CIRCULAR
Amending and supplementing a number of articles of the Minister of Finance's Circular No. 26/2019/TT-BTC dated May 10, 2019, guiding the formulating, management, usage and finalization of budget for state administrative reform

Pursuant to the Law on States Budget dated June 25, 2015;
Pursuant to the National Assembly’s Resolution No. 34/2021/QH15 dated November 13, 2021 on the 2022 State budget estimates;
Pursuant to the Government’s Decree No. 163/2016/ND-CP dated December 21, 2016, on detailing a number of articles of the Law on the State Budget;
Pursuant to the Government’s Decree No. 87/2017/ND-CP dated July 26, 2017, on defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to the Government’s Decree No. 61/2018/ND-CP dated April 23, 2018, on the implementation of the single-window and inter-agency single-window mechanism in the performance of administrative procedures;
Pursuant to the Government’s Decree No. 107/2021/ND-CP dated December 06, 2021, amending and supplementing a number of articles of the Government’s Decree No. 61/2018/ND-CP dated April 23, 2018, on the implementation of the single-window and inter-agency single-window mechanism in the performance of administrative procedures;
In implementing the Government's Resolution No. 76/NQ-CP dated July 15, 2021, promulgating the Master Program on State Administration Reform in the 2021-2030 period;
At the proposal of the Director of the Department of Public Expenditure;
The Minister of Finance hereby promulgates the Circular amending and supplementing a number of articles of the Minister of Finance's Circular No. 26/2019/TT-BTC dated May 10, 2019, guiding the formulating, management, usage and finalization of budget for state administrative reform (hereinafter referred to as the Circular No. 26/2019/TT-BTC).
Article 1. To amend and supplement a number of articles of the Circular No. 26/2019/TT-BTC
1. To amend and supplement Clause 2, Article 3 as follows:
“2. Expenses for formulating outlines for annual, 5-year and 10-year administrative reform programs and plans; formulating thematic and periodical administrative reforms reports”.
2. To amend and supplement Clause 15, Article 3 as follows:
“15. Expenses for formulating and maintaining information technology systems to serve the settlement of administrative procedures”.
3. To amend and supplement Clause 1, Article 4 as follows:
“1. Expenses for formulating outlines for annual, 5-year, and 10-year administrative reform programs and plans; expenses for the formulation of administrative reform monitoring and evaluating indicators for ministries, central authorities, and localities; expenses for organizing meetings to give opinions and appraisal of outlines for annual, 5-year, and 10-year administrative reform programs and plans, and give opinions to thematic and periodical administrative reforms reports: comply with regulations on the level of expenses for the formulation of programs, projects, and plans specified in the Joint Circular No. 14/2014/TTLT-BTC-BTP dated January 27, 2014, of the Ministry of Finance and the Ministry of Justice, regulating the formulating, management, use, and settlement of state budget to ensure the dissemination and education of law and law access standards of people at unit levels”.
4. To amend and supplement Point b Clause 7 Article 4 as follows:
“7. Expenses for information and propaganda on administrative reform
b) Expenses for formulating electronic information to serve the propaganda on administrative reform: comply with regulations on management of investment in information technology application using state budget capital and relevant laws; economic-technical norms in the field of information and communications”.
5. To amend Clause 12 Article 4 as follows:
“12. Expenses for formulating and maintaining information technology systems to serve the settlement of administrative procedures; expenses for formulating, improving, managing and operating the administrative reform database system and the administrative reform website; expenses for digitization to serve administrative reform: comply with regulations on management of investment in information technology application using state budget capital and relevant laws; economic-technical norms in the field of information and communications”.
6. To amend Clause 14 Article 4 as follows:
“14. Overtime expenses: comply with the provisions of the Labor Code and its guiding documents”.
7. To amend the last paragraph of Clause 1 Article 6 as follows:
“The non-wage allowance regime for officials, public servants, public employees, and laborers specified in this Circular shall be implemented until the new salary regime for officials, public servants, and public employees, forcing armed promulgated by the Government to implement the Resolution No. 27-NQ/TW dated May 21, 2018, of the Seventh Conference of the 12th Central Committee on reforming salary policy for officials, public servants, public employees, force armed and laborers in enterprises are carried out”.
Article 2. Implementation provisions
1. This Circular takes effect on August 15, 2022.
2. Any difficulties and problems arising in the course of implementation of this Circular should be reported to the Ministry of Finance for timely settlement./.
