CIRCULAR
Prescribing economic-technical norms for energy audit
Pursuant to the Law on Economical and Efficient Use of Energy No. 50/2010/QH12; Pursuant to the Law Amending and Supplementing a Number of Articles of the Law on Economical and Efficient Use of Energy No. 77/2025/QH15;
Pursuant to the Law on the State Budget No. 89/2025/QH15 dated June 25, 2025 of the National Assembly;
Pursuant to Decree No. 351/2026/ND-CP dated September 11, 2026 of the Government prescribing the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 30/2026/ND-CP dated January 21, 2026 of the Government detailing a number of articles and measures for organization and guidance for implementation of the Law on Economical and Efficient Use of Energy;
Pursuant to Decree No. 32/2019/ND-CP dated April 10, 2019 of the Government providing for task assignment, order placement or bidding for provision of public products and services using the state budget from recurrent expenditure sources;
Pursuant to Circular No. 47/2018/TT-BCT dated November 15, 2018 of the Ministry of Industry and Trade providing for the formulation, appraisal, and promulgation of economic-technical norms for public non-business services using the state budget in the field of economic non-business services and other non-business services within the scope of state management of the Ministry of Industry and Trade;
Pursuant to Circular No. 64/2026/TT-BCT dated September 30, 2026 of the Ministry of Industry and Trade providing for the formulation of plans and reports on the implementation of plans on economical and efficient use of energy; application of energy management models and conduct of energy audits;
Pursuant to Decision No. 573/QD-TTg dated April 25, 2017 of the Prime Minister promulgating the list of public services using the state budget within the Ministry of Industry and Trade's state management;
At the request of the Director of the Energy - Petroleum Agency;
The Minister of Industry and Trade promulgates the Circular prescribing economic-technical norms for energy audit.
Article 1. To promulgate together with this Circular the techno-economic norms for conducting energy audits.
Article 2. Effect
1. This Circular takes effect from December 16, 2026.
2. For tasks for which cost estimates have been approved or contracts have been signed before the effective date of this Circular, they shall continue to be implemented in accordance with the regulations in force at the time of approval/signing of the contracts, except where the parties otherwise agree, provided that the cost estimates do not exceed the total estimated state budget amount allocated by the competent.
Article 3. Units under the Ministry of Industry and Trade and relevant organizations and individuals shall be responsible for implementing this Circular./.
