Circular 19/2021/TT-NHNN amending Circular No. 01/2014/TT-NHNN, prescribing the delivery and receipt, preservation and transportation of cash, precious assets and valuable papers

CIRCULAR

Amending and supplementing a number of articles of Circular No. 01/2014/TT-NHNN dated January 6, 2014, of the Governor of the State Bank of Vietnam, prescribing the delivery and receipt, preservation and transportation of cash, precious assets and valuable papers

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to the Government's Decree No. 40/2012/ND-CP dated May 02, 2012, on issue of money, and preservation and transportation of precious assets and valuable papers within the system of the State Bank, credit institutions and foreign bank branches;

Pursuant to the Government's Decree No. 16/2017/ND-CP dated February 17, 2017, defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Issuance and Vault Department;

The Governor of the State Bank of Vietnam promulgates the Circular amending and supplementing a number of articles of Circular No. 01/2014/TT-NHNN dated January 6, 2014, of the Governor of the State Bank of Vietnam, prescribing the delivery and receipt, preservation and transportation of cash, precious assets and valuable papers.

Article 1. Amending and supplementing a number of articles of Circular No. 01/2014/TT-NHNN dated January 6, 2014, of the Governor of the State Bank of Vietnam, prescribing the delivery and receipt, preservation and transportation of cash, precious assets and valuable papers

1. To amend and supplement Clause 1 Article 11 as follows:

“1. Cash delivery and receipt in a bundle which is enough 10 sheaves, with its seal remains intact or the money bag with its lead seal remains intact in the following cases:

a) Cash delivery and receipt within internal Transaction Bureau, the State Bank’s branches for cash which were put into circulation, except cases prescribed at Point c, g Clause 2 of this Article;

b) Cash delivery and receipt in denominations of VND 50,000 or more based on transfer orders between the Central vaults with Transaction Bureau, the State Bank’s branches and vice versa; among Central vaults; among the State Bank’s branches and vice versa, except cases prescribed at Point dd Clause 2 of this Article;

c) Cash delivery and receipt between the Transaction Bureau, the State Bank’s branches with credit institutions, branches of foreign banks and vice versa; among credit institutions, branches of foreign banks in provinces, cities.”

2. To add Points d, dd, e, g to Clause 2 Article 11 as follows:

“d) Delivery and receipt of cash whose par value does not exceed VND 20,000 based on transfer orders between the Central vaults with Transaction Bureau, the State Bank’s branches and vice versa; among Central vaults; among the State Bank’s branches and vice versa;

dd) Delivery and receipt of cash whose par value is VND 50,000 based on transfer orders between the Central vaults with the State Bank’s branches in Phu Tho, Nghe An, Binh Dinh, Vinh Long Provinces and vice versa; among Central vaults; among Central vaults; among the State Bank’s branches in Phu Tho, Nghe An, Binh Dinh, Vinh Long Provinces;

e) Delivery and receipt of cash within the Central vaults;

g) Delivery and receipt of cash within the State Bank’s branches in Phu Tho, Nghe An, Binh Dinh, Vinh Long Provinces when performing transfer orders.”

3. To amend and supplement Clause 1 Article 12 as follows:

“1. Counting cash that is delivered and receipted according to the transfer orders of the State Bank for the money already in circulation;

a) The Transaction Bureau, the State Bank’s branches (the State Bank’s branches in Phu Tho, Nghe An, Binh Dinh, Vinh Long Provinces shall comply with Point b of this Clause) organizing the reference count of sheets (pieces) of money received must set up the Reference count Councils as prescribed in Clause 3, Article 62 of this Circular. The reference count duration is 30 working days from the date of receiving money. The delivering unit shall assign its personnel to witness; in case of no witness, the delivering unit must send a written notice to the receiving unit.

Director of the Issuance and Vault Department shall consider and decide on extending the time of cash reference count based on transfer orders in cases of having objective reasons at the proposal of the Transaction Bureau or the State Bank’s branches.

b) The State Bank’s branches in Phu Tho, Nghe An, Binh Dinh, Vinh Long Province organize the reference count of sheets (pieces) of the amount of money used to spend on credit institutions, branches of foreign banks in provinces, cities. The Reference count Councils are set up as prescribed in Clause 3, Article 62 of this Circular and take responsibility for property safety supervision.

c) For the amount of money is not organize the reference count of sheets (pieces), the Transaction Bureau or the State Bank’s branches may deliver such bundles (bags) of money which its seals remain intact to credit institutions, branches of foreign banks within the same provinces or cities and have to assign persons to witness the money reference count by sheets (pieces) organized by the credit institutions, branches of foreign banks.”

4. To amend and supplement Point b Clause 2 Article 26 as follows:

“b) At other locations of Vault I, Director of the Issuance and Vault Department shall be entitled to authorize in writing a Deputy Director or Head of the Vault I to perform his/her task in managing cash, precious assets, valuable papers and vaults in a certain period. In case where the authorized person is absent, Director of the Issuance and Vault Department shall be entitled to authorize another Deputy Director or a Deputy Head of the Vault I in writing on a case-by-case basis.

5. To amend and supplement Clause 1 Article 48 as follows:

“1. The Issuance and Vault Department shall be responsible for organizing the transport of cash, precious assets and valuable papers from the establishments which printed or casted money, airports, harbors, stations to the Central vault; among the Central vaults; from the Central Vault to the vaults of State Bank’s branches and vice versa; among vaults of the State Bank’s branches.

In necessary cases, the Transaction Bureau, the State Bank’s branches shall appoint a person to escort and deliver, receive cash, precious assets and valuable papers at the Central Vault or another State Bank branch.

The State Bank’s branches in Phu Tho, Nghe An, Binh Dinh, Vinh Long Provinces shall be responsible for organizing the transport of cash, precious assets and valuable papers between the branches of Phu Tho, Nghe An, Binh Dinh, Vinh Long provinces and the Central vault; among the State Bank’s branches in provinces, cities in the region (according to the decision of the Governor of the State Bank in each period).”

Article 2. Implementation responsibilities

Chief of Office, Director of the Issuance and Vault Department, Heads of units affiliated to the State Bank of Vietnam, Directors of the State Bank of Vietnam’s branches in provinces/cities, credit institutions, branches of foreign banks shall implement this Circular.

Article 3. Implementation provisions

1. This Circular takes effect on January 08, 2022.

2. This Circular annuls Clauses 1, 2 Article 1 of the Circular No. 12/2017/TT-NHNN dated August 31, 2017 of the State Bank of Vietnam, on amending a number of articles of the Circular No. 01/2014/TT-NHNN dated January 06, 2014 by the Governor of The State Bank of Vietnam, on delivery, receipt, storage and transport of cash, precious assets and valuable papers./.
