Circular No. 37/2010/TT-BCT of December 2, 2010, on the import of goods of Cambodian origin at the import duty rate of 0% under 2010 and 2011 import quotas
Pursuant to the Government’s Decree No. 189/2007/ND-CP of December 27, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Agreement on accelerating bilateral trade signed on October 29, 2010, between the Ministry of Industry and Trade of the Socialist Republic of Vietnam and the Ministry of Trade of the Kingdom of Cambodia;
In furtherance of the Prime Minister’s directing opinions in Document No. 8339/VPCP-QHQT of November 16, 2010, on the implementation of the Vietnam-Cambodia Agreement on commodity preferences;
The Ministry of Industry and Trade provides for the import of goods of Cambodian origin at the import duty rate of 0% under 2010 and 2011 import quotas as follows:
Article 1. List of goods subject to import quotas and the volume of import quotas for 2010 and 2011
1. To apply import quotas with the import duty rate of 0% (zero per cent) for 2010 and 2011 to 2 commodity groups of Cambodian origin including rice and paddy of all kinds; and dried tobacco leaves.
The import duty rate of 0% for the 2010 import quotas apply to customs declarations registered with customs offices from November 1, 2010, through December 31, 2010. The import duty rate of 0% under the 2011 import quotas will apply to customs declarations registered with customs offices from January 1, 2011, through December 31, 2011.
2. Commodity headings and the total volume of import quotas of commodity groups eligible for the preferential import duty rate of 0% are specified in Appendix 1 to this Circular.
Article 2. Conditions for enjoying the import duty rate of 0% for import quotas
1. Imported goods must have a certificate of origin (C/O), form S, issued by a competent authority of the Kingdom of Cambodia according to regulations and be cleared from customs procedures through any pair of border gates specified in Appendix 2 to this Circular. Import procedures shall be carried out at import border gate customs offices by the mode of automatic reconciliation (the quantity of imported goods of each category shall be subtracted from the total quantity of imported goods eligible for the import duty rate of 0%).
2. Vietnamese traders may import rice and paddy of all kinds under import quotas. As for dried tobacco leaves, only traders that have a permit for the import of material tobacco issued by the Ministry of Industry and Trade under Circular No. 04/2006/TT-BTM of April 6, 2006, of the Ministry of Trade (now the Ministry of Industry and Trade) may import these goods. The quantity of imported goods shall be subtracted from import quotas indicated in the permit issued by the Ministry of Industry and Trade.
Article 3. Effect
This Circular takes effect from January 17, 2011, through December 31, 2011.
