Circular No. 23/2010/TT-BCT of May 20, 2010, on the import of salt
Pursuant to the Government’s Decree No. 189/2007/ND-CP of December 27, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 12/2006/ND-CP of January 23, 2006, detailing the Commercial Law regarding international goods trading and goods trading agency, processing and transit with foreign parties;
In furtherance of the Prime Minister’s instructions in Official Letter No. 681/TTg-KTTH of April 27, 2010, on the administration of salt import in 2010;
The Minister of Industry and Trade provides for the import of salt as follows:
Article 1. Scope of regulation
1. This Circular provides for the import of salt by traders for production and trading on the domestic market.
2. The import of salt in the following cases is not regulated by this Circular and must comply with current regulations:
a/ Salt which is temporarily imported for re-export, temporarily exported for re-import, transferred from/to border gate or transited.
b/ Salt imported for export production or processing of goods for foreign traders..
Article 2. Management of salt import
1. From the effective date of this Circular, traders possessing licenses to import salt based on tariff quotas may only import salt of the categories with HS codes 2501.00.90.90, 2501.00.41.20 and 2501.00.49.20 (in the Export Tariff and Import Tariff promulgated by the Ministry of Finance) and must satisfy technical standards on salt specified in Appendix No. 01 to this Circular. The certification of satisfaction of technical standards on salt complies with guidance of the Ministry of Agriculture and Rural Development.
2. Salt of all categories under heading 2501 (in the Export Tariff and Import Tariff promulgated by the Ministry of Finance) imported in excess of tariff quotas before import contracts are signed is subject to quality certification of the Ministry of Agriculture and Rural Development.
Article 3. Effect
1. This Circular takes effect on June 1, 2010, through December 31, 2010.
2. This Circular does not regulate lots of salt for which import contracts have been signed and which satisfy either of the following conditions:
a/ They had been loaded onto vehicles, with the date of loading indicated in the bill of lading (for lots transported by sea, railway or air) or the date of arrival at a border gate (for lots transported by road), before June 10, 2010.
b/ Letters of credit had been opened for them or their payment documents had been made before June 10, 2010.
