SUMMARY

From 2020-2022, the import tariff quota for unmanufactured tobacco is 500 tons/year

On August 28, 2020, the Ministry of Industry and Trade issues the Circular No. 20/2020/TT-BCT on prescribing the application of import tariff quotas for unmanufactured tobacco and poultry eggs originated from member states of the Eurasian Economic Union in 2020, 2021 and 2022.

Accordingly, to apply the import tariff quota for unmanufactured tobacco and poultry eggs originated from member states of the Eurasian Economic Union under the Vietnam - Eurasian Economic Union Free Trade Agreement.

To be specific: The import tariff quota for poultry eggs in 2020, 2021 and 2022 is 9,724 dozens, 10,210 dozens and 10,721 dozens, respectively; The import tariff quota for unmanufactured tobacco in 03 years (2020, 2021 and 2022) is 500 tons/year.

Noticeably, imports must have certificates of origin (C/O form EAV) provided by competent agencies of state members of the Eurasian Economic Union in accordance with current regulations.

This Circular takes effect from October 15, 2020, to the end of December 31, 2022.

CIRCULAR

Providing the application of the 2020, 2021 and 2022 import tariff quotas of raw tobacco and poultry eggs originating in Eurasian Economic Union’s member states[1]

 

Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

In implementation of the Vietnam-Eurasian Economic Union Free Trade Agreement ratified by the President of the Socialist Republic of Vietnam;

At the proposal of the Director General of the Agency of Foreign Trade,

The Minister of Industry and Trade promulgates the Circular providing the application of the 2020, 2021 and 2022 import tariff quotas of raw tobacco and poultry eggs originating in Eurasian Economic Union’s member states.

 

Article 1. Scope of regulation

Import tariff quotas for raw tobacco and poultry eggs originating in Eurasian Economic Union’s member states shall be applied in accordance with the Vietnam-Eurasian Economic Union Free Trade Agreement.

Article 2. Subjects of application

This Circular applies to traders importing under tariff quotas raw tobacco and poultry eggs from Eurasian Economic Union’s member states and other related organizations and individuals.

Article 3. Commodities and import quota quantities

1. The HS codes and 2020, 2021 and 2022 import quota quantities of commodity groups subject to tariff quotas specified in Article 1 of this Circular must comply with the Appendix promulgated together with this Decree.

2. Imports must have certificates of origin issued by competent agencies of the Eurasian Economic Union’s member states (abbreviated as C/O form EAV) in accordance with current regulations.

Article 4. Subjects eligible for and allocation of import tariff quotas

1. Import tariff quotas for raw tobacco shall be allocated to traders that are licensed for cigarette production by the Ministry of Industry and Trade and wish to use imported raw tobacco for cigarette production.

2. Import tariff quotas for poultry eggs shall be allocated to traders with import demand.
