CIRCULAR
Promulgating the List, organizing the licensing of dual-use goods, and monitoring and tracing information on strategic trade control under the state management of the Ministry of Science and Technology
Pursuant to the Law on Organization of the Government No. 63/2025/QH15;
Pursuant to the Law on Foreign Trade Management No. 05/2017/QH14;
Pursuant to the Government's Decree No. 55/2025/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;
Pursuant to the Government's Decree No. 259/2025/ND-CP on strategic trade control;
At the proposal of the Director General of the Authority of Information Technology Industry;
The Minister of Science and Technology promulgates the List, organizes the licensing of dual-use goods, and monitors and traces information on strategic trade control under the state management of the Ministry of Science and Technology.
Article 1. List of dual-use goods under the state management of the Ministry of Science and Technology
Promulgated together with this Circular is the Appendix on the List of dual-use goods under the state management of the Ministry of Science and Technology (hereinafter referred to as the List).
Article 2. Principles of applying the List
1. Only goods that concurrently possess the HS code, description, and technical and technological characteristics identical to the Appendix attached to this Circular shall be subject to licensing management by the Ministry of Science and Technology in accordance with Clause 2, Article 4 of Decree No. 259/2025/ND-CP on strategic trade control.
In cases where only a 6-digit HS code is listed, all 8-digit HS codes under such 6-digit subheading shall be applicable; In cases detailed to an 8-digit HS code, only such specific 8-digit HS codes shall be applicable.
2. The export, temporary import for re-export, merchanting trade, transshipment, and transit of goods on the List must comply with the provisions of Decree No. 259/2025/ND-CP on strategic trade control and current legal regulations on foreign trade management, commerce, taxation, customs, and other specialized laws.
Article 3. Organization of licensing for export, temporary import for re-export, merchanting trade, transshipment, and transit of dual-use goods under the management authority of the Ministry of Science and Technology
1. The Ministry of Science and Technology decentralizes to provincial-level People's Committees the implementation of licensing for the export, temporary import for re-export, merchanting trade, transshipment, and transit of dual-use goods under the management authority of the Ministry of Science and Technology.
For dual-use goods which are radioactive materials and nuclear equipment falling within the scope of regulation of the law on atomic energy, the licensing shall be implemented in accordance with the law on atomic energy and relevant laws.
2. The dossier and procedure for licensing the export, temporary import for re-export, merchanting trade, transshipment, and transit of dual-use goods under the management authority of the Ministry of Science and Technology shall be implemented in accordance with Article 9 of Decree No. 259/2025/ND-CP on strategic trade control.
3. Traders shall submit 01 (one) dossier set as prescribed in Clause 2 of this Article either directly, by post, or online via the Vietnam National Single Window Portal or the local information systems for processing administrative procedures.
Article 4. Effect
1. This Circular takes effect on June 06, 2026.
2. Provincial-level People's Committees and the Vietnam Agency for Radiation and Nuclear Safety are responsible for sending the licenses granted to traders as prescribed in Clause 1, Article 3 of this Circular to the Ministry of Science and Technology via the National Information System on Digital Technology Industry; and sending them to the Ministry of Industry and Trade and customs authorities via specialized online reporting systems for coordinated management.
3. The Authority of Information Technology Industry is responsible for building, maintaining, upgrading, and managing the National Information System on Digital Technology Industry to serve the monitoring and tracing of information on strategic trade control under the state management of the Ministry of Science and Technology.
4. During the implementation of this Circular, should any difficulties arise,
traders, relevant agencies, and organizations shall report them in writing to the Ministry of Science and Technology (The Authority of Information Technology Industry) for settlement./.
