of personal data, private life, personal secrets and family secrets in accordance with law.
Chapter II
ORGANIZATION AND OPERATION OF PARENT ASSOCIATIONS
Article 4. Position and role of Parent Associations
1. Parent Association means a representative organization of student parents, elected by student parents in accordance with this Charter and established at groups, classes and educational institutions; it is not part of the organizational structure of an educational institution and does not have legal person status, a seal or a separate account.
2. Parent Association represents, gathers and reflects the opinions, aspirations and recommendations of student parents; and coordinates with the educational institution and student parents in the care, nurturing and education of early childhood education children and students in accordance with this Charter.
3. Parent Association shall be accountable to the student parents who elected it for the performance of its tasks and exercise of its rights in accordance with this Charter.
Article 5. Organization, tasks and rights of Parent Associations of groups and classes
1. The Parent Association of group or class shall be established in each childcare group, pre-primary class or class of educational institution.
2. The Parent Association of group or class shall be elected by the conference of student parents of the group or class at the beginning of the academic year and shall consist of 03 to 05 members, including Head, one Deputy Head and other members, the specific number of members shall be decided by the conference of student parents of the group or class in accordance with the size of the group or class.
3. The term of office of a Parent Association of group or class shall be one academic year and shall end when the Parent Association of the group or class for the subsequent academic year is elected. The term of office of the Parent Association of a group or class in the final year of an education level ends at the end of the academic year.
4. The Parent Association of group or class shall have the following tasks:
a) Gather, represent and reflect the opinions, aspirations and recommendations of student parents in the group or class;
b) Coordinate with the teacher in charge of the group or class or the homeroom teacher in the care, nurturing and education of early childhood education children and students as specified in this Charter;
c) Support the exchange of information between student parents and the teacher in charge of the group or class, the homeroom teacher and the educational institution;
d) Coordinate in carrying out activities involving the participation of student parents in accordance with the educational plan of the educational institution;
dd) Report on its operational results to the conference of student parents of the group or class.
5. The Parent Association of group or class shall have the following rights:
a) To be provided with necessary information directly related to the performance of the tasks of the Parent Association of the group or class in accordance with law and this Charter;
b) To provide opinions on coordination in the care, nurturing and education of early childhood education children and students in the group or class;
c) To give feedback and make recommendations to the teacher in charge of the group or class, the homeroom teacher or the head of the educational institution on matters related to the performance of the tasks of the Parent Association of the group or class;
d) To request the teacher in charge of the group or class, the homeroom teacher or the head of the educational institution to organize discussions on matters related to the care, nurturing and education of early childhood education children and students in the group or class;
dd) To be provided with favorable conditions by the educational institution for the performance of its tasks in accordance with this Charter.
Article 6. Organization, tasks and rights of the Parent Association of educational institution
1. Each educational institution shall have one Parent Association.
2. The Parent Association of an educational institution shall be elected by the conference of Parent Associations of groups and classes from among the Heads or Deputy Heads of Parent Associations of groups and classes who are assigned by the Heads to attend the conference.
3. The Parent Association of an educational institution shall consist of a Head, Deputy Heads and members. The number of members and Deputy Heads shall be decided by the conference of Parent Associations of groups and classes in accordance with the size, number of groups and classes, number of education levels and number of educational sites of the educational institution.
For an educational institution that organizes educational activities at multiple sites, its Parent Association shall include members who are parents of students at those sites. No separate Parent Association of an educational institution shall be established by grade, education level or educational site.
4. The term of office of the Parent Association of an educational institution shall be one academic year and shall end when the Parent Association of the educational institution for the subsequent academic year is elected.
5. In case an educational institution is reorganized during an academic year, its Parent Association shall be organized as follows:
a) In case of merger, consolidation, division, separation or change in the organizational model that results in a change in the structure of groups, classes, education levels or educational sites, the Parent Association of the educational institution shall be consolidated or newly elected in accordance with the structure of the educational institution after reorganization;
b) In case of renaming or other changes that do not alter the organizational structure of the educational institution, the Parent Association of the educational institution shall continue to operate until the end of its term of office;
c) In case the educational institution is dissolved or terminates its operation, the Parent Association of the educational institution shall cease its operation.
6. The Parent Association of an educational institution is not the superior level of Parent Associations of groups and classes.
7. The Parent Association of an educational institution shall have the following tasks:
a) Represent student parents in coordination with the educational institution as specified in Article 11 of this Charter;
b) Consolidate and reflect the opinions, aspirations and recommendations of student parents and Parent Associations of groups and classes;
c) Coordinate with the head of the educational institution in the care, nurturing and education of early childhood education children and students as specified in this Charter;
d) Coordinate in carrying out activities involving the participation of student parents in accordance with the educational plan of the educational institution;
dd) Support the exchange of information, feedback, recommendations and dialogue between student parents and the educational institution;
e) Report its operational results to the conference of Parent Associations of groups and classes.
8. The Parent Association of an educational institution shall have the following rights:
a) To be provided with necessary information directly related to the performance of the tasks of the Parent Association of the educational institution in accordance with law and this Charter;
b) To provide opinions on matters of coordination in the care, nurturing and education of early childhood education children and students;
c) To give feedback and make recommendations to the head of the educational institution on matters related to the performance of the tasks of the Parent Association of the educational institution;
d) To request the head of the educational institution to organize discussions and dialogues with student parents on matters related to the care, nurturing and education of early childhood education children and students;
dd) To be provided with favorable conditions by the educational institution for the performance of its tasks in accordance with this Charter.
Article 7. Members of Parent Associations
1. A member of a Parent Association must satisfy the following conditions:
a) Be the father, mother or guardian of an early childhood education child or student studying in the group, class or educational institution where the Parent Association is established;
b) Voluntarily participate and be elected by the competent conference specified in Article 9 of this Charter.
2. The Head of a Parent Association shall have the following responsibilities:
a) Organize the formulation and implementation of the operation plan of the Parent Association;
b) Convene and chair meetings; organize the implementation of matters agreed upon by the Parent Association;
c) Assign tasks and coordinate the activities of members;
d) Represent the Parent Association in coordination with student parents, the educational institution, and relevant agencies, organizations and individuals;
dd) Receive, consolidate and reflect the opinions, aspirations and recommendations of student parents in accordance with this Charter;
e) Provide information on the activities of the Parent Association; keep and hand over plans, minutes and relevant documents;
g) Be responsible for the performance of the tasks of the Head in accordance with this Charter.
3. The Deputy Head shall assist the Head in performing tasks as assigned; perform tasks on behalf of the Head when assigned and be responsible for the assigned tasks.
4. Members of a Parent Association shall perform tasks as assigned; participate in the activities of the Parent Association; gather and reflect the opinions, aspirations and recommendations of student parents; and be responsible for the assigned tasks.
5. A member of a Parent Association shall cease to be a member in any of the following cases:
a) No longer satisfying the condition specified at Point a Clause 1 of this Article;
b) Wishing to cease participation in the Parent Association;
c) Being dismissed by the conference that elected such member.
6. The dismissal, addition or replacement of a member of a Parent Association shall be decided by the conference that elected such member in accordance with Article 9 of this Charter.
Article 8. Working regime of Parent Associations
1. Parent Associations shall work on a collective basis. A decision of a Parent Association shall be adopted when approved by more than half of the total number of its members.
2. The Parent Association shall formulate operation plan appropriate to its tasks and rights and actual conditions. The Parent Association of group or class shall coordinate with the teacher in charge of the group or class or the homeroom teacher in formulating and implementing its operation plan; the Parent Association of an educational institution shall coordinate with the head of the educational institution on relevant matters. The operation plan shall be communicated to student parents or Parent Associations of groups and classes within the scope of representation.
3. The Parent Association shall organize meetings in accordance with its operation plan or when necessary as decided by the Head or at the request of at least one-third of the total number of members of the Parent Association.
4. The meetings, information exchange, consultation and voting shall be conducted in person, online, or through a combination of in-person and online methods.
5. The minutes shall be made for meetings of a Parent Association, specifying the time, form of organization, participants, matters discussed, voting results and matters adopted. The minutes shall be certified by the Head and the person taking the minutes, and shall be kept and handed over upon a change of the Head, the end of the term of office, or the cessation of operation of the Parent Association.
6. The results of activities of the Parent Association shall be communicated to student parents or Parent Associations of groups and classes within the scope of representation.
Article 9. Conference of student parents
1. Conferences of student parents include:
a) Conference of student parents of a group or class;
b) Conference of Parent Associations of groups and classes in an educational institution.
2. The conference of student parents of a group or class consists of student parents of such group or class. The first conference shall be held at the beginning of the academic year to carry out the following matters:
a) Exchange information on the care, nurturing and education and the learning, training and development of early childhood education children and students in the group or class;
b) Discuss matters requiring coordination between student parents and the teacher in charge of the group or class or the homeroom teacher in the care, nurturing and education of early childhood education children and students;
c) Elect the Parent Association of the group or class;
d) Discuss other matters related to the tasks and rights of the Parent Association of the group or class.
3. The conference of student parents of a group or class shall be held during the academic year when necessary to carry out the following matters:
a) Hear the report on the results of activities of the Parent Association of the group or class;
b) Dismiss, add or replace members of the Parent Association of the group or class;
c) Discuss matters related to the tasks and rights of the Parent Association of the group or class.
4. The conference of Parent Associations of groups and classes shall consist of the Heads of Parent Associations of groups and classes in the educational institution. In case a Head is unable to attend such conference, a Deputy Head assigned by the Head shall attend.
5. The first conference of Parent Associations of groups and classes shall be held after the Parent Associations of groups and classes are elected to carry out the following matters:
a) Elect the Parent Association of the educational institution as specified in Article 6 of this Charter;
b) Discuss and provide opinions on matters requiring coordination between student parents and the educational institution in the care, nurturing and education of early childhood education children and students;
c) Discuss and provide opinions on the orientation for activities of the Parent Association of the educational institution;
d) Discuss other matters related to the tasks and rights of the Parent Association of the educational institution.
6. The conference of Parent Associations of groups and classes shall be held during the academic year when necessary to carry out the following matters:
a) Hear the report on the results of activities of the Parent Association of the educational institution;
b) Dismiss, add or replace members of the Parent Association of the educational institution;
c) Discuss matters related to the tasks and rights of the Parent Association of the educational institution.
7. The teacher in charge of the group or class or the homeroom teacher shall organize the first conference of student parents of the group or class. The subsequent conferences shall be organized by the Parent Association of the group or class in coordination with the teacher in charge of the group or class or the homeroom teacher.
8. The head of the educational institution shall organize the first conference of Parent Associations of groups and classes. The subsequent conferences shall be organized by the Parent Association of the educational institution in coordination with the head of the educational institution.
9. The conference shall be held in person, online, or through a combination of in-person and online methods. The results of the conference shall be recorded in minutes and communicated to the participants.
10. The method of electing, dismissing, adding or replacing members of a Parent Association shall be decided by the conference. A person elected must agree to participate in the Parent Association.
Article 10. Prohibited acts of Parent Associations and members of Parent Associations
Parent Associations and members of Parent Associations shall not perform the following acts:
1. Interfering in the organizational structure, governance, management, administration and professional activities of educational institutions; interfering in the implementation of educational programs, contents and methods, and the examination and assessment of early childhood education children and students; participating in the assessment and classification of education administrators, teachers and education support personnel.
2. Taking advantage of the name of a Parent Association to commit acts contrary to law or this Charter; obstructing the activities of educational institutions; infringing upon the lawful rights and interests of agencies, organizations and individuals.
3. Imposing mandatory contributions; setting or allocating support amounts, average support amounts, minimum support amounts or support deadlines; compelling or exerting pressure on student parents to provide support for the activities of Parent Associations.
4. Using the name of a Parent Association to solicit sponsorship for an educational institution; collecting, receiving, managing or using sponsorship intended for the educational institution.
5. Collecting, receiving or managing funds provided to support the activities of a Parent Association; using supported goods or services for improper purposes; taking advantage of the activities of a Parent Association for personal gain or to serve the interests of an organization or individual.
6. Discriminating against or causing disadvantage to early childhood education children, students or student parents due to their participation or non-participation in activities of, or support for the activities of, a Parent Association.
7. Collecting, providing, using or disclosing, contrary to law, information, personal data, information on private life, personal secrets or family secrets of early childhood education children, students, student parents and relevant individuals.
8. Establishing Parent Associations contrary to this Charter; establishing Parent Associations for groups of schools or at administrative levels, or any other organization or representative focal point for student parents other than those specified in this Charter.
9. Performing other acts prohibited by law.
Chapter III
ROLE OF PARENT ASSOCIATIONS IN COORDINATION BETWEEN STUDENT PARENTS AND EDUCATIONAL INSTITUTIONS
Article 11. Matters of coordination between student parents and educational institutions and the role of Parent Associations
1. Student parents and educational institutions shall coordinate in the care, nurturing and education of early childhood education children and students in a manner appropriate to the responsibilities of each party, age, education level, educational program and actual conditions.
2. Matters of coordination include:
a) Monitoring and supporting the learning, training, health care and development of early childhood education children and students; promptly exchanging information and coordinating support when difficulties arise in learning, training and development;
b) Education on ethics, lifestyles, behavioral culture, life skills, awareness of compliance with law and civic responsibility; education on cultural traditions, national history, family values and school culture;
c) Facilitating the participation of early childhood education children and students in educational activities in accordance with the educational plan of the educational institution; coordinating psychological counseling, career guidance and streaming orientation appropriate to their age and education level;
d) Building a safe, healthy, democratic, disciplined and friendly educational environment; preventing and combating school violence, child abuse, accidents, injuries, social vices and violations of law related to early childhood education children and students;
dd) Guiding and supporting early childhood education children and students in participating in a safe and healthy digital environment; developing digital skills and a culture of conduct in the digital environment appropriate to their age;
e) Exchanging necessary, accurate and timely information directly related to the care, nurturing, education and development of early childhood education children and students; coordinating in resolving related arising issues.
3. The Parent Association shall represent student parents in coordinating with the educational institution in implementing the matters specified in Clause 2 of this Article in accordance with the tasks and rights specified in this Charter; gather and reflect the opinions, aspirations and recommendations of student parents; and support connection and information exchange between student parents and the educational institution.
4. The participation of the Parent Association in coordination shall not replace or transfer the responsibilities of student parents, the educational institution, education administrators, teachers, education support personnel and relevant entities.
Article 12. Forms of coordination
1. The coordination between student parents and educational institutions with the participation of Parent Associations in accordance with the tasks and rights specified in this Charter shall be carried out in one or more of the following forms:
a) Conferences of student parents as specified in Article 9 of this Charter;
b) Direct exchange between student parents and teachers in charge of groups or classes, homeroom teachers, teachers, education support personnel, heads of educational institutions or assigned persons;
c) Exchange through communication books, electronic communication books, web portals, information systems, applications, digital platforms or information channels established or selected by educational institutions;
d) Seminars, counseling, dialogues, surveys, consultation or educational activities involving the participation of student parents;
dd) Feedback and recommendations made directly, in writing or through information reception channels of educational institutions;
e) Other forms appropriate to the matters of coordination, actual conditions and provisions of law.
2. Forms of coordination shall be selected and implemented in a manner appropriate to the matters requiring coordination, the actual conditions and the student parents’ ability to access such forms; shall not result in any procedures, documentation requirements, or financial obligations contrary to law.
3. The student parents shall not be required to use fee-based applications, digital platforms or services for coordination.
Article 13. Responsibilities and rights of student parents in coordination
1. Student parents shall have the following responsibilities:
a) Coordinate with educational institutions in the care, nurturing and education of early childhood education children and students in accordance with law and this Charter;
b) Proactively exchange and provide necessary, accurate and timely information related to the learning, training, health, psychological state and development of early childhood education children and students; coordinate in resolving related arising issues;
c) Participate in activities under the educational plan of the educational institution that involve the participation of student parents, in a manner appropriate to their responsibilities and actual conditions;
d) Promptly communicate with the educational institution upon detecting risks or acts affecting the safety, lawful rights and interests of early childhood education children and students;
dd) Respect the honor, dignity, reputation, lawful rights and interests of education administrators, teachers, education support personnel and relevant individuals; respect the functions, tasks and governance, management, administration and professional activities of the educational institution;
e) Comply with provisions of law on information security, protection of personal data, private life, personal secrets and family secrets.
2. Student parents shall have the following rights:
a) To be provided with necessary, accurate and timely information directly related to the care, nurturing, education and development of early childhood education children and students in accordance with law;
b) To provide opinions on matters directly related to the care, nurturing and education of early childhood education children and students;
c) To give feedback and make recommendations directly to the educational institution or through the Parent Association; to request discussions and dialogues and be informed of the handling results as prescribed;
d) To use forms of coordination appropriate to actual conditions; not to be required to use fee-based applications, digital platforms or services;
dd) Not to be compelled to support the activities of the Parent Association or be discriminated against or placed at a disadvantage due to participation or non-participation in activities of, or support for the activities of, the Parent Association;
e) To be guaranteed the rights to private life, information security and personal data protection in accordance with law.
Article 14. Responsibilities of educational institutions and heads of educational institutions in coordination
1. Educational institutions shall have the following responsibilities:
a) Proactively organize coordination with student parents in a manner appropriate to educational objectives and programs, age, education level and actual conditions;
b) Exchange and provide necessary, accurate and timely information directly related to the care, nurturing, education and development of early childhood education children and students; coordinate in resolving related arising issues;
c) Establish, publicize and maintain channels for exchanging and receiving information with student parents; ensure information security and personal data protection in accordance with law;
d) Facilitate student parents in exercising their responsibilities and rights and Parent Associations in performing their tasks and exercising their rights and participating in coordination in accordance with this Charter;
dd) Not assign student parents, Parent Associations or members of Parent Associations to perform tasks falling within the governance, management, administration, financial or professional responsibilities of the educational institution;
e) Coordinate with relevant agencies, organizations and individuals in building a safe and healthy educational environment; preventing and combating school violence, child abuse, accidents, injuries, social vices and violations of law related to early childhood education children and students.
2. The heads of educational institutions shall have the following responsibilities:
a) Organize the implementation of the provisions of Clause 1 of this Article; assign education administrators, teachers and education support personnel to perform relevant tasks;
b) Organize the first conference of Parent Associations of groups and classes; facilitate the establishment, consolidation and operation of Parent Associations in accordance with this Charter;
c) Direct the establishment and maintenance of channels for exchanging information and receiving feedback and recommendations from student parents and Parent Associations;
d) Receive and handle feedback and recommendations within their competence, or provide guidance on forwarding such feedback and recommendations to competent agencies, organizations or individuals; provide information on the handling results in accordance with regulations;
dd) Promptly detect, prevent, rectify and handle within their competence, or report and recommend competent agencies, organizations or individuals to handle, acts in violation of this Charter.
Article 15. Responsibilities of teachers and education support personnel in coordination
1. Coordinate with student parents in the care, nurturing and education of early childhood education children and students in accordance with their assigned tasks; exchange necessary, accurate and timely information directly related to the learning, training and development of early childhood education children and students.
2. Teachers in charge of groups or classes and homeroom teachers shall organize the first conference of student parents of groups or classes; coordinate with Parent Associations of groups or classes in organizing subsequent conferences and carrying out relevant activities in accordance with this Charter.
3. Receive and handle, according to their assigned tasks, feedback and recommendations from student parents and Parent Associations, or report them to the head of the educational institution for consideration and handling.
4. Not assign student parents, Parent Associations or members of Parent Associations to perform tasks falling within their professional responsibilities or other tasks assigned by the educational institution.
5. Respect the honor, dignity, lawful rights and interests of early childhood education children, students and student parents; not discriminate against or cause disadvantage to early childhood education children or students due to the participation or non-participation of student parents in activities or support.
6. Comply with provisions of law on information security, protection of personal data, private life, personal secrets and family secrets.
Article 16. Feedbacks, recommendations and dialogues in coordination
1. Educational institutions shall establish, publicize and maintain channels for receiving feedback and recommendations from student parents and Parent Associations.
2. Parent Associations shall receive, consolidate and reflect the opinions, aspirations and recommendations of student parents to educational institutions in accordance with the tasks and rights specified in this Charter; and shall not exercise on behalf of student parents their right to lodge complaints or denunciations or other individual rights and obligations in accordance with law.
3. The heads of educational institutions shall handle feedback and recommendations falling within their competence and provide information on the handling results. In case feedback or recommendations fall outside their competence, the heads of the educational institutions shall provide guidance or forward such feedback or recommendations to competent agencies, organizations or individuals in accordance with law.
4. The heads of educational institutions shall organize dialogues with student parents or Parent Associations when necessary to discuss, clarify and resolve matters falling within their competence.
5. The receipt and handling of feedback and recommendations and the organization of dialogues shall not give rise to separate procedures, dossiers or reporting regimes; persons providing feedback or making recommendations shall not be discriminated against or placed at a disadvantage; information security and protection of personal data, private life, personal secrets and family secrets shall be ensured in accordance with law.
6. The complaints and denunciations shall be made in accordance with the law on complaints and denunciations.
Chapter IV
ASSURANCE AND ORGANIZATION OF IMPLEMENTATION
Article 17. Assurance of conditions for the operation of Parent Associations
1. The educational institutions shall provide Parent Associations with conditions regarding venues, information and other necessary conditions for the performance of their tasks and exercise of their rights in accordance with this Charter and appropriate to actual conditions; ensure the management and use of assets in accordance with law and without affecting the activities of educational institutions.
2. In case support is required for carrying out a specific activity falling within the tasks and rights of a Parent Association and identified in the operation plan under Article 8 of this Charter, the Parent Association shall publicly inform student parents of the purpose and contents of the activity, support needs and method of implementation.
3. The student parents shall voluntarily decide whether to support the activities specified in Clause 2 of this Article through one of the following forms:
a) Directly providing goods or services necessary for the activities;
b) Making direct payment to organizations or individuals providing goods or services.
The Parent Associations shall not collect, receive or manage support funds.
4. The Parent Associations shall not set or allocate support amounts; shall not determine average support amounts, minimum support amounts or support deadlines; shall not make lists of student parents required to provide support or require specific student parents to provide support. In case the actual support does not meet the needs, the Parent Associations shall adjust the contents, scale or method of implementation of the activities in accordance with actual conditions.
5. The provision or non-provision of support shall not affect the lawful rights and interests of early childhood education children, students and parents of students, nor shall it be used as a basis for discrimination against or causing disadvantage to early childhood education children, students or parents of students.
6. The support specified in this Article shall not be requested or used for the following purposes:
a) Construction, renovation or repair of physical foundations; purchase, lease, installation, repair or maintenance of equipment, supplies and other conditions serving the activities of groups, classes or educational institutions;
b) Governance, management, administration or professional activities; organization of the implementation of educational programs and plans and other tasks falling within the responsibilities of educational institutions;
c) Payment of remuneration, wages, bonuses, gifts or other support to education administrators, teachers or education support personnel;
d) Services for the regular operation of the educational institution, including security, cleaning, vehicle parking, and other services under the responsibility of the educational institution for their organization and provision;
dd) Matters that do not directly serve specific activities falling within the tasks and rights of Parent Associations or matters prohibited by law and this Charter.
7. Supported goods and services must be appropriate to the purpose and contents of the activities, ensure quality and safety, and not be subject to conditions contrary to law. The Parent Associations shall publicly disclose to student parents the results of the activities and the support provided after the activities are completed.
8. The solicitation, receipt, management, use and public disclosure of sponsorship for educational institutions shall comply with the law on sponsorship for educational institutions and shall not fall within the scope of regulation of this Article.
Article 18. Responsibilities for implementation organization
1. The state education management agencies shall, within the scope of their functions, tasks and powers, have the following responsibilities:
a) Direct and guide the implementation of this Charter;
b) Receive and handle feedback and recommendations within their competence, or provide guidance on forwarding such feedback and recommendations to competent agencies, organizations or individuals in accordance with law;
c) Coordinate with relevant agencies, organizations and individuals in organizing the implementation of this Charter;
d) Not prescribe separate procedures, documentary evidence, sets of criteria or reporting regimes for the implementation of this Charter, unless otherwise provided by law.
2. The relevant agencies, organizations and individuals shall, within the scope of their functions, tasks and powers, coordinate with state education management agencies, educational institutions, families and Parent Associations in the implementation of this Charter in accordance with law.
Article 19. Inspection of implementation and handling of violations
1. The state education management agencies shall, within the scope of their functions, tasks and powers, inspect the implementation of this Charter; promptly rectify and handle violations within their competence, or recommend competent agencies, organizations or individuals to handle violations.
2. The heads of educational institutions shall be responsible for inspecting the implementation of this Charter at the educational institution; promptly detecting, preventing and rectifying violations and handling them within their competence, or reporting and recommending competent agencies, organizations or individuals to handle violations.
3. The student parents and Parent Associations shall have the right to give feedback and make recommendations to educational institutions or competent agencies, organizations or individuals regarding the implementation of this Charter and violations in accordance with law.
4. The inspection of the implementation of this Charter shall be integrated into existing inspection, periodic review, final review and reporting activities; and shall not give rise to separate procedures, dossiers or reporting regimes.
