CIRCULAR

On repealing a number of article or the entire legal documents on business investment criteria issued by the Ministry of Construction or join-issuing

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015;

Pursuant to the Law on Investment dated November 26, 2014;

Pursuant to the Govenrment’s Decree No. 34/2016/ND-CP on detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents dated May 14, 2016;

Pursuant to the Govenrment’s Decree No. 118/2015/ND-CP on detailing and guiding the implementation of a number of articles of the Investment Law dated November 12, 2015;

Pursuant to the Govenrment’s Decree No.62/2013/ND-CP on defining the functions, tasks, powers and organizational structure of the Ministry of Construction dated June 25, 2013;

At the proposal of the Head of Department of Legal Affairs;

The Minister of Construction promulgate the Circular on repealing a number of article or the entire legal documents on business investment criteria issued by the Ministry of Construction or join-issuing

Article 1. To repeal a number of legal documents on business investment criteria

1. To repeal the Joint Circular No. 1529/1998/TTLT-BKHCNMT-BXD dated October 17, 1998 of the Ministry of Science Technology and Environment and the Ministry of Construction on guiding environmental protection requirements in the use of asbestos in the manufacture of products and materials and construction activities.

2. To repeal the Circular No. 11/2007/TT-BXD dated December 11, 2007 of the Minister of Construction on guiding the implementation of the Government’s Decree No. 124/2007/ND-CP dated July 31, 2007 on management of construction materials.

3. To repeal the Decision No. 27/2000/QD-BXD dated December 08, 2000 of the Minister of Construction on promulgate the List of criteria on construction.

4. To repeal the Direction No. 02/2008/CT-BXD dated March 27, 2008 of the Minister of Construction on improvement the labor safety and labor hygiene guarantee measurement in construction units.

Article 2. To repeal a number of article in legal documents on business investment criteria

1. To repeal Article 6 of the Circular No. 12/2009/TT-BXD dated June 24, 2009 of the Minister of Construction on detailing the issuance of construction practice certificates.

2. To repeal Article 8 of the Circular No. 22/2009/TT-BXD dated July 06, 2009 of the Minister of Construction on detailing the qualification criteria in construction.

3. To repeal Article 3 of the Circular No. 25/2009/TT-BXD dated July 29, 2009 of the Minister of Construction guiding on training, retraining for professional skills of construction investment projects management and construction supervision.

4. To repeal Article 3 of the Circular No. 05/2010/TT-BXD dated May 26, 2010 of the Minister of Construction guiding on training, retraining for professional skills of construction valuation and granting certificates of construction valuation engineer.

5. To repeal Article 5 of the Circular No. 21/2010/TT-BXD dated December 16, 2010 of the Minister of Construction on guiding regulation conformity certification and announcement for construction material products and goods.

6. To repeal Article 4 of the Circular No. 01/2011/TT-BXD dated January 01, 2011 of the Minister of Construction on guiding the strategic environmental assessment in construction and urban plans.

7. To repeal Article 7 of the Circular No. 03/2011/TT-BXD dated April 06, 2011 of the Minister of Construction on guiding the inspection, assessment and certification of full satisfaction of force bearing safety conditions and certification of quality standard conformity of construction works.

8. To repeal Clause 1 Article 1, Clause 2 Article 2 of the Circular No. 06/2011/TT-BXD dated June 21, 2011 of the Minister of Construction on amending and supplementing a number of article on administrative procedures on construction, construction planning architecture to implement the Decree No. 55/NQ-CP dated December 14, 2010 on simplicity administrative procedures under management of the Ministry of Construction.

9. To repeal Point c Article 2 of the Circular No. 06/2013/TT-BXD dated May 13, 2015 of the Minister of Construction on guiding the content of urban design.

10. To repeal Clause 1 Article 28 of the Circular No. 02/2016/TT-BXD dated February 15, 2016 of the Minister of Construction on regulation on management and use of condominiums.

Article 3. Effect

1. This Circular takes effect on the signing date.

2. Relevant agencies, individuals and organizations shall implement this Circular.-
