Circular 40/2019/TT-BTC amend Circular 15/2016 use of support funding for basic training courses

CIRCULAR

On amending and supplementing a number of Article of the Circular No. 15/2016/TT-BTC dated October 17, 2016 of the Ministry of Finance on management and use of support funding for basic training courses and under 03 months training courses

Pursuant to the Law on State Budget dated June 05, 2015;

Pursuant to the Decree No. 163/2016/ND-CP dated December 21, 2016 of the Government on detailing and instructing the implementation of the Law on State Budget;

Pursuant to the Decision No. 46/2015/QD-TTg dated September 28, 2018 of the Prime Minister on support for basic training courses and under 03 months training courses;

Pursuant to the Decision No. 12/2017/QD-TTg dated April 22, 2017 of the Prime Minister on promulgating the Regulation on rule, criteria and norms of central budget allocations and the proportion of reciprocal capital of the local budget for implementing the National target program on building a new countryside in the 2016-2020 period;

On implementation the Decision No. 1600/QD-TTg dated August 16, 2016 of the Prime Minister on approval of the National program on new rural construction in the 2016-2020 period;

On implementation the Decision No. 1100/QD-TTg dated June 21, 2016 of the Prime Minister on approval the Plan to implement the Union Nation Conventions on rights of the disable;

On implementation the Resolution No. 71/NQ-CP dated May 31, 2018 of the Government on a number of policies for multidimensional poverty household;

At the proposal of the Director of the Administrative Career Financial Department;

The Minister of Finance issues the Circular on amending and supplementing a number of Article of the Circular No. 15/2016/TT-BTC dated October 17, 2016 of the Ministry of Finance on management and use of support funding for basic training courses and under 03 months training courses

Article 1. To amend and supplement a number of the Circular No. 152/2016/TT-BTC

1. To amend Clause 1 and point a Clause 2 Article 5 as follow:

“1. Central budget

a) Budget of the National target program on building a new countryside in the 2016-2020 period which is located in annual state budget expense estimation of Ministries, central agencies and purposeful supplement for localities have not yet have abilities to self -balance budget and Quang Ngai province as prescribed in the Decision No. 12/2017/QD-TTg dated April 22, 2017 of the Prime Minister on promulgating the Regulation on rule, criteria and norms of central budget allocations and the proportion of reciprocal capital of the local budget for implementing the National target program on building a new countryside in the 2016-2020 period shall be used for implement support policies to train rural and disable worker in basic training course and under 03 month training course.

b) Arrange budget in regular expenses estimation of the Vietnam Women Union to implement basic training course and under 03 month training course for urban women.

c) For the period after 2020, source of funding and list of supported localities shall be carried out as state competent agencies provisions.

2. Local budget

a) Localities have abilities to self-balance budget as prescribed in the Decision No. 12/2017/QD-TTg dated April 22, 2017 (except for Quang Ngai Province) shall ensure the whole budget to implement support policies for basic training course and under 03 month training course as prescribed in the Decision No. 46/2015/QD-TTg”

2. To amend Clause 1 Article 6 as follow:

“1. For funding sources arranged in regular expenditure estimates: the process of estimating, managing, using and settling funding according to the provisions of the Law on State Budget and guiding documents. Agencies and units assigned to provide basic training course and under 03 month training course for urban women shall have to made cost estimation and submit to the same level financial agency. The estimate must include detail description on the number of female worker shall be trained and cost for each profession in such plan year, result analyses report, efficiency of vocational training associated with annual career target to serve as a basis for estimate.”

3. To supplement Clause 4 Article 7 as follow:

“4. Persons supported at the extent prescribed in point b and c Clause 1 this Article are low income household and multidimensional poverty household without at least 01 education index.

Persons in multidimensional poverty household without lack of education index shall be supported with the extent for near poverty household prescribed in point d Clause 1 this Article.”

4. To amend Clause 1 and Clause 2 Article 8 as follow:

“1. The support of implement basic training course and under 03 month training course in the form of order or assignment as prescribed in the Decree No. 32/2019/ND-CP dated April 10, 2019 of the Government on provision on assignment, order or bidding in provide public product, service using state budget in regular expenditure source.

2. For disable learner, agency assigned to implement policy shall engage a contract with the training institution or produce and business establishments have Plan on vocational training associated with career for the disable (vocational training in the form of career transmission or working while studying) and settle the payment as the actual number of learner and training cost approved by the competent authority.”

5. To remove the phrase “định mức chi phí” (norm of cost) in Clause 4 Article 9.

6. To amend title of Article 10 as follow:

“Article 10. Formulate order price when economic-technical norm has not been established”.

7. To amend Clause 3 Article 10 as follow:

“3. Expenditure for teacher, vocational trainer in basic course and under 03 month course:

a) Fulltime teacher working in state education institutions: Applying current salary levels and allowances of teachers and lecturer;

b) Vocational trainer other than cases in point a this Clause: payment rate shall be suggested by the head of agency assigned to formulate order price and shall not excess the rate regulated in point a Clause 2 Article 5 of the Circular No. 36/2018/TT-BTC dated March 30 of the Ministry of Finance”.

Article 2. Effect

This Circular takes effect on September 01, 2019.

Any problems arising in the course of implementation should be promptly reported to the Ministry of Finance for consideration and settlement.
