Circular No. 23/2017/TT-BCT dated November 16, 2017 of the Ministry of Industry and Trade on prescribing contents and processes for implementation of load adjustment programs
Pursuant to the Government s Decree No. 98/2017/ND-CP dated August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Law on Electricity dated December 3, 2004 and the Law on Amendment to certain Articles of the Electricity Law dated November 20, 2012;
Pursuant to the Government’s Decree No. 137/2013/ND-CP dated October 21, 2013 detailing a number of articles of the Electricity Law and the Law Amending and Supplementing a Number of Articles of the Electricity Law;
Upon the request of the Director of the Electricity Regulatory Authority,
The Minister of Industry and Trade hereby issues the Circular prescribing contents and processes for implementation of load adjustment programs.
Chapter I
GENERAL PROVISIONS
Article 1.Scope of adjustment
1. This Circular prescribes contents and processes for implementation of load adjustment programs.
2. This Circular shall not apply to suspension and reduction of amount of emergency power supply under Regulations on requirements and processes for suspension and reduction of amount of power supply enforced by the Ministry of Industry and Trade.
Article 2. Subjects of application
This Circular shall apply to the following entities and individuals:
1. Power distribution entities.
2. Power distribution and retailing entities.
3. Power customers.
4. Load adjustment service providers.
5. National load dispatch entity (i.e. National Load Dispatch Center).
6. Vietnam Electricity Corporation.
7. Other organizations and individuals concerned.
Article 3. Definition
For the purpose of this Circular, terms used herein shall be construed as follows:
1.Power system securityrefers to capability of the power source to generate adequate power to meet the needs of electrical load in a specified time or time duration, which takes into account constraints existing in the power system.
2.Load Duration Curve (LDC)refers to a graph displaying all load levels in descending order and time duration for which each load continues during a given time.
3.Load adjustmentrefers to one of power demand management programs that encourages customers to actively reduce the consumption needs for power supplied by the national power system according to power price signals or incentive policies as requested by the entity implementing load adjustment programs, contributes to a decrease in the peak-time maximum capacity of the power system, reduces the power grid overload or are needed to improve economic effectiveness of the power system.
4.Power distribution entityrefers to an electricity entity that is licensed to distribute and sell electricity, including:
a) Power Corporation;
b) Power companies of provinces and centrally-affiliated cities (hereinafter referred to as provincial power company).
5.Power distribution and retailing entityrefers to an electricity entity licensed to distribute and retail electricity or purchase electricity in bulk from a power distribution entity for retail distribution of purchased power to power customers.
6.Entity implementing load adjustment programrefers to an entity authorized to implement load adjustment programs, including:
a) Power distribution entity;
b) Load adjustment service provider.
7.National load dispatch entityrefers to an entity that commands and controls the process of generating transmitting and distributing power within the national power system, including the following dispatch levels:
a) National dispatch level;
b) Regional dispatch level.
8.Load adjustment service providerrefers to an entity established and granted business registration under law, having enough physical, information infrastructure and personnel to act as a mediator between power customers and sellers in implementing load adjustment programs in conformity with agreement with power customers and sellers.
9.Baseline load defined in a load adjustment (hereinafter referred to as baseline load)refers to a power customer’s load profile which is created and formed from projection based on electrical power measurement data collected at intervals of past 30 minutes. The baseline load depicts power consumption tendencies and habits of power customers in a day or a specific point of time when a load adjustment event takes place. The baseline load is used for calculation of a power customer’s capacity or electrical power subject to a decreasing adjustment after end of a load adjustment event.
10.Load adjustment program control systemrefers to a tool, including software, hardware and information portal, which an entity implementing load adjustment program develops and manages to assist in and oversee implementation of a load adjustment program.
11.Load factorrefers to a factor that assesses power usage effectiveness of electrical loads or power systems, and is determined according to the following formula:

- kpt: Load factor;
- Ptb: Average load-carrying capacity of electrical load or power system in a calculating cycle;
- Pmax:Maximum load-carrying capacity of electrical load or power system in a calculating cycle.
12.Contract for participation in load adjustment programrefers to an agreement between a power customer and an entity implementing load adjustment program for participation in a load adjustment program.
13.Contract for provision of load adjustment servicerefers to an agreement between a power distribution entity and s load adjustment service provider for provision of load adjustment services.
14.Customer participating in load adjustment programrefers to a power customer that has entered into a Contact for participation in load adjustment program with an entity implementing load adjustment program for participation in load adjustment programs.
15.Electricity demand managementrefers to a combination of engineering – technological – economic – social solutions to assisting customers in using power, electricity entities in producing, trading and using power in an effective and cost-consuming manner which contributes to optimizing power supply and demand balancing, and improves power usage effectiveness for the entire power system.
16.Load adjustment eventrefers to a time period during which a power customer participating in a load adjustment program makes a decreasing adjustment to his/her power demands upon receipt of a notice from an entity implementing load adjustment program.
17.Power shortagerefers to a situation in which the power system lacks either electrical power or capacity, or both, to meet load demands.
Article 4. Principles of implementing load adjustment programs
A load adjustment program shall be implemented according to the following principles:
1. Balancing power supply and demand in the case of lack of power supply from the power system.
2. Reducing overload or excess of power transmission limits, and eliminating risks of power grid overload (except in the case of emergency where an electrical load needs to be shed).
3. Improving economic effectiveness of the power system.
Chapter II
ASSESSMENT OF DEMANDS AND ESTABLISHMENT OF THE PLAN FOR IMPLEMENTATION OF LOAD ADJUSTMENT PROGRAMS
Section 1. ASSESSMENT OF DEMANDS FOR IMPLEMENTATION OF LOAD ADJUSTMENT PROGRAMS
Article 5. Assessment of demands for implementation of load adjustment programs
The national power dispatch entity and the power distribution entity shall be charged with conducting an assessment of demands for implementation of load adjustment programs for the national power system, regional power systems and those put under their jurisdiction, which encompasses the following main activities:
1. Analyzing and assessing the previous year’s chart of electrical loads within the national power system, regional power systems or those ones put under their jurisdiction under the provisions of Article 6 hereof.
2. Studying electrical loads as per Article 7 hereof.
3. Forecasting load demands under Regulations on the power system for transmission and Regulations on the power system for distribution, enforced by the Ministry of Industry and Trade.
4. Analyzing and assessing current conditions of the power system, the plan for investment in power sources, power grids, and evaluating power system security under the provisions of Article 8 hereof.
5. Defining demands for implementation of load adjustment programs.
Article 6. Analysis and assessment of the load profile
Building up, analyzing and evaluating load profiles existing in preceding years (at least 03 years) for identification of load information and characteristics, including the following specific activities:
1. Developing and analyzing the load profile and LDC graph of the national power system, regional power systems or those ones put under their jurisdiction.
2. Analyzing and evaluating load growth rate of the national power system, regional power systems or those ones put under their jurisdiction.
3. Determining month- or year-based load factors of the power system.
4. Evaluating load demands that need to be reduced by load adjustment programs for improvement of load factors of the power system and decreasing pressure for development or renovation of the power system.
Article 7. Load study
1. Conducting load study as per Regulations on requirements, methods and processes for studying electrical loads which are enforced by the Ministry of Industry and Trade as the basis for evaluation of their capabilities of implementing load adjustment programs, including the following activities:
a) Constructing the load profile of each load component, load group and load subgroup;
b) Analyzing the load profile of each load component, load group and load subgroup as well as assessing the following contents:
- Analyzing the contributory proportion of each load component, load group and load subgroup during peak time. Determining which load component, load group and load subgroup greatly contributing to the peak-time maximum capacity of the power system;
- Assessing tendency to change in the load profile of load components, load groups and load subgroups that have significant contribution during peak time on the power system;
- Assessing the growth rate of load components, load groups and load subgroups.
2. Determining load components, load groups and load subgroups which are capable of participating in load adjustment programs, depending on load study results.
Article 8. Analysis and assessment of current conditions of the power system, the plan for investment in power sources, power grids, and evaluation of power system security
1. Analyzing and assessing current conditions of the power system and current state of power supply; statistically reporting and assessing current operational conditions of power grids, load carriage of power lines and transformer stations, including number of times, hours and percents of duration of full load (load-carrying range from 90% to 100%), overloads in a specified cycle (load-carrying range from 100% to 110%, and the load-carrying range of more than 110%) and load factors.
2. Analyzing and assessing the plan and progress of development of power sources and grids. Formulation and evaluation of the plan for operation of the power system is aimed at meeting the load demands.
3. Conducting assessment of power system security or capacity to ensure sufficient power supplies of the power system, regional power systems or those ones put under their jurisdiction.
4. Determining the demands for implementation of load adjustment programs based on the results of assessment of current conditions of the power system, the plan for development of power sources, power grids and the plan for operation of the power system as well as assessing power system security:
a) Demands for carrying out load adjustment shall arise once the national power system or the regional power system fails to meet load demands, including the followings:
- Power shortage that may occur within the precinct of the power grid;
- Date and time period during which power shortage may occur;
- Level of capacity or load that needs to be reduced for maintenance of power system security.
b) Demands for implementation of load adjustment programs shall arise due to power grid overloads or excess of transmission limits, including the followings:
- Overload or excess of transmission limits that may occur within the precinct of power grid area;
- Date and time period during which power shortage may occur;
- Overload proportion, level of electricity capacity or load that needs to be reduced for controlling power grid overloads or excess of power transmission limits.
c) Demands for implementation of load adjustment programs shall be aimed at minimizing costs of power purchase on the entire system or improving load factors of the power system, including the followings:
- Power grid areas where load adjustment may be made;
- Date or time period during which load adjustment events need to take place;
- Level of electricity capacity and load that need to be reduced for improvement of economic effectiveness of the power system.
Article 9. Determination of demands for implementation of load adjustment programs
Synthesizing, evaluating and determining demands for implementation of load adjustment programs on the basis of the results achieved by carrying out activities stated in Article 5, 6, 7 and 8 hereof, including the following contents:
1. Total capacity and load that need to be reduced after implementation of load adjustment programs.
2. Power grid areas (e.g. power transformer stations and lines) where load adjustment may be made.
3. Proposed date or time period during which load adjustment events need to take place;
4. Power customers that are able to participate in load adjustment programs.
5. Reasons for load adjustment to be made in the cases prescribed in Clause 4 Article 8 hereof.
Article 10. Responsibilities of relevant entities for assessment of demands for implementation of load adjustment programs
1. Responsibilities of Vietnam Electricity Corporation
a) Directing the national power dispatch entity and the power distribution entity to assess the demands for load adjustment programs to be implemented under the provisions of this Circular;
b) Deciding to approve the report on results of assessment of the demands for load adjustment programs for the national power system to be implemented in the following year, month and week which is prepared and submitted by the National Load Dispatch Entity as per Clause 2 of this Article;
c) Sending a report to the Electricity Regulatory Authority on the results of assessment of the demands for load adjustment programs for the national power system to be implemented in the following year which is prepared under Regulations on the power system for transmission and Procedures for national load dispatch issued by the Ministry of Industry and Trade.
2. Responsibilities of the national load dispatch entity
a) Assessing the demands for implementation of load adjustment programs for the national power system and the regional power system in the following year, month and week. Contents of assessment of the demands for load adjustment programs for the national power system and the regional power system to be implemented as part of the plan for operation of the national power system in the following year, month and week which is formulated under Regulations on the power system for transmission and Procedures for national load dispatch issued by the Ministry of Industry and Trade;
b) Informing electricity distribution entities and reporting to Vietnam Electricity Corporation on the results of assessment of the demands for load adjustment programs for the national power system and the regional power system to be implemented as part of the plan or method for operation of the national power system in the following year, month and week as per Regulations on the power system for transmission and Procedures for national load dispatch issued by the Ministry of Industry and Trade.
3. Responsibilities of the power distribution entity
Assessing the demands for load adjustment programs to be implemented within its jurisdiction on the basis of the results of assessment of the demands for load adjustment programs to be implemented which are provided by the national load dispatch entity, and on the basis of particular characteristics of the power system within their jurisdiction. Contents of assessment of the demands for load adjustment programs to be implemented are part of the plan or method for operation of the national power system for distribution as per Regulations on the power system for distribution enforced by the Ministry of Industry and Trade.
4. Responsibilities of the load adjustment service provider, the electricity distribution and retailing entity
Load adjustment service provider, the electricity distribution and retailing entity shall be responsible for cooperating with the electricity distribution entity in the process of assessment of the demands for load adjustment programs to be adjusted.
Section 2. FORMULATION OF THE PLAN FOR IMPLEMENTATION OF LOAD ADJUSTMENT PROGRAMS BY THE ELECTRICITY DISTRIBUTION ENTITY
Article 11. General provisions for the plan for implementation of load adjustment programs
1. The electricity distribution entity shall be responsible for drawing up the plan for implementation of load adjustment programs in the succeeding year, month and week on the basis of assessment of the demands for load adjustment programs to be implemented as referred to in Section 1 of this Chapter;
2. The plan for implementation of load adjustment programs in the succeeding year, month and week shall be part of the plan for operation of the power system for distribution which is established and declared under Regulations on the power system for distribution enforced by the Ministry of Industry and Trade.
3. Annually on the first of December, the electricity distribution entity shall assume the following responsibilities:
a) The Electricity Corporation finishes establishing and synthesizing plans for implementation of load adjustment programs in the succeeding year of the entire corporation and provincial electricity companies thereof for reporting to the Electricity Regulatory Authority;
b) The Electricity Corporation of Hanoi, Ho Chi Minh city and provincial electricity companies prepare a complete plan for implementation of load adjustment programs for the succeeding year for reporting to the Department of Industry and Trade of the local jurisdictions where they are located.
4. The electricity distribution entity shall be responsible for drawing up the plan for implementation of load adjustment programs for the succeeding month and week with reference to the plan for implementation of load adjustment programs for the succeeding year. The plan for implementation of load adjustment programs shall be regularly updated with reference to input data collected till the date prior to sending of the notification of implementation of load adjustment programs to customers participating in these programs.
Article 12. Contents of the plan for implementation of load adjustment programs
1. Demands for load adjustment programs to be implemented shall be subject to regulations laid down in Section 1 Chapter II hereof.
2. Specific scope and objectives of load adjustment shall comprise:
a) Intended power grid, transformer station and electrical line areas where load adjustment activities may be performed;
b) Level of electricity capacity and load to be reduced; proposed date or time period during which load adjustment events need to take place and total number of load adjustment events planned to take place;
c) Reasons for load adjustment to be made in the cases prescribed in Clause 4 Article 8 hereof.
3. Methods for implementation of load adjustment programs
a) Analyzing and deciding on load adjustment programs which correspond to load adjustment objectives, participating customers and current electrical grid conditions;
b) Contents of each load adjustment program to be implemented shall be composed of the followings:
- Name and contents of the program;
- Target customers and number of customers planned to take part in the program;
- Estimated capacity and load to be reduced;
- Proposed date or time period for implementation of the program;
- Total number of load adjustment events in the program that are planned to take place;
- Incentive policies for implementation of the program (if any), which are adopted by competent authorities.
Chapter III
LOAD ADJUSTMENT PROGRAMS AND IMPLEMENTATION PROCESS
Section 1. LOAD ADJUSTMENT PROGRAMS
Article 13. Load adjustment programs
Load adjustment programs classified by incentive policies applied thereto shall encompass the followings:
1. Load adjustment programs to which the direct financial support policy is applied
a) Load reduction program;
b) Emergency load reduction program.
These load adjustment programs shall be subject to provisions laid down in the Appendix 1A hereto attached.
2. Load adjustment programs to be implemented through electricity pricing mechanisms
a) Program for creating two-tiered electricity price schedule;
b) Program for creating real-time maximum electricity price schedule.
Details of these load adjustment programs through electricity pricing mechanisms shall be subject to provisions laid down in the Appendix 1B hereto attached.
3. Load adjustment programs to be implemented through non-commercial preferential policies
Details of these load adjustment programs implemented through non-commercial preferential policies shall be subject to provisions laid down in the Appendix 1C hereto attached.
4. Voluntary load adjustment programs
Details of these voluntary load adjustment programs shall be subject to provisions laid down in the Appendix 1C hereto attached.
5. In addition to load adjustment programs referred to in Clause 1, 2, 3 and 4 of this Article, the Vietnam Electricity Corporation and its subsidiaries implementing load adjustment programs shall have the option of studying, proposing other load adjustment programs and presenting them to the Ministry of Industry and Trade for its assessment and grant of its decision.
Article 14. Customers participating in load adjustment programs
1. Based on contents of each load adjustment program, infrastructure conditions and business operations of customers, they shall make their decision to select and register load adjustment programs that they wish to take part in.
2. When taking part in load adjustment programs, they shall be required to assume the following responsibilities:
a) Collaborate with and provide adequate information for the entity implementing load adjustment programs to facilitate its assessment of capability of such customer to make load adjustment;
b) Negotiate and enter into the contract for participation in the load adjustment program with the entity implementing load adjustment program;
c) Make load adjustment under terms and conditions of the contract for participation in the load adjustment program that they have signed.
Article 15. Load adjustment service providers
Load adjustment service provider shall have the following rights and responsibilities:
1. Act on behalf of a single customer or a group of customers to negotiate and conclude a contract with the electricity seller to meet requirements for making load adjustment on a large scale.
2. Act on behalf of the principal customer to discharge that customer s obligations defined in load adjustment programs.
3. Gain benefits from participation in implementation of load adjustment programs as agreed upon with the customer.
4. Exercise rights and comply with obligations specified in the contract for provision of load adjustment services.
Article 16. Incentive to implement load adjustment programs
1. Customers participating in load adjustment programs shall be entitled to:
a) Incentive sums per electricity load or capacity that they have reduced after making load adjustment events take place;
b) Advantages given through electricity pricing mechanisms;
c) Priority policies for improvement of reliability in power supply and quality of customer services, depending on actual conditions of the power system.
2. Customers participating in a load adjustment program shall be entitled to incentives which are specific to that load adjustment program that they have registered and implemented, and which are specifically agreed upon in the contract for participation in that load adjustment program.
3. Incentive policies referred to in Point a and b Clause 1 of this Article shall be subject to regulations enforced by competent authorities.
Section 2. PROCESSES FOR IMPLEMENTATION OF LOAD ADJUSTMENT PROGRAMS
Article 17. Processes for implementation of load adjustment programs
1. Load adjustment programs to which the direct financial support policy is applied shall be implemented by taking the following main steps:
a) Customers register and sign the contract for participation in load adjustment programs;
b) The entity implementing load adjustment program develops plans and calculates the baseline load for participating customers as well as cooperates with them in making a load adjustment event take place;
c) The entity implementing load adjustment programs calculates amount of electrical power that has been reduced and incentive sums given to customers in a load adjustment event.
2. Load adjustment programs implemented through electricity pricing mechanisms and priority policies for improvement of power supply reliability and customer service quality shall follow the following steps:
a) Customers register for participation in load adjustment programs;
b) The entity implementing load adjustment program collaborates with customers in making load adjustment programs take place.
Article 18. Registration for participation in load adjustment programs
1. Customers shall register for participation in load adjustment programs with the entity implementing load adjustment programs.
2. The entity implementing load adjustment program shall be responsible for primarily assessing customer’s registration information, making a decision to accept their registration or give them more advice on their capability to participate in a load adjustment program;
3. Where customers are judged to be capable of participating in these programs after preliminary assessment steps have been taken, the entity implementing load adjustment program shall be responsible for collaborating with customers in conducting a survey or field inspection at their business establishments.
4. Upon completing such survey or field inspection at customers’ business establishments, the entity implementing load adjustment programs and customers shall negotiate and conclude the contract for participation in load adjustment program. The contract for participation in the load adjustment program to which financial incentive policies are applied shall be made by using the sample contract given in the Appendix 2 hereof.
5. After customers and the entity implementing load adjustment program enter into the contract for participation in load adjustment programs, the entity shall be responsible for keeping all updated information of customers in the load adjustment program control system.
Article 19. Formulation of the load adjustment plan and implementation of load adjustment events
1. On the basis of the plan for implementation of load adjustment program referred to in Section 2 Chapter II hereof, the updated approach to operation of the power system and at the request of the load dispatch entity, the entity implementing load adjustment program shall be responsible for establishing the plan, verifying and assessing capability of implementing load adjustment events, based on the followings:
a) Data stored in the load adjustment program control system;
b) Detailed terms and conditions of the contract for participation in load adjustment program.
2. The entity implementing load adjustment program shall make a decision on implementation of load adjustment events and calculate the baseline load of customers participating in load adjustment programs as per Article 20 hereof.
3. Before the proposed date on which a load adjustment event may take place, the entity implementing load adjustment program shall be responsible for sending notification of load adjustment event and the baseline load for such event which has been calculated (if any) to the customer participating in a load adjustment program. Forms and contents of such notification shall be specified in the contract for participation in load adjustment program with the customer.
4. The entity implementing load adjustment program shall be responsible for sending notification of the start and end date of load adjustment event to the customer participating in the load adjustment program.
5. After end of the load adjustment program, the entity implementing load adjustment program shall be responsible for calculating electricity capacity and load which are reduced, and incentive sums given to customers (if any).
Article 20. Calculation of the baseline load for customers participating in load adjustment programs
1. The entity implementing load adjustment program shall be responsible for calculating the baseline load for the load adjustment event according to the method referred to in the process for calculation and informing the baseline load to customers participating in load adjustment programs enforced by the Electricity Regulatory Authority.
2. The entity implementing load adjustment program shall be responsible for updating, on a daily basis, measurement data received from electronic electricity meters of customers participating in load adjustment programs at the cycle of 30 minutes/time and storing them in the database as well as the load adjustment program control system.
3. The entity implementing load adjustment program shall be responsible for checking uniformity of time shown on electronic electricity meters of customers participating in load adjustment programs with time shown on the system for collection and storage of measurement data.
4. After finishing calculation of the baseline load of customers participating in load adjustment programs, the entity implementing load adjustment program shall be responsible for sending a notification of results of calculation of the baseline load to customers as agreed upon in the contract for participation in load adjustment program.
Article 21. Calculation of load which is reduced and incentive sum given to customers in a load adjustment event
1. The entity implementing load adjustment program shall be responsible for collecting, checking, synthesizing and storing data in the load adjustment program control system for calculation of reduced capacity and load of customers participating in a load adjustment event.
2. After checking that all data are adequate, the entity implementing load adjustment program shall calculate the reduced level of capacity, load and incentive sum (if any) given to participating customers according to the plan which has been agreed upon in the contract for participation in load adjustment program.
3. The entity implementing load adjustment program shall be responsible for informing the results of calculation of reduced load, capacity and incentive sum (if any) to participating customers.
4. Participating customers shall be responsible for checking and confirming such results as the basis for the implementing entity’s payment of incentive sums (if any).
Chapter IV
SUPERVISION, ASSESSMENT AND REPORTING OF RESULTS OF IMPLEMENTATION OF LOAD ADJUSTMENT PROGRAMS
Article 22. Supervision and assessment of implementation of load adjustment programs
1. The Electricity Regulatory Authority shall be responsible for supervision and assessment of implementation of load adjustment programs
2. The entity implementing load adjustment programs shall be responsible for storing information and data for supervision and assessment of implementation of load adjustment programs, including the following contents:
a) Customer’s application documents for registration for participation in load adjustment programs;
b) Contract for participation in load adjustment program between the entity implementing load adjustment program and customers participating in load adjustment programs;
c) Contract for provision of load adjustment service between the power distribution entity and the load adjustment service provider;
d) Notifications of the baseline load and implementation of load adjustment events, sent to customers;
dd) Measurement data used for calculation of reduced electricity capacity and load of customers participating in each load adjustment event;
e) Statistical data of the power system under its jurisdiction available on the date before, during and after the date on which a load adjustment event takes place, e.g. those about capacity, electrical power, load factors and load-carrying level of the power grid;
g) Reports on results of calculation and payment of incentive sums to customers.
Article 23. Reporting of results of implementation of load adjustment programs
1. Before the 31stof January every year, the Power General Corporation shall report to the Electricity Regulatory Authority, the Vietnam Electricity Corporation on and inform the national load dispatch entity of results of implementation of load adjustment programs in the previous year, including the following contents:
a) Details of load adjustment programs which have been implemented: objectives, contents and scope of these programs;
b) Details of pricing schedule and incentive sum or other incentive policies applied to customers participating in load adjustment programs;
c) Statistical and general report on results of load adjustment events already implemented in the preceding year;
d) General information about actual incentive sums for implementation of each load adjustment program in a year;
dd) Comparison between objectives and results of program implementation; program effectiveness; proportion (%) of capacity reduced in load adjustment events to power system capacity if there are none of load adjustment programs.
2. Before the 10thof every month, the Electricity General Company of Hanoi and Ho Chi Minh city and provincial Electricity Companies shall be responsible for compiling results of implementation of load adjustment programs into a general report on operation of the power system in the preceding month and submitting it to the relevant Department of Industry and Trade, including the following contents:
a) Statistical and general report on results of load adjustment events already implemented in the preceding month;
b) General information about actual incentive sums for implementation of each load adjustment program in the preceding month.
3. Before the 15thof every month, the Electricity General Company shall be responsible for compiling results of implementation of load adjustment programs into a general report on operation of the power system in the preceding month and submitting it to the Electricity Regulatory Authority, Vietnam Electricity Corporation as well as notifying the national load dispatch entity, including the following contents:
a) Statistical and general report on results of load adjustment events already implemented in the preceding month;
b) General information about actual incentive sums for implementation of each load adjustment program in the preceding month.
Chapter V
IMPLEMENTING PROVISIONS
Article 24. Implementationprovisions
1. The Electricity Regulatory Authority shall be responsible for providing guidance on and carrying out inspection of compliance with this Circular.
2. The Vietnam Electricity Corporation, Electricity General Company and Electricity Company shall be responsible for disseminating contents, objectives and benefits of load adjustment programs issued together with this Circular to power customers within their jurisdiction.
3. Within duration of 03 months from this Circular’s entry into force, the Vietnam Electricity Corporation shall be responsible for preparing the guide to procedures for implementation of load adjustment programs and submitting it to the Electricity Regulatory Authority for publication, including:
a) Procedures for registration for participation in load adjustment programs;
b) Procedures for calculation and notification of the baseline load for customers participating in load adjustment programs;
c) Procedures for implementation of load adjustment events;
d) Procedures for calculation of reduced load and incentive sum given to customers after they completely implement load adjustment events.
Article 25. Entry into force
1. This Circular takes effect on January 2, 2018.
2. In the course of implementation of this Circular, if there is any difficulty that may arise, entities concerned are advised to send feedbacks directly to the Electricity Regulatory Authority for its consideration and decision within its jurisdiction or for its reporting to the Ministry of Industry and Trade to give its solutions./.
