SUMMARY

28 documents required for seagoing ships during their domestic and international voyages

On December 31, 2019, the Ministry of Transport issues the Circular No. 55/2019/TT-BGTVT providing the List of certificates and documents of Vietnam’s seagoing ships, official-duty seagoing ships, submarines, submersibles, floating docks, floating storage and offloading units and mobile offshore units.

Accordingly, 28 certificates and documents required to be carried on board Vietnam’s sea ships, official-duty seagoing ships during their domestic and international voyages include: Seagoing ship Registration Certificate; Classification Certificate; Tonnage Certificate; Load Line Certificate; Oil Pollution Prevention Certificate; International Sewage Pollution Prevention Certificate; Certificate of Test of Lifting Appliances; etc.

For passenger ships, along with the above-mentioned documents, Passenger ship Safety Certificate and Exemption Certificate (if any) are required for large ships operating along international routes, for large ships not operating along international routes, Passenger ship Safety Certificate is required. For high-speed crafts, along with the certificates as specified generally, the following certificates are required: High-speed Craft Safety Certificate and Permit to Operate High-speed Craft (in cases of large ships operating along international routes).

CIRCULAR

Providing the List of certificates and documents of Vietnam’s seagoing ships, official-duty seagoing ships, submarines, submersibles, floating docks, floating storage and offloading units and mobile offshore units

Pursuant to the Vietnam Maritime Code dated November 25, 2015;

Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

At the request of Director of the Department of Legal Affairs, Administrator of Vietnam Maritime Administration and Director General of Vietnam Register;

The Minister of Transport promulgates a Circular providing the List of certificates and documents of Vietnam’s seagoing ships, official-duty seagoing ships, submarines, submersibles, floating docks, floating storage and offloading units and mobile offshore units.

 

Article 1. Scope of regulation

This Circular provides for the list of certificates and documents required to be carried on board Vietnam’s sea ships, official-duty seagoing ships, submarines, submersibles, floating docks, floating storage and offloading units and mobile offshore units during their domestic and international voyages.

Article 2. Subjects of application

This Circular applies to Vietnamese and foreign organizations and individuals related to certificates and documents required to be carried on board Vietnam’s ships, official-duty seagoing ships, submarines, submersibles, floating docks, floating storage and offloading units and mobile offshore units during their domestic and international voyages.

Article 3. List of certificates and documents

1. The list of certificates and documents of Vietnam’s ships and official-duty seagoing ships is provided in Appendix I to this Circular.

2. The list of certificates and documents of Vietnam’s submarines and submersibles is provided in Appendix II to this Circular.

3. The list of certificates and documents of Vietnam’s floating storage and offloading units and mobile offshore units is provided in Appendix III to this Circular.

4. The list of certificates and documents of Vietnam’s floating docks is provided in Appendix IV to this Circular.

Article 4. Implementation provisions

1. This Circular takes effect from March 1, 2020.

2. Circular No. 41/2016/TT-BGTVT dated December 16, 2016, of the Minister of Transport, providing the List of certificates and documents of Vietnam’s seagoing ships, official-duty seagoing ships, submarines, submersibles, floating docks, floating storage and offloading units and mobile offshore units is repealed.

3. In case any legal documents referred to in this Circular is amended, supplemented or replaced, the newest ones shall prevail.

4. Chief of the Ministry Office, Chief Inspector of the Ministry, Directors, Administrator of the Vietnam Maritime Administration, Director General of Vietnam Register, heads of relevant organizations and individuals shall implement this Circular./.

[1] Certificates granted to ships operating along international routes may be also used when they are not operating along international routes.

[2] Large ship means a seagoing ship which must be registered in the Vietnam National Register of Ships under Article 19 of the Vietnam Maritime Code, including motor ship with a main engine power of 75 kilowatt (kW) or more, or non-motor seagoing ship with a gross tonnage of 50 GT or more or a dead weight of 100 tons or more or a design waterline length of 20 meters or more.

[3] Small ship means a ship not being a large ship.
