CIRCULAR

Amending and supplementing a number of articles of the Circular No. 11/2020/TT-BCT dated June 15, 2020 of the Minister of Industry and Trade providing the Rules of Origin in the Free Trade Agreement between Vietnam and the European Union

Pursuant to the Law on Promulgation of Legal Documents;

Pursuant to the Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016, on detailing and guiding the implementation of a number of articles of the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 154/2020/ND-CP dated December 31, 2020, amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016, on detailing and guiding the implementation of a number of articles of the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 31/2018/ND-CP dated March 8, 2018 detailing the Law on Foreign Trade Management in terms of origin of goods;

At the proposal of the Director of the Agency of Foreign Trade;

The Minister of Industry and Trade promulgates the Circular amending and supplementing a number of articles of the Circular No. 11/2020/TT-BCT dated June 15, 2020 of the Minister of Industry and Trade providing the Rules of Origin in the Free Trade Agreement between Vietnam and the European Union (hereinafter referred to as Circular No. 11/2020/TT-BCT).

Article 1. Supplementing, replacing or repealing a number of words and phrases in Appendix II at Point b Clause 1 Article 4 of Circular No. 11/2020/TT-BCT

1. Replace the phrase “or drawn from artificial filament” with the phrase “or extruded into artificial filament” in the 3^rdcolumn - Processing stage of HS 5309 to 5311.

2. Repeal Footnote No. 3 in the 3^rd column - Processing stage of HS 5907 as follows: “Weaving the fabric and then dyeing or covering it with lint… provided that the value of the unprinted fabric used does not exceed 47.5% of the ex-factory price of the product.”

3. To add Footnote No. 5 in the 3^rd column - Processing stage of HS 6213 and 6214 with the description of goods “- embroidered; and” as follows: “.... “Manufactured from the unembroidered fabric, provided that the value of the unembroidered fabric used does not exceed 40% of the ex-factory price of the product:⁵ or ...”

4. Replace the phrase “...pen refills and ballpoint pen refills of the same subgroup as the product that may be used” with the phrase “...pen refills and ballpoint pen refills of the same group as the product that may be used” in 3^rd column - Processing stage of HS 9608.

Article 2. Implementation provisions

1. This Circular takes effect on February 20, 2023.

2. Repealing the Decision No. 1949/QD-BCT dated July 24, 2020 of the Minister of Industry and Trade on the correction of Circular No. 11/2020/TT-BCT./.
