SUMMARY

Circular 53/2026/TT-NHNN on safety requirements, risk management for AI systems in banking sector

Provisions on Safety and Risk Management in the Application of Artificial Intelligence in the Banking Sector

On September 30, 2026, the State Bank of Vietnam issued Circular No. 53/2026/TT-NHNN, which stipulates safety requirements, risk management, and conditions for the deployment of artificial intelligence systems in the banking sector. This Circular takes effect on November 15, 2026.

This Circular applies to credit institutions, branches of foreign banks, organizations providing intermediary payment services, organizations providing mobile money services, credit information companies, the Asset Management Company of Vietnamese credit institutions, the National Banknote Printing Plant, and the Deposit Insurance of Vietnam.

- Principles for the Application of Artificial Intelligence

The application of artificial intelligence must comply with legal regulations on artificial intelligence, cybersecurity, data, and personal data protection. Artificial intelligence does not replace human authority and responsibility, and entities must be accountable to the law and customers for all decisions based on artificial intelligence systems.

- Classification and Risk Management of Artificial Intelligence Systems

Before deployment, units must classify artificial intelligence systems according to high, medium, and low risk levels. High-risk systems include those that automatically execute electronic transactions or make large-value credit decisions. Units must compile and update the list of artificial intelligence systems annually.

- Conditions for Deployment and Control

Artificial intelligence systems may only be automated when they meet conditions for inspection, supervision, and human intervention capability. For high-risk systems, continuous monitoring tools and human intervention capabilities are required to ensure safety.

- Data Safety Management and System Changes

Units must comply with regulations on personal data protection and intellectual property during data processing for artificial intelligence systems. Any significant changes to the system must be managed through a change management process, including impact assessment and updating of guidance documents.

- Risk Management in Outsourcing and Supply Chain

When outsourcing the development, deployment, or operation of artificial intelligence systems, units must ensure that third parties comply with legal regulations and possess appropriate technical capabilities. Units must regularly monitor and assess risks arising from reliance on third parties.
