CIRCULAR
Amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 33/2019/TT-BCT dated November 22, 2019, on prescribing the system of criteria of the Vietnam National Brand Program

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government’s Decree No. 98/2017/ND-CP dated August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government's Decree No. 28/2018/ND-CP dated March 1, 2018, detailing the Law on Foreign Trade Management regarding foreign trade development measures;
Pursuant to the Prime Minister's Decision No. 30/2019/QD-TTg dated October 8, 2019, promulgating the Regulation on formulation, management and implementation of the Vietnam National Brand Program;
At the request of the Director of the Vietnam Trade Promotion Agency;
The Minister of Industry and Trade promulgates a Circular on amending and supplementing a number of articles of the Circular No. 33/2019/TT-BCT dated November 22, 2019, of the Minister of Industry and Trade of Vietnam, on prescribing the system of criteria of the Vietnam National Brand Program.
Article 1. Amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 33/2019/TT-BCT dated November 22, 2019, on prescribing the system of criteria of the Vietnam National Brand Program
1. To add Clause 3 Article 3 as follows:
“3. The contents of the projects' activities must be consistent with those of the Vietnam National Brand Program and are specified in Appendix 1a to this Circular.”
2. To amend Point a Clause 2 Article 6 as follows:
“a) Being an enterprise established under Vietnamese law, of which more than 50% of charter capital or total ordinary shares is held by Vietnamese organizations or individuals.
In case the enterprise fails to satisfy all the criteria for capital but has a product participating in the selection that shows Vietnamese unique elements, contributing to improving the image and value of the Vietnam national brand, the Vietnam National Brand Council shall consider and decide".
Article 2. Supplementing and replacing a number of Appendices of the Minister of Industry and Trade’s Circular No. 33/2019/TT-BCT dated November 22, 2019, on prescribing the system of criteria of the Vietnam National Brand Program
1. To add Appendix 1a - Contents of activities of projects under the Vietnam National Brand Program before Appendix 1 issued together with the Minister of Industry and Trade’s Circular No. 33/2019/TT-BCT dated November 22, 2019, on prescribing the system of criteria of the Vietnam National Brand Program.
2. To replace Appendix 2 issued together with the Minister of Industry and Trade’s Circular No. 33/2019/TT-BCT dated November 22, 2019, on prescribing the system of criteria of the Vietnam National Brand Program with Appendix 2 - Criteria for selection of products of Vietnam national brands promulgated together with this Circular.
Article 3. Effect
1. This Circular takes effect from February 7, 2022.
2. Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Industry and Trade for study and settlement./.
