CIRCULAR
PROMULGATING THE LIST OF PRODUCTS AND GOODS LIKELY TO BE UNSAFE SUBJECT TO THE STATE MANAGEMENT BY THE MINISTRY OF TRANSPORT
Pursuant to the November 21, 2007 Law on Product and Goods Quality;
Pursuant to the Government s Decree No. 132/2008/ND-CP of December 31, 2008, detailing the implementation of a number of articles of the Law on Product and Goods Quality;
Pursuant to the Government s Decree No. 51/2008/ND-CP of April 22, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
The Minister of Transport promulgates the list of products and goods likely to he unsafe subject to the state management by the Ministry of Transport and provides the principles of quality management of these products and goods as follows:
Article 1.Scope of regulation This Circular specifies:
1. List of products and goods likely to be unsafe (below referred to as list of group-2 products and goods) subject to the state management by the Ministry of Transport specified at Point c. Clause 2. Article 32 of the Government s Decree No. 132/2008/ND-CP of December 31, 2008, detailing the implementation of a number of articles of the Law on Product and Goods Quality (below referred to as Decree No. 132/2008/ND-CP).
2. Principles of quality management of group-2 products and goods subject to the state management by the Ministry of Transport.
Article 2.Subjects of application
This Circular applies to:
1. Domestic and foreign organizations and individuals engaged in the production, trading, design or construction of products and goods on the list of group-2 products and goods subject to the state management by the Ministry of Transport.
2. Organizations and individuals carrying out activities related to the quality of group-2 products and goods subject to the state management by the Ministry of Transport.
Article 3.List of group-2 products and goods subject to the state management by the Ministry of Transport
The list of group-2 products and goods subject to the state management by the Ministry of Transport is provided in the Appendix to this Circular.
Article 4.Management principles
1. The quality of products and goods on the list of group-2 products and goods subject to the state management by the Ministry of Transport provided in the Appendix to this Circular shall be managed on the principle that these products and goods, before being marketed or put into operation or use. must be certified and announced or tested to be conformable with relevant national technical regulations on quality management promulgated by the Ministry of Transport.
2. Designated conformity assessment organizations shall register their operation domains under Clause 2. Article 17 of Decree implementation of this Circular, and propose No. 132/2008/ND-CP.
Article 5.Effect and organization of implementation
1. This Circular takes effect 45 days from the date of its signing.
2. The Science-Technology Department shall assume the prime responsibility for, and coordinate with related agencies in. guiding the the Minister to amend or supplement the list to meet management requirements.
3. The chief of the Ministry Office, the Ministry Chief Inspector, directors of departments of the Ministry and heads of related agencies and organizations shall implement this Circular. -

LIST OF PRODUCTS AND GOODS LIKELY TO BE UNSAFE SUBJECT TO THE STATE MANAGEMENT BY THE MINISTRY OF TRANSPORT

6 | Special-use vehicles and machines for construction of transport works (bulldozers, excavators, leveling machines, scraper machines, excavators, shovel-bulldozers, rollers, piping machines, etc.); |
7 | Railway vehicles (locomotives, carriages and special-use propelled vehicles) |
8. | Seagoing ships and inland waterway vessels (except those used for national defense and public security and fishing ships); |
9. | Signaling ships, tug-boats, push-boats, rescue boats and dredger boats, floating cranes, floating docks for ship repair and other special-use vessels; |
10. | Floating equipment and lifeboats used in transport; |
11. | Steamers, pressure vessels and containers used in transport: |
12. | Drilling rigs, oil and gas prospecting and exploiting equipment, and offshore oil or gas pipeline networks; |
13. | Maritime, road, railway, air and inland waterway signals; |
14. | Aircraft (except those used for national defense or public security); |
15. | Flying areas signaling light systems, air navigation systems, night lighting systems, instrument landing systems and distance measuring equipment (ILS/DME) of airfields; |
16. | Ground cooling units, passenger stairs, passenger conveyors, ground power units, aircraft towing and pushing tractors, baggage handling systems, automatic fire alarm systems used in terminals, ports, airfields, warehouses and storing yards and fire engines exclusively used in the aviation industry; |
II. Transport infrastructure | |
17. | Road infrastructure works: Railway infrastructure works; Inland waterway infrastructure works; Maritime infrastructure works; Aviation infrastructure works. |
III. Transport services | |
18. | Maritime pilotage services Maritime and aviation security services. |
19. | Coastal communication services; |
20. | Maritime safety assurance services. |
