CIRCULAR
Guiding the emulation and commendation of the banking sector
--------------------------
Pursuant to the Law on Emulation and Commendation dated November 26, 2003; the Law Amending and Supplementing a Number of Articles of the Law on Emulation and Commendation dated June 14, 2005; the Law Amending and Supplementing a Number of Articles of the Law on Emulation and Commendation dated November 16, 2013;
Pursuant to Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government, detailing the implementation of a number of articles of the Law on Emulation and Commendation;
Pursuant to Decree No. 16/2017/ND-CP dated February 17, 2017 of the Government, defining the functions, tasks, powers and organizational structure of the State Bank Vietnam;
At the proposal of the Director of the Emulation and Rewarding Department;
The Governor of the State Bank of Vietnam hereby promulgates the Circular guiding the emulation and commendation of the banking sector.
Chapter I
GENERAL PROVISION
Article 1. Scope of regulation
This Circular guides the emulation and commendation of the banking sector, which covers the following contents: the subject matter of the emulation and commendation; the organization of emulation movements; titles and criteria for emulation titles; commendation forms and criteria; commendation jurisdictions, commendation nomination procedures; conferment of emulation titles and commendation forms; emulation and commendation funds; the State management over emulation and commendation; Councils for Emulation and Commendation and Councils for Initiatives at all levels; rights and obligations of commended individuals and collectives.
Article 2. Subjects of application
Individuals and collectives of the State Bank of Vietnam (hereinafter referred to as the State Bank); credits institutions; branches of foreign banks; the Deposit Insurance of Vietnam; standing bodies of associations and enterprises managed by the State Bank; other individuals and collectives that have made direct and practical contributions to the banking sector.
Article 3. Collectives within the banking sector
1. For the State Bank
a) Large collectives are units under the State Bank, standing bodies of the Party and mass organizations at the headquarters of the State Bank;
b) Grassroots collectives are Departments and Offices under the Banking Supervision Agency; Sub-departments under Departments;
c) Small collectives are divisions (commissions) and their equivalents under collectives prescribed at Point a and Point b of this Clause.
2. For credits institutions, branches of foreign banks and the Deposit Insurance of Vietnam
a) Large collectives are Commercial Banks, the Vietnam Bank for Social Policies, the Cooperative Bank of Vietnam, the Deposit Insurance of Vietnam, branches of foreign banks, financial companies, finance leasing companies, microfinance institutions (other than subsidiaries of credits institutions);
b) Grassroots collectives are divisions (commissions), centers at the headquarters, branches, subsidiaries and equivalent units under the collectives prescribed at Point a of this Clause (other than microfinance institutions);
c) Small collectives are divisions (commissions), transaction offices and equivalent units under the collectives prescribed at Point b of this Clause.
3. For banking educational institutions
a) Large collectives are the Banking Academy and the Banking University of Ho Chi Minh City;
b) Grassroots collectives are divisions, faculties, departments, training centers and educational institutions, and units under the collectives prescribed at Point a of this Clause;
c) Small collectives are divisions (commissions), faculties, departments and equivalent units under the collectives prescribed at Point b of this Clause.
4. For enterprises managed by the State Bank
a) Large collectives are the National Banknote Printing Plant, the National Payment Corporation of Vietnam, the Vietnam Asset Management Company and other enterprises managed by the State Bank;
b) Grassroots collectives are divisions (commissions), workshops and equivalent units under the collectives prescribed at Point a of this Clause;
c) Small collectives are teams and equivalent units under the collectives prescribed at Point b of this Clause.
5. For standing bodies of associations managed by the State Bank
a) Large collectives are standing bodies of the Vietnam Banks Association, the Vietnam Association of People’s Credit Funds, the Vietnam Finance Leasing Association and other Associations managed by the State Bank;
b) Small collectives are divisions (commissions) and equivalent units under the collectives prescribed at Point a of this Clause.
Article 4. Principles for commendation
The principles for commendation within the banking sector shall comply with Article 3, Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government, detailing the implementation of a number of articles of the Law on Emulation and Commendation (Decree No. 91/2017/ND-CP) and the following regulations:
1. The Governor of the State Bank (hereinafter referred to as the Governor) shall only confer Certificates of Merit, or nominates collectives and individuals for State-level commendation once a year, unless they obtain extraordinary or thematic achievements.
2. Collectives and individuals shall not be commended or nominated for higher-level commendation if they are undergoing consideration for disciplinary actions by competent authorities, or being investigated, inspected or scrutinized since they show signs of violation or they are related to any written complaint or petition with verification thereof in progress.
3. Only credits institutions, branches of credits institutions, branches of foreign banks and individuals, who are Managers or Executive Officers of credit institutions, CEOs (Managing Directors) of branches of foreign banks that have bad debts at an acceptable ratio annually specified by the Governor, shall be commended or nominated for higher-level commendation.
4. Having a “Governor’s Certificate of Merit” (on any comprehensive achievement) shall be taken into consideration for nominating any collective or individual of the banking sector for the “Prime Minister’s Certificate of Merit”. For the collectives and individuals of the Banking Supervision Agency, the Banking Academy, the Banking University of Ho Chi Minh City, Party and mass organizations, having a “Governor’s Certificate of Merit” or a Certificate of Merit of any ministry, sector or Central-level mass organization (on any comprehensive achievement) shall be taken into consideration for the nomination above-mentioned.
5. Being recognized as a “Collective successfully completing its tasks” shall be taken into consideration for nominating any collective for the Title “Excellent Labor Team” conferred by a competent authority.
6. The time during which one can be nominated for another commendation shall start from when he/she/it obtained the previous achievement as recorded in the previous commendation decision. If the commendation decision did not to record the time the achievement was obtained, the time during another commendation can be nominated shall start from when the commendation decision was issued.
Article 5. Initiatives within the banking sector
1. Initiatives within the banking sector (hereinafter referred to as initiatives) mean newly created solutions or improved existing solutions applicable in the course of task performance, which may bring about practical benefits (economic efficiency or social benefits), improving the productivity, work quality and efficiency, including:
a) Managerial solutions mean approaches for the managing entities to administer the management to the managed entities in order to achieve certain goals at work;
b) Technical solutions mean technical means or methods to solve a definite task;
c) Operational solutions mean advice and proposals of work methods for the managing entities to help them solve the tasks effectively;
d) Applications of scientific, technical and technological advances means approaches, methods and measures of applying any known technical solution to actual banking operations.
2. Influence of initiatives
a) Initiatives with high efficiency and nationwide influence (hereinafter referred to as national-level initiatives) newly created solutions or improved existing solutions applicable in the banking sector, which bring about practical benefits throughout the country;
b) Initiatives that are effective and influential inside the banking sector (hereinafter referred to as sectorial-level initiatives) mean newly created solutions or improved existing solutions applicable in the banking sector, which bring about practical benefits for the banking sector;
c) Initiatives that are effective and have grassroots-level influence (hereinafter referred to as grassroots-level initiatives) mean newly created solutions or improved existing solutions applicable in any unit, which bring about practical benefits for such unit.
Chapter II
EMULATION AND EMULATION TITLES
Section 1
EMULATION AND ORGANIZATION OF EMULATION MOVEMENTS
Article 6. Types of emulation movements
1. Regular emulation means a type of emulation movements based on the functions, assigned tasks of collectives and individuals, which are launched to encourage them to well perform the daily, monthly, quarterly every year work of their agencies, organizations or units. The subject matter of the regular emulation includes individuals in a collective, collectives within the same agency, organization, or unit, or between agencies, organizations, and units with similar functions, tasks, and work characteristics.
The purposes, requirements, goals, and specific targets of the regular emulation movements shall be clearly defined before being launched in agencies, organizations, units, or in Emulation Blocks or Groupings, of which emulation agreements shall be signed. At the end of the working year, Heads of agencies, organizations, units, or Heads of the Emulation Blocks and Groupings shall review the emulation movements in between and consider the conferment of emulation titles.
2. Thematic (or intermittent) emulation means a type of emulation movements aimed at encouraging the good performance of a key task or a defined area within a certain period of time or those organized to promote the endeavor to complete any key, ad hoc, or urgent task by agencies, organizations, or units. The units shall only launch thematic (or intermittent) emulation movements when they can clearly define the time, purposes, requirements, targets, contents and approaches the tasks therewithin.
When reviewing or concluding thematic emulation movements within the banking sector, the units may confer themselves or nominate collectives and individuals with outstanding achievements for commendations, in which the highest commendation is the “Prime Minister’s Certificate of Merit” for movements being implemented in 03 years or more; and “Third-class Labor Order” for those in 05 years or more.
Article 7. Registration for emulation titles and signing of emulation agreements
1. Annually, the large collectives specified in Article 3 of this Circular (hereinafter referred to as the units) shall bear the responsibility for guiding every collectives and individuals within their ambit to register their target emulation titles, then make and send summaries of such registration using Form No. 01 attached to this Circular to the State Bank (via the Emulation and Rewarding Department) no later than February 28. Microfinance institutions shall send the summaries of registration of emulation titles to the State Bank’s branches in provinces and municipalities under the scope of their management.
2. Annually, Heads of the Emulation Blocks or Groupings shall host the signing of emulation agreements among units under the respective Emulation Blocks or Groupings and send the signed emulation agreements to the State Bank (via the Emulation and Rewarding Department) no later than February 28. The criteria, contents and measures to organize emulation movements shall be endorsed by the Emulation Blocks or Groupings for uniform implementation. The Emulation Blocks or Groupings shall be established by the respective authorities.
Article 8. Responsibilities for organizing the emulation movements
1. The Governor shall initiate, organize, and direct the emulation movements within the banking sector. The Emulation and Rewarding Department shall bear the responsibility for advising the Governor in initiating, organizing and directing emulation movements as well as for inspecting the implementation of emulation movements initiated by the Governor.
2. Heads of the units (heads of units under the State Bank; legal representatives of credits institutions, the Deposit Insurance of Vietnam, enterprises managed by the State Bank; CEOs (Managing Directors) of branches of foreign banks; Secretaries General of Associations managed by the State Bank) shall bear the responsibility for initiating, organizing, reviewing and concluding emulation movements within their ambit.
3. Heads of Emulation Blocks and Groupings shall bear the responsibility for initiating emulation movements and inspecting the implementation thereof among the units under the respective Emulation Blocks and Groupings as well as reviewing and concluding the emulation movements.
4. Execution Committees of Party and mass organizations at all levels inside the banking sector shall coordinate closely Heads of the units to lead the implementation of emulation movements.
5. News and press agencies inside the banking sector shall increase the coverage of the emulation and commendation; correctly report the results of emulation movements and the commendation work; discover individuals and collectives that have excellent achievements in the emulation movements to set examples or nominate them to the Councils for Emulation and Commendation at all levels for commendation; counter and criticize acts of violating the law provisions on emulation and commendation within the banking sector.
Section 2
EMULATION TITLES AND CRITERIA FOR EMULATION TITLES
Article 9. Emulation titles
1. For individuals: “Shock Worker”, “Grassroots Emulation Winner”, “Grassroots Emulation Winner of the Banking Sector”, “National Emulation Winner”.
2. For collectives: “Shock Labor Team”, “Excellent Labor Team”, “Emulation Flag of the State Bank”, “Emulation Flag of the Government”.
Article 10. The Title “Shock Worker”
1. The Title “Shock Worker” shall be annually considered and conferred on individuals that satisfy the following criteria:
a) Having well fulfilled their assigned tasks, achieve high productivity and quality;
b) Having well observed undertakings and policies of the Party, laws of the State, showing a spirit of self-reliance and self-strengthening, unity and mutual assistance, having actively participate in emulation movements;
c) Having actively studied political, cultural and professional knowledge;
d) Possessing good ethics and a healthy lifestyle.
2. The lawful maternity leave shall be included in the time during which one can be considered and conferred the Title “Shock Worker”.
3. Individuals who act bravely to save lives or properties, thereby suffering injuries and requiring treatment or nursing, the duration of such treatment and nursing shall be included in the time during which one can be considered and conferred the Title “Shock Worker”.
4. For individuals who change their jobs, their new work units shall bear the responsibility for considering and electing them for the Title “Shock Worker”. In cases where they have worked for 6 months or more in their old work units, opinions of such units are required. In cases where individuals are dispatched or seconded to other agencies, organizations or units within a certain period of time, the consideration and election for the Title “Shock Worker” shall be conducted by the agencies, organizations or units from which they were dispatched or seconded, which shall be certified by the agencies, organizations, or units to which the individuals were dispatched or seconded.
5. For individuals assigned to participate in short-term training courses and refreshers at home or abroad in less than 01 year and they well abide by the regulations of the training institutions, the time they spend on such training courses and refreshers shall be considered as the time they work at their work units in order for them to be considered and elected for the Title “Shock Worker”. In cases where individuals assigned to participate in short-term training courses and refreshers at home or abroad in 01 year or more and they abide well with regulations of the training institutions and have good or higher academic results, they may be considered and elected for the Title “Shock Worker” at their work units.
6. The Title “Shock Worker” shall not be conferred on one of the following cases: those who are newly hired in less than 10 months, those who are reprimanded or undergo any stricter disciplinary action.
Article 11. The Title “Shock Labor Team”
The Title “Shock Labor Team” shall be considered and conferred annually on collectives that satisfy the following criteria:
1. Having well fulfilled their assigned tasks and plans;
2. Having regular, practical and effective emulation movements;
3. With more than 50% of their individual members having won the Title “Shock Worker” and none of their individual members, who are public employees or public servants, undergoing disciplinary warning or any stricter disciplinary action, or none of them, who are employees, undergoing salary freeze for no more than 6 months or being dismissed or laid off as a disciplinary action.
4. Having preserved internal unity, well observed undertakings and policies of the Party and laws of the State.
Article 12. The Title “Grassroots Emulation Winner”
1. The Title “Grassroots Emulation Winner” shall be annually considered and conferred on individuals that satisfy the following criteria:
a) Having satisfied the criteria for the Title “Shock Worker”;
b) Having initiatives to increase labor productivity and work efficiency recognized by the units or conducting scientific research projects that have been approved and applied at the agencies and units.
2. Percentage of individuals recognized the Title “Grassroots Emulation Winner” not more than 15% of the total individuals who achieved the Title “Shock Worker" of units.
Article 13. The Title “Grassroots Emulation Winner of the Banking Sector” and “National Emulation Winner”
1. The Title “Grassroots Emulation Winner of the Banking Sector” shall be considered and conferred on individuals that satisfy the following criteria:
a) Having outstanding performance among individuals who have won the Title “Grassroots Emulation Winner” three consecutive times prior to the time of nomination for commendation. Individuals with “outstanding performance” are those who have been conferred the “Governor’s Certificate of Merit” or commended by the Prime Minister or the State President during the time they are considered for the “Grassroots Emulation Winner of the Banking sector”;
b) Having initiatives or sectorial-level scientific research projects.
2. The consideration and conferment of the Title “National Emulation Winner” shall comply with Clause 1, Article 9 and Point a, Clause 1, Article 48 of Decree No. 91/2017/ND-CP.
Article 14. The Title “Excellent Labor Team”
1. The Title “Excellent Labor Team” shall be annually considered and conferred on outstanding collectives chosen from those that have won the Title “Shock Labor Team” and satisfy the following criteria:
a) Having been creative, having overcome difficulties and excellently fulfilled their tasks, well performed their obligations towards the State;
b) Having regular, practical and effective emulation movements;
c) 100% of their individual members having fulfilled their assigned tasks, at least 70% of whom winning the Title “Shock Worker”;
d) Have individual(s) winning the Title “Grassroots Emulation Winner”.
2. Collectives that have excellently fulfilled their tasks as prescribed at Point a Clause 1 of this Article shall be defined as follows:
a) Collectives under the State Bank: Having excellently fulfilled their work plans in the year and other tasks assigned by their superiors; making various proposals and suggestions to improve the regulations and policies of the State Bank; having well observed the reporting and statistical regimes;
b) Collectives under credits institutions, branches of foreign banks and the Deposit Insurance of Vietnam: Having excellently fulfilled their targets and work plans in the year; having well performed the work of internal inspection and control; having well complied with the policies and laws of the State and the rules and regulations of the State Bank;
c) Collectives under banking educational institutions: Having excellently fulfilled all assigned targets and plans; ensuring the education quality; having well organized and maintained scientific research work in an orderly manner; having well complied with regulations on information and reporting regimes; having well managed their students; having taken measures to promptly prevent social evils and preserve a good pedagogical environment at school; having actively participated in social activities;
d) Collectives under enterprises managed by the State Bank: Having excellently fulfilled all assigned targets and plans; having strictly observed the information and reporting regimes as prescribed; having well performed the work of internal inspection and control;
dd) Standing bodies of associations managed by the State Bank: Having effectively disseminating policies of the Party, laws of the State and regulations of the State Bank; making various proposals to improve the regulations and policies on banking activities.
Article 15. The Title “Emulation Flag of the State Bank” and “Emulation Flag of the Government”
1. The Title “Emulation Flag of the State Bank” shall be annually considered and conferred on collectives that satisfy the following criteria:
a) Being outstanding collectives in emulation movements of the banking sector in each field, area, region or system; having successfully completed the assigned targets and tasks in the year; being elected or venerated as the vanguard of the Emulation Blocks or Groupings inside the banking sector; having won the Title “Excellent Labor Team” recognized by the competent authorities;
b) Having new impacts or new models for other collectives in the same Block or Grouping or the whole system to follow;
c) Having well observed the undertakings and policies of the Party, laws of the State, regulations of the State Bank, the units and localities; Having preserved internal unity, actively practiced thrift, countered corruption, wastefulness and other social evils.
2. The Title “Emulation” Flag of the Government” shall be annually considered and conferred on:
a) The vanguards elected from outstanding collectives satisfying the criteria for the “Emulation Flag of the State Bank” in annual emulation movements. The percentage of collectives nominated for the “Emulation Flag of the Government” shall not exceed 20% of all collectives that satisfy the criteria for the “Emulation Flag of the State Bank”;
b) The vanguards of thematic emulation movements launched by State President and the Prime Minister, who are nominated or elected when such movements are reviewed or concluded after 05 years or more.
Chapter III
COMMENDATION AND CRITERIA FOR COMMENDATION
Article 16. Types of commendation
1. Commendation for merits and achievements means a type of commendation bestowed upon collectives and individuals that have made outstanding achievements or excellently completed the tasks assigned to them, thereby contributing to the cause of national construction and defense.
2. Thematic (or intermittent) commendation means a type of commendation bestowed upon collectives and individuals that have achieved excellent results after finishing the emulation movements launched by the State President, the Prime Minister, the Governor, or the Heads of the agencies and units under the banking sector.
3. Extraordinary commendation means a type of commendation bestowed upon collectives and individuals that have made extraordinary achievements in labor, production, and combat service support; those who courageously saved lives and properties of the people or the State (an extraordinary achievement means any achievement made by a collective or an individual in an unforeseen circumstance, not in accordance with the programs, plans, and tasks they must undertake).
4. Commendation for dedication means a type of commendation bestowed upon individuals who have participated in activities during revolutionary periods, been holding leading or managerial positions in State agencies, non- businesses units, mass organizations, socio-political organizations, made meritorious achievements and contributions to the revolutionary cause of the Party and the country.
5. Diplomatic commendation is a type of commendation bestowed upon foreign teams and individuals that have made achievements and contributions to the construction and defense of the Vietnamese Fatherland in the economic field.
Article 17. Orders, Medals, “Prime Minister’s Certificate of Merit”, State honorable titles, “Ho Chi Minh Prize”, “State prize”
Criteria for Orders, Medals, “Prime Minister’s Certificate of Merit”, State honorable titles, “Ho Chi Minh Prize”, “State prize” shall comply with the provisions of the 2003 Law on Emulation and Commendation (revised) and Decree No. 91/2017/ND-CP of the Government.
Article 18. “Governor’s Certificate of Merit”
1. The “Governor’s Certificate of Merit” shall be conferred on exemplary individuals who well abide by the guidelines of the Party, policies and laws of the State and regulations of the banking sector as well as satisfy one of the following criteria:
a) In 02 or more consecutive years: having excellently completed their tasks or made excellent achievements that have been taken into consideration for commendation in annual emulation movements initiated by the Governor. During the above time, they must have 02 grassroots-levels initiatives recognized and effectively applied within their units;
b) Having made various achievements, having influence in each work field of the banking sector;
c) Having made extraordinary, outstanding achievements.
d) Having been working in the banking sector for 25 years or more regarding men and 20 years or more regarding women; successfully completing their assigned tasks in 05 consecutive years before their retirement; having undergone no disciplinary action and not yet been conferred the “Governor’s Certificate of Merit” or any State-level commendation during their years of service.
2. The “Governor’s Certificate of Merit” shall be conferred on exemplary collectives who well abide by the guidelines of the Party, policies and laws of the State and regulations of the banking sector as well as satisfy one of the following criteria:
a) Having excellently completed their tasks in 02 consecutive years or more, preserved internal unity, well implemented the grassroots democracy regulations, well organized emulation movements; taking good care of material and spiritual lives of their individual members; practicing thrift; fully implementing lawful regimes and policies;
b) Having made excellent achievements that have been taken into consideration in emulation movements;
c) Having achieved extraordinary achievements, having influence in each work field of the banking sector.
3. The “Governor’s Certificate of Merit” shall also be conferred on collectives and individuals outside the banking sector that have made various achievements, thereby making direct and practical contributions to activities of the banking sector.
Article 19. Diploma of Merit
Heads of units may confer Diplomas of Merit on collectives and individuals in accordance with Articles 74 and 75 of the 2003 Law on Emulation and Comment (revised).
Article 20. Commendation of dedication
Commendation for dedication may be conferred on or posthumously awarded to individuals as prescribed in Articles 41 and 42 of Decree No. 91/2017/ND-CP.
Chapter IV
COMMEMORATIVE MEDAL
Article 21. Commemorative Medal
1. The Commemorative Medal “For the cause of Vietnam Banking” (hereinafter referred to as the Commemorative Medal) means a commendation form conferred by the Governor to recognize the contributions of individuals inside and outside the banking sector to the development of the banking sector.
2. The Commemorative Medal shall be considered and conferred on individuals only once every year on the founding anniversary of Vietnam’s banking sector (May 6).
Article 22. Criteria for the Commemorative Medal
1. For officials inside the banking sector
a) The Commemorative Medal shall be conferred on individuals who have successfully completed their tasks and been working in the banking sector for full 20 years regarding men and full 15 years regarding women;
b) Officials who shall be automatically conferred or posthumously awarded the Commemorative Medal: banking officials recognized as martyrs; officials who had joined the Preparatory Committee for the establishment of the National Bank of Vietnam; banking officials who fought in battlefield B from 1968 onward; banking officials awarded by the State the titles: “Golden Star Order”, “Ho Chi Minh Order”, “Independence Order” of all classes, “Labor Hero”; and leaders of the State Bank;
c) Officials shall be considered and conferred the Commemorative Medal first: officials who worked in the banking sector from May 6, 1951 to May 7, 1954 and had been working continuously for 10 years; banking officials who fought in battlefields B, C, K during the resistance war against the U.S. before April 30, 1975, their working period shall be double when considering the conferment thereof to them (one working year of such persons shall be considered as two years); officials who previously worked in the banking sector, then joined the army, served as youth volunteers, or went to school or seconded to other sectors, and returned to the banking sector afterward, such time of whom shall be considered as the time they worked in the banking sector when considering the conferment thereof to them.
2. For individuals outside the banking sector
Individuals outside the banking sector shall be considered and conferred the Commemorative Medal if they satisfy one of the following criteria:
a) Having meritorious achievements in terms of leadership, thereby contributing to building and developing the banking sector of Vietnam;
b) Having initiatives or scientific research projects of practical value for the banking sector of Vietnam;
c) Having meritorious achievements in building and consolidating cooperative relations between the banking sector of Vietnam and other countries, international organizations;
d) Having made direct and practical contributions to the development of the banking sector of Vietnam.
3. Foreigners who have been working in the banking sector of Vietnam for 10 years or more and successfully completed their assigned tasks therewithin.
4. The Commemorative Medal shall not be conferred in the following cases:
a) Individuals undergo disciplinary actions and are forced to quit their jobs;
b) Individuals are being prosecuted for criminal liability by law enforcement agencies or are involved in criminal cases without conclusions of competent legal authorities;
c) Individuals who have been and are serving prison sentences (with or without probation) or non-custodial corrections.
Chapter V
JURISDICTION OVER CONFERMENT;
PROCEDURES FOR CONSIDERATION AND COMMENDATION
Section 1
JURISDICTION OVER CONFERMENT
Article 23. The jurisdiction to confer emulation titles and commendation forms
1. The Governor is entitled to confer:
a) The Title “Shock Worker” and “Grassroots Emulation Winner” on the leadership of the State Bank;
b) The Title “Grassroots Emulation Winner of the Banking sector”;
c) The Title “Emulation Flag of the State Bank”;
d) Certificates of Merit on collectives and individuals;
dd) The Title “Excellent Labor Team”;
e) Commemorative Medals on individuals.
2. Directors of the State Bank’s branches in provinces and municipalities, Heads of the non-business units under the State Bank are entitled to confer the Title “Shock Labor Team” on collectives; the Title “Shock Worker”, “Grassroots Emulation Winner” on individuals within the ambit of their jurisdiction, and Diplomas of Merit.
3. Chief Inspector of the Vietnam Banking Supervision Agency is entitled to confer the Title “Shock Labor Team” on collectives; the Title “Shock Worker”, “Grassroots Emulation Winner” on individuals within the ambit of their jurisdiction, and Diplomas of Merit.
4. Heads of units prescribed at Point a, Clauses 2, 3, 4, 5, Article 3 of this Circular are entitled to confer the Title “Shock Labor Team” on collectives; the Title “Shock Worker”, “Grassroots Emulation Winner” on individuals within the ambit of their jurisdiction, and Diplomas of Merit.
5. The Governor shall authorize the Heads of:
a) Agencies, Departments, units, standing bodies of the Party and mass organizations at the headquarters of the State Bank to confer the Title “Shock Labor Team” on collectives; the Title “Shock Worker”, “Grassroots Emulation Winner” on individuals within the ambit of their jurisdiction.
b) The State Bank’s branches in provinces and municipalities; the Vietnam Banking Supervision Agency to confer the Title “Excellent Labor Team” on small collectives within the ambit of their jurisdiction;
c) The Administration Department; the Issue and Vault Department; the Information Technology Department to confer the Title “Excellent Labor Team” on small collectives under their sub-departments;
d) Credit institutions (other than microfinance institutions), branches of foreign banks and the Deposit Insurance of Vietnam to confer the Title “Excellent Labor Team” within their units.
dd) Units prescribed at Point a, Clauses 2, 3, 4, 5, Article 3 of this Circular to confer the Title “Excellent Labor Team” on collectives within the ambit of their jurisdiction;
e) The State Bank’s branches in provinces and municipalities to confer the Title “Excellent Labor Team” on microfinance institutions in the localities under their management;
Article 24. The jurisdiction to recognize initiatives
1. For sectoral- and national-level initiatives: The Council for Initiatives of the banking sector shall scrutinize and evaluate the efficiency and influence thereof. Based on the assessments of the Council, the Governor shall authorize to the Director of the Emulation and Rewarding Department to recognize the sectoral- and national-level initiatives.
2. For grassroots-level initiatives: The Councils for Initiatives at the grassroots level shall consider and evaluate the efficiency and influence thereof. Based on the assessments of the Councils, Heads of the units shall decide to recognize the grassroots-level initiatives.
Article 25. Award ceremonies
1. Ceremonies to confer Orders, Medals, State honorable titles, “Ho Chi Minh Prize”, “State prize”, “Emulation Flag of the Government”, Title “National Emulation Winner” and “Prime Minister’s Certificate of Merit” shall comply with the provisions of Decree No. 145/2013/ND-CP dated October 29, 2013 of the Government prescribing the organization of anniversaries; ceremonies to confer and receive commendations, emulation titles; diplomatic protocols to welcome and receive foreign guests.
2. For Orders, Medals, State honorable titles, “Ho Chi Minh Prize”, “State prize”, “National Emulation Winner”: When receiving the notifications of the Emulation and Rewarding Department, Heads of the units shall plan to organize the award ceremonies and submit such plans to the Governor (via the Emulation and Rewarding Department). After obtaining the approval of the Governor, the Emulation and Rewarding Department shall bear the responsibility for coordinating with the units to organize ceremonies to announce and confer the decorations or titles.
3. For “Emulation Flag of the Government” and “Prime Minister’s Certificate of Merit”: When receiving the notifications of the Emulation and Rewarding Department, Heads of the units shall actively plan and organize ceremonies to confer such titles on the commended collectives and individuals of their units. Before organizing such ceremonies, the units shall send notifications to the Emulation and Rewarding Department to follow up.
4. The Emulation and Rewarding Department shall give advises to the Governor for decision on the announcement and conferment of State-level commendation forms on individuals and collectives at the headquarters of the State Bank.
5. For the emulation titles and commendation forms under the jurisdiction of the Governor, he/she may authorize Heads of units the organize to announce and confer on the commended collectives and individuals.
Heads of units together with the Emulation and Rewarding Department shall give advice to the Governor for decision on the announcement and conferment of the “Governor’s Certificate of Merit” and the Commemorative Medal on collectives and individuals outside the banking sector.
6. The announcement and conferment of the emulation titles and commendation forms is an opportunity to honor good people, good deeds and typical examples, so the organization thereof shall be solemn, effective, and economical and shall not be obtrusive, perfunctory, and wasteful. Other events of the units may be organized in combination therewith to save time and money.
Section 2
COMMENADTION PROCESS, DOSSIERS OF NOMINATION FOR COMMENDATION
Article 26. The linear process of commendation
1. Heads of units within the banking sector shall bear the responsibility for commending or nominating officials, public employees, public servants, and employees under their management for higher-level commendation, whichever level launching the emulation movements shall consider commending or nominating collectives and individuals that have made outstanding achievements for higher-level commendation.
2. Units in the sector shall submit dossiers of nomination for commendation directly at the Single-Window Section of the State Bank or by post, or make online filings to the State Bank (via the Emulation and Rewarding Department).
After receiving the dossiers of nomination for commendation, the Emulation and Rewarding Department shall bear the responsibility for checking the legality thereof, verifying the achievements stated therein and submitting them to the competent authorities within 20 working days (30 working days if additional commendation-related information is required). Illegal dossiers shall be notified or returned to the units that submit them within 05 working days from the date they are received; the units that submit such dossiers shall bear the responsibility for completing the dossiers and send them back to the Emulation and Rewarding Department within 05 working days from the date such dossiers are returned. For the commendation for merits and achievements, the reports on achievements nominated for State-level commendation, if the prescribed time limit is exceeded, shall be updated with achievements of the nominated collectives and individuals.
3. For the Title “Labor Hero”: Heads of the units shall submit the proposal for the Title “Labor Hero” conferment the approval to the Governor (via the Emulation and Rewarding Department) for approval. The Emulation and Rewarding Department shall seek opinions of the First Vice-Chairperson of the sectorial-level Council for Emulation and Commendation, then seek the approval of the Governor for the building of collective or individual “Labor Heroes”. Based on opinions of the Governor, the Emulation and Rewarding Department shall notify the units in writing. After receiving the dossiers requesting the conferment of the Title “Labor Hero”, the Emulation and Rewarding Department shall check them, evaluate the achievements stated therein, summarize and submit them to the sectorial-level Council for Emulation and Commendation for consideration at its meeting; based on the assessments of the Council, the Emulation and Rewarding Department shall submit the dossiers to the Party Committee of the State Bank for consideration before requesting the Governor to submit them to the competent authorities for further consideration.
4. For the Title “Grassroots Emulation Winner of the Banking Sector” and “National Emulation Winner”: After receiving the dossiers from the units, the Emulation and Rewarding Department shall check the legality thereof, verify the achievements stated therein and submit them to the Council for Initiatives of the banking sector and the sectorial-level Council for Emulation and Commendation for consideration. Based on the assessments of the Councils, the Emulation and Rewarding Department shall seek opinions of the First Vice-Chairperson of the sectorial-level Council for Emulation and Commendation before submitting the dossiers to the Governor for decision. Particularly, the dossiers of nomination for the “National Emulation Winner” shall be submitted to the Party Committee of the State Bank for consideration before requesting the Governor to submit them to the competent authorities for further consideration.
5. For the Title “Emulation Flag of the State Bank” and “Emulation Flag of the Government”: After receiving the dossiers from the units, the Emulation and Rewarding Department shall check the legality thereof, verify the achievements stated therein and submit them to the sectorial-level Council for Emulation and Commendation for consideration. Based on the assessments of the Council, the Emulation and Rewarding Department shall seek opinions of the First Vice-Chairperson of the sectorial-level Council for Emulation and Commendation before submitting the dossiers to the Governor for decision or requesting the Governor to submit them to the competent authorities for further consideration.
6. For Orders, Medals of all kinds and classes: After receiving the dossiers from the units, the Emulation and Rewarding Department shall check the legality thereof, verify the achievements stated therein and submit them to the Council for Initiatives of the banking sector and the sectorial-level Council for Emulation and Commendation for consideration. Based on the assessments of the Councils, the Emulation and Rewarding Department shall submit the dossiers to the Party Committee of the State Bank for consideration before requesting the Governor to submit them to the competent authorities for further consideration.
7. For “Prime Minister’s Certificate of Merit”: After receiving the dossiers from the units, the Emulation and Rewarding Department shall check the legality thereof, verify the achievements stated therein and submit them to the sectorial-level Council for Emulation and Commendation for consideration. Based on the assessments of the Council, the Emulation and Rewarding Department shall seek opinions of the First Vice-Chairperson of the sectorial-level Council for Emulation and Commendation before submitting the dossiers to the Governor for decision.
8. For the Title “Excellent Labor Team” and “Governor’s Certificate of Merit”: After receiving the dossiers from the units, the Emulation and Rewarding Department shall check the legality thereof, verify the achievements stated therein and submit them to the First Vice-Chairperson of the sectorial-level Council for Emulation and Commendation to seek his/her opinions before submitting the dossiers to the Governor for decision.
9. For commendation for individuals and collectives outside the banking sector: Heads of the units that have direct working relations with the external entities shall make and submitted notes enclosed with reports on achievements of individuals and collectives nominated for commendation to the Emulation and Rewarding Department. After receiving the dossiers from the units, the Emulation and Rewarding Department shall check the legality thereof, verify the achievements stated therein and submit them to the First Vice-Chairperson of the sectorial-level Council for Emulation and Commendation to seek his/her opinions before submitting the dossiers to the Governor for decision.
10. For the Title “People’s Teacher”, “Meritorious Teacher”, “Ho Chi Minh Prize”, “State prize”: the process prescribed in the 2003 Law on Emulation and Commendation, which is amended and supplemented in the 2013 Law, Decree No. 91/2017/ND-CP and other regulations of the State shall prevail.
11. For the emulation titles and commendation forms prescribed in Clauses 3, 4, 5, 6, 7, 8, 9, 10 of this Article, in case of necessity, the Emulation and Rewarding Department shall collect opinions from relevant units before considering the commendation thereof. Particularly for the Titles “Hero of Labor”, “National Emulation Winner” and other commendation forms prescribed in Clauses 6 and 10 of this Article, public opinions on the nominated collectives and individuals shall be collected via the web portal of the State Bank before the considering the commendation thereof.
12. Annually, the Emulation and Rewarding Department in collaboration with the Office of the State Bank to prepare dossiers and propose the conferment of emulation titles and commendation forms on leaders of the State Bank, the submit the dossiers to the sectorial-level Council for Emulation and Comments for consideration.
13. For commendation for dedication
a) For retired or deceased officials:
i) For officials who retired or deceased leaders the State Bank, the Human Resources Department shall bear the responsibility for preparing the dossiers of nomination for commendation;
ii) For others, heads of the units, where the retired officials had worked before their retirement or where the deceased officials had worked shall, bear the responsibility for conducting the procedures to nominate the commendation. The case of the last working unit of officials under the Commendation has dissolved, split, merged, amalgamated, then Heads of the units accept the quest of those units bear the responsibility for setting up dossiers of nomination for commendation;
iii) The Emulation and Rewarding Department shall bear the responsibility for checking and summarizing the dossiers and seeking the certification of Human Resources Department (unless the Human Resources Department itself nominates the commendation), then submitting the dossiers to the sectorial-level Council for Emulation and Commendation for consideration; Based on the assessments of the Council for Emulation and Commendation, the Emulation and Rewarding Department shall seek opinions of the Party Committee of the State Bank before submitting the dossiers to the Governor for decision.
b) For officials who are about to retire:
i) For leaders the State Bank who are about to retire, the Office of the State Bank shall bear the responsibility for conducting the procedures to nominate for the commendation as prescribed;
ii) For others who meet the criteria, Heads of the units managing them shall made the dossiers of nomination for their commendation. The Emulation and Rewarding Department shall check and summarize the dossiers and seek the certification of Human Resources Department (unless the Human Resources Department itself nominates the commendation), and submit the dossiers to the sectorial-level Council for Emulation and Commendation for consideration, and then to the Party Committee of the State Bank for further consideration before submitting the dossiers to the Governor for decision.
c) The Human Resources Department shall bear the responsibility for certifying in writing the time during which the nominees for commendation have held their positions as well as the disciplinary actions, the reasons and the duration thereof they have undergone (if any), and the equivalents to the nominees’ positions; coordinating with relevant units to resolve complaints (if any) about the officials to be commended for their time-honored dedication to the banking sector.
14. For the Commemorative Medal
a) For officials who have been and are working in the banking sector: Heads of the units managing the officials (including those who retired, deceased, or changed their jobs) shall make and send notes enclosed with the dossiers of those who satisfy the prescribed criteria to the Emulation and Rewarding Department.
b) For officials outside the banking sector: leaders of the Party, State, National Assembly, and Government shall be nominated by the Office of the State Bank. Individuals of ministries, commissions, sectors and central mass organizations; foreigners who have been working in Vietnam, and Vietnamese nationals working abroad shall be nominated by Heads of the Agencies, Departments, or units under the State Bank that have direct working relations with them. Leaders of Party Committees, People’s Councils, People’s Committees of provinces and municipalities as well as other individuals working in localities who have made contributions to the banking sector shall be nominated by Directors of the State Bank’s branches in provinces and municipalities. Special cases of commendation shall be nominated by the Emulation and Rewarding Department and decided by the Governor.
c) For subjects prescribed at Points a and b of this Clause, the Emulation and Rewarding Department shall bear the responsibility for checking the dossiers and seeking opinions of the First Vice-Chairperson of the sectorial-level Council for Emulation and Commendation before submitting them to The Governor for decision.
15. The State Bank’s branches in provinces and municipalities shall consider commending or suggest the Governor to confer thematic or extraordinary commendation, or the Commemorative Medal on collectives and individuals of People’s Credit Funds in the localities under their management.
16. For collectives and individuals of microfinance institutions: The State Bank’s branches in provinces and municipalities where microfinance institutions are headquartered shall consider commending or suggesting the competent authorities to confer the commendation.
Article 27. Principles of making dossiers
1. Any report or summary report on achievements of any collective or individual nominated for commendation shall be affixed with the seal of the nominating unit on adjoining edges of its pages (if any).
2. For units that are obliged to make payments to the State budget and implement insurance policies for employees, when nominating collectives or individuals who are Heads of the units and Directors of branches of credit institutions for commendation, the dossiers thereof shall be certified in writing by the competent authorities. Particularly for emulation titles and commendation forms under the jurisdiction of the Governor, Heads of the units shall bear the responsibility for certifying the above contents in the reports on achievements (the written certifications of tax and insurance by the competent authorities stored at the units).
3. When submitting dossiers of nomination for commendation, credits institutions and enterprises managed by the State Bank (legal entities) shall obtain conclusions of the audit agencies within the period for which they are nominated for commendation (for commendation under the jurisdiction of the Governor, the audit conclusions shall be made in the time of consideration for the emulation titles and commendation forms; for State-level commendation, the audit conclusions shall be made in the period of 05 consecutive years prior to the nomination for commendation).
Article 28. Dossiers of nomination for emulation titles
1. The emulation titles and commendation forms shall be realized in the units by Heads of such units under their jurisdiction or under the authorization from the Governor, in accordance with the 2003 Law on Emulation and Commendation (revised), Decree No. 91/2017/ND-CP and this Circular.
2. A dossier of nomination for the Title “Grassroots Emulation Winner” contains:
a) A written request for recognition of the Title “Grassroots Emulation Winner”;
b) A report on achievements of the individual nominee;
c) A written request for recognition of initiative(s) (made using Form No. 09 attached to this Circular) or a decision on recognition of scientific research project(s);
d) A meeting minute enclosed with the result of the secret ballot held by the Council for Emulation and Commendation of the unit with the polling percentage of 70% or higher out of the total membership of such Council (if any member of the Council is absent, his/her opinions in writing shall be collected).
3. A dossier of nomination for the Title “Grassroots Emulation Winner of the Banking Sector” contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of the individual nominees for commendation (using Form No. 02 attached to this Circular);
b) A summary report on achievements of the individual nominees for commendation (made using Form No. 14 attached to this Circular). Detailed reports on achievements of each nominee shall be archived at the unit;
c) A written request for recognition of the efficiency and influence of the initiative(s), enclosed with a summary of sectorial-level initiative(s) of the individual nominees (made using Forms No. 07 and No. 08 attached to this Circular) or a decision on recognition of sectorial-level scientific research project(s);
d) A meeting minute enclosed with the result of the secret ballot held by the Council for Emulation and Commendation of the unit with the polling percentage of 90% or higher out of the total membership of such Council (if any member of the Council is absent, his/her opinions in writing shall be collected).
4. A dossier of nomination for the Title “National Emulation Winner” contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of the individual nominees for commendation (using Form No. 02 attached to this Circular);
b) 03 copies of each report on achievements of the individual nominees certified by the nominating unit (made using Form No. 13 attached to this Circular);
c) A written request for recognition of the efficiency and influence of initiative(s), enclosed with the summary of national-level initiative(s) of the individual nominees, or a decision on recognition of the scientific research project(s) (made using Forms No. 07 and No. 08 attached to this Circular);
d) A meeting minute enclosed with the result of the secret ballot held by the Council for Emulation and Commendation of the unit with the polling percentage of 90% or higher out of the total membership of such Council (if any member of the Council is absent, his/her opinions in writing shall be collected).
5. A dossier of nomination for the Title “Excellent Labor Team” (applicable to the collectives recognized by the Governor) contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of the collective nominees for commendation (using Form No. 02 attached to this Circular);
b) A summary report on achievements of collective nominees for commendation (made using Form No. 15 attached to this Circular). Detailed reports on achievements of each nominee shall be archived at the unit;
c) A meeting minute enclosed with the result of the secret ballot held by the Council for Emulation and Commendation of the unit with the polling percentage of 70% or higher out of the total membership of such Council (if any member of the Council is absent, his/her opinions in writing shall be collected).
6. A dossier of nomination for the Title “Emulation Flag of the State Bank” contains:
a) A written proposal for commendation made by the Head of the unit or Head of the Emulation Block or Grouping, enclosed with the list of the collective nominees for commendation (using Form No. 02 attached to this Circular);
b) A summary report on achievements of collective nominees for commendation (made using Form No. 15 attached to this Circular). Detailed reports on achievements of each nominee shall be archived at the unit;
c) A meeting minute of the Council or the Emulation Block or Grouping enclosed with the result of the secret ballot with the polling percentage of 70% or higher out of the total membership of the Council or the Emulation Block or Grouping (if any member is absent, his/her opinions in writing shall be collected).
7. A dossier of nomination for the Title “Emulation Flag of the Government” contains:
a) A written proposal for commendation made by the Head of the unit or Head of the Emulation Block or Grouping, enclosed with the list of the collective nominees for commendation (using Form No. 02 attached to this Circular);
b) 03 copies of each report on achievements of the collective nominees certified by the nominating unit (made using Form No. 12 attached to this Circular);
c) A meeting minute of the Council or the Emulation Block or Grouping enclosed with the result of the secret ballot with the polling percentage of 70% or higher out of the total membership of the Council or the Emulation Block or Grouping (if any member is absent, his/her opinions in writing shall be collected).
8. A dossier of nomination for the Title “Labor Hero” contains:
a) A written proposal made by the Head of the units enclosed with the list of the collective and individual nominees for commendation (using Form No. 02 attached to this Circular);
b) 04 copies of each report on achievements of the collective or individual nominee for commendation certified by the nominating unit (made using Forms No. 17, 18 attached to this Circular);
c) A meeting minute enclosed with the result of the secret ballot held by the Council for Emulation and Commendation of the unit with the polling percentage of 90% or higher out of the total membership of such Council (if any member of the Council is absent, his/her opinions in writing shall be collected).
Article 29. Dossiers of nomination for commendation forms
1. Regarding the nomination of collectives and individuals for the “Governor’s Certificate of Merit”, a dossier contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of the collective and individual nominees for commendation (using Form No. 02 attached to this Circular);
b) A summary report on achievements of collective and individual nominees for commendation (made using Forms No. 14, 15 attached to this Circular). Detailed reports on achievements of nominees shall be archived at the unit. Particularly, the summary report on achievements of the nominees for the “Governor’s Certificate of Merit” as prescribed at Point d, Clause 1, Article 18 of this Circular shall be made using Form No. 14a attached to this Circular.
c) A meeting minute of the Council for Emulation and Commendation of the unit.
2. Regarding the nomination of collectives and individuals for the “Prime Minister’s Certificate of Merit”, a dossier contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of the collective and individual nominees for commendation (using Form No. 02 attached to this Circular);
b) 03 copies of each report on achievements of the collective and individual nominees certified by the nominating unit (Forms No. 12 and No. 13 attached to this Circular);
c) A meeting minute enclosed with the result of the secret ballot held by the Council for Emulation and Commendation of the unit with the polling percentage of 70% or higher out of the total membership of such Council (if any member of the Council is absent, his/her opinions in writing shall be collected).
3. Regarding the nomination of individuals for Orders of any kind and classes, a dossier contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of the individual nominees for commendation (using Form No. 02 attached to this Circular);
b) 04 copies of each report on achievements of the individual nominees certified by the nominating unit (made using Form No. 13 attached to this Circular);
c) A written request for recognition of the efficiency and influence of sectoral- or national-level initiative(s), enclosed with the summary of such initiative(s) (made using Forms No. 07 and No. 08 attached to this Circular);
d) A meeting minute enclosed with the result of the secret ballot held by the Council for Emulation and Commendation of the unit with the polling percentage of 70% or higher out of the total membership of such Council (if any member of the Council is absent, his/her opinions in writing shall be collected).
4. Regarding the nomination of collectives for Orders of any kind and classes, a dossier contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of the collective nominees for commendation (using Form No. 02 attached to this Circular);
b) 04 copies of each report on achievements of the collective nominees certified by the nominating unit (made using Form No. 12 attached to this Circular);
c) A meeting minute enclosed with the result of the secret ballot held by the Council for Emulation and Commendation of the unit with the polling percentage of 70% or higher out of the total membership of such Council (if any member of the Council is absent, his/her opinions in writing shall be collected).
5. Regarding the nomination for Medals, a dossier contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of nominees for commendation (using Form No. 02 attached to this Circular);
b) A shortlist of the nominees for commendation certified by the nominating unit.
6. Regarding the nomination for extraordinary commendation, a dossier contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of the collective and individual nominees for commendation (using Form No. 02 attached to this Circular);
b) A report on achievements of the collective or individual nominee made by the nominating unit. In case of nomination for the “Prime Minister’s Certificate of Merit”, the report shall be made into 03 copies; in case of nomination for Orders, the report shall be made into 04 copies (using Form No. 19 attached to this Circular);
7. Regarding the nomination for intermittent (thematic) commendation, a dossier contains:
a) A written proposal for commendation made by the Head of the unit enclosed with the list of the collective and individual nominees for commendation (using Form No. 02 attached to this Circular);
b) A meeting minute of the Council for Emulation and Commendation of the unit;
c) Reports on achievements of the collective and individual nominees certified by the nominating unit. In case of nomination for the “Prime Minister’s Certificate of Merit”, each report shall be made into 03 copies; in case of nomination for Orders, each report shall be made into 04 copies (using Form No. 20 attached to this Circular);
8. Regarding the commendation for dedication, a dossier contains:
a) For retired or deceased officials
i) A proposal made by the Head of the unit (for leaders of the State Bank, the proposal shall be made by the Department of Personnel and Organization) enclosed with the list of the individual nominees for commendation (using Form No. 02 attached to this Circular);
ii) 04 copies of each report on achievements of the individual nominees certified by the nominating unit. If the nominees who satisfy the criteria for commendation deceased, the nominating unit shall actively coordinate with the Department of Personnel and Organization to prepare reports on achievements for them (using Form No. 16 attached to this Circular).
b) For officials who are about to retire
i) A proposal made by the Head of the unit (for leaders of the State Bank, the proposal shall be made by the Department of Personnel and Organization) enclosed with the list of the individual nominees for commendation (using Form No. 02 attached to this Circular);
ii) 04 copies of each report on achievements of the individual nominees certified by the nominating unit (made using Form No. 16 attached to this Circular);
iii) A meeting minute of the Council for Emulation and Commendation of the unit (not required in case of nomination for commendation of the State Bank leaders).
9. Regarding commendation for those outside the banking sector, a dossier contains:
a) A written proposal for commendation made by the Head of the unit that has direct relations with the collective and individual nominees for commendation, enclosed with the list of such nominees (using Form No. 02 attached to this Circular);
b) Reports on achievements related to the banking sector of the collective and individual nominees, certified by the nominating unit (made using Form No. 21 attached to this Circular).
10. Regarding the nomination for the Commemorative Medal, a dossier contains:
a) For officials within the banking sector
i) A written proposal for commendation made by the Head of the unit enclosed with the list of the individual nominees for commendation (made using Form No. 03 attached to this Circular);
ii) A work history statement of each individual nominee (made using Form No. 04 attached to this Circular). Regarding the Joint Stock Commercial Bank for Foreign Trade of Vietnam, Joint Stock Commercial Bank for Industry and Trade of Vietnam, Joint Stock Commercial Bank for Investment and Development of Vietnam, Bank for Agriculture and Rural Development of Vietnam, Vietnam Bank for Social Policies, Cooperative Bank of Vietnam, Deposit Insurance of Vietnam, and People’s Credit Funds, the work history statements of the individual nominees shall not be sent to the State Bank, but archived by the nominating unit;
iii) A shortlist of the nominees and their information (made using Form No. 05 attached to this Circular).
b) For officials outside the banking sector
i) A written proposal for commendation made by the Head of the unit enclosed with the list of the individual nominees for commendation (made using Form No. 03 attached to this Circular);
ii) A summary of achievements and contributions to the development of Vietnam’s banking sector of the individual nominees, certified by the nominating unit (made using Form No. 06 attached to this Circular).
Article 30. Deadlines for submitting dossiers
1. Annual commendation
a) For the emulation titles and commendation forms under the jurisdiction of the Governor: Dossiers shall be submitted before February 28 every year. The banking educational institutions shall submit the dossiers before August 15 every year; particularly, dossiers for the Commemorative Medal “For the cause of Vietnam Bank” shall be submitted before February 28 every year.
b) For State-level emulation titles and commendation forms:
i) Dossiers for the “Emulation Flag of the Government” shall be submitted before February 28 every year;
ii) Dossiers for the “National” Emulation Winner”, “Prime Minister’s Certificate of Merit”, Medals, Orders of all kinds and classes shall be submitted before March 15 every year;
iii) The banking educational institutions shall submit the dossiers before August 15 every year;
iv) Dossiers for the “Labor Hero” shall be considered and conferred every 5 years on the occasion of the patriotic emulation congresses at all levels, unless otherwise there are extraordinary excellent achievements;
v) Dossiers for the Title “People’s Teacher”, “Meritorious Teacher”, “Ho Chi Minh Prize”, “State prize” shall be submitted in accordance with regulations of the concerned State agencies.
c) For the emulation titles and commendation forms under the jurisdiction of Heads of units: Heads of the units are assigned to stipulate in detail.
2. For extraordinary commendation: Dossiers shall be submitted immediately after the collectives and individuals make extraordinary achievements.
3. For thematic commendation: Dossiers shall be submitted immediately after each work program or campaign is accomplished.
4. For commendation for dedication: Dossiers shall be submitted in 06 months before the retirement of the officials. For retired officials, the dossiers shall be submitted before March 15 every year.
5. For the nominees for commendation as prescribed at Point d, Clause 1, Article 18 of this Circular: Dossiers shall be received no more than 06 months before the retirement. For retired officials, the dossiers shall be submitted before March 15 every year.
Article 31. The number of “Emulation Flag of the State Bank” to be conferred
1. For Agencies, Departments, and units at the headquarters of the State Banks, enterprises managed by the State Bank: Annually, the Governor shall confer the “Emulation Flag of the State Bank” on the excellent vanguard of emulation movements in each emulation block. The composition of each emulation block shall be specified in a decision by the Governor. For units under the Banking Supervision Agency, the Governor annually confers his/her Emulation Flag on the excellent vanguard of the emulation movements within the Banking Supervision Agency.
2. For the State Bank’s branches in provinces and municipalities: Annually, the Governor confers his/her Emulation Flags on excellent vanguards of emulation movements of every emulation groupings. The composition of each emulation grouping shall be specified in a decision by the Governor.
3. For credits institutions, branches of foreign banks, the Deposit Insurance of Vietnam and other units within the banking sector: Annually, based on the task performance and size of each unit, the State Bank will announce the number of Emulation Flags to be conferred on each unit.
4. For banking educational institutions: Annually, the Governor confers his/her Emulation Flags to outstanding units in the emulation movements.
5. Collectives that can be conferred Emulation Flags are the large collectives specified in Article 3 of this Circular; Agencies, Departments, Offices under the Banking Supervision Agency; branches, subsidiaries of credits institutions; branches of the Deposit Insurance of Vietnam; branches of banking educational institutions.
Chapter VI
EMULATION AND COMMENDATION FUNDS, RIGHTS AND OBLIGATIONS OF COMMENDED COLLECTIVES AND INDIVIDUALS, AND STATE MANAGEMENT OVER EMULATION AND COMMENDATION
Section 1
EMULATION AND COMMENDATION FUNDS
Article 32. Emulation and Commendation Fund
The funding sources and norms as well as the management and use of the Emulation and Commendation Funds shall comply with the provisions of Articles 65, 66, 67 of Decree No. 91/2017/ND-CP and its guiding documents.
Article 33. Principles for calculating rewards and responsibilities for giving rewards
1. The principles for calculating rewards shall comply with the provisions of Article 68, Decree No. 91/2017/ND-CP.
2. The responsibilities for giving rewards
a) For collectives and individuals commended by the Prime Minister or the State President:
i) Collectives and individuals of the State Bank (other than non-business units) shall be rewarded by the State Bank;
ii) Collectives and individuals of credits institutions, branches of foreign banks, the Deposit Insurance of Vietnam, non-business units, standing bodies of associations and enterprises managed by the State Bank shall be rewarded by the units managing them;
b) For collectives and individuals commended by the Governor:
i) Rewards for collectives and individuals of the State Bank (other than non-business units) and those outside the banking sector shall be covered by the Emulation and Commendation Fund of the State Bank;
ii) Rewards for collectives and individuals of credits institutions, branches of foreign banks, the Deposit Insurance of Vietnam, non-business units, standing bodies of associations and enterprises from the State Management bank shall be covered by the Emulation and Commendation Funds of the respective managing units;
c) The rewards for collectives and individuals commended by Directors of the State Bank’s branches in provinces and municipalities shall be covered by the Emulation and Commendation Funds of the respective State Bank’s branches (other than collectives and individuals of credits institutions);
d) The rewards for collectives and individuals of credits institutions, branches of foreign banks, the Deposit Insurance of Vietnam, non-business units, standing bodies of associations and enterprises managed by the State Bank, who are commended by Heads of their managing units, shall be covered by the Emulation and Commendation Funds of the respective managing units.
3. The rewards for emulation titles and commendation forms specified herein shall comply with the provisions from Articles 69 to 74 of Decree No. 91/2017/ND-CP and its guiding documents.
Section 2
RIGHTS AND OBLIGATIONS OF COLLECTIVES AND INDIVIDUALS
Article 34. Rights and obligations of collectives and individuals in terms of emulation and commendation
1. Rights of collectives and individuals in terms of emulation and commendation.
a) To participate in emulation movements initiated by the State, the State Bank, agencies, organizations, and units;
b) To be considered for titles and commendation forms in accordance with the law provisions;
c) To express their opinions or request the competent agencies to consider and confer titles and commendation forms on collectives and individuals that make achievements and satisfy the criteria prescribed by the law provisions;
d) Annually, commended individuals shall be considered for early salary raises, prioritized to study, conduct research, improve professional qualifications, go on visits and surveys at home and abroad; be included in leadership development plans, appointed to higher positions, or re-appointed.
2. Obligations of collectives and individuals in terms of emulation and commendation.
a) To strictly abide by the laws of the State and regulations of the State Bank, organizations, units in terms of emulation and commendation;
b) Commended collectives and individuals must preserve their commendation-related artifacts and shall not lend them to others so as to commit illegal acts;
c) To refuse titles or commendation forms that they do not deserve for their achievements and do not meet the criteria and procedures prescribed by the law provisions;
d) To bear the responsibility for discovering individuals with extraordinary achievements, good examples, good deeds, typical examples to timely nominate them for commendation, or report and denounce collectives and individuals who commit deceitful acts or violate the law provisions on emulation and commendation.
Section 3
STATE MANAGEMENT OVER EMULATION AND COMMENDATION
Article 35. Dissemination and replication of typical examples
1. The Emulation and Rewarding Department shall advise the Governor to work out plans and disseminate the patriotic emulation ideology of President Ho Chi Minh, guidelines and policies of the Party, laws of the Party State on emulation and commendation; praise, honor and replicate typical examples in emulation movements across the banking sector.
2. Units within the banking sector shall work out plans, popularize and replicate typical examples, good people, good deeds as well as select collectives and individuals with outstanding achievements in emulation movements to praise, honor, commend or nominate for commendation.
Article 36. Training and improvement
The Emulation and Rewarding Department shall work out plans to organize training courses and refreshers for officials in charge of emulation and commendation of the large collectives specified in Article 3 of this Circular. The large collectives shall work out plans and organize training courses on emulation and commendation for the grassroots collectives and small collectives directly under their management depending on specific requirements and conditions.
Article 37. Inspection of emulation and commendation
1. The Emulation and Rewarding Department shall bear the responsibility for inspecting the emulation and commendation of units throughout the sector.
2. Heads of the units shall bear the responsibility for inspecting the emulation and commendation of the units under their management.
Chapter VII
COUNCILS FOR EMULATION AND COMMENDATION
AND COUNCILS FOR INITIATIVES AT ALL LEVELS
Article 38. Councils for Emulation and Commendation, Councils for Initiatives at all levels within the banking sector
1. The State Bank shall establish the Council for Emulation and Commendation and the Council for Initiatives of the banking sector.
2. The units shall establish their own Councils for Emulation and Commendation and Councils for Initiatives.
Article 39. Composition of the Council for Emulation and Commendation the banking sector
1. Chairperson: The Governor of the State Bank.
2. First Vice-Chairperson: The Deputy Governor in charge of emulation and commendation within the banking sector.
3. Standing Vice-Chairperson: The Director of the Emulation and Rewarding Department.
4. Council members: Director of the Personnel and Organization Department, Standing Deputy Secretary of the Party Committee of the State Bank, Standing Vice-Chairperson of the Vietnam Banking Trade Union, Chief of the State Bank Office, Chief Inspector or the Banking Supervision Agency, Director of Internal Audit Department, Director of Monetary Policy Department, Director of Finance and Accounting Department, Deputy Director of the Emulation and Rewarding Department.
5. Secretary: A specialist from the Emulation and Rewarding Department.
Article 40. Composition of a Council for Emulation and Commendation of any unit under the State Bank
1. Chairperson: The Head of the unit.
2. Vice-Chairperson: The Deputy Head of the units.
3. Council members: Representatives from the Party Committee, Chairperson of the Trade Union and other seniors of the unit designated by Head of the unit, ensuring that the total membership (including the Chairperson, Vice-Chairperson and members) shall not exceed 09 people. For the Banking Supervision Agency, the total membership of a council shall not exceed 13 people and the Chief Inspector shall decide to establish Councils for Emulation and Commendation of subordinate Agencies, Departments, and units.
4. Secretary: An official in charge of emulation and commendation.
Article 41. Composition of a Council for Emulation and Commendation of any credit institution, branch of a foreign bank, the Deposit Insurance of Vietnam or any enterprise managed by the State Bank
1. Chairperson: Chairperson of the Board of Directors or Chairperson of the Members’ Council. Particularly, the CEO of the Bank for Social Policies and the CEO (Managing Director) of any branch of a foreign bank shall be the Chairperson of the Council.
2. Vice-Chairperson: The CEO (Managing Director). Particularly, Deputy CEO (Deputy Managing Director) of the Bank for Social Policies and any branch of a foreign bank shall be the Vice-Chairperson of the Council.
3. Council members: Representatives from the Party Committee, Chairperson of the Trade Union and other seniors of the unit designated by Head of the unit, ensuring that the total membership shall not exceed 13 people.
4. Secretary: Deputy Head of the division (commission) in charge of emulation and commendation or a specialist in charge of emulation and commendation.
Article 42. Composition of a Council for Emulation and Commendation of any standing body of an association managed by the State Bank
1. Chairperson: The Secretary General.
2. Vice-Chairperson: The Trade Union Chairperson.
3. Other members shall be designated by the Head of the unit. The total membership of the council shall not exceed 09 people.
3. Secretary: An official in charge of emulation and commendation.
Article 43. Composition of the Council for Initiatives of the banking sector
1. Chairperson: The Deputy Governor in charge of emulation and commendation within the banking sector.
2. Standing Vice-Chairperson: Director of the Emulation and Rewarding Department.
3. Other members and the secretary shall be proposed by the Emulation and Rewarding Department to the Governor.
Article 44. Composition of a Council for Initiatives of any unit
1. Chairperson: The Head of the unit.
2. Vice-Chairperson: The Deputy Head of the unit.
3. Other members and the secretary shall be designated by the Head of the unit.
Article 45. Working principles, duties and powers of Councils for Emulation and Commendation and Councils for Initiatives
1. Working principles, specific tasks and powers of the Council for Emulation and Commendation and the Council for Initiatives of the banking sector shall comply with the working regulations set by the Governor.
2. Working principles, specific tasks and powers of Councils for Emulation and Commendation and Councils for Initiatives of units shall comply with working regulations set by Heads of the respective units.
Chapter VIII
MANAGEMENT OF EMULATION AND COMMENDATION DOSSIERS AND NOTIFICATION OF COMMENDATION
Article 46. Management of dossiers
1. The Emulation and Rewarding Department shall bear the responsibility for managing dossiers and documents related to emulation titles, commendation forms the jurisdiction of the Governor and the superiors.
2. Units shall bear the responsibility for managing and archiving documents related to emulation and commendation according to regulations.
Article 47. Notification of commendation
Annually, the Emulation and Rewarding Department shall bear the responsibility for notifying the results of consideration for commendation for the nominating units.
Chapter IX
ORGANIZATION OF IMPLEMENTATION
Article 48. Reporting on emulation and commendation
1. At the end of the working year, the units summarize and evaluate emulation and commendation work and submit written reports to the State Bank (via the Emulation and Rewarding Department) before February 15 of the following year. The Banking Academy and the Banking University of Ho Chi Minh City shall submit their reports before August 15 every year. The outline of a summary report on emulation and commendation work is provided in Form No. 29 attached to this Circular.
2. Upon initiating any emulation movement, a unit shall bear the responsibility for sending a written notice on such initiation and, after each emulation movement, such unit shall bear the responsibility for sending a summary report to the State Bank (via the Emulation and Rewarding Department) to follow up and serve as bases for consideration and commendation.
3. Microfinance institutions shall send written notices on initiation of emulation movements and summary reports on emulation and commendation work to the State Bank’s branches in provinces and municipalities where they are located so as to follow up and report to the State Bank (via the Emulation and Rewarding Department).
Article 49. Responsibilities of the units
1. The Emulation and Rewarding Department shall bear the responsibility for advising the Governor in deciding on:
a) The maximum bad debt ratio acceptable for credits institutions, branches of credits institutions, branches of foreign banks and individuals who are Managers and Executive Officers of credit institutions, CEOs (Managing Directors) of branches of foreign banks to be considered for commendation;
b) The specific number of Emulation Flags to be conferred on each Emulation Block or Grouping and each unit;
c) The percentage of collectives to be conferred the Title “Excellent Labor Team” in every units.
2. The Banking Inspection Agency shall bear the responsibility for providing information using to Form No. 22 attached to this Circular related to credits institutions, branches of foreign banks and individuals, who are the Managers and Executive Officers of credit institutions, CEOs (Managing Directors) of branches of foreign banks, nominated for commendation under the jurisdiction of the Governor and for State-level commendation.
3. The State Bank’s branches in provinces and municipalities shall bear the responsibility for providing information using Form No. 22 attached to this Circular related to branches of credits institutions and individuals, who are Directors, Deputy Directors of branches of credit institutions, nominated for commendation under the jurisdiction of the Governor and for State-level commendation.
4. Concerned Agencies, Departments, and units under the State Bank shall bear the responsibility for providing information related to collectives and individuals of the State Bank, the Deposit Insurance of Vietnam, banking educational institutions, standing bodies of associations and enterprises managed by the State Bank so as to consider for commendation.
5. The Communication Department shall bear the responsibility for posting on the web portal of the State Bank For the information related to collective and individual nominees for Orders of types and classes, State honorable titles, and the Title “National Emulation Winner”.
6. The Finance and Accounting Department shall bear the responsibility for coordinating with the Emulation and Rewarding Department in guiding the use of emulation and commendation funds and the rewards in accordance with regulations as well as summarizing the revenues and expenditures and sending the data thereof to the Emulation and Rewarding Department before June 30 and December 31 annually.
7. Heads of units prescribed at Point a Clauses 2, 3, 4, 5, Article 3 of this Circular shall bear the responsibility for guiding the emulation and commendation work conformable with the size and activities of the respective units.
Article 50. Effect
This Circular takes effect from December 16, 2019, and replaces Circular No. 08/2018/TT-NHNN dated March 30, 2018 of the Governor of the State Bank, guiding the emulation and commendation in the banking sector.
Article 51. Organization of implementation
Chief of the State Bank Office, Heads of the units under the State Bank, Chairpersons of Boards of Directors, Chairpersons of Members’ Councils and CEOs (Managing Directors) of credits institutions, branches of foreign banks, the Deposit Insurance of Vietnam, enterprises managed by the State Bank, Secretaries General of associations managed by the State Bank shall be responsible for the implementation of this Circular./.
