Circular No. 32/2013/TT-BTC dated March 19, 2013promulgating the regime of collection, payment, management and use of charges for granting the driving road motor license for People s Police

Pursuant to the Law on Road Traffic No: 32/2013/TT-BTC dated November 13, 2008;

Pursuant to the Ordinance No. 38/2001/UBTVQH10 dated August 28, 2001 on charges and fees;

Pursuant to the Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government on detailing the implementation of the ordinance on charges and fees and the Decree No. 24/2006/ND-CP dated March 06, 2002 of Government amending and supplementing a number of articles of the Decree No. 24/2006/ND-CP dated June 3, 2002;

Pursuant to the Decree No. 118/2008/ND-CP dated November 27, 2008 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Tax Policy Department;

The Minister of Finance issues the Circular promulgating on the regime of collection, payment, management and use of charges of granting the driving road motor license for People s Police, as follows:

Article 1. Subjects of application

Police officers working in People’s Police Offices when requesting for testing to get the driving road motor license at units of People’s Police and being tested by these units must pay charges and fees for testing as stipulated under this Circular, except for students who are major in traffic police, fire prevention and fighting police at People’s Police Schools studied to drive according to the training program of the Ministry of Public Security.

Article 2. Level of charges

1. Level of charges for testing on driving motor vehicles is provided as follows:

a) For testing for driving motorcycle (ranks of A1, A2, A3, A4):

- Theory testing: VND 40,000 /time;

- Practice testing: VND 50,000 /time;

b) For testing for driving automobile (ranks of B1, B2, C, D, E, F):

- Theory testing: VND 90,000 /time;

- Practice testing in pictures: VND 300,000 /time;

- Practice testing on public traffic roads: VND 60,000 /time;

c) The participants of testing for grant of permit of driving road motor vehicles in a part shall pay charges of testing of that part (calculating times of testing: First testing, grade level testing retesting).

2. The charge level of granting the driving license is VND 30,000 /time (for new issuance, extension, exchange and re-issuance of driving license).

Article 3. Management and use of charges

1. Agencies, units managing the testing for granting the driving license are the agencies collecting charges.

2. Charges of testing for granting the driving license are revenues of the State budget, the agencies collecting charges are entitled to extract 65% of testing charges for costs of holding the testing and collection in accordance with the regulation (including the cost of renting the testing center (if any).

Agencies collecting charges shall submit 35% of testing charges and 100% of collected fees for granting the driving license to the state budget in accordance with chapter, section of the current list of state budget.

Article 4. Implementation organization

1. This Circular takes effect on May 05, 2013.

2. Other contents relating to registration, declaration, collection, remittance, management, use, public of regime of collection of charges of granting the driving license for People’s Police not provided in this Circular comply with guides in the Circular No. 63/2002/TT-BTC, of July 24, 2002 of the Ministry of Finance guiding the implementation of the Law provisions on charges and fees, the Circular No. 45/2006/TT-BTC dated May 25, 2006, of the Ministry of Finance amending and supplementing the Finance Ministry’s Circular No. 63/2002/TT-BTC dated July 24, 2002, guiding the implementation of legal provisions on charges and fees, the Circular No. 28/2011/TT-BTC dated February 28, 2011 guiding a number of articles of the Law on Tax Administration and the Government’s Decree No. 85/2007/ND-CP  dated May 25, 2007 and the Decree No. 85/2007/ND-CP dated October 28, 2010 of the Government, the Circular No. 153/2012/TT-BTC dated September 17, 2012 of the Ministry of Finance guiding the printing, issuance, management and use of documents for the collection of charges and fees belonging to the state budget and documents of amendments, supplementations (if any).

3.  For any arising problems in the course of implementation, agencies, organizations and individuals shall reflect promptly to the Ministry of Finance for having research and additional guidance./.
