SUMMARY

List of potentially unsafe commodities in the field of transport

List of potentially unsafe commodities under the management of the Ministry of Transport is prescribed by the Ministry of Transport in the Circular 41/2018/TT-BGTVT.

Some of the potentially unsafe commodities are road vehicles, such as: Bus (for the transport of 10 or more persons, including the driver); Passenger cars; Ambulances; Motorcycles (including those with side-cars); Mopeds; Electric bicycles; Motored bicycles…

Potentially unsafe rail transport vehicles are: Diesel-electric locomotives; Diesel-electric locomotives; Passenger coaches, not self-propelled; power generation coaches; other special purpose railway or tramway coaches, not self-propelled…

Besides, there are potentially unsafe parts, such as: Frames of motorcycles and mopeds; Rear-view mirrors of motorcycles and mopeds; Steel rims of motorcycles and mopeds; Batteries; Pneumatic tyres of motorcycles and mopeds…

This Circular is issued on July 30, 2018, takes effect on September 15, 2018.

THE MINISTRY OF TRANSPORT

Circular No.41/2018/TT-BGTVT dated July 30, 2018 of the Ministry of Transport on the List of potentially unsafe commodities under the management of the Ministry of Transport

Pursuant to the Law on Road Traffic 2008;

Pursuant to the Law on Quality of Products and Goods 2007;

Pursuant to the Government s Decree No. 132/2008/ND-CP dated 31 December, 2008 providing guidelines for certain articles of the Law on Quality of Products and Goods and Government’s Decree No. 74/2018/ND-CP dated May 15, 2018 on amendments to some Articles of the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008;

Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017 defining functions, tasks, entitlements and organizational structure of the Ministry of Transport;

At the request of the Director General of Department of Science and Technology and Director General of Vietnam Register;

The Minister of Transport hereby promulgates a Circular on the list of potentially unsafe commodities under the management of the Ministry of Transport.

Article 1. Scope of adjustment

This Circular provides for:

1. The list of potentially unsafe commodities under the management of the Ministry of Transport.

2. HS Code for the list of category 2commodities.

Article 2. Subject of application

This Circular applies to:

1. Domestic and foreign organizations and individuals related to production, business, design and construction of thecategory 2 commoditiesunder the management of the Ministry of Transport.

2. Organizations and individuals related to management and assessment of the quality ofcategory 2 commoditiesunder the management of the Ministry of Transport.

Article 3. Rules for managing the list of potentially unsafe commodities under the management of the Ministry of Transport

1. Regarding the list of commodities in the Appendix I enclosed with this Circular, the following rules shall be applied:

a) Imports must be certified conformable with corresponding national technical regulations and standards before customs clearance;

b) Commodities that are domestically manufactured and assembled must be certified or declared conformable with corresponding national technical regulations and standards before marketing;

2. Regarding the list of commodities in the Appendix II enclosed with this Circular, the following rules shall be applied:

a) Imports must be certified or declared conformable with corresponding national technical regulations and standards. The inspection and certification shall be carried out after customs clearance and before marketing;

b) Commodities that are domestically manufactured must be certified or declared conformable with corresponding national technical regulations and standards before marketing.

Article 4. Rules for application

1. If there is only a 4-digit code, all 8-digit commodities in the same 4-digit heading are applied if conformable with the name specified in the certificate of quality.

2. If there is only a 6-digit code, all 8-digit commodities in the same 6-digit heading are applied if conformable with the name specified in the certificate of quality.

Article 5. Effect

1. This Circular takes effect on September 15, 2018 and replaces the Circular No. 39/2016/TT-BGTVT dated December 06, 2016 of the Minister of Transport on the list of potentially unsafe commodities under the management of the Ministry of Transport.

2. The HS codes and management rules prescribed in this Circular shall be applied from September 15, 2018, to be specific: from the date of opening the customs declaration or date of arrival at the port or date of arrival at Vietnam’s checkpoint, regarding imports; from the release date, regarding commodities that are domestically manufactured or assembled.

3. In the cases where any of the legislative documents, technical standards and regulations referred to in this Circular is amended or replaced, the newest one shall apply.

Article 6. Implementation responsibility

1. General Departments and Departments affiliated to the Ministry of Transport shall:

a) implement this Circular;

b) review the list of commodities under their management and submit it to the Ministry.

2. Difficulties that arise during the implementation should be promptly reported to the Ministry of Transport.

Article 7. Implementation organization

Chief of the Ministry Office, Chief Inspector of Ministry, Directors, Director General of Directorate For Roads Of Vietnam, Director General of Vietnam Inland Waterway Administration, Director General of the Vietnam Maritime Administration, Director General of Vietnam Railway Authority, Director General of Civil Aviation Administration of Vietnam, heads of relevant authorities, units and individuals shall implement this Circular.
