CIRCULAR
Prescribing the rates and the collection, remittance, management and use of charges for exploiting and using data on environment

Pursuant to the Law on Charges and Fees dated November 25, 2015;
Pursuant to the Law on Hydro-meteorology dated November 23, 2015;
Pursuant to the Government’s Decree No. 120/2016/ND-CP dated August 23, 2016 detailing and guiding the implementation of a number of Articles of the Law on Charges and Fees;
Pursuant to the Government’s Decree No. 38/2016/ND-CP dated May 15, 2016 on detailing a number of Articles of the Law on Hydro-meteorology;
Pursuant to the Government’s Decree No. 73/2017/ND-CP dated June 14, 2017 on collection, management and use of data on natural resources and environment;
Pursuant to the Government’s Decree No. 87/2017/ND-CP dated July 26, 2017 on defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Department of Tax Policy;
The Minister of Finance hereby promulgates the Circular on prescribing the rates and the collection, remittance, management and use of charges for exploiting and using data on environment.
Article 1. Scope of regulation
1. This Circular prescribes the rates and the collection, remittance, management and use of charges for exploiting and using data on environment.
2. This Circular does not regulate the exploitation and use of data on environment of the state agencies for the purposes as prescribed in Clause 5, Article 32 of the Law on Hydro-meteorology, Article 23 of the Government s Decree No. 38/2016/ND-CP dated May 15, 2016 on detailing a number of Articles of the Law on Hydro-meteorology.
Article 2. Subjects of application
1. Charge payers that are agencies, organizations and individuals;
2. Charge collectors;
3. Other agencies, organizations and individuals related to the exploitation and use of data on environment and the collection, remittance of charges.
Article 3. Charge collectors and charge payers
1. Charge collectors include:
a) Centre for Environmental Information and Data of Vietnam Environment Administration (Ministry of Natural Resources and Environment);
b) Agencies assigned to provide information and data on environment by Ministries and ministerial-level agencies;
c) The Department of Natural Resources and Environment of provinces and centrally-run cities.
2. Agencies, organizations and individuals submitting dossiers of request for providing information and data on environment at agencies and units as prescribed in Clause 1 of this Article must pay charges for exploitation and use of data on environment.
Article 4. Charge rates
1. Charge rates for exploiting and using data on environment are prescribed in the Tariff attached to this Circular.
2. The charge rate for exploiting and using data on environment which is equal 70% of the rate prescribed in the Tariff issued together with this Circular, shall be applied from May 26, 2020 to the end of December 31, 2020.
Article 5. Declaration and remittance of charges
1. Charge payers shall directly remit charges to the charge collectors or remit into the charge collectors’ accounts of charges to be remitted into the state budget, opened at the State Treasury. In case the charge collectors collect charges in the mode of non-cash payment, the remittance of charges shall be carried out in accordance with the charge collectors’ notices.
2. By the 5thevery month at the latest, charge collectors shall deposit the charge amounts collected in the previous month into an account of charges and charges to be remitted into the state budget, opened at the State Treasury.
3. Charge collectors shall declare and remit the collected charge amounts on a monthly basis and make final accounts on an annual basis in accordance with Clause 3, Article 19, and Clause 2, Article 26, of the Minister of Finance’s Circular No. 156/2013/TT-BTC dated November 06, 2013 on guiding the implementation of a number of Articles of the Law on Tax Administration, the Law on amending and supplementing a number of Articles of the Law on Tax Administration, and the Government’s Decree No. 83/2013/ND-CP dated July 22, 2013.
Article 6. Management and use of charges
1. Charge collectors being public non-business units may retain 70% of the total collected charge amount for expenses as prescribed in Article 5 of the Government s Decree No. 120/2016/ND-CP dated August 23, 2016 on detailing and guiding the implementation of a number of Articles of the Law on Charges and Fees, and remit the remaining 30% into the state budget according to the corresponding chapters, items and sub-items of the State Budget Index.
2. Charge collectors being State agencies shall fully remit the collected charge amounts into the state budget. Expenses for data provision and charge collection activities shall be included in state budget estimates of charge collectors based on state budget expenditure norms under regulations.
Article 7. Implementation organization and implementation provisions
1. This Circular takes effect on May 26, 2020.
2. Other matters related to the collection, remittance, management and use of charges, charge receipts, and publicity of the regulations on charge collection which are not mentioned in this Circular must comply with the Law on Charge and Fees; the Government’s Decree No. 120/2016/ND-CP dated August 23, 2016, on detailing and guiding the implementation of a number of Articles of the Law on Charges and Fees; the Minister of Finance’s Circular No. 156/2013/TT-BTC dated November 06, 2013, on guiding the implementation of a number of Articles of the Law on Tax Administration, the Law on amending and supplementing a number of Articles of the Law on Tax Administration, and the Government’s Decree No. 83/2013/ND-CP dated July 22, 2013; the Minister of Finance’s Circular No. 303/2016/TT-BTC dated November 15, 2016, on guiding the printing, issuance, management and use of different types of receipts of charges and fees belonging to the state budget.
3. In case referential legal normative documents in this Circular are amended, supplemented or replaced, the newly amended, supplemented or replaced documents shall be applied.
4. Any difficulties arising in the course of implementation of this Circular should be promptly reported to the Ministry of Finance for studying and guidance./.
