Circular 35/2026/TT-NHNN amend Circulars on letters of credit, bank guarantee, credit programs due to renaming of units under the State Bank

CIRCULAR

Amending and supplementing a number of articles of Circulars on operations of letters of credit, bank guarantee, and guidance on the implementation of certain credit programs due to the renaming of units under the State Bank of Vietnam

Pursuant to the Law on the State Bank of Vietnam No. 46/2010/QH12;

Pursuant to the Law on Credit Institutions No. 32/2024/QH15, amended and supplemented under Law No. 96/2024/QH15;

Pursuant to the Government’s Decree No. 26/2025/ND-CP defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam, amended and supplemented under Decree No. 198/2025/ND-CP;

At the proposal of the Director of the Credit Department;

The Governor of the State Bank of Vietnam hereby promulgates the Circular amending and supplementing a number of articles of Circulars on operations of letters of credit, bank guarantee, and guidance on the implementation of certain credit programs due to the renaming of units under the State Bank of Vietnam.

Article 1. To amend and supplement a number of articles of Circular No. 11/2013/TT-NHNN providing the grant of housing support loans under the Government’s Resolution No. 02/NQ-CP of January 7, 2013, which was amended and supplemented under Circular No. 32/2014/TT-NHNN, Circular No. 25/2016/TT-NHNN, and Circular No. 85/2025/TT-NHNN

1. To replace the phrase “the Department of Credit for Economic Sectors” with the phrase “the Credit Department” in Clause 5, Article 8 (amended and supplemented under Article 1 of Circular No. 85/2025/TT-NHNN), Article 11 (amended and supplemented under Article 3 of Circular No. 85/2025/TT-NHNN), Appendix No. 01, Appendix No. 02, Appendix No. 03 and Appendix No. 04 to Circular No. 11/2013/TT-NHNN (amended and supplemented under Article 5 of Circular No. 85/2025/TT-NHNN).

2. To replace the phrase “the Forecasting and Statistics - Monetary and Financial Stabilization Department” with the phrase “the Forecasting and Statistics Department” in Appendix No. 02 to Circular No. 11/2013/TT-NHNN (amended and supplemented under Article 5 of Circular No. 85/2025/TT-NHNN).

Article 2. Amending and supplementing a number of articles of Circular No. 13/2014/TT-NHNN guiding lending under the Prime Minister’s Decision No. 68/2013/QD-TTg dated November 14, 2013, on support policies for reduction of losses in agriculture, which was amended and supplemented under Circular No. 85/2025/TT-NHNN

To replace the phrase “the Department of Credit for Economic Sectors” with the phrase “the Credit Department” in Articles 7 and 9 (amended and supplemented under Article 7 of Circular No. 85/2025/TT-NHNN), and Forms to Circular No. 13/2014/TT-NHNN.

Article 3. Amending and supplementing a number of articles of Circular No. 22/2014/TT-NHNN guiding the implementation of credit policies under the Government's Decree No. 67/2014/ND-CP dated July 07, 2014, on a number of fisheries development policies, which was amended and supplemented under Circular No. 21/2015/TT-NHNN, Circular No. 12/2018/TT-NHNN, and Circular No. 85/2025/TT-NHNN

To replace the phrase “the Department of Credit for Economic Sectors” with the phrase “the Credit Department” in Article 10 (amended and supplemented under Article 9 of Circular No. 85/2025/TT-NHNN), and Forms to Circular No. 22/2014/TT-NHNN.

Article 4. Amending and supplementing a number of articles of Circular No. 27/2015/TT-NHNN guiding loans for production forest growing and livestock development under the Government's Decree No. 75/2015/ND-CP dated September 09, 2015, which was amended and supplemented under Circular No. 85/2025/TT-NHNN

To replace the phrase “the Department of Credit for Economic Sectors” with the phrase “the Credit Department” in Article 10 (amended and supplemented under Article 11 of Circular No. 85/2025/TT-NHNN).

Article 5. Amending and supplementing a number of articles of Circular No. 01/2016/TT-NHNN guiding policies on provision of loans to develop supporting industries, which was amended and supplemented under Circular No. 85/2025/TT-NHNN

To replace the phrase “the Department of Credit for Economic Sectors” with the phrase “the Credit Department” in Clause 2, Article 8 (amended and supplemented under Article 14 of Circular No. 85/2025/TT-NHNN), and Article 9 (amended and supplemented under Article 15 of Circular No. 85/2025/TT-NHNN).

Article 6. Amending and supplementing a number of articles of Circular No. 45/2018/TT-NHNN providing credit institutions with instructions for grant of loans guaranteed by credit guarantee funds under regulations of Government’s Decree No. 34/2018/ND-CP dated March 08, 2018, which was amended and supplemented under Circular No. 85/2025/TT-NHNN

To replace the phrase “the Department of Credit for Economic Sectors” with the phrase “the Credit Department” in Article 8 (amended and supplemented under Article 17 of Circular No. 85/2025/TT-NHNN).

Article 7. Amending and supplementing Article 8 of Circular No. 17/2022/TT-NHNN guiding the management of environmental risks in credit extension of credit institutions and foreign bank branches

“Article 8. Implementation organization

Heads of units under the State Bank, credit institutions, foreign bank branches, and relevant organizations and individuals shall organize the implementation of this Circular.”

Article 8. Amending and supplementing a number of articles of Circular No. 21/2024/TT-NHNN prescribing letter of credit operations and other business operations related to letters of credit, which was amended and supplemented under Circular No. 85/2025/TT-NHNN

To replace the phrase “the Department of Credit for Economic Sectors” with the phrase “the Credit Department” in Clause 1, Article 55 (amended and supplemented under Article 21 of Circular No. 85/2025/TT-NHNN).

Article 9. Amending and supplementing a number of articles of Circular No. 61/2024/TT-NHNN prescribing bank guarantee

To replace the phrase “the Department of Credit for Economic Sectors” with the phrase “the Credit Department” in Clause 1, Article 36.

Article 10. Amending and supplementing a number of articles of Circular No. 29/2025/TT-NHNN guiding credit institutions and foreign bank branches in providing loans in the field of agriculture and rural areas

To replace the phrase “the Department of Credit for Economic Sectors” with the phrase “the Credit Department” in Article 7 and the Appendix to Circular No. 29/2025/TT-NHNN.

Article 11. Effect

1. This Circular takes effect from July 01, 2026. 

2. This Circular repeals Article 2 of Circular No. 85/2025/TT-NHNN.

3. Heads of units under the State Bank, credit institutions, and foreign bank branches shall organize the implementation of this Circular.
