CIRCULAR
Prescribing scientific research activities of students in higher education institutions[1]
Pursuant to the June 18, 2012 Law on Higher Education; and the November 19, 2018 Law Amending and Supplementing a Number of Articles of the Law on Higher Education;
Pursuant to the June 18, 2013 Law on Science and Technology;
Pursuant to the Government’s Decree No. 99/2019/ND-CP of December 30, 2019, detailing and guiding the implementation of a number of articles of the Law Amending and Supplementing a Number of Articles of the Law on Higher Education;
Pursuant to the Government’s Decree No. 08/2014/ND-CP of January 27, 2014, detailing and guiding the implementation of a number of articles of the Law on Science and Technology;
Pursuant to the Government’s Decree No. 69/2017/ND-CP of May 25, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;
At the proposal of the Director of the Department of Science, Technology and Environment;
The Minister of Education and Training promulgates the Circular prescribing scientific research activities of students in higher education institutions.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation and subjects of application
1. This Circular prescribes the management and organization of scientific research activities of students; and responsibilities and powers of related organizations and individuals for scientific research activities of students in higher education institutions.
2. This Circular applies to higher education institutions and organizations and individuals involved in scientific research activities of students.
Article 2. Objectives of students’ scientific research activities
1. To form and develop scientific research capacity for students; to contribute to find and foster young talented scientists to meet the requirements for training of high-quality human resources.
2. To create a convenient environment to support students in participating in scientific research in order to form startup ideas and projects, contributing to create job opportunities for students after graduation.
Article 3. Requirements on students’ scientific research activities
1. To conform to students’ capacity and desires.
2. To comply with the training objectives, contents, and programs which students are pursuing; to conform to the orientations for scientific and technological activities of higher education institutions.
3. Research outcomes must have scientific value, be novel and creative, and enable the application of acquired knowledge in reality.
4. To comply with the current law on scientific and technological activities.
Article 4. Funds for students’ scientific research activities
Funds for students’ scientific research activities will be mobilized from the following sources:
1. Lawful revenues of higher education institutions;
2. Donations and aid of organizations and individuals at home and abroad;
3. Other funding sources under regulations.
Chapter II
MANAGEMENT AND ORGANIZATION OF STUDENTS’ SCIENTIFIC RESEARCH ACTIVITIES
Article 5. Management of students’ scientific research activities
1. Plans on, and contents of, students’ scientific research activities must be included in annual and long-term plans on scientific and technological activities of higher education institutions.
2. Students’ scientific research activities include:
a/ Organizing the implementation of scientific research projects for students;
b/ Organizing activities to improve knowledge, provide further training for raising students’ scientific research and technology transfer capacity;
c/ Holding scientific conferences, seminars and forums; and competitions on startup ideas and projects for students; guiding and encouraging students to participate in science and technology awards and exhibitions, and academic competitions and forums for students at home and abroad;
d/ Organizing communications activities on science and technology to raise the awareness about research ethics and intellectual property knowledge for students; introducing startup ideas and projects and scientific research outcomes of students to investors and enterprises at home and abroad;
dd/ Commending or proposing commendation, and praising individual students, groups of students, and instructors that record outstanding achievements in scientific research activities; honoring organizations and individuals that make great contributions to students’ scientific research activities;
e/ Other forms of students’ scientific and technological activities under current regulations.
Article 6. Implementation of student’s scientific research projects
1. Students shall propose their scientific research projects according to plans of higher education institutions.
2. Students shall implement their projects after they are approved. For each project, there will be 1 student who takes the main charge and other students who participate in the project. The number of students participating in a scientific research project will be decided by the concerned higher education institution.
3. The time for implementation of scientific research projects must comply with plans of higher education institutions.
Article 7. Organization of students’ science and technology conferences
Annually, higher education institutions shall organize science and technology conferences for students in order to:
1. Evaluate outcomes of, and set orientations for, scientific and technological activities of students.
2. Honor students’ outstanding research outcomes; and share startup ideas and projects of students.
3. Announce and bestow awards to collectives and individuals having typical and outstanding research outcomes and startup ideas or projects.
Article 8. Introduction of students’ scientific research outcomes
Higher education institutions shall introduce outstanding research outcomes and science and technology products, and startup ideas and projects of students to enterprises, organizations, and investors to call for investment and cooperation so as to apply research outcomes in reality and support students in forming startup projects.
Article 9. Students’ science and technology information activities
1. To publish scientific journals and announcements, and records of conferences and seminars publicizing outcomes of students’ scientific research projects and other types of publication in accordance with law.
2. To manage, store, and exploit in an effective manner students’ scientific research outcomes under regulations.
3. To announce students’ scientific research outcomes under current regulations; to publish students’ scientific research outcomes on websites of higher education institutions and in the mass media.
Chapter III
RESPONSIBILITES AND POWERS OF ORGANIZATIONS AND INDIVIDUALS
Article 10. Responsibilities of higher education institutions
1. To promulgate regulations on organization of students’ scientific research activities, including the following contents:
a/ Procedures for proposing, considering, approving, implementing, evaluating, and conducting pre-acceptance testing of, students’ scientific research projects;
b/ Regulations on commendation of individual students, student collectives, and students’ instructors that record outstanding achievements in scientific research activities; and honoring organizations and individuals that make great contributions to students’ scientific research activities;
c/ Regulations on forms of handling students and instructors who commit violations of regulations on students’ scientific research activities under current regulations;
d/ Regulations defining the functions and tasks of units, organizations, and individuals regarding students’ scientific research activities; obligations and rights of students and their instructors and related organizations and individuals;
dd/ Regulations on other contents related to students’ scientific research activities.
2. To promulgate and implement annual and long-term plans on scientific research activities of students in conformity with the objectives and orientations of higher education institutions under current regulations.
3. To promulgate regulations on funds for students’ scientific research activities included in higher education institutions’ financial regulations according to current regulations.
Article 11. Responsibilities and rights of students’ instructors in scientific research
1. Instructors shall instruct students in scientific research activities, be held responsible for the contents of the scientific research projects assigned for instruction, fully adhere to the principle of research ethics, and comply with current regulations.
2. Instructional time shall be calculated as instructors’ time spent on scientific research, instructors will be entitled to remunerations and other benefits under higher education institutions’ regulations after accomplishing the tasks of instructing students’ scientific research activities.
3. Instructors whose students’ scientific research outcomes are graded as extinction, win science and technology awards at home and abroad, or are applied in reality, bringing about socio-economic effects will be given with priority in consideration and bestowal of emulation titles of all levels and other forms of commendation.
Article 12. Responsibilities and rights of students participating in scientific research activities
1. Responsibilities of students:
a/ To carry out scientific research in a truthful and serious manner;
b/ To be held responsible for implementing scientific research projects reserved for students; and participate in science conferences, seminars and forums, and other scientific and technological activities in higher education institutions;
c/ To comply with the laws on intellectual property and science and technology activities, and other relevant laws.
2. Rights of students:
a/ To propose and register for implementation of scientific research projects;
b/ To enjoy favorable conditions in using available physical foundations and equipment of higher education institutions for carrying out their research activities;
c/ To be provided with financial support for carrying out scientific research at the rates specified by higher education institutions;
d/ To announce and be supported to announce their research outcomes in scientific magazines, and other science and technology records and publications at home and abroad under regulations;
dd/ To be supported in registering intellectual property rights over their research outcomes under current regulations;
e/ To be considered for bonus academic and discipline scores; to be given with priority in consideration for grant of scholarships and bestowal of emulation titles, and commendation under higher education institutions’ regulations;
g/ To enjoy other benefits under regulations.
Article 13. Commendation, and handling of violations
1. Students, students’ instructors, and organizations and individuals that make achievements in students’ scientific research activities will be commended or proposed to competent authorities for commendation under current regulations.
2. Collectives and individuals violating regulations on students’ scientific research activities shall, depending on the severity of their violations, be subject to handling and disciplines under higher education institutions’ regulations and current regulations.
Chapter IV
IMPLEMENTATION PROVISIONS
Article 14. Effect
1. This Circular takes effect on November 2, 2021.
2. This Circular replaces the Minister of Education and Training’s Circular No. 19/2012/TT-BGDDT of June 1, 2012, prescribing scientific research activities of students in higher education institutions.
Article 5. Implementation responsibility
The Chief of the Office, the Director of the Department of Science, Technology and Environment, and heads of related units under the Ministry of Education and Training; directors of general universities and academies; rectors of universities; and related organizations and individuals shall implement this Circular.-
