Circular No.53/2016/TT-BLDTBXH dated December 28, 2016 of the Ministry of Labor, Ward Invalids and Social Affairs on introduction of the list of machinery, equipment and materials subject to occupational hygiene and safety requirements
Pursuant to the Law No. 84/2015/QH13 on Occupational Hygiene and Safety dated June 25, 2015;
Pursuant to the Government’s Decree No.44/2016-ND-CP dated May 15, 2016 detailing a number of Articles of the Law on Occupational Hygiene and Safety regarding technical safety inspection, training of occupational hygiene and safety and occupational environment monitoring;
Pursuant tothe Government s Decree No. 106/2012/ND-CP dated December 20, 2012, defining the functions, rights, responsibilities and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;
Upon request of the Director of the Department of Labor safety;
The Minister of Labor, War Invalids and Social Affairs hereby issues this Circular introducing the List of machinery, equipment and materials subject occupational hygiene and safety requirements.
Article 1. The list of machinery, equipment and materials strictly subject to occupational hygiene and safety requirements
The list of machinery, equipment and materials subject to occupational hygiene and safety requirement is issued herewith.
Article 2. Implementation organizations
1.According to socio-eco development and State management requirements, the competent Ministries that have the power to manage machinery, equipment and materials subject to occupational hygiene and safety requirements (hereinafter referred to as “the List”) as stipulated in Article 33 of the Law on Occupational Hygiene and Safety submit written requests or proposals for supplement and modification to the List to the Ministry of Labor, War Invalids and Social Affairs. To be specific:
-Name of machinery, equipment and materials deemed necessary to added to the List, including its scientific name and trade name ( if any);
-The necessity, feasibility and impact of addition and modification to the List ( enclosed with draft inspection procedures, if any).
2.The Department of Labor safety shall aggregate and submit proposals for modification and addition to the List to the Ministry of Labor, War Invalids and Social Affairs as prescribe by laws.
3.Departments of Labor, War Invalids and Social Affairs of provinces and centrally-affiliated cities (hereinafter referred to as “province”) shall cooperate with relevant authorities in dissemination and provisions of instructions on implementation of this Circular for entities using machinery, equipment and materials on the List within the province; aggregate and submit annual status reports on implementation of this Circular and status reports on occupational hygiene and safety to the Ministry of Labor, War Invalids and Social Affairs.
Article 3. Effect
1.This Circular takes effect on February 12, 2017.
2.Circular No. 05/2014/TT-BLDTBXH dated March 06, 2014 by the Ministry of Labor, War Invalids and Social Affairs on introduction of the list of machinery, equipment and materials subject to occupational hygiene and safety requirements shall expire from the effective date of this Circular.
3.Any issue arising in the course of implementation of this Circular should be reported in writing to the Ministry of Labor, War Invalids and Social Affairs. /.

OF MACHINERY, EQUIPMENT AND MATERIALS SUBJECT TO OCCUPATIONAL HYGIENE AND SAFETY REQUIREMENTS
