CIRCULAR

Amending and supplementing a number of articles of Circular No. 38/2024/TT-NHNN on consultancy services of credit institutions and foreign bank branches

Pursuant to the Law on the State Bank of Vietnam No. 46/2010/QH12;

Pursuant to the Law on Credit Institutions No. 32/2024/QH15, amended and supplemented under Law No. 96/2024/QH15;

Pursuant to the Government’s Decree No. 26/2025/ND-CP defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam, amended and supplemented under Decree No. 198/2026/ND-CP;

At the proposal of the Director of the Department of Legal Affairs;

The Governor of the State Bank of Vietnam hereby promulgates the Circular amending and supplementing a number of articles of Circular No. 38/2024/TT-NHNN on consultancy services of credit institutions and foreign bank branches.

Article 1. To amend and supplement Clause 1, Article 6

“1. In pursuance to this Circular and other relevant laws, credit institutions providing consultancy services shall formulate internal regulations on consultancy services before providing consultancy services.

Within 10 days after the promulgation or amendment, supplementation or replacement of internal regulations, credit institutions providing consultancy services shall submit such internal regulations directly, or send them by post, to the State Bank as follows:

a) Credit institutions providing consultancy services that are people’s credit funds or foreign bank branches subject to microprudential supervision by the SBV Regional branches, shall send internal regulations to such SBV Regional branches;

b) Credit institutions providing consultancy services subject to microprudential supervision by the Credit Institutions Supervision Department shall send internal regulations to the Credit Institutions Supervision Department.”

Article 2. To amend and supplement Article 12

“Article 12. Responsibility for implementation organization

Heads of units under the State Bank, credit institutions, and foreign bank branches shall organize the implementation of this Circular./.”

Article 3. Effect

This Circular takes effect from November 15, 2026.

Heads of units under the State Bank, credit institutions, and foreign bank branches shall implement this Circular./.
