SUMMARY

Additional works for passenger transport vehicles departing from stations

On July 15, 2022, the Ministry of Transport issues the Circular No. 17/2022/TT-BGTVT amending and supplementing a number of articles of the Minister of Transport's Circular No. 12/2020/TT-BGTVT dated May 29, 2020, providing regulations on the organization and management of by-automobile transport activities and road transport support services.

Accordingly, the Ministry of Transports adds works to be settled for vehicles when departing from stations as follows: Departure on time according to the operation chart announced by the route management agency. Escape tools must be equipped on the vehicle; fire prevention and fighting safety requirements for road motor vehicles prescribed in Decree No. 136/2020/ND-CP must be ensured.

Besides, provincial-level Departments of Transport shall manage and organize the printing of by-automobile transport business licenses, using the provided form; grant and re-grant by-automobile transport business licenses to the passenger and goods transport business units in localities. Concurrently, manage and organize the printing of badges and signboards according to forms or specific taxi badges of localities; grant and re-grant badges and signboards according to regulations.

This Circular takes effect from September 15, 2022.

CIRCULAR

Amending and supplementing a number of articles of the Minister of Transport's Circular No. 12/2020/TT-BGTVT dated May 29, 2020, providing regulations on the organization and management of by-automobile transport activities and road transport support services

 

Pursuant to the Law on Road Traffic dated November 13, 2008;

Pursuant to the Government’s Decree No. 10/2020/ND-CP dated January 17, 2020, providing by-automobile transport business and its conditions;

Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

At the request of the Director of the Department of Transportation and the Director General of the Directorate for Roads of Vietnam,

The Minister of Transport hereby promulgates the Circular amending and supplementing a number of articles of the Minister of Transport's Circular No. 12/2020/TT-BGTVT dated May 29, 2020, providing regulations on the organization and management of by-automobile transport activities and road transport support services.

 

Article 1. Amending and supplementing a number of articles of the Minister of Transport's Circular No. 12/2020/TT-BGTVT dated May 29, 2020, providing regulations on the organization and management of by-automobile transport activities and road transport support services

1. To add Point dd Clause 4 Article 6 as follows:

“d) Departure on time according to the operation chart announced by the route management agency.”.

2. To amend and supplement Clause 4 Article 20 as follows:

“4. Escape tools must be equipped on the vehicle; fire prevention and fighting safety requirements for road motor vehicles prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020, detailing a number of articles and measures to implement the Law on Fire Prevention and Fighting and the Law Amending and Supplementing a Number of Articles of the Law on Fire Prevention and Fighting, must be ensured.”

3. To amend and supplement Clause 1 Article 25 as follows:

“1. A paper or electronic transport order shall be self-issued by an enterprise or cooperative according to the form provided in Appendix 6 to this Circular. In addition to the required information specified in Appendix 6, an enterprise or cooperative may state on such transport order additional information in service of its management.

During the trip, the driver must carry a paper transport order or equip a device that can access to the electronic transport order content; and present the paper or electronic transport order upon request of the competent authorities.

The provision of information stated on the transport order shall comply with Clause 4 Article 51 of this Circular.”.

4. To amend and supplement Clause 2 Article 29 as follows:

“2. Escape tools must be equipped on the vehicle; fire prevention and fighting safety requirements for road motor vehicles prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020, detailing a number of articles and measures to implement the Law on Fire Prevention and Fighting and the Law Amending and Supplementing a Number of Articles of the Law on Fire Prevention and Fighting, must be ensured.”

5. To amend and supplement Point a Clause 6 Article 30 as follows:

“a) A paper or electronic transport order shall be self-issued by an enterprise or cooperative according to the form provided in Appendix 6 to this Circular. 6. To amend and supplement Clause 3 Article 38 as follows:

“3. Fire prevention and fighting safety requirements for road motor vehicles prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020, detailing a number of articles and measures to implement the Law on Fire Prevention and Fighting and the Law Amending and Supplementing a Number of Articles of the Law on Fire Prevention and Fighting, must be ensured.”

7. To amend and supplement Clause 7 Article 43 as follows:

“7. Escape tools must be equipped on the vehicle; fire prevention and fighting safety requirements for road motor vehicles prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020, detailing a number of articles and measures to implement the Law on Fire Prevention and Fighting and the Law Amending and Supplementing a Number of Articles of the Law on Fire Prevention and Fighting, must be ensured.”

8. To amend and supplement Clause 5 Article 46 as follows:

“5. Escape tools must be equipped on the vehicle; fire prevention and fighting safety requirements for road motor vehicles prescribed in the Government's Decree No. 136/2020/ND-CP dated November 24, 2020, detailing a number of articles and measures to implement the Law on Fire Prevention and Fighting and the Law Amending and Supplementing a Number of Articles of the Law on Fire Prevention and Fighting, must be ensured.”

9. To amend Clause 5 Article 62 as follow:

“5. Announcing the information structure, equipment, and order of checking information of QR codes on the badges.”.

10. To amend and supplement Clause 10 Article 63 as follows:

“10. Managing and organizing the printing of by-automobile transport business licenses, using the form provided in this Circular; granting and re-granting by-automobile transport business licenses to the passenger and goods transport business units in localities.”.

11. To amend and supplement Clause 11 Article 63 as follows:

“11. Managing and organizing the printing of badges and signboards according to the forms provided in this Circular or specific taxi badges of localities; granting and re-granting badges and signboards according to regulations.”.

Article 2. Effect

1. This Circular takes effect from September 15, 2022.

2. Chief Offices, Chief Inspectors of the Ministry, Directors General, the Directors of the Departments of Transport of provinces and centrally-run cities, heads of related agencies, organizations and individuals shall take responsibility for the implementation of this Circular./.
