CIRCULAR
Prescribing prices for technical safety and environmental protection inspection services of currently circulating motor vehicles, special-use equipment and vehicles; assessment and calibration of equipment inspecting motor vehicles
Pursuant to the Law No. 23/2008/QH12 dated November 13, 2008 on Road Traffic;
Pursuant to the Law No. 11/2012/QH13 dated June 20, 2012 on Prices;
Pursuant to the Law No. 97/2015/QH13 dated November 25, 2015 on Charges and Fees;
Pursuant to the Government's Decree No. 177/2013/ND-CP dated November 14, 2013 detailing and guiding the implementation of a number of articles of the Law on Prices and the Government’s Decree No. 149/2016/ND-CP dated November 11, 2016 on amending and supplementing a number of articles of the Decree No. 177/2013/ND-CP dated November 14, 2013;
Pursuant to the Government’s Decree No. 215/2013/ND-CP dated December 23, 2013, defining the functions, powers and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Price Management Department,
The Minister of Finance promulgates the Circular on prescribing prices for technical safety and environmental protection inspection services of currently circulating motor vehicles, special-use equipment and vehicles; assessment and calibration of equipment inspecting motor vehicles.
Article 1. Scope of regulation
This Circular regulates the prices for technical safety and environmental protection inspection services of currently circulating motor vehicles, special-use equipment and vehicles; assessment and calibration of equipment inspecting motor vehicles.
Article 2. Subjects of application
1. Agencies, organizations and individuals, whose currently circulating motor vehicles, special-use equipment and vehicles undergo the inspection of technical safety and environmental protection carried out by registration units, shall be responsible for paying service prices to the registration units according to the provisions of this Circular.
2. The registration units shall carry out the technical safety and environmental protection inspection of currently circulating motor vehicles, special-use equipment and vehicles.
3. Other relevant organizations and individuals.
Article 3. Inspection service prices
1. Prices for technical safety and environmental protection inspection services for currently circulating motor vehicles, special-use equipment and vehicles; assessment and calibration of equipment inspecting motor vehicles shall comply with the Tables of prices attached to this Circular.
The service prices specified in this Circular are inclusive of value-added tax (VAT) but exclude fees for issuance of the technical safety and environmental protection inspection certificate for motor vehicles and special-use vehicles according to regulations of the Ministry of Finance and expenses for accommodation, travel, and communications to carry out inspection in places more than 100 km away from the head offices of the registration units. Expenses for accommodation, travel, and communications to carry out the inspection in places more than 100 km away from the head offices of the registration units (if any) shall comply with the current regulations of the Ministry of Finance on business trip allowances for state agencies and public non-business units.
2. When collecting service prices, the registration units shall use service provision invoices in accordance with the Government's Decree No. 51/2010/ND-CP dated May 14, 2010 defining goods sale and service provision invoices; the Government’s Decree No. 04/2014/ND-CP dated January 17, 2014, amending and supplementing a number of articles of the Government's Decree No. 51/2010/ND-CP dated May 14, 2010 defining goods sale and service provision invoices; the Circular No. 39/2014/TT-BTC dated March 31, 2014 of the Minister of Finance guiding the implementation of the Decree No. 51/2010/ND-CP dated May 14, 2010 and the Government’s Decree No. 04/2014/ND-CP dated January 17, 2014 on goods sale and service provision invoices and replacing documents or amended and supplemented documents (if any).
The registration units are obliged to publicize information and service prices, pay tax on the collected amount and have the right to manage and use the remaining amount after the tax has been paid in accordance with the law provisions.
Article 4. Implementation organization
1. This Circular takes effect from January 1, 2017 and replaces the Minister of Finance’s Circular No. 114/2013/TT-BTC dated August 20, 2013 prescribing the rates, collection, remittance, management and use of charges for technical safety and quality inspection of components, motor vehicles, special-use equipment and vehicles and the Minister of Finance’s Circular No. 132/2014/TT-BTC dated September 20, 2014 prescribing the rates, collection, remittance, management and use of charges for technical safety and quality inspection of electric bicycles; charges for inspection of technical safety and environmental protection for currently circulating three-wheel motorcycles and similar vehicles.
2. Any difficulty arising in the course of implementation shall be promptly reported to the Ministry of Finance for consideration and guidance./.

TABLES OF PRICES
For technical safety and environmental protection inspection services of currently circulating motor vehicles, special-use equipment and vehicles; assessment and calibration of equipment inspecting motor vehicles

I. Prices for technical safety and environmental protection inspection services of currently circulating motor vehicles

2. Any inspected motor vehicle that fails to meet technical safety and environmental protection standards must be maintained, repaired for re-inspection. The prices of re-inspections are determined as follows:
a) In case the re-inspection is conducted in the same day (in working hours) as the first inspection: motor vehicles shall be exempted from the inspection price for the first and second re-inspection times; and shall, for the third time onwards, be charged 50% of the inspection prices specified in the Table 1 per re-inspection time.
b) Motor vehicles undergoing the re-inspection after 01 day but not exceeding 07 days from the date of the first inspection (excluding days off under provisions) shall be charged 50% of the inspection prices defined in the Table 1 per inspection time.
c) Motor vehicles undergoing the re-inspection after 07 days from the date of the first inspection (excluding days off under provisions) shall be charged as for the first inspection.
3. Motor vehicles undergoing inspection for being granted the technical safety and environmental protection inspection certificate (within no more than 15 days) shall be charged 100% of the prices specified in Table 1.
4. The prices applicable to motor vehicles undergoing the inspection as a technical inspection or quality assessment at request of organizations, individuals shall be agreed upon but not exceed 03 times of that specified in Table 1.

(*) The bucket volume is considered as the volume of the largest bucket;
(**) For lifting equipment, if only the moving part is inspected, the prices shall be 40% of the price rates specified in Table 2; if only the lifting part is inspected, the prices shall be 60% of the price rates specified in Table 2;
(***) For CNG and LPG tanks, fuel tanks with the inspection cycle of 1 year or more, the price shall be determined by multiplying the annual price and the number of years in the inspection cycle.
Note: For special-use equipment and vehicles with many features, the prices shall be only determined based on the feature applied with the highest price rate.
2. Inspected special-use equipment and vehicles that fail to meet technical safety and environmental protection standards must have their parts failing to meet the standards maintained and repaired to be re-inspected. The prices of re-inspections will be determined as follows:
a) In case the re-inspection is conducted in the same day (in working hours) as the first inspection: motor vehicles shall be exempted from the inspection price for the first and second re-inspection times; and shall, for the third time onwards, be charged 50% of the inspection prices specified in the Table 2 per re-inspection time.
b) Motor vehicles undergoing the re-inspection after 01 day but not exceeding 07 days from the date of the first inspection (excluding days off under provisions) shall be charged 50% of the inspection prices defined in the Table 2 per re-inspection time.
c) Motor vehicles undergoing the re-inspection after 07 days from the date of the first inspection (excluding days off under provisions) shall be charged as for the first inspection.
3. For any special-use equipment or vehicle other than those specified in this Table, relevant parties shall, according to the State’s provisions, negotiate the inspection price on the principle of ensuring the interest parity.
4. The prices applicable to motor vehicles undergoing the inspection as a technical inspection or quality assessment at request of organizations, individuals shall be agreed upon but not exceed 03 times of that specified in Table 2.
III. Prices for technical safety and quality inspection services of motor vehicles or special-use vehicles used for renovation

2. Any equipment failing to satisfy the producer’s standards shall be repaired, re-assessed and re-calibrated; any equipment surprisingly breaking down shall be repaired, re-assessed and re-calibrated before the required period. The re-assessment and -calibration prices shall be conformable to the Table 4./.
