Circular No. 22/2018/TT-BCT dated August 21, 2018 of the Ministry of Industry and Trade on providing guidance on pilot auctions for sugar import quotas in 2018
Pursuant to the Government s Decree No. 98/2017/ND-CP dated August 18, 2017, on defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government s Decree No.69/2018/ND-CP dated May 15, 2018 on guidelines for the Law on Foreign Trade Management;
Pursuant to the Government s Decree No. 62/2017/ND-CP dated May 16, 2017 elaborating on certain articles regarding measures for enforcement of the Law on Property Auctions;
Pursuant to the Government s Decree No. 151/2017/ND-CP dated December 26, 2017 elaborating on certain articles of the Law on Management and Use of Public Property;
Upon the request of the Director of the Import and Export Department;
The Minister of Industry and Trade hereby issues the Circular providing guidance on pilot auctions for sugar import quotas in 2018.
Article 1. Scope of adjustment
This Circular provides for sugar import quotas and principles of pilot auctions for sugar import quotas in 2018.
Article 2. Subjects of application
1. Tradespersons directly using sugar as materials in the production process and those who use crude sugar for production of refined sugar.
2. Individuals and organizations related to the import of sugar according to the specified tariff quotas in 2018.
Article 3. Number of sugar import quotas at auction in 2018
The amount of imported sugar to be auctioned (HS code 17.01) according to tariff quotas in 2018 shall be 94,000 tons.
Article 4. Auctioning principles
1. The auction of sugar import quotas in 2018 shall be conducted under the control of the Board of pilot auction for sugar import quotas in 2018.
2. Principles, processes and procedures for the property auction shall be subject to legislative regulations on auction and shall agree with the nature of property put up for auction.
3. The Ministry of Industry and Trade shall establish the Board of pilot auction for sugar import quotas in 2018. The Chairperson of the auction Board shall issue regulations on pilot auction of sugar import quotas in 2018.
Article 5. Import procedures
1. After obtaining the review report on the auction results prepared by the auction Board, the Ministry of Industry and Trade shall issue the written notification of assignment of the right to use a sugar import quota to the auction winning tradesperson.
2. When completing sugar import procedures, in addition to implementing current regulations, tradespersons shall be required to submit the written notification of assignment of the right to use sugar import quota, issued by the Ministry of Industry and Trade to the customs authority where import procedures are implemented in accordance with customs legislation.
Article 6. Effect
This Circular takes effect from August 21, 2018 to December 31, 2018./.
