CIRCULAR
Detailing and guiding the implementation of a number of articles
of the Law on Emulation and Commendation in the education sector

 

Pursuant to Law No. 06/2022/QH15 on Emulation and Commendation, as amended and supplemented by Law No. 06/2026/QH16;

Pursuant to the Government’s Decree No. 279/2026/ND-CP dated July 12, 2026, defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;

At the proposal of the Director General of the Personnel and Organization Department;

The Minister of Education and Training hereby promulgates the Circular detailing and guiding the implementation of a number of articles of the Law on Emulation and Commendation in the education sector.

 

Article 1. Scope of regulation

This Circular details the implementation of Clause 3, Article 12; Clause 4, Article 24; Clause 3, Article 26; Clause 3, Article 27; Clause 3, Article 28; Clause 3, Article 32; Clause 2, Article 71; Clause 6, Article 74; Clause 2, Article 75; Clauses 3 and 4, Article 76; Clause 8, Article 84; Clause 6, Article 90; and Clause 10, Article 93 of the Law No. 06/2022/QH15 on Emulation and Commendation, as amended and supplemented by Law No. 06/2026/QH16 (below referred to as the Law on Emulation and Commendation).

Article 2. Subjects of application

This Circular applies to agencies, units and education institutions; cadres, civil servants, public employees, employees and collectives in the education sector; learners and collectives of learners falling within the scope of state management of the Ministry of Education and Training; domestic organizations, households, collectives and individuals, and overseas Vietnamese; foreign organizations, collectives and individuals having achievements or making contributions to the building and development of the education sector; and related agencies, organizations and individuals.

Article 3. Interpretation of terms

1. Units under the Ministry of Education and Training include departments, agencies, offices, specialized agencies advising and assisting the Party Committee of the Ministry of Education and Training, and project management boards and programme management boards under the Ministry of Education and Training (below referred to as units under the Ministry).

2. Units attached to the Ministry of Education and Training include public non-business units directly attached to the Ministry of Education and Training, public non-business units serving the state management functions of the Ministry of Education and Training, and enterprises under the management of the Ministry of Education and Training (below referred to as units attached to the Ministry).

3. Collectives eligible for consideration and conferment of emulation titles and forms of commendation include faculties, divisions, sections, and equivalent or higher-level organizations.

4. Collectives of learners include classes and groups of learners.

Article 4. Recognition of levels of task accomplishment of individuals and collectives under management competence

The recognition of levels of task accomplishment of individuals and collectives under management competence shall comply with regulations of the Party, laws of the State, and regulations of the Minister of Education and Training on quality assessment and classification of collectives, civil servants, public employees and employees of the Ministry of Education and Training.

Article 5. Recognition of the effectiveness of application and capacity for replication of initiatives and the scope of influence of scientific, technological and innovation tasks

The recognition of the effectiveness of application and capacity for replication of initiatives and the scope of influence of scientific, technological and innovation tasks of individuals in units under and attached to the Ministry shall comply with the law on science, technology and innovation and guidance of the Minister of Education and Training.

Article 6. The “Advanced Laborer” title

1. The “Advanced Laborer” title shall be considered and conferred annually, at the end of an academic year or working year, upon individuals of units under the Ministry or units attached to the Ministry who satisfy the criteria prescribed in Clause 1, Article 24 of the Law on Emulation and Commendation.

2. The consideration and conferment of the “Advanced Laborer” title in a number of specific cases shall comply with the Circular of the Minister of Home Affairs providing measures for organizing and guiding the implementation of the Law on Emulation and Commendation. For seconded officers of the Vietnam People’s Army and the People’s Public Security, the consideration and conferment shall comply with relevant laws.

Article 7. The “Emulation Flag of the Ministry of Education and Training” title

1. Subjects eligible for consideration and conferment of the “Emulation Flag of the Ministry of Education and Training” title are collectives leading emulation movements of emulation clusters and blocs organized by the Ministry of Education and Training, including:

a) Units under the Ministry and units attached to the Ministry;

b) Collectives specified in Clause 3, Article 3 of this Circular of units under or attached to the Ministry;

c) Provincial-level Departments of Education and Training under provincial-level People’s Committees.

2. The “Emulation Flag of the Ministry of Education and Training” title shall be considered and conferred upon collectives satisfying the criteria prescribed in Clauses 1 and 2, Article 26 of the Law on Emulation and Commendation, specifically as follows:

a) Exceeding emulation targets; leading emulation clusters or blocs organized by the Ministry of Education and Training; being recognized as having excellently accomplished their tasks in the year in which the achievement proposed for commendation is recorded, or in two of the years during the implementation period of the emulation movement in case of consideration at the final review;

b) Maintaining internal solidarity; having their Party organizations assessed as having well accomplished their tasks or higher, for collectives having Party organizations; properly practising thrift and combating wastefulness, preventing and combating corruption and negative practices, and preventing and combating other social evils.

Article 8. The “Excellent Labor Collective” title

1. Subjects eligible for consideration and conferment of the “Excellent Labor Collective” title include:

a) Units under the Ministry and units attached to the Ministry;

b) Collectives specified in Clause 3, Article 3 of this Circular of units under the Ministry or units attached to the Ministry.

2. The “Excellent Labor Collective” title shall be considered and conferred annually, at the end of an academic year or working year, upon collectives satisfying the criteria prescribed in Clause 1, Article 27 of the Law on Emulation and Commendation.

Article 9. The “Advanced Labor Collective” title

1. Subjects eligible for consideration and conferment of the “Advanced Labor Collective” title include:

a) Units under the Ministry and units attached to the Ministry;

b) Collectives specified in Clause 3, Article 3 of this Circular of units under the Ministry or units attached to the Ministry.

2. The “Advanced Labor Collective” title shall be considered and conferred annually, at the end of an academic year or working year, upon collectives satisfying the criteria prescribed in Clause 1, Article 28 of the Law on Emulation and Commendation.

Article 10. Emulation titles of National Universities

1. Directors of National Universities shall prescribe emulation titles, criteria for emulation titles, and subjects eligible for consideration and conferment of emulation titles of National Universities, ensuring conformity with the Law on Emulation and Commendation and this Circular.

2. Directors of National Universities shall prescribe criteria for the emulation flag title of National Universities for annual consideration and conferment upon collectives leading emulation movements of emulation blocs organized by National Universities.

3. No consideration or decision on the conferment of the Emulation Flag of a National University shall be made in respect of a collective that has been conferred the Emulation Flag of the Ministry of Education and Training for the same achievement.

4. Directors of National Universities shall prescribe the embroidered contents of the “Emulation Flag of a National University” in accordance with law.

Article 11. The Commemorative Medal “For the Cause of Education”

The Commemorative Medal “For the Cause of Education” (below referred to as the Commemorative Medal) is a form of commendation of the Ministry of Education and Training to be conferred once upon individuals inside and outside the education sector who exemplarily comply with the guidelines of the Party and policies and laws of the State and have made many contributions to the cause of education and training, including:

1. Individuals who have worked in the education sector for 20 years or more.

Where an individual working in the education sector is sent by a competent agency to study or perform military service and subsequently continues working in the education sector, the period of study or military service shall be counted as working time in the education sector for consideration and conferment of the Commemorative Medal. The period during which a disciplinary decision is being executed shall not be counted as working time for consideration and conferment of the Commemorative Medal.

The period during which an individual works in the education sector in an area with exceptionally difficult socio-economic conditions as prescribed by the Prime Minister shall be multiplied by a coefficient of 2 when calculating the working time for consideration and conferment of the Commemorative Medal.

2. Individuals outside the education sector who satisfy one of the following criteria:

a) Having held a leadership or managerial position for 05 years or more, or having been assigned to be in charge of education and training affairs at a specialized agency under a commune-level People’s Committee, having worked in the education sector for 05 years or more, and having made many contributions to the leadership, direction and organization of task performance, thereby contributing to the development of the education sector;

b) Having made many contributions to the formulation and improvement of mechanisms and policies; having organized practical and effective activities for the development of the education sector; or having provided financial support, rewards in kind or other resources for the development of the education sector, as certified and proposed by the beneficiary agency or unit;

c) Being overseas Vietnamese, Vietnamese working for foreign organizations in Vietnam, or foreigners who have made active contributions to the building and development of Vietnam’s education and training cause or to strengthening friendship and international cooperation in education.

Article 12. Diploma of Merit of the Ministry of Education and Training

1. The Diploma of Merit of the Ministry of Education and Training shall be considered and awarded or posthumously awarded to individuals who set a good example in observing the guidelines of the Party and policies and laws of the State and satisfy one of the following criteria:

a) Having outstanding achievements selected upon annual consideration or at the preliminary review or final review of emulation movements launched by the Ministry of Education and Training. Such individuals shall be assessed by a competent authority as having excellently accomplished their tasks in one of the years in which the achievement proposed for commendation is recorded in case of a preliminary review, or in two of the years in which the achievement proposed for commendation is recorded in case of a final review. In case of annual consideration, such individuals shall be assessed by a competent authority as having excellently accomplished their tasks in the year in which the achievement proposed for commendation is recorded or in the immediately preceding year where the year in which such achievement is recorded has not yet been assessed by a competent authority;

b) Having recorded numerous achievements or unexpected achievements with influence in one of the fields within the management scope of the Ministry of Education and Training; or having outstanding achievements in accordance with the rules or regulations of examinations, festivals, contests or sports competitions organized under the chairmanship of the Ministry of Education and Training. Such individuals shall be assessed by a competent authority as having excellently accomplished their tasks in the year in which the achievement proposed for commendation is recorded or in the immediately preceding year where the year in which such achievement is recorded has not yet been assessed by a competent authority. The condition regarding quality classification results of task accomplishment shall not be considered where the individual under consideration for award is a learner, or in cases of commendation for unexpected achievements or exceptionally outstanding unexpected achievements;

c) Having made effective contributions to the education sector in socio-economic development, national defence, security and foreign affairs; application of science and technology, innovation and digital transformation; social work and humanitarian charity. Such individuals shall be assessed by a competent authority as having excellently accomplished their tasks in the year in which the achievement proposed for commendation is recorded or in the immediately preceding year where the year in which such achievement is recorded has not yet been assessed by a competent authority. The above contributions shall be certified and proposed for commendation by the beneficiary agency or unit;

d) Individuals working in units under the Ministry or units attached to the Ministry who, up to the time of proposal, have been conferred the “Grassroots-level Emulation Fighter” title for 02 consecutive times or more, or have been recognized as having excellently accomplished their tasks for 02 consecutive years or more;

dd) Employees having recorded numerous achievements in labor and production, with influence in a field under the state management of the Ministry of Education and Training in accordance with law. The above achievements shall be certified and proposed for commendation by the beneficiary agency or unit.

2. The Diploma of Merit of the Ministry of Education and Training shall be awarded to collectives that set a good example in observing the guidelines of the Party and policies and laws of the State, maintain internal solidarity, and satisfy one of the following criteria:

a) Satisfying the criteria prescribed at Point a, Clause 1 of this Article. Such collectives shall be assessed by a competent authority as having excellently accomplished their tasks in one of the years in which the achievement proposed for commendation is recorded in case of a preliminary review, or in two of the years in which the achievement proposed for commendation is recorded in case of a final review. In case of annual consideration, such collectives shall be assessed by a competent authority as having excellently accomplished their tasks in the year in which the achievement proposed for commendation is recorded or in the immediately preceding year where the year in which such achievement is recorded has not yet been assessed by a competent authority;

b) Having recorded exceptionally outstanding unexpected achievements with influence in a field within the management scope of the Ministry of Education and Training; or having outstanding achievements in accordance with the rules or regulations of examinations, festivals, contests or sports competitions organized under the chairmanship of the Ministry of Education and Training. Such collectives shall be assessed by a competent authority as having excellently accomplished their tasks in the year in which the achievement proposed for commendation is recorded or in the immediately preceding year where the year in which such achievement is recorded has not yet been assessed by a competent authority. The condition regarding quality classification results of task accomplishment shall not be considered where the collective under consideration for award is a collective of learners, or in cases of commendation for unexpected achievements or exceptionally outstanding unexpected achievements;

c) Having made effective contributions to the education sector in socio-economic development, national defence, security and foreign affairs; application of science and technology, innovation and digital transformation; social work and humanitarian charity. Such collectives shall be assessed by a competent authority as having excellently accomplished their tasks in the year in which the achievement proposed for commendation is recorded or in the immediately preceding year where the year in which such achievement is recorded has not yet been assessed by a competent authority. The above contributions shall be certified and proposed for commendation by the beneficiary agency or unit;

d) Collectives specified in Clause 3, Article 3 of this Circular of units under the Ministry or units attached to the Ministry that, up to the time of proposal, have been recognized as having excellently accomplished their tasks for 02 consecutive years or more; properly implemented grassroots democracy; properly organized emulation movements; taken care of the material and spiritual life within the collective; practiced thrift and combated wastefulness; and prevented and combated corruption and negative practices.

3. The Diploma of Merit of the Ministry of Education and Training shall be awarded to households that set a good example in observing the guidelines of the Party and policies and laws of the State, have made many contributions in terms of labor, land and property to the education sector, and are certified and proposed for commendation by the beneficiary unit.

4. Other cases satisfying the criteria prescribed in Article 74 of the Law on Emulation and Commendation shall be considered and decided by the Minister of Education and Training based on proposals of the standing body of the Emulation and Commendation Council of the Ministry of Education and Training after consultation with related agencies and units.

Article 13. Diploma of Merit of a National University

1. Directors of National Universities shall prescribe the criteria and subjects eligible for consideration and award of Diplomas of Merit of National Universities.

2. No consideration or decision on the award of a Diploma of Merit of a National University shall be made in respect of individuals or collectives that have been awarded the Diploma of Merit of the Ministry of Education and Training for the same achievement.

Article 14. Certificates of merit

1. Heads of legal-person agencies and units under or attached to the Ministry of Education and Training shall consider and confer certificates of merit upon individuals, collectives and households having achievements or making contributions within their management scope in accordance with the criteria prescribed in Clause 3 of this Article.

2. Heads of legal-person agencies and units under legal-person agencies and units under or attached to the Ministry shall confer certificates of merit upon individuals, collectives and households having achievements or making contributions within their management scope in accordance with the criteria prescribed by the directly managing agency or unit and in Clause 3 of this Article.

3. Heads of education institutions shall consider and confer certificates of merit upon learners and collectives of learners studying at education institutions within the national education system (except where the heads of ministries, sectors or organizations managing such education institutions have otherwise prescribed) who have good moral qualities, exemplarily comply with the guidelines and policies of the Party, laws of the State and internal rules of the education institutions, and satisfy one of the following criteria:

a) Having outstanding or prominent achievements in learning and training;

b) Having outstanding achievements in emulation movements organized by the education institutions;

c) Having exceptionally outstanding unexpected achievements of exemplary significance within the education institutions;

d) Winning prizes at examinations, festivals, contests or sports competitions organized by the education institutions.

Article 15. Competence of heads of units under or attached to the Ministry of Education and Training

1. Heads of legal-person units under or attached to the Ministry have the following competence:

a) To confer the “Advanced Labor Collective”, “Excellent Labor Collective”, “Advanced Laborer” and “Grassroots-level Emulation Fighter” titles upon collectives and individuals under their management competence;

b) To submit to the Minister of Education and Training for consideration and decision on the conferment of the “Excellent Labor Collective” and “Advanced Labor Collective” titles upon their units;

c) To submit to the Minister of Education and Training for consideration and decision on the conferment of the “Emulation Flag of the Ministry of Education and Training”, “Ministerial-level Emulation Fighter” title, Diploma of Merit of the Ministry of Education and Training and Commemorative Medal in accordance with regulations; and to submit to the Minister for consideration and further submission to competent authorities for consideration and State-level commendation in accordance with regulations.

2. Heads of non-legal-person units under the Ministry shall submit to the Minister of Education and Training for consideration and decision on the conferment of the “Advanced Labor Collective”, “Excellent Labor Collective”, “Emulation Flag of the Ministry of Education and Training”, “Advanced Laborer”, “Grassroots-level Emulation Fighter” and “Ministerial-level Emulation Fighter” titles, Diploma of Merit of the Ministry of Education and Training and Commemorative Medal in accordance with regulations; and submit to the Minister for consideration and further submission to competent authorities for consideration and State-level commendation in accordance with regulations.

3. Directors of National Universities shall decide on the conferment of emulation titles and Diplomas of Merit of National Universities according to their competence.

Article 16. Competence of the Director of a provincial-level Department of Education and Training to propose commendation

1. To submit to the Minister of Education and Training for consideration and decision on the conferment of the “Emulation Flag of the Ministry of Education and Training”, Diploma of Merit of the Ministry of Education and Training and Commemorative Medal upon the provincial-level Department of Education and Training, and collectives and individuals under his/her management competence.

2. To submit to the Minister of Education and Training for consideration and decision on the conferment of the Diploma of Merit of the Ministry of Education and Training and Commemorative Medal upon collectives and individuals under the management competence of Chairpersons of commune-level People’s Committees.

3. To propose the Minister of Education and Training to consider and decide on the conferment of the Diploma of Merit of the Ministry of Education and Training and Commemorative Medal upon collectives and individuals having made contributions to the development of education institutions under the management competence of the Director of the provincial-level Department of Education and Training or Chairpersons of commune-level People’s Committees.

Article 17. Competence to propose commendation of heads of ministries, commissions, sectors and ministerial-level agencies; and Chairpersons of People’s Committees of provinces and centrally run cities

1. To propose the Minister of Education and Training to consider and decide on the conferment of the Diploma of Merit of the Ministry of Education and Training and Commemorative Medal upon education institutions, collectives and individuals within their management scope.

2. To propose the Minister of Education and Training to consider and decide on the conferment of the Diploma of Merit of the Ministry of Education and Training and Commemorative Medal upon collectives and individuals having made contributions to the development of education institutions within their management scope.

Article 18. Provisions on dossiers and procedures for commendation under the competence of the Ministry of Education and Training

1. Persons competent to propose or submit for consideration the conferment of emulation titles or award of forms of commendation (except proposals for the Commemorative Medal “For the Cause of Education”, commendation for unexpected achievements, and commendation according to simplified procedures) shall publicize the list of individuals and collectives on the portal of their agencies or units for at least 05 working days before a meeting of the Emulation and Commendation Council of such agency or unit. Where an agency or unit has no portal, the list shall be publicly posted or publicized at a plenary meeting of the agency or unit. The results of such publicization (including complaints and denunciations, if any) shall be reported to the Emulation and Commendation Council of the submitting unit before submission to a superior-level authority for commendation and shall be reflected in the minutes of commendation consideration.

2. A dossier of proposal for consideration of the conferment of an emulation title or award of a form of commendation at the Ministry of Education and Training level shall be made in 01 original set (paper documents bearing original signatures and seals, if any); concurrently, electronic files of the dossier (in .word and .pdf formats) shall be sent to the Personnel and Organization Department of the Ministry of Education and Training (except documents containing information classified as state secrets).

3. A dossier of proposal for commendation, except a dossier of proposal for consideration and award of the Commemorative Medal, commendation for unexpected achievements, or commendation according to simplified procedures, shall comprise:

a) A written submission proposing consideration of the conferment of an emulation title or award of a form of commendation (Form No. 01);

b) Achievement reports of the individuals or collectives proposed for commendation;

c) Minutes of emulation consideration or minutes of commendation consideration;

d) Minutes of the meeting of the examination-marking council; decisions recognizing prize-winning individuals and collectives, and lists of individuals and collectives proposed for commendation; supporting documents relating to the results achieved in cases of proposals based on outstanding achievements under the rules or regulations of examinations, festivals, contests or sports competitions organized under the chairmanship of the Ministry of Education and Training; and certifications by beneficiary agencies or units of the achievements in cases of proposals made according to the criteria prescribed at Points c and dd, Clause 1; Point c, Clause 2; and Clause 3, Article 12 of this Circular.

4. A dossier of proposal for commendation by award of the Commemorative Medal shall comprise:

a) A written submission proposing consideration and award of the Commemorative Medal (Form No. 06);

b) A list of individuals proposed for consideration and award of the Commemorative Medal (Form No. 07);

c) Summaries of achievements of individuals proposed for consideration and award of the Commemorative Medal (Form No. 08 or Form No. 09);

d) Certifications by beneficiary agencies or units of the achievements of individuals proposed according to the criterion prescribed at Point b, Clause 2, Article 11 of this Circular.

5. Time limits for submission of commendation proposal dossiers:

a) For merit-based commendation:

Dossiers of proposals for commendation under the commendation competence of the Ministry of Education and Training shall be sent to the Ministry of Education and Training before March 31 every year.

Dossiers of proposals for State-level commendation shall be sent to the Ministry of Education and Training before May 15 every year.

b) For commendation at preliminary or final reviews of emulation movements or thematic emulation movements launched by the Prime Minister or the Minister of Education and Training: The time limits shall comply with the guidance applicable to each emulation movement or thematic emulation movement;

c) For commendation for outstanding achievements or exceptionally outstanding unexpected achievements: Dossiers of proposals for commendation shall be sent to the Ministry of Education and Training immediately after individuals or collectives record such outstanding achievements or exceptionally outstanding unexpected achievements;

d) For commendation for examinations, festivals, contests or sports competitions organized under the chairmanship of the Ministry of Education and Training: Dossiers of proposals for commendation shall be sent to the standing body of the Emulation and Commendation Council of the Ministry of Education and Training within 20 working days after the completion of such examination, festival, contest or sports competition;

dd) For commendation by award of the Commemorative Medal: Dossiers of proposals for commendation shall be sent to the Ministry of Education and Training before December 31 every year;

e) The time limit for submission of dossiers for consideration and proposal for commendation at legal-person units under or attached to the Ministry shall be prescribed by heads of such units.

6. Receipt, processing and notification of appraisal results:

a) Within 05 working days from the date of receipt of a dossier, if the dossier is incomplete or invalid, the standing body of the Emulation and Commendation Council of the Ministry of Education and Training shall issue a one-time written notice requesting the agency or unit to complete the dossier;

b) Where a dossier is complete and valid and satisfies the prescribed conditions and criteria, the standing body of the Emulation and Commendation Council of the Ministry of Education and Training shall submit it to a competent authority for consideration and decision. Where the prescribed conditions or criteria are not satisfied, within 15 working days from the date of receipt of a complete and valid dossier, the standing body of the Emulation and Commendation Council of the Ministry of Education and Training shall notify the submitting agency or unit in writing, clearly stating the reason.

Article 19. Dossiers and procedures for proposals for consideration and award of Certificates of Merit by heads of legal-person units under or attached to the Ministry of Education and Training

1. Heads of legal-person units under or attached to the Ministry of Education and Training shall prescribe dossiers, procedures and time limits for proposals for consideration and award of Certificates of Merit under their competence, ensuring conformity with the Law on Emulation and Commendation and this Circular.

2. Heads of legal-person units under legal-person units under or attached to the Ministry shall prescribe dossiers, procedures and time limits for proposals for consideration and award of Certificates of Merit, ensuring conformity with the Law on Emulation and Commendation, this Circular, and regulations and guidance of the directly managing agency or unit.

Article 20. Dossiers and procedures for proposals for consideration and conferment of emulation titles and Diplomas of Merit of National Universities

Directors of National Universities shall prescribe dossiers and procedures for proposals for consideration and conferment of emulation titles and Diplomas of Merit of National Universities, ensuring conformity with the Law on Emulation and Commendation and this Circular.

Article 21. Emulation and Commendation Council of the Ministry of Education and Training

1. The Emulation and Commendation Council of the Ministry of Education and Training shall be established by the Minister of Education and Training and has the function of advising and counselling the Minister on emulation and commendation affairs.

2. The organization of the Emulation and Commendation Council of the Ministry of Education and Training shall comprise:

a) The Chairperson of the Council is the Minister of Education and Training. The Chairperson of the Council shall decide on the structure and composition of the Council and promulgate the Regulation on organization and operation of the Council;

b) The standing body of the Emulation and Commendation Council of the Ministry of Education and Training is the Personnel and Organization Department of the Ministry of Education and Training.

3. The tasks, powers, working principles and working regime of the Council shall comply with the Regulation on organization and operation promulgated by the Minister of Education and Training.

Article 22. Grassroots-level Emulation and Commendation Councils

1. Grassroots-level Emulation and Commendation Councils shall be established at units under or attached to the Ministry and legal-person units attached to units under or attached to the Ministry, and shall be established by heads of such units. Departments under the Ministry and specialized agencies advising and assisting the Party Committee of the Ministry shall not establish grassroots-level Emulation and Commendation Councils; heads of such units shall decide on methods for considering emulation titles and forms of commendation in accordance with regulations.

2. The organization of a grassroots-level Emulation and Commendation Council shall comprise:

a) The Chairperson of the Council is the head of the unit. The Council shall have no more than 02 Vice Chairpersons. The head of the advisory section in charge of emulation and commendation affairs of the unit shall act as a Vice Chairperson. The Chairperson of the Council shall decide on the structure and composition of the Council;

b) The standing body of the Council is the advisory section in charge of emulation and commendation affairs of the unit.

3. The Chairperson of the Council shall promulgate the Regulation on organization and operation of the Council.

Article 23. Dossiers and procedures for proposals for exchange and re-issuance of rewards in kind and correction of information in commendation decisions under the competence of the Ministry of Education and Training and heads of legal-person agencies and units under or attached to the Ministry

1. A reward in kind shall be exchanged where it is still in existence but is damaged, is no longer fit for use, or contains incorrect information.

A reward in kind shall be re-issued where it is lost, misplaced or destroyed due to objective reasons such as natural disasters, floods or fires.

Correction of information in a commendation decision means the correction of one or more pieces of information in a commendation decision issued by a competent authority where such information is inaccurate compared with lawful dossiers and documents.

2. A dossier of proposal for exchange or re-issuance of a reward in kind or correction of information in a commendation decision shall comprise:

a) An official letter of the agency or unit that proposed the commendation, requesting exchange or re-issuance of the reward in kind or correction of information in the commendation decision, enclosed with supporting documents (Form No. 10);

b) An application of the commended individual or collective requesting exchange or re-issuance of the reward in kind or correction of information in the commendation decision, enclosed with supporting documents (Form No. 11);

c) The reward in kind proposed for exchange or correction of information.

3. Procedures for exchange and re-issuance of rewards in kind and correction of information in commendation decisions:

a) Individuals and collectives shall send their applications and the rewards in kind proposed for exchange or correction of information to the agencies or units that submitted the commendation proposals;

b) For commendations falling under the decision-making competence of the Ministry of Education and Training, the agency or unit that submitted the commendation proposal shall send the dossier to the Personnel and Organization Department. The Personnel and Organization Department shall search for and verify information, coordinate with the Ministry Office in carrying out the exchange or re-issuance of rewards in kind or submitting proposals for correction of information in commendation decisions, and concurrently recover old or damaged rewards in kind or those containing incorrect information.

For commendations falling under the decision-making competence of heads of legal-person agencies and units under or attached to the Ministry, the advisory section in charge of emulation and commendation affairs shall receive and consolidate dossiers, submit them to the head of the agency or unit for consideration and decision, and recover old or damaged rewards in kind or those containing incorrect information;

c) For commendations falling under the decision-making competence of the Ministry of Education and Training, the Minister of Education and Training shall consider and decide on the exchange or re-issuance of rewards in kind. A leader of the Personnel and Organization Department of the Ministry of Education and Training shall, by order, sign certificates of exchange or re-issuance of rewards in kind and correction of information in commendation decisions.

For commendations falling under the decision-making competence of heads of legal-person agencies and units under or attached to the Ministry, heads of such units shall consider the exchange or re-issuance of rewards in kind. A leader of the advisory section in charge of emulation and commendation affairs of the unit shall, by order, sign certificates of exchange or re-issuance of rewards in kind and correction of information in commendation decisions.

4. Time limit for settlement

The time limit for consolidating and submitting dossiers to a competent authority for consideration and decision on the exchange or re-issuance of rewards in kind or correction of information in commendation decisions shall be 15 working days from the date of receipt of a complete dossier as prescribed.

5. Agencies and units competent to decide on commendation shall organize the destruction of recovered rewards in kind under their management competence; such destruction shall be recorded in minutes in accordance with regulations.

Article 24. Dossiers and procedures for cancellation of decisions conferring emulation titles or forms of commendation and recovery of rewards in kind and bonuses for emulation titles and forms of commendation under the competence of the Ministry of Education and Training and heads of legal-person agencies and units under or attached to the Ministry

1. Individuals and collectives committing acts falling into the cases specified in Clause 2, Article 93 of the Law on Emulation and Commendation shall have decisions conferring emulation titles or forms of commendation cancelled and the rewards in kind and bonuses already received recovered in accordance with regulations.

2. Based on conclusions of competent agencies determining that individuals or collectives have committed violations falling into the cases specified in Clause 2, Article 93 of the Law on Emulation and Commendation, the units that submitted the commendation proposals shall propose competent commendation authorities to issue decisions cancelling decisions conferring emulation titles or forms of commendation and recovering rewards in kind and bonuses.

3. A dossier of proposal for cancellation of a decision conferring an emulation title or form of commendation shall comprise 01 original set, including:

a) An official letter proposing cancellation of the decision conferring the emulation title or form of commendation and recovery of rewards in kind and bonuses;

b) A summary report of the agency or unit that directly submitted the commendation proposal, clearly stating the grounds and reasons for proposing cancellation of the decision conferring the emulation title or form of commendation and the conclusion of the competent agency (enclosed with the commendation decision).

4. The Personnel and Organization Department shall be responsible for consolidating dossiers and submitting them to the Minister of Education and Training for consideration and decision on cancellation of decisions conferring emulation titles or forms of commendation under the Minister’s competence.

The advisory sections in charge of emulation and commendation affairs of legal-person agencies and units under or attached to the Ministry shall be responsible for consolidating dossiers and submitting them to heads of such agencies or units for consideration and cancellation of decisions conferring emulation titles or forms of commendation under their competence.

5. The time limit for consolidating dossiers and submitting them to competent authorities for consideration and cancellation of decisions conferring emulation titles or forms of commendation shall be 10 working days from the date of receipt of complete dossiers as prescribed.

6. Within 15 working days from the date of receipt of decisions cancelling commendation decisions issued by the Minister of Education and Training or heads of competent agencies or units, individuals and collectives shall fully return the rewards in kind and bonuses already received to the agencies or units that paid the bonuses.

7. The Personnel and Organization Department and advisory sections in charge of emulation and commendation affairs of units under or attached to the Ministry shall be responsible for urging individuals and collectives to return rewards in kind and bonuses within the prescribed time limit; organizing the recovery, management and disposal of recovered rewards in kind; and remitting recovered bonuses to the state budget or the emulation and commendation fund in accordance with regulations.

Article 25. Tasks and powers of organizations and individuals in emulation and commendation affairs

1. The Personnel and Organization Department of the Ministry of Education and Training, acting as the standing body of the Emulation and Commendation Council of the Ministry of Education and Training, shall assume the prime responsibility for, and coordinate with related agencies and units in, advising and assisting the Minister of Education and Training in guiding, inspecting and urging agencies and units to organize the implementation of this Circular.

2. The International Cooperation Agency shall assume the prime responsibility for consolidating dossiers of proposals for commendation of collectives and individuals being overseas Vietnamese, Vietnamese working for foreign organizations in Vietnam, and foreign collectives and individuals having typical outstanding achievements and making contributions to the cause of education and training; assume the prime responsibility for seeking opinions of the Ministry of Public Security, the Ministry of Foreign Affairs and related agencies and units; and forward the dossiers to the Personnel and Organization Department for appraisal and submission to the Minister of Education and Training for consideration and decision.

3. Heads of units under the Ministry and units attached to the Ministry, Directors of provincial-level Departments of Education and Training, and heads of education institutions shall coordinate with mass organizations at the same level in specifying the contents, criteria and measures for organizing emulation movements and inspecting their implementation; conducting preliminary and final reviews of emulation movements and replicating advanced models; detecting collectives and individuals having typical outstanding achievements and making contributions to the cause of education and training, and submitting them to competent agencies or persons for timely consideration and commendation commensurate with their achievements; and proposing innovations in emulation and commendation affairs.

4. Information, press and publishing agencies under the Ministry of Education and Training, provincial-level Departments of Education and Training, and education institutions shall regularly disseminate the guidelines of the Party and policies and laws of the State on emulation and commendation affairs; actively participate in detecting collectives and individuals having outstanding achievements and making contributions to the education sector; disseminate and set examples of advanced models, good persons and good deeds; and combat manifestations of achievement-driven practices and violations of the law on emulation and commendation.

5. Collectives and individuals proposed for consideration and conferment of emulation titles or award of forms of commendation shall fully and promptly comply with the provisions on dossiers, procedures and time limits for submission of proposal dossiers prescribed in this Circular and relevant laws, and shall take responsibility before law for the accuracy of their dossiers.

Article 26. Effect and organization of implementation

1. This Circular takes effect on October 1, 2026, and replaces Circular No. 07/2026/TT-BGDDT dated February 15, 2026, of the Minister of Education and Training, detailing the implementation of a number of articles of the Law on Emulation and Commendation and the Government’s Decree No. 152/2025/ND-CP dated June 14, 2025, on decentralization and delegation of powers in the field of emulation and commendation; and detailing and guiding the implementation of a number of articles of the Law on Emulation and Commendation in the education sector.

2. In the case where legal documents referred to in this Circular are amended, supplemented or replaced, the amending, supplementing or replacing documents shall apply.

3. Dossiers of proposals for consideration and conferment of emulation titles or award of forms of commendation that have been sent to the Ministry of Education and Training (as indicated by the incoming-document stamp) before the effective date of this Circular shall continue to be processed in accordance with Circular No. 07/2026/TT-BGDDT dated February 15, 2026, of the Minister of Education and Training. For dossiers under appraisal, where the application of the provisions of this Circular is more beneficial to the recipients of emulation titles or forms of commendation, the provisions of this Circular shall apply.

4. The Chief of the Ministry Office, the Director General of the Personnel and Organization Department, heads of units under or attached to the Ministry, Directors of provincial-level Departments of Education and Training, heads of education institutions, and related agencies, organizations and individuals shall implement this Circular./.
