CIRCULAR
DEFINING THE QUALITY MANAGEMENT FOR WIRE AND CABLE INSULATED WITH POLYVINYL CHLORIDE WITH RATED VOLTAGE UP TO AND EQUAL 450/750V
Pursuant to the Law on Quality of products and goods dated November 21, 2007;
Pursuant to Decree No.28/2008/ND-CP dated March 14, 2008 of the Government regulating functions, duties, powers and organizational structure of Ministry of Science and Technology;
Pursuant to the Decree No.132/2008/ND-CP dated December 31, 2008 of the Government detailing the implementation of some Articles of the Law on Product Quality of products and goods;
Pursuant to Circular No.21/2009/TT-BKHCN dated September 30, 2009 of the Minister of Science and Technology issuing National Technical Regulations QCVN 4:2009/ BKHCN on safety for electronic and electrical equipment;
Minister of Science and Technology regulates the quality management for wire and cable insulated with polyvinyl chloride with rated voltage up to and equal 450/750v as follows:
Chapter 1.
GENERAL PROVISIONS
Article 1. Scope of governing
This Circular prescribes the quality management for wire and cable insulated with polyvinyl chloride with rated voltage up to and equal 450/750V (hereinafter referred to as PVC insolated wire and cable) specified in national technical regulations QCVN 4:2009/BKHCN on safety for electrical and electronic equipment, issued together with Circular No.21/2009/TT-BKHCN dated September 30, 2009 of the Minister of Science and Technology.
Article 2. Subjects of application
1. This Circular applies to the following subjects:
a) Organizations and individuals producing, importing and trading wire and cable insulated with PVC;
b) The conformity assessment organizations designated to perform certification of electrical and electronic equipment appropriate to national technical regulations QCVN 4:2009 / BKHCN;
c) The agencies of state management on quality of concerned products, goods.
2. This Circular does not apply to:
a) Wire and cables insulated with PVC which were built-in in electrical equipment;
b) Wire and cables insulated with materials different from PVC material.
Chapter 2.
QUALITY MANAGEMENT FOR WIRE AND CABLE INSULATED WITH PVC
Article 3. Quality management measures
1. All types of wire and cable insulated with PVC must be managed on quality in accordance with provisions of the national technical regulations QCVN 4:2009/BKHCN.
2. For wire and cable insulated with polyvinyl chloride with nominal cross-section of the conductor of nominal cross-section band of the conductor with rated voltage up to and equal 450/750V specified in respective national technical regulations in national technical regulations QCVN 4:2009/BKHCN, they must be performed the conformity assessment according to national technical regulations QCVN 4:2009 / BKHCN.
The determination of the nominal value for wire and cable insulated with PVC defined in this Clause to assess the conformity according to national technical regulations QCVN 4:2009/BKHCN shall comply with technical documents on the method of determining the nominal valuesfor wire and cable insulated with polyvinyl chloride with rated voltage up to or equal 450/750V issued by the Directorate for Standards, Metrology and Quality.
3. Wire and cable insulated with polyvinyl chloride must be labeled according to respective national standards stipulated in the national technical regulations QCVN 4:2009/BKHCN and provisions of law on goods labels prior to the circulation in the market.
Article 4. Conditions for wire and cable insulated with PVC to be circulated on the market
When wire and cable insulated with PVC are circulated on the market, they must be labeled according to the provisions of the legislation on goods labeling; must be certified regulations conformity, affixed mark of regulations conformity (CR) under the provisions of law on technical standards and regulations and legislation on the quality of products and goods.
Chapter 3.
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS, MANAGEMENT AGENCIES
Article 5. Responsibilities of organizations and individuals
1. To comply with regulations on quality management for wire and cable insulated with PVC in accordance with the provisions of this Circular and other relevant laws.
2. To perform statistics and reports on the remaining number of wire and cable insulated with PVC under the guidance of the Branches for Standards, Metrology and Quality of provinces, cities where the organizations or individuals make business registration. The time limit for completion of the statistics, reports is before March 01, 2013.
3. To be subject to examination, inspection on quality of products and goods as prescribed by law.
Article 6. The responsibilities of management agencies
1. Responsibilities of the Directorate for Standards, Metrology and Quality
a) To conduct public information, dissemination, and professional guidance of management of quality for wire and cable insulated with PVC as prescribed in this Circular.
b) To issue technical documents on the method of determining the nominal value for wire and cable insulated with polyvinyl chloride with the rated voltage of up to and equal 450/750V to assess the suitability of the wire and cable insulated with PVC prescribed in Clause 2, Article 3 of this Circular.
c) To examine, inspect and handle violations of the law for wire and cable insulated with PVC as prescribed in this Circular and other concerned existing regulations.
2. Responsibilities of the Branches for Standards, Metrology and Quality
a) To receive registration and manage the statement of regulations conformity for wire and cable insulated with PVC of producing organizations and individuals; receive registration documents for examining quality of wire and cable insulated with PVC of importing organizations and individuals.
b) To guide the trading and importing, producing organizations and individuals to make statistics and reports on the remaining number of wire and cable insulated with PVC prescribed in Clause 2, Article 3 of this Circular; to make statistics, synthesize and report to the Department of Science and Technology and Directorate for Standards, Metrology and Quality before March 15, 2013.
c) To guide the importing, producing organizations and individuals to process and send dossiers to the conformity assessment organization stipulated to be guided the assessment of conformity with national technical regulations QCVN 4:2009/BKHCN and affixed mark of regulations conformity (CR) for the remaining wire and cable insulated with PVC provided for in Clause 2, Article 3 of this Circular according to statistical quantity specified in Clause 2, Article 5 of this Circular.
d) To organize, co-organize with the inspectorate, market management, public security forces in the inspection of the quality of wire and cable insulated with PVC in the areas as prescribed in this Circular and other concerned current regulations.
Chapter 4.
ORGANIZATION OF IMPLEMENTATION
Article 7. Effect
This Circular takes effect from February 01, 2012.
Article 8. Transitional provisions
1. Since March 01, 2013, wire and cable insulated with PVC which are not specified in the respective national standards in the national technical regulations QCVN.
4:2009/BKHCN shall not be produced, imported.
2. From January 01, 2014, wire and cable insulated with PVC with nominal cross-section of the conductor which are not specified in the respective national standards in national technical regulations QCVN 4:2009/BKHCN shall not be circulated on the market.
Article 9. Organization of implementation
1. Directorate for Standards, Metrology and Quality is responsible for guiding, implementing this Circular.
2. Where the legal documents, national technical regulations cited in this Circular are amended, supplemented, or replaced, it shall be complied with the new documents.
3. During the implementation, if any problems arise, agencies, organizations, and individuals should promptly reflect to the Ministry of Science and Technology for consideration and settlement.
