Circular 55/2025/TT-BCT amending Circular 07/2019/TT-BCT on export of textile and apparel goods to Mexico under CPTPP

CIRCULAR

Amending and supplementing a number of articles of the Minister of Industry and Trade’ Circular No. 07/2019/TT-BCT of April 19, 2019, providing the export of textile and apparel goods to Mexico under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership

Pursuant to Law No. 05/2017/QH14 on Foreign Trade Management;

Pursuant to the National Assembly’s Resolution No. 72/2018/QH14 of November 12, 2018, ratifying the Comprehensive and Progressive Agreement for Trans-Pacific Partnership and other related documents;

Pursuant to the Government’s Decree No. 40/2025/ND-CP of February 26, 2025, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 31/2018/ND-CP of March 8, 2018, detailing the Law on Foreign Trade Management regarding the origin of goods;

At the proposal of the Director General of the Agency of Foreign Trade;

The Minister of Industry and Trade promulgates the Circular amending and supplementing a number of articles of the Minister of Industry and Trade’ Circular No. 07/2019/TT-BCT of April 19, 2019, providing the export of textile and apparel goods to Mexico under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.

Article 1. To amend and supplement or replace a number of provisions of the Minister of Industry and Trade’ Circular No. 07/2019/TT-BCT of April 19, 2019, providing the export of textile and apparel goods to Mexico under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP)

1. To amend and supplement Clause 3, Article 3 as follows:

“The Ministry of Industry and Trade shall announce tariff-rate quotas for the subsequent years based on the commitments in the Bilateral Letter dated March 8, 2018, of the Minister of Industry and Trade of Vietnam and the Minister of Economy of Mexico on Trade between Mexico and Vietnam for some textile and apparel goods using short supply sources and for children's clothing”.

2. To amend and supplement Clause 1, Article 4 as follows:

“Having a Certificate of Origin, form CPTPP, issued by a competent agency in the form provided in Appendix II to the Ministry of Industry and Trade’s Circular No. 06/2020/TT-BCT of March 24, 2020, amending and supplementing a number of articles of the Ministry of Industry and Trade’s Circular No. 03/2019/TT-BCT of January 22, 2019, providing the rules of origin under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership”.

3. To amend and supplement Point b, Clause 3, Article 4 as follows:

“Textile and apparel goods out of tariff-rate quotas with the ordinal numbers 01, 02 and 03 in Appendix I to this Circular and satisfying the rules of origin referred to in the CPTTP and the Ministry of Industry and Trade’s Circular No. 03/2019/TT-BCT of January 22, 2019, providing the rules of origin under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (which is amended and supplemented under the Ministry of Industry and Trade’s Circular No. 06/2020/TT-BCT of March 24, 2020), are entitled to Mexico’s import duty rates under the CPTPP”.

4. To amend and supplement Point c, Clause 3, Article 4 as follows:

“Textile and apparel goods within tariff-rate quotas with the ordinal number 04 in Appendix I to this Circular and satisfying the rules of origin referred to in the CPTTP and the Ministry of Industry and Trade’s Circular No. 03/2019/TT-BCT of January 22, 2019, providing the rules of origin under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (which is amended and supplemented under the Ministry of Industry and Trade’s Circular No. 06/2020/TT-BCT of March 24, 2020), are entitled to Mexico’s import duty rates under the CPTPP.

5. To amend and supplement Point d, Clause 3, Article 4 as follows:

“Textile and apparel goods out of tariff-rate quotas with the ordinal number 04 in Appendix I to this Circular and satisfying the product specific rules specified in Article 5 of this Circular are entitled to Mexico’s import duty rates under the CPTPP. The declarations shown in the Certificate of Origin (C/O), form CPTPP, of Vietnam, for textile and apparel goods referred to at this Point must comply with the provisions in Appendix IV to the Ministry of Industry and Trade’s Circular No. 06/2020/TT-BCT of March 24, 2020, amending and supplementing a number of articles of the Ministry of Industry and Trade’s Circular No. 03/2019/TT-BCT of January 22, 2019, providing the rules of origin under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership”.

          6. To replace Form No. 02 (Certificate of Eligibility), Form No. 03 (Additional page(s) of Certificate of Eligibility), and Form No. 04 (Registration of Enterprise) provided in Appendix III to Circular No. 07/2019/TT-BCT with Form No. 02, Form No. 03, and Form No. 04 provided in the Appendix to this Circular.

Article 2. Implementation provision

This Circular takes effect on January 13, 2026.
