CIRCULAR

Prescribing the list of scraps subject to temporary suspension from temporary import, re-export and border-gate transfer^[1]

Pursuant to June 12, 2017 Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Prime Minister’s Decision No. 27/CT-TTg of September 17, 2018, on a number of urgent solutions for strengthening the management of import and use of scraps imported for use as production materials;

At the proposal of the Director of the Import-Export Agency,

The Minister of Industry and Trade issues the Circular prescribing the list of scraps subject to temporary suspension from temporary import, re-export and border-gate transfer.

Article 1.To promulgate the list of scraps subject to temporary suspension from temporary import, re-export and border-gate transfer

1. To promulgate the list of scraps subject to temporary suspension from temporary import, re-export and border-gate transfer.

2. The list of scraps provided in the Appendix to this Circular is not applicable to cases of border-gate transfer of goods transported directly from exporting countries to importing countries not via Vietnamese border gates.

Article 2.Transitional provision

For scrap shipments that have undergone the customs procedures for temporary import or border-gate transfer before the effective date of this Circular, the re-export or border-gate transfer thereof may continue to be carried out under the Government’s Decree No. 69/2018ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management and relevant current regulations.

Article 3.Effect

1. This Circular takes effect from December 20, 2018, to December 31, 2019.

2. Any problems arising in the course of implementation of this Circular should be reported in writing to the Import-Export Agency of the Ministry of Industry and Trade for solution.

APPENDIX

LIST OF SCRAPS SUBJECT TO TEMPORARY SUSPENSION FROM TEMPORARY IMPORT, RE-EXPORT AND BORDER-GATE TRANSFER

(To the Minister of Industry and Trade’s Circular No. 41/2018/TT-BCT
of November 6, 2018)

This list is drawn up based on the list of Vietnam’s exports and imports promulgated together with the Ministry of Finance’s Circular No. 65/2017/TT-BTC of June 27, 2017. In case of 4-digit headings, this Circular shall apply to all 8-digit sub-headings pertaining to such 4-digit headings.
